(APPROVED) , f.\>1 . \Y\ ~' MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETI NG OCTOBER 15, 1985 The City Council of the City of Arcadia and the Arcadia Redevelop- ment Agency met in a regular session October 15, 1985 at 7:30 p. m. in the Arcadia City Hall Council Chamber. Lojeski and Pellegrino ABSENT: Councilmembers Gilb and Young It was MOVED by Counci1member Hannah, seconded by Councilmember Lojeski and CARRIED that Cbuncilmembers Gilb and Young be EXCUSED. It was MOVED by Counci1member Lojeski, seconded by Councilmember Hannah and CARRIED that the Minutes of the Adjourned and Regular Meetings of October 1,1985 be APPROVED. It was MOVED by Counci1member Hannah, seconded by Councilmember Lojeski and CARRIED that all ordinances and resolutions be read by title only and that the reading in full be waived. Petition for street lights on'Arcadia Avenue from Golden West Avenue to Sunset Boulevard was presented to the City Council on October 1, 1985. Notices of this hearing were posted on each property and mailed to each property owner. It was noted in the staff report that this project is categorically exempt from the requirements of the California Environmental Quality Act. Mayor Pellegrino declared the hearing open and June Hughes, 1027 Arcadia Avenue, spoke in favor of the proposed street lighting, She noted the darkness of the street and the need for adequate illumination. Lois Anderson, 1024 Arcadia Avenue, spoke in opposition and asked the City Council to reconsider this project before spending the 'money. She felt the petition was circulated at a time when fear of the night stalker was prevalent and that the new apartment buildings have installed tasteful lighting. Robert Christy, 1034 Arcadia Avenue, said he circulated the petition and encountered only one in opposition. The only light on the street is from the newly constructed apartment buildings .,. he noted that he had started petitioning for the new lighting before the night stalker period at which time he came to realize how really dark the street was. '1'< r ~I 25: 1352 No one else desiring to be heard, the hearing was CLOSED on MOTION by Counci1member Lojeski, seconded by Counci1member Hannao and CARRIED, It was then MOVED by Counci1member Hannah, seconded by Counci1- member Lojeski and CARRIED on roll call vote as follows that the Superintendent of Streets be AUTHORIZED to proceed with the work in accordance with the provisions of Chapter 27 of the Improvement Act of 1911, I AYES: NOES: ABSENT: Counci1members Hannah, Lojeski and Pellegrino None Counci1members Gi1b and Young The residents (Mr. and Mrs. Harry Young) of 2241 Highland Vista Drive requested a variance from the requirements of the Arcadia Municipal Code Section 3420 which sets forth the fencing require- ments for poo1fspa areas. This is for their hot tub which is located on the rear portion of the subject site and is not visible from the public right-of-way or adjoining properties. The Planning and Build- ing Divisions have reviewed the requested variance and, while there is a grade differential between the hot tub and the adjacent street, the differential is not so significant that it would preclude access to the hot tub. The Planning Department recommended denial, Photo- graphs were circulated. Mayor Pellegrino declared the hearing open and, no one desiring to be heard, the hearing was CLOSED on MOTION by Counci1member Lojeski, seconded by Counci1member Hannah and CARRIED. It was further MOVED by Counci1member Lojeski, seconded by Counci1- member Hannah and CARRIED on roll call vote as follows that the variance request be DENIED per staff report dated October 15, 1985. AYES: NOES: ABSENT: Councilmembers Hannah, Lojeski and Pellegrino None Counci1members Gi1b and Young Modification request of Benny Joseph to construct an industrial building at 45 E. La Porte Street of 8,000 sq. ft., in lieu of the 15,000 sq. ft. It would be a single story building with six parking spaces and a loading zone. The building would maintain a 10' front yard setback with zero side yards. It would meet or exceed all code requirements except for lot size. The staff report dated October 15, 1985 sets forth all conditions if the modification were approved. Mayor Pellegrino declared the hearing open and Ned Kah10n, owner of apartment units at 49 E. La Porte Street, had some objections to the proposed project .,. the lot on which the commercial building would be constructed is very small and noted drainage problems and a trash problem from the vacant lot because of the lack of retaining walls, Staff advised that the developer would be required to submit a grading a~d drainage plan. I Benny Joseph, 401 N. First Avenue, owner of 45 E. La Porte Street, sai~, in part, that he will check out the problems referred to by Mr. Kah10n, Nimar Matta, 1679 Alta Oaks Drive, owner of 41 E. La Porte Street, speaking also for the owner of 43 E. La Porte Street, said, in part, that he realizes his property is non-conforming; however it was not ten years ago. He explained what he paid for the property and what he would probably have to sell it for now." a buyer would only be interested in the land and expressed concern for the type of business which would be conducted. "',M I NUTE APPROVAL ( Oct. 1 ,1985) (APPROVED) . ,- i 25:1353 Staff also advised that the