FEBRUARY 5, 1985
The City Council of the City of Arcadia and the Arcadia Redevelopment
Agency met in a regular session Tuesday, February 5, 1985 at 7:30 p.m.
in the Arcadia City Hall Council Chamber.

Consideration of Text Amendment 84-7 requesting amendment of the .
Arcadia Municipal Code to provide regulations to allow 210 square
feet of retail sales area in a service or self-service gasoline
station (continued from 1/22/85).
Staff report presented in which it was recommended that alcoholic
beverages be prohibited. Councilmember Gilb referred to a communica-
tion from the Los Angeles County Alcohol Commisssion asking that this
type of request be rejected. Mayor Hannah declared the hearing open.
Don Wilson, Real Estate Representative for Atlantic Richfield Company,
300 W. Glenoaks Blvd., Glendale, CA., stated, in part, that at the
last meeting they were asked to come back with some guidelines which
they are doing. They are asking for conversion of the dealer's office
(210 sq. ft.) to sales of snack items (soft drinks, candy, nuts, gum,
chips, etc.) ... these are permitted now if sold through vending
machines. They are asking that the provision that all such items be
sold through vending machines be removed. They do not intend to sell
alcoholic beverages, magazines, periodicals or other such items. As
to the concern expressed that another dealer might apply for an
alcoholic permit, it was stated that a text amendment is before
Council at this time and it would carry the restriction which would
apply to all gas stations in the City.

The method of keeping the shelves stocked was explored. ~ During
this consideration, Makram Gharib) Arco Station at Baldwin and Las
Tunas, explained that they have an extra person to handle this --
not the gasoline attendant ... however, stocking only has to be
done once every day which can be done in the morning or late in the
evening.
He,-b Fletcher, 175 VI. Lemon Avenue reminded Council that he had . .c'
spoken to this particular item previously and brought to their
attention the fact that the sales tax on gasoline provides a source
of considerable revenue to the City. He reiterated that the City I
should encourage gas stations to continue operating in the City.
He felt that the provision of non-sale of alcoholic beverages was
.. discriminatory. Grocery stores sell alcoholic beverages of all kinds
and probably 99% of the customers drive to the market and will drive
away. There are all kinds of liquor stores in the City -- one is
even a drive-in liquor store. Does not see the necessary correlation
between drinking and driving and the sale of beer at gas stations.
Ed Schreimer, 5 VI. Foothill Blvd.) Arco Station, stated, in part,
That the sale of convenience items c'reates no problems of attendants
not paying attention to the gas pumps because the station is computer-
ized -- in the event of an emergency of any kind, the pumps are
automatically closed down. The cashier can also control this from
inside the station. The stockin~ of the merchandise is done in the
late evening or early morning so attendants are not diverted from
attending to the service islands. He does not and does not wish to
sell alcoholic beverages -- only convenience items. All stations
that have computerized equipment have emergency switches. Mr. Wilson
stated that, with regard to safety, he,has a letter from the National
Fire Protection Association affirming the effectiveness of this equip-
ment in providing fire safety. Councilmember Gilb raised the question
of the age of attendants in service stations with regard to sale of
alcoholic beverages. Staff report pointed out that there is an effort
to raise the age to 18, but the bill has not yet passed the State
Legislature. Councilmember Pellegrino stated that persons under age
can sell alcoholic beverages in restaurants if 75% of their job is to
sell food.
It was MOVED by Councilmember Gilb, seconded by Councilmember Lojeski
and CARRIED on roll call vote as follows that the public hearing be
closed.

Further discussion ensued regarding the safety factors in the event
of an emergency situation and the value of an automatic shut-off SWitCh.I' \
It was MOVED by Councilmember Gilb, seconded by Councilmember
Pellegrino and CARRIED on roll call vote as follows to approve and
file the Negative Declaration and find that the project will not
have a significant effect on the environment and direct the City
Attorney to prepare the appropriate ordinance for introduction with
restriction of sale of alcoholic beverages and magazines and periodicals
and a gasoline pump shut-off switch inside the building.

