MAY 19, 19B7 The City Council and the Arcadia Redevelopment Agency met in a regular session May 19,1987 at 7:30 p.m., in the Arcadia City Hall Council Chamber. Elder Stan Raddon, Church of Jesus Christ of Latter Day Saints Councilmember Roger Chandler PRESENT: Councilmembers Chandler, Harbicht, Lojeski, Young and Gilb ABSENT: None On MOTION by Councilmember Lojeski, seconded by Councilmember Young and CARRIED, the Minutes of the Special Meeting and Regular Meeting of May 5, 1987 were APPROVED. It was MOVED by Councilmember Harbicht, seconded by Councilmember Young and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. Application of the Happy Wednesday Club to hold Bingo Games at the County Park Clubhouse on Wednesday afternoons (pursuant to the Arcadia Municipal Code, Section 4216). It was noted in the application that the purpose' is to provide entertainment for the senior citizens and they charge 25~ per card and give canned goods instead of money. Mayor Gilb declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by Councilmember Young, seconded by Councilmember Harbicht and carried. It was MOVED by Councilmember Chandler, seconded by Councilmember Lojeski and carried on roll call vote as follows that a License for this non-profit charitable organ- ization be issued pursuant to the approval of the Building, Planning, Fire and Police Departments, on the condition that ,prizes be non- monetary. AYES: NOES: ABSENT: Councilmembers Chandler, Harbicht, Lojeski, Young and Gilb None None AUDIENCE PARTICIPATION Mark Meahl, 261 West Carter, Sierra Madre, owner of the Garden View Nursery--Dn the grounds of the Anoakia School, 758 West Anoakia Lane, stated in part that he has been given a time limit in which to remove his business from the premises. He needs time in which to relocate, but also would like time in which to apply for a Text Amendment with th~ City. He would also have to apply for a Conditional Use Permit. -1- ' 5-19-87 3. 4. 4a. MINUTE APPROVAL (May 5, 1987) (APPROVED) \.~j-P!~2 29:0192 He would prefer to keep the nursery in Arcadia, if possible, but if he has to relocate to property he has located (in La Canada) which is owned by the Edison Compan~ he needs more time to remain at Anoakia. If he files for the text amendment he would like to be able to remain at Anoakia until the outcome of that matter.. and perhaps at that time the transaction with Edison would have been resolved. It was noted that Mr. Meahl has moved,his office from Anoakia. During this consideration Councilmember Harbicht observed in part that everyone has a right to apply, however he would not encourage Mr. Meahl to file for a Text Amendment as he felt that the property is reSidential and not commercial. But if Mr. Meahl does file the application it woul seem only fair to allow him to remain until a decision has been made. In response to a question by Councilmember Chandle~ Mr. Meahl said he is proceeding with the LaCanada site regardless of what happens at Anoakia, because he knows that sooner or later the Anoakia property will be devel- oped. Councilmember Lojeski stated in part, that in order to be fair, arid if Mr. Meahl initiates the text amendment between now and May 22. he would be inclined to ease off on the enforcement. Tony O'Keefe, 1137 Hugo Reid Drive, has children going to Anoakia School, spoke in support of Mr. Meahl remaining at Anoakia and noted the change in the appearance of the site .., of course, Mr. Meahl can move his business elsewhere but the benefits which have been brought about by the landscaping and care of the land should be considered. He asked Council to visit the site and see what has been contributed to the community. Ed Daniell, 777 Anoakia Lane, 'spoke in opposition to the continuation of a-nursery in a residential zone.. it is the responsibility of the owner to maintain his own property and said permission should not be granted. Steve Worsley, 348 West Norman Avenue, said in part that about five years ago when he first enrolled his children ,in the Anoakia School he was concerned about the absence of grassy areas on which to play. That un~ess one has seen the property it is difficult to really see what has taken place since Mr. Meahl has been there. The children are being taught about growing things and the place is no longer an eyesore.. the outside of the wall facing Foothill Boulevard as well as the interior is being maintain- ed. He asked Council. staf~ and all concerned to take a hard look at the Spirit of the .Law and not entirely on the Spirit of the Letter and on the' impac~ on the students who find it hard to understand why things of beauty are being taken away. He asked Council to allow Mr. Meahl to remain on the property with his landscaping plants. Munne, Architect, proposes to construct a new 5,598 sq. 