zoning was changed in the late 60's at which time all of the residential uses became non-conforming; and Mr. Matta was aware of that when he purchased his property about three years ago. No one else desiring to be heard, the hearing was CLOSED on MOTION by Council member Lojeski, seconded by Councflmember Hannah and CARRIED. In response to questions by Councilmember Hannah, staff said, in part, that four or five modifications have been granted during ~he last three years ... that this is the first application submitted by Mr. Joseph. The zoning was probably changed so that larger buildings could be constructed ,.. but it hasn't been very effective to date. Council- member Hannah felt a study of the area should be made ... if the ordinance is wrong, it should be changed. Modifications should not be granted if the zoning is wrong. He felt all parties should be treated fairly. Councilmember Lojeski said, in part, that, based on the circumstances and comments, he would MOVE to APPROVE the modification subject to the following conditions: 1. That the block wall along the rear property line adjacent ,to the alley be deleted or shall be a wrought iron fence. 2, Plans shall be in substantial compliance with the plans approved by the City Council. 3. That the modification shall not take effect until owner and applicant have executed a form available from the Planning Department indicating awareness and acceptance of the conditions of approval. The MOTION was AMENDED to include "that staff study the subject area and submit an analysis to Council as to whether or not the zoning should be changed and, if so, that a public hearing be scheduled accordingly" . ADJOURNMENT 25 : 1354 The Agency received the Design Review of a two unit industrial building and parking lot at 45 E. La Porte Street. Application filed by Benny Joseph whose modification request for the subject property was approved this date. It was MOVED by Member Lojeski, seconded by Member Hannah and CARRIED on roll call vote as follows that the Agency concurs with the Council!s approval of Modification 85-119 and finds that the proposal is an . exceptional circumstance under Section 423 and that the variation and Design Review of the plans be APPROVED subject to the following conditions. I 1. All State and City codes shall be satisfied (e,g., zoning, building, and safety, etc.). 2. Applicant to satisfy the requests of the Planning and Public Works Departments as stated in the report dated October 15. 3. Property owners shall execute an OWner Participation Agreement prior to the issuance of a building permit.. 4. Building's exterior, landscaping, signage and parking lot shall be maintained to the satisfaction of the Planning and Economic Development Departments. L. Kaplan Construc- tion Company at 119-127 La Porte Street, The three existing single family residences will be demolished. The zoning is M-l Planned Industrial District. It was MOVED by Member Hannah, seconded by Member Lojeski and CARRIED on roll call vote as follows that the variation under the Redevelopment Plan for this development be APPROVED and that the Design Review be APPROVED subject to all conditions set forth in staff report dated October 15, 1985, AYES: NOES: ABSENT: Members Hannah, Lojeski and Pellegrino None Members Gilb and Young At this point in the proceedings, Member Lojeski suggested that in the essence of time that staff prepare one report which could cover all of the Design Review items to be considered instead of individual reports on each. He also suggested that Council take a look at;a new development near Tenth and Duarte... where a cul de sac accommodates 6 new very large houses; also a development in Temple City just to see if that is what Council would want in Arcadia. Staff will check into appointments as listed on a report to Council, 10f15185 -6- I I 25:1357 COUNCIL ENTERED A CLOStD SESSION TO DISCUSS LITIGATION, RECONVENED, .', Councilmember Lojeski adjourned the meeting in memory of Jack Tyrell, Temple City Councilman from 1960 to date. Mr. Tyrell passed away October 7, 1985 after a two year bout with cancer. Mr. Tyrell attended the last City Council Meeting of September 17. A memorial service was held at the Holy Trinity Episcopal Church in Alhambra, He was a power force in the drive for the incorporation of Temple City and started many public safety programs. He was a trial attorney practicing in the area more than 30 years. He'i s survi ved by hi s wife, hi smother, a daughter, two sons and one grandson. Ben F. Smith, Sr. was a resident of Arcadia from 1939 to 1957, He was born iniOowney, California on April 18, 1905, He attended Garden Grove High School and continued his education by attending engineering classes at night. In 1928, at age 23, Ben Smith started the Ben F. Smith Company, which has become one of the largest concrete subcontractors in Southern California. Ben was active in the oil business in Texas and the ranching business in California. He was affiliated with many groups but his most active involvement was in,the Tournament of Roses and the Pasadena Boys Club. Ben passed away on September 30, and is survived by his wife, Julia; two sons, Ben F. Smith, Jr., and R. Ernest Smith, both of Arcadia; one daughter, Barbara Rose of San Diego; nine grandchildren and seven great-grand- children, 12.