PUBLIC Consideration of Tentative Map of Tract No. 43882 for a proposed
HEARING eight-lot single family subdivision at 1019-1031 S. Eighth Avenue.
Tract No. The site is presently developed with seven dwellings and it is zoned
43882 R-1. All of the existing buildings would be removed. The Planning
(Tentative Commission recommended approval subject to conditions spelled out in
Map) the staff report dated February 5, 1985. One of the conditions con-

judgement about replacing the trees ... he had no problem with the

south and west boundary of the subdivision.

Discussion ensued centering mainly on the matter of the trees and/or
the replacement of the trees removed for construction. It was MOVED, .
by Counci1member Lojeski, seconded by Counci1member Young and CARRIED
on r011 ca11 vote as follows that the evaluations of the environmental
impacts as set forth in the initial study are appropriate; that the
project will not have a significant effect on the environment; that
the Negative Declaration be approved and filed; that the subdivision,
together with the provisions for its design and improvement, is consist-
ent with the Arcadia General Plan; that the discharge of sewage into
the public sewer system will not violate requirements prescribed by
the California Regional Water Quality Control Board for this region;
that the Director of Public Works be authorized to approve and execute
the subdivision agreement and that the proposed project be APPROVED
subject to the construction of a block wall along the north, south
and west boundary of the tract and that the tree replacement be to
the satisfaction of the Planning Directo~.

BOARDS AND COMMISSIONS
The decision on the use of the remaining Olympic funds was continued
to this date from January 22. Gordon Penhar10w responded to questions
and Counci1member Gi1b said, ,in part, that he is still of the opinion
that there are'. a great many,.peop1e 'who. had', worked diligently, but were
not to be named. He felt they may feel hurt and/or slighted. He
referred to a 1 etter from Ray Rogers ,who was on the Commi ss i on, sugges t-:,
i ng some changes in the wordi ng of the p1 aque. Mr. Gi 1 b had brought ' '",

a small equestrian statue as a sample which tou1d be purchased at 1ess
than what the Commission is'proposing. He suggested that the plaque
be placed somewhere inside as Los Angeles had many of its plaques pried
off and stolen.

Mr. Penharlow said, in part,that they had endeavored to add names
of those who had devoted time and effort, but were not compensated
i n a ny way.
Councilmember Lojeski submitted, in part, that he felt the Commission
had done a commendable jOb and had reached conclusion of a very
difficult problem. He felt the 5K - 10K runners should be named,
the sponsors should be named as proposed by the Commission, the I
Essay Competition winners should be named and where it says "Santa
Anita Park and the hundreds of volunteers from Arcadia", it should
be changed to read, "Santa Anita Park and the Hundreds of Volunteers
from the Arcadia Community" ... and that portion be in bolder letters
so it may stand out.
Councilmember Young agreed with Councilmember Lojeski and also felt
that some of the remaining funds should be used to replace the Americll!1
Flags donated by the ~nerican Legion which had been stolen.
It was MOVED by Councilmember Lojeski, seconded by Councilmember
Young and CARRIED on roll call vote as follows that the recommenda-
tions of the Olympic Commission be accepted; that a portion of the
funds be used to replace the flags which were stolen which had been
donated by the Arcadia American Legion Post No. 247; and that the
remaining funds be placed in the Recreation Facilities Fund toward
some Olympic-type endeavor.

On MOTION by Member Pellegrino, seconded by Member Young and so
ordered, the Minutes of the Regular Meeting of January 22, 1985 were
APPROVED. Member Pellegrino abstained since he was not present at
the January 22, 1985 meeting.
Consideration of the Design Review for a proposed office/warehouse I
building for Greenscapes at 126 E. St. Joseph Street. Staff report
reyiewed in which it was recommended for approval subject to specific
conditions. .'
Steven Schober, President of Greenscapes, a landscaping firm, has
appl ied for a building permit. The City Council on October 14, 1984
approved a modification for 8,000 sq. ft."in lieu of the required
15,000 sq. ft. Inasmuch as the property is located in the Central
Redevelopment Project area, the Agency must approve or disapprove
the Design Review before a building permit may be issued. In
response to Mr. Schober's question as to what would happen to h~s
property in the event it was taken for redevelopment, staff advlsed,
in part, that there would be two appraisals and the Agency could pay
no less than the lowest appraisal. Mr. Schober would also be eligibl~
for relocation expenses to a suitable site -- somewhere in the
community at large -- not necessarily in Arcadia. It was also pointed
out by staff that the property would be subject to eminent domain.