'ft., two story animal hospital and demolition of the existing animal hospital building at 311 North Santa Anita Avenue. The existing zoning is C-M (Commer~ial Manufacturing) and is surrounded by a MU (Mixed Use) designation. The proposed development is designed to allow construction on the project while the existing hospital continues to operate.. The new hospital will be located immediately to the west and directly behind the current hospital, Demolition of ,the e~isting animal hospital must be within 30 days after completion of the n~w facility. It was noted by the applicant that construction, should start in late September or early October 1987, an4 be ready for occupancy May 1,1988. Some discussion held on the disposition of the FFE. It was explained by staff that some had been taken by Mr. Kawahata to his new location for the muffler services at 635 East Live Oak Avenue, the balance sold at auction. They request permission to combine these 2 levels of programming into one level. Benefits to the residents were set forth in their letter of April 28. Staff reviewed the request and weighed the advantages of the One Tier system and recommended the consolidation of Tier I and Ti~r II basic s~rvice into one service Tier, The benefits to the resi4ent~ were considered and it was noted in partfcular that there would no longer be a need for a Cablevislon Box (Channel Selector) and that each cus- tomer could use their own Remote Control H4,nd Unit and Ty ,and eliminate the need to pay for the Cablevision Remote ~and Unit and Box. AYES: NOES: ABSENT: Councilmembers Chandler, Harbicht, Lojeski, Young and Gilb None None MATTERS FROM STAFF The City Manager reported on the request of the Arcadia Methodist Hospital to refinance 22.9 million revenue bond issue issued in August of 1980 to assist the hospital in financing new facilities. Final payment is due August 1, 2010. The highest coupon (or interest) rate is 9 5/8%. Annual Debt Service on the bonds is $2.5 million and is 'paid by the Hospital out of its revenues. Due to decline in interest rates the Hospital is requesting cooperation of the City in refunding the bonds. It is felt by the Hospital that they can save about $2.5 million over the remaining 23 year lif~ of the bonds and also replenish their capital fund if they refinance. They will not extend the term of the bonds beyond the existing August 1, 2010 due date, nor will they increase their annual debt service payment above the existing $2.5 million. The Hospital will pay all costs, including Ci~y of Arcadia costs, for the refinancing. ' A Resolution of Inducement for the proposed refunding will have to be considered and adopted by the City Council.. this is a statement of interest and intent ,by the City Council in support of the proposed refunding.. it would not be final. The Bond Counsel will prepare necessary documents and agreements and have them approved by the various participants.. all would come back for final approval by Council... probably in July or early August. Following Council approval and execu- tion of the Agreement, the Underwriter will market and sell the Refunding bonds when he feels the market is advantageous. It was MOVED by Councilmember Young, seconded by Councilmember Chandler and carried on roll call vote as follows that, 1) Place the resolution of Inducement for 'consideration on the agenda for June 2, 1987; and 2) Approve retention of Gibson, Dunn and Crutcher as Special Counsel subject to affirmation as approved by,the City Attorney that the Hospital will be responsible for the legal fees incurred. AYES: NOES: ABSENT: Councilmembers Chandler, Harbicht, LOjeski, Young and Gilb None None MATTERS FROM ELECTED OFFICIALS Referred to the inability to make out the City Seal inscription on the pins in particular and lead in a discussion to consider returning to the former seal on pins, badges, letterheads and,the like. The City Flag would not be changed as it is very clear and attractive as is. Costs were explored and staff explained that the dyes are still avail- able and that it should not be too costly. During this consideration Councilmember Lojeski told about the time and effort made in deciding on the current seal which has been used since 1983. He felt the current design indicates just what the City stands for and would not be in favor of returning to the former seal. Councilmember Harbicht said in part, he did not favor one over the other... but would like to cut costs.. and as a case in point referred to the cost of 30~ each for Council note pads. He would favor a simpler design which was not"o difficult and expensive to reproduce. -7- 5-19-87 CHANDLER ~')f 29:0198 Mayor Gilb then MOVED that staff be directed to prepare an ordinance for Council consideration at