Administrative Pastor William Manning, Arcadia Church of Christ Peter Kinnahan, Assistant City Manager for Redevelopment PRESENT: Councilmembers Chandler, Harbicht, Lojeski, Young and Gilb ABSENT: None CITY ATTORNEY "This evening the City Council and the Arcadia Redevelopment Agency met in a CLOSED SESSION pursuant to Government Code Section 54956.8 to give instructions to the City Negotiator regarding property acquisition negotiations with Emkay, specifi- cally, Mr. Rick Smith, concerning the northside project property. Additionally, pursuant to Government Code 54956.9 City Council conferred with City Attorney concerning the existing lawsuit of Duffy vs. City of Arcadia." On MOTION by Councilmember Young, seconded by Councilmember Chandler and CARRIED, the Minutes of the Adjourned and Regular Meetings of July 21, 1987 were APPROVED. It was MOVED by Councilmember Harbicht, seconded by Councilmember Lojeski and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be waived. PRESENTATION Councilmember Young presented to Mayor Gilb and the Councilmembers a certificate from the Commission of the Bicentennial of the United States Constitution. It is signed by Warren Burger and it designates Arcadia as an official bicentennial community for our celebration on September 17, 1987. The Planning Commission at its June 23, 1987 meeting voted 6 to 0 with one member absent to recommend to the City Council approval of Text Amendment 87-11 amending Section 9275.1.52.3 of the Arcadia Municipal Code to allow plant nurseries in residential zones with an approved conditional use permit. Staff report presented. Council- member Harbicht inquired if only three areas were to be affected by this Text Amendment. Staff replied in the affirmative; the Anoakia Property, the Los Angeles County Flood Control spreading area and some sites north of the Highlands. 8/4/87 '. 29 :0251 Mayor Gilb declared the hearing open. , Mark Meahl, 261'West Carter, Sierra Madre, owner of Garden View Landscaping, stated that he felt his nursery was an,asset to the area ,because the owner of the ,property has that portion of his property maintained by the nursery. The area around the Anoakia house is well maintained. He had circulated a petition and 47% of the neighbors were in favor. In door-to-door survey 65 in favor; 9 against. He felt the required Conditional Use Permit 1 would serve as a control for his business. Mayor Gilb inquired if he kept the property up as part of the rent. Mr. Meahl answered in the affirmative and that he also teaches horticulture to the students. John Schiavone, 1005 Hampton Road, President of the Rancho Santa Anita Home~wners' Association, stated, in part, that he is represent- ing approximately 425 individual members and they are against Council granting this Conditional Use Permit. Individuals in the Santa Anita Oaks Homeowners' Association, close to the area, also have objections. They don't object to the beautification project; they are in opposition to a business located in a residential area. In response to Councilmember Harbicht's question as to whether or not the meetings had been with all the residents, Mr. Schiavone said they were with the Boards of Directors. Mayer Piet, 757 Anoakia Lane, stated, in part, that he also objected to the granting of the Conditional Use Permit. He has lived opposite ,the school for 32-34 years and is against having a nursery located across the street from his house. Being a registered mechanical engineer, he felt the water system could become contaminated by fertilizers, pesticides, etc. Also possibility that soil could become contaminated. Also wondered if the Department of Agriculture would not have to inspect the property. In addition, Mr. Piet felt that Anoakia has been a haven for rats and,that having a commercial nursery there would only encourage them. He felt the nursery should move; the property is zoned for residential use. Why should the neighbors have to have a commercial enterprise in their midst? As to traffic, with the nursery there, there wi'l be trucks going in and out; people working on Saturdays and Sundays, etc. The property should revert to residential zoning. Harold Ellis, 1504 S. Eighth Avenue stated, in part, that he had not come in to speak on this subject but he wanted to say that he agreed with Mr. Piet and felt that residential areas should be protected for the residents. He referred to the potential problem that had occurred last year with the possibility of a tennis club being established in a residential area which should be reserved for residents. No one else desiring to be heard, the hearing was CLOSED on MOTION by Counci1member Chandler, seconded by Councilmember Young and CARRIED. 1 Counci1member Chandler agreed with Mr. Ellis' remarks and commented that it was not too long ago that they went through an emotional situation in the City because of ,the thought of a tennis club going in on the County debris basin. He was opposed to that project and he has to use the same philosophy concerning other projects which do not belong in R-l residential zones. He is against this -- does not feel this type of use should be perpetuated. 