During this consideration, Ron Rossiter, 962 Paloma Drive, owner
of 150 ,Santa Clara Street, stated~ 'in'part, 'that he has endeavored
.to acquire the property which adjoins'his on Santa Clara to no
avail, ,Mr. Rossiter was granted a modification for 8,000 sq. ft.,
in lieu of the 15,000 sq. ft. on January 8, 1985. He referred to
an Owners Participation Agreement which he would be required to
sign and'expressed concern that a cloud might be placed on his
Title if he did so ... that it might make it very difficult for
him to ever sell his property. The Agreement clearly stated that
the Agency has the right to. acquire his property by purchase or
otherw'ise pursuant to the Sta te Redeve 1 opinent Law. The Agreement
would be recorded in order to ensure that'the owner and/or his
,'successors 'in ownership would be' aware of thi's. .Mr. Rossiter said
.he is 'planning to spend a great deal of money on development and
.. is. opposed to restricting his 'r'ight to his property.
Staff advised there are no clear p'lcins for' deve;opment of the subject
area at this time '" they would be glad to confer with Mr. Ro~~jter
should the adjacent property become available to him ... also:~nat
there ,might be plans in the future for a large,development.~nd,~~
without ~he Owners Participation Agreement,. there would be"th~:~\'
possibi'lity that one small'lot in the middle of the developmenT:
might stop .the entire project. 'Mr. Rossiter also felt there 'would
", be, more 'opportunities to develop the area if the zoning were more
appropriate.
Maurice Stewart, 75 N. Santa Anita, spoke to property on St.
Joseph St: '" he 'was also granted a modification for 8,000 sq. ft.

Avenue between Naomi and Norman Avenues (Job No. 561) and Huntington
Drive westbound between Civic Center Place and the Arcadia Wash (Job
No. ~60). The storm drain on Lovell will be funded from State Gas
Tax Funds and on Huntington Drive from Capital Outlay Funds.
APPROVED lease of 1500 acre feet of water rights in the Main San
Gabriel Basin for 1984-85 as set forth in the staff report dated
February 5, 1985 -- also lease 1500 acre feet of water rights in
the East Unit of the Raymond Basin from the'City of Sierra Madre
for the amount of $145,000 ($96.67 per acre foot). Mayor and City
Clerk authorized to execute the necessary lease documents in form
approved by the City Attorney.

If the Council decides tonight to stay with the new Seal we would recom-
mend that we still only replace the Seals by attrition so that for a period
of maybe a year, maximum 18 months, we will have on Police vehicles two
different Seals -- but, both Arcadia Seals.
That could be corrected though. The current Police car has the black and
white police badge. In the center of the police badge there's a small -
I don't know what the dimensions are, 4 inch. 8 inch, whatever it is -
the old Seal, the former Seal. To get that Seal up to snuff if you wanted
uniformity with the badge look - could just simply be nothing more than I
a black and white cutout overlay which attaches right to that badge. Yo,
not changing the entire decal, because, we have already in stock, of
those large black decals, 20. That decal is valued at $7 each. I would
presume that production of a small black and white duplicate of the new
Seal to just simply go over the old Seal, which now would bring all your
cars up to conformity, it's got to be 1 ess tha~ $7 per overl ay .

I think r understand the money aspect, but there are some other
elements to this proposition.