the June 2 regular meeting amending Arcadia Municipal Code Section 2710 to change the City Seal back to that used prior to the adoption of the current one; with the provision that the current City Seal be used for flags. Motion seconded by Councilmember Chandler and carried on roll call vote as follows: AYES: NOES: ABSENT: , Councilmembers Chandler, Harbicht, Young and Gilb Councilmember Lojeski (for stated reasons) None Councilmember Chandler read the following statement: I "I would like to get the facts straight relative to the article in Saturdays Tribune, about mini-marts. I think it's important to do this before Gary Kovacic and other members of our Planning Commission continue a "Knee-Jerk" reaction to what they perceive as a problem. The project in question, Santa Anita and Huntington Drive, The Drive- In Liquor, is owned and being developed by three long standing Arcadia businessmen. These are not developers who want to "make a dollar and take-off." They are investing their hard earned money to improve their property. They have met every requirement, including parking requi rements. I would like to know what legal or logical reason Mr. Kovacic, Mr. Amato or Mr. Lojeski would use to deny these citizens of their rights as businessmen and land owners. The statement "I'm afraid they will pop up allover town"; or the other statement, "There are a myriad of gas stations that are ripe for that kind of development" are not, under any stretch of the imagination, justifiable reasons for denying approval for the project we passed on a 4-1 vote. If Mr. Kovacic has his way he will be running this city, and I can assure you, it would be at a snails pace. Mr. Amato, the last thing the redevelopment agency needs to do, "is to give developers a little more of a hassle." The whole idea of a street corner moratorium is pure emotional dribble, and I suggest we quickly squelch this notion before any more unneces- sary staff time is wasted; not to mention the turmoil, just prin~ing the word moratorium creates. If some members of the Planning Commission think they can come up with a better idea for privately owned street corners, then they should do their homework and follow with a presentation. I We just approved an architectural review authority for commercial and multi-family building. Either Mr. Kovacic has forgotten about that, or else he is upset that he cannot control the redevelopment agency. After serving as liaison with the Planning Commission for this past year, it is my opinion that Gary Kovacic is a grandstander, who burdens the Planning Commission with his self indulgence. Councilmember Young continued in part in asking staff to ascertain whether or not the lawn in front of City Hall could be used for a City-wide celebration on September 17. Publicity will be processed tlirough the Arcadia Tribune and Television... It is also hoped that the block parties foi July 4 will emphasize the Bicentennial event. (later in these minutes the City Attorney was directed to prepare a Resolution declaring September 17, 1987 as Constitution Day). ' Said in part that he was surprised at the remarks of Councilmember Chandler concerning the proposed mini mall development at Santa Anita and Huntington Drive, and asked Mr. Chandler if he had read the minutes of the Planning Commission. Mr. Chandler said he was refer- ring to the article in the newspaper which said Mr. lojeski was in opposition to the mini mall at that location. Mr. Chandler said further, in part, that a year's experience with Gary is sufficient for him.. he would like to call a stop to it. Councilmember lojeski said in part that it would have been appropriate for Mr. Chandler to come to him.. that the article is only partly correct, that the Commission was concerned not only for that particular corner, but also what is bein9 constructed at Santa Anita and Duarte and at Baldwin and Fairview.. all mini malls.. concerned for the neighborhood; the parking; ingress and egress; and he did not want to be accused of grandstanding. Councilmember Young stated that perhaps Council should look into it... the City could have a problem.. we should be lookin9 ahead as to what we want in Arcadia, and added that a moratorium is being declared in los Angeles. Referred to the Bicentennial Celebration, the Committee would like to declare September 17 as Constitution Day. It was the consensus of Council that a resolution be prepared to that effect for presentation to Council on June 2.' Would like a brief presentation by staff and the consultant on the Downtown Revitalization Program on June 2. Council concurred. Referred to the forthcoming consideration of appointments to the various Commissions and asked Councilmembers to review the packet containing information and citizen resumes.