8/4/87 -2- 1 1 ROLL CALL 2. PUBLIC HEARING AMENDMENT TO THE SOUTH SIDE D & D AGREEMENT ~ /~ ~1 f\ 29:0252 Councilmember Harbicht commented briefly on the purpose of the use of the Conditional Use Permits in zoning and the circumstances under which certain uses are permitted in residential zones. He does not see mhat a nursery is any more desirable in a residential area than other commercial ventures he can think of. He would,oppose the Text Amendment. Councilmember Young said she was approaching this matter from a different aspect. She feels that for many years the City has had good zoning orqinances and Council needs to uphold them. She would be against the Text Amendment. Councilmember Lojeski asked if staff had done a traffic analysis. Reply was no -- not unless the Text Amendment were approved and a Conditional Use Permit applied for. In discussion,it was noted' that part of the business has already moved out -- the sales office is now located in Sierra Madre, but when something is sold, it is picked up from Anoakia and delivered ... it is essentially a growing area. Sales are made elsewhere. Mayor Gilb said everying else is there and he thought the trucks were parked there at night. He also thought that Mr. Meahl had done a nice job with the students with , his teaching. It was then MOVED by Councilmember Chandler, seconded by Council- member Harbicht and CARRIED on roll call vote as follows that Text Amendment 87-11 be DENIED. AYES: NOES: ,ABSENT: Councilmembers Chandler, Harbicht, Lojeski, Young and Gilb None None JOINT MEETING OF THE CITY COUNCIL/REDEVELOPMENT AGENCY PRESENT: Councilmembers Chandler, Harbicht, Lojeski, Young and Gilb ABSENT: None An Amendment (No.1) to the Disposition and Development Agreement with Stanley Gribble and Associates: for the South Side Project was submitted and executed by Mr. Gribble. Features of the amend- ment were summarized in staff report dated August 4,1987, includ- ing site, design, scope of development (minimum/maximum), building size and other changes in said report. The Agency's Environmental Consultant (The Planning Center); the Agency's Traffic Consultant;, Keyser Marston (assisted the Agency in determining the re-use value of the site) advised that the proposed changes are not significant enough to cause any adverse impact. Katz, Hollis and Coren and Associates have also reviewed the financial impact and advise that the changes are slightly an advantage to the Agency (tax increment) and slightly a disadvantage to the City (sales tax) -- overall there would be small net increase. The developer also asked for Agency approval of Bennigan's Restaurant as the owner/tenant of Parcel C. AYES: NOES; ABSENT: Counci1members Chandler, Harbicht, Lojeski, Young and Gilb None None' CITY COUNCIL RECESSED IN ORDER TO ACT AS THE ARCADIA REDEVELOPMENT AGENCY On MOTION by Member Harbicht, seconded by Member Lojeski and CARRIED, THE Minutes of the Meeting of July 21, 1987 were APPROVED. The Applicant, James M. Thompson, 5661 Kelvin, Woodland Hills, owner of Arcadia Lumber Company, proposes to construct a 5,100 square foot lumber storage shed and a 450 square foot saw shed. Both structures will be located toward the northeast portion of the site which abuts the intersections of St. Joseph Street and Front Street. The new parking lot will be located directly south of the proposed lumber storage area. A new removable sleeved pipe barracade located near 1 the St. Joseph Street entrance will help control vehicular access to this parking lot. The purpose of this removable barracade is to provide security when in place and delivery access when removed. Mr. Thompson was present to inquire the reason for his having to submit a drainage plan for the proposed parking lot prepared and signed by a registered Civil Engineer. Staff replied that the plans submitted'did not include a drainage plan and the Public Works Depart- ment wanted to make sure what kind of drainage was to be provided. " There was further discussion concerning ramp for handicapped, a sTight change in the colors on the wall and an increased number of trees to be planted along the wall. All of these were concurred in by the applicant. It was then MOVED by Member Lojeski, seconded by Member Young and CARRIED on roll 'call vote as follows that the Arcadia Redevelopment Agency APPROVE the Design Review subject to the following conditions: 1. CITY COUNCIL RECONVENED AUDIENCE PARTICIPATION Albert Corrigan, 517 Santa Rosa Road, addressed Council with regard to a letter which had been sent to all the residents on Harvard Drive by Ray Rogers of the Santa Anita Turf Club concern- ing the possibility of having helicopter landings at the Santa Anita race track necessitating the installation of a heliport. The neighbors were very concerned because they considered this to be noisy and dangerous and would adversely affect the surround- ing property values. Mayor Gilb responded that the Council was aware of .the letter in question and wanted to assure Mr. Corrigan that the matter. of the he1 icopter landings on the race, track property has been dropped.. The residents on Harvard Drive have probably I", not been notified of this as yet because Mr. Rogers is out of the City,on vacation. Apparently there were a few horse owners who had made inquiry of the Turf Club if