One of the big items is the Police badges. Now, that's a $17,000 or
$18,000 item, but then some people say, "well, they don't have to be
changed", but, I don't think you can have two Seals.
I'd like to address that fact. I happened to be at a function, in fact
it was a memorial service for Mr. Powell last Thursday and Mr. Powell's

cousin, Mr. Jim Bateson, who is our Fire .Battalion Chief, was there at
the meeting. He was wearing, obviously, as he always does, his fireman
badge - his Fireman Battalion Chief's Badge. The logo in the center of
that badge - and the badge was all worn - he's been a City employee al-
most 25 years that I'm aware of....

It's Jim Elder,. I'm sorry, excuse me. The center of hjs said, "Arcadia
the Queen City", so his badge is supposed to not conform even from the

standpoint of, evidently -- when I asked/about that he said, "that's
the original badge I was issued and you just. don't go changing a badge
until either the badge becomes tarnished, they're taken away from you
.or retired, basically, from service." I understand our Chief of Police
finally got his "Queen City" logo taken off of his badge, approximately,
a year ago. So, there have. been over the history of years in the City
of Arcadia, two and three badges, accordingly. The outside design of
.the badge, it says, ",Police Department" and soforth, hasn't changed.'
What has ,changed has been the small logo in the center. The City has
always gone by the attrition method, and really, to my knowledge. correct
me if I'm wrong Mr. Bocian, h~sn't gone in and totally replaced eyery"

No, we have not.
We have some items that we have a lot of and -- use them up as you need
them. One, is the 200 City plaques which are valued at $23 each. Use
those as they've been used and as new ones need to be ordered - and .the
new one is ordered - June of 1983 the Council voted by resolution, the
design was, copyri,ghted, there was no tricks, ands or buts about it" the
City adopted a new City Seal and it's taken a year and a half - this
report finally comes - I even question it as far as the general adminis-
tration part of the report - "one City Clerk Notary stamp at $275."
The logo of the City of Arcadia was changed June of 1983.
Well, we have a motion that was passed and it's a question of implementing
it and unless someone makes a motion that we not implement I guess staff
is directed to implement it.
I'll ,make a MOTION that we do not.

It has nothing to do with the money. It's like I stated before - I think
that the City Seal belongs to the people. This was voted on a three to
nothing vote in June of 83' and if the Seal is ever going to be changed
a citizens committee should have something to say' about it - not three
Councilmen changing the Seal of the City - because, it actually belongs
to the citizens. Now, you have the power to do it, but that doesn't
give you the right to do it. I'm just saying that that's my personal
opinion.

It has always been changed by ordinance. I have the ordinances here -
I do not have the information of what process preceded the ordinance.

The meeting adjourned in memory of Dr. Clarence H. Wilcox who
passed away February 1, 1985. He was a member of the Arcadia
Lodge #547 F. & A. M. He is survived by his wife, Mary; daughter,
Joanne Mellin and grandsons, Howard and Steven Mellin. A memorial
service was held in the Church of our Heritage at Forest Lawn,
Covina Hills, February 4, 1985.
In memory of Ralph W. Powell who was fatally injured in an airplane
accident January 27. Mr. Powell was born in Monrovia where he
attended elementary school then moved to Arcadia, where he attended
First Avenue Junior High School and Arcadia High School. He
attended San Bernardino Valley College and the University of Southern
California. He was Secretary of Boy Scout Troop 103, on the Boards
of Santa Anita School PTA and Arcadia High School PTA. He was a
Member of the Arcadia Tournament of Roses Association, the Santa
Anita Homeowners' Association and was President of the American
Field Service in Arcadia and was involved in Adventure Unlimited,
a church youth group. He is survived by his wife, Eleanor and
eight children: Kristin, Bill, Greg, Carin, Weston, Brent, Ryan
and Courtney. Memorial services were held at the Church of the Good
Shepherd on January 31, 1985. A Special Ralph W. Powell Memorial
Fund is being established in his honor.
The meeting adjourned at 9:50 p. m. to 5:15 p. m., February 19, 1985
in the Conference Room to conduct the business of the Council and
Agency and any Closed Session necessary to discuss personnel,
litigation matters and evaluation of properties.