they could have the privilege of making two or three landings a week during the racing season. This was the reason the original letter was written to the residents on Harvard Drive. The matter has been dropped. Wes Anderson, 1635 Oakhaven Drive, representing .the Rotary Club Community Service Project, addressed Council at length in regard to the possibility of ~stablishing a bicycle lane on Huntington Drive, Michillinda Drive and ,Colorado Blvd. It would encompass ,about five miles. Mr. Anderson realized there are other jurisdic- tions involved"but the project would have to be approved by the City Council. Some discussion held on the possibility of using some of the available SB 821 funds of about $30,000, earmarked for pedestrian and bicycle facilities -- perhaps $8,000 could be set aside for the Rotary Project until and if they receive County and State approval. The route of the proposed bike lane was explained and Council would like a staff ,report or input August 18. Harold Ellis, 1504 S. Eighth Avenue, spoke to some of the wording in the new ordinance, specifically where it refers to non-conforming uses. For complete clarification, Mr. Ellis will confer with the City Attorney. BOARDS AND COMMISSIONS t- ," Council recei ved the Planni ng Commi ss ion's report on Mi ni -Shopping Centers (Mini-Malls). The Commission felt that a moratorium on such centers was not necessary and also felt that the existing revi~w procedure~,.inc1udi~g Architectural Design Reviews, may not provlde for sufflclent reVlews of these types of projects -- in particular, the parking ,and traffic circulation impacts. It was submitted in the report that Council consider a Text Amendment requiring a Conditional Use Permit for "Mini-Shopping Centers". This term was defined as any development with a site area of less than 45,000 sq. ft., which is or will be improved with more than one retail store, shop, business, service or facility, with R/4/R7 /\ 8. f\,\ 8a. During the considerations, Counci1member Chandler observed, in part, that he was not in favor of a moratorium and was pleased that there is now an Architectural Review Board which renders 1 a great deal of leeway. Conditional Use Permits place 90vernment right in the middle between the property owner and the person who may want to develop the property into some business endeavor. The City does not belong in the middle ... which is a very precarious place to,be. He agreed with the Commission report .,. he was ,against a Conditional Use Permit but in favor of the other recommendations. Counci1member Harbicht agreed, in part, with Council member Chandler .., he ,felt the major concern is parking and referred to the survey. The City has the most stringent requirements for retail parking and he did not feel that parking is a legitimate concern ... then there is the probl em of appearance. ,:That .has been addressed through the Design Review Process which provides adequate protection for the City to obtain desirable projects. He was in favor of the recommenda- tions 1n~the report, but not in favor of a Conditional Use Permit. Counci1member Lojeski said, in part, that as long as the City Code is adhered to, parking would not be impacted. ',' he was concerned about ingress and egress ... its effect on circulation ... these are not always recognized. He could not see a problem with the, legislative body looking at the projects. He was in favor of a Conditional Use Permit and not in favor of a moratoriu~. Counci1member Young said, in part, that she did not favor a moratorium, but there should be some control for traffic .., circulation ... for the tenants and for the adjacent residents. She was in favor of a Conditional Use Permit or someother tool if there were such. Further discussion held on traffic circulation concerns primarily on mini-shopping centers and not on one store for instance. The City Manager advised that traffic circulation is checked in all projects in the City and the City Engineer brings all problems to the attention of the City Council. It was noted in the staff report that low bid was 40% higher than the anticipated cost. The Director of Public Works was AUTHORIZED to readvertise for bids at a later date. AUTHORIZED staff to solicit proposals from qualified consulting engineering firms to prepare plans and specifications and to provide construction inspection services for the Live Oak Well, Forebay and Booster Station. During this consideration, Ed Zareh, 1051 Catalpa Road, spoke to the work of the Sound Wall Committee and urged Council to impart the seriousness of the situation to the California Department of Transportation. It was MOVED by Councilmember Lojeski, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows that the report be submitted to CALTRANS with a cover letter signed by Mayor Gilb, the City Manager and the Director of Public Works requesting an immediate study of the qualifying sections in the report for the purpose of including those proposed projects on the CALTRANS Priority List for sound wall construction. The Sound wall Committee will earmark specific points in the report which will be emphasized in the cover letter. Copies of the Report will be sent to Senator Russell and Assemblyman Mountjoy.
