READ BY TITLE ONLY CLOSED SESSION (CITY ATTORNEY) MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING JULY 1, 1986 The City Council of the City of Arcadia and the Arcadia Redevelop- ment Agency met in a regular session July 1, 1986 at 7:30 p. m. in the Arcadia City Hall Council Chamber. Rev. John H. Farley, Associate Pastor, Church of the Good Shepherd Councilmember Gilb PRESENT: Councilmembers Gilb, Lojeski and Young ABSENT: Councilmembers Chandler and Harbicht On MOTION by Councilmember Gilb, seconded by Councilmember Lojeski and CARRIED, Councilmembers Chandler and Harbicht were EXCUSED. It was MOVED by Councilmember Lojeski, seconded by Councilmember Gilb and CARRIED that all ordinances and resolutions be read by title only and that reading in full be waived. Pursuant to Government Code Section 54956.9(a), the City Council and the Redevelopment Agency met in a Closed Session preceding this meeting to discuss the existing personal injury case of Starkey vs. Arcadia. Additionally. the case. of the City vs. Bong was discussed. And pursuant to the Government Code Section 54956.8, the Agency was in Closed Session to instruct its negotiators regarding the potential price in terms of possible acquisition of certain properties within the Redevelooment Area. PRESENTATIONS Mayor Young presented plaques of appreciation for the efforts and accomplishments of the following outgoing members of the various Boards and/or Commissions as indicated: Eileen Hubbard, Arcadia Beautiful Commission Beatrice Chute, Library Board Edith Casey and Bob Harbur, Sister City Commission Councilmember Lojeski presented plaques of appreciation for the efforts and accomplishments of the following members of the Historical Commis- sion. Mr. Lojeski spoke of the accomplishment of finally obtaining a building and a .site for the Museum. Mary Leupold, Alice Slater and Herb Goddard (Lornetta Platford and Elb Souders were unable to be present.) Foothill Blvd. (Thomas l. Parrish, appl icant). Staff report presented. During a site inspection, the City's Inspector noted that a radio controlled self-closing gate was installed across the driveway. The gate was in the fence which enclosed the pool area. This does not comply with the City Code which states that "no fence, 9ate or wall required by this Part may be constructed across any driveway". The property complies with City Code for fence and gates around swimming pools with the exception of the gate across the driveway. The Planning Department recommends approval of the variance based upon the property location (on the private frontage road) and the distance of the self-closing gate from the street that the publiC safety would not be jeopardized by the granting of this variance request. Mayor Young declared the hearing open, and Thomas l. Parrish, 895 West Foothill Blvd. the applicant, was present to answer questions. No one else'desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Gilb, seconded by Councilmember lojeski and CARRIED. The City Attorney has advised that Section 809 of the City Charter provides authority for the Board to perform this function, subject to approval by the City Council. Accordingly, the fund raisipg function would be covered by the City's insurance coverage. It was MOVED by Councilmember Gi1b, seconded by Counci1member Lojeski and CARRIED on roll call vote as follows that permission be granted the Library Board to sponsor the Friends wine tasting Al\oakia event on September 26, 1986. The Agency received the explanatory report on the staff's request for authorization to proceed with formal eminent domain proceedings for the acquisition of property at 326 E. Huntington Drive (Derby Motel/Patel). It was noted that while the negotiations may continue in order to comply with the Development Schedule in the Disposition and Development Agreement with Stanley W. Gribble and Associates, these proceedings should commence. Councilmember Gilb read the title of ARA Resolution No, 99 and MOVED for its adoption. The meeting adjourned to 7:00 p. m., Ju1y 15, 1986. COUNCIL RECONVENED AUDIENCE PARTICIPATION I Frank Niles, 834 W. Duarte Road, Arcadia, spoke to the need for rent control for senior citizens, in particular. He recited how his monthly rent has increased and asked Council to consider such a regulation. . Sharon Wayer, 452 W. Huntington Drive, Arcadia, spoke to problems encountered in the County Park near the pool and tennis courts... a great deal of vandalism occurs as well as a great deal of untoward actions. The City Manager thanked Ms. Wayer for bringing this to the attention of the City Council and said he would discuss this with the Police Chief and that the County will also be notified. Richard Karlbaum, 805 S. Second Avenue, Arcadia, spoke at length and, in part, urged Council to adopt a Resolution for stricter enforcement of immigration laws; stronger cooperation with I & N S agents; reporting illegal aliens and their employers to the I & N S; that the bilingual education program be discontinued and that English be declared the official language of the United States. He said he realizes it will. be difficult to uniform California under one language and urged the Council to pass such a resolution. , \ CONSENT ITEMS HEARING scheduled for July 15 on the appeal of Modification M-86-70 for a proposed 4 unit apartment building at 819 S. Golden West Avenue. APPROVED a substandard lot depth on Lot No.1 of Tentative Parcel Map 86-2 for property at 67 W. Palm Drive and 70 W. Birchcroft Street. Three lots are to be created from two. RECEIVED results of bids received and AWARDED the contract for 1986-87 Resurfacing of Various Streets, Job No. 590 to the low bidder, Su11y- Miller Contracting Company in the amount of $366,330.20 and APPROPRIATED $420,000 from State Gas Tax and Federal Section 2126 Funds to cover the cost of construction, engineering, inspection, contingencies and contract amount; all informalities or irregularities in the bid or bidding process were waived and the Mayor and City Clerk were AUTHORIZED to execute the contract in form approved by the City Attorney. RECEIVED the results of bids received and AWARDED the contract for improvement of Arcadia Avenue Job No. 584 to J. E. C. Construction Company in the amount of $49,649.50 and APPROPRIATED $60,000 from State Gas Tax Funds to cover the cost of engineering, inspections,contingencies, and the contract amount; any informalities or irregularities in the bids or bidding process were waived and the Mayor and City Clerk were AUTHORIZED to execute the contract in form approved by the City Attorney. RECEIVED the results of bids received and AWARDED the contract for installation of colored paving block crosswalks at various inter- sections, Job No. 588B to the low bidder, E. C. Construction Company in the amount of $134,967.11; and appropriated $170,000 from Community Development Block Grant Public Works Funds to cover the cost of engineering, inspection, contingencies and the contract amount; any informalities or irregularities in the bids or bidding process were waived and the Mayor and City: Clerk were AUTHORIZED to execute the contract in form approved by the City Attorney. RECEIVED th~ results of bids received and AWARDED the contract for the construction of the City Corporation Yard, Job, No. 578 to the low bidder, Bernards Bros. Construction in the amount of $2,675,450 and APPROPRIATED $3,077,000 from Capital Outlay Funds to cover the cost of engineerin9, inspection, contingencies and the contract amount; all informalities or irregularities in the bids or bidding process were waived and the Mayor and City Clerk were authorized to execute the, contract in form approved by the City Attorney. Specifications for this project call for the new facilities to be ready for occupancy by January 30, 1987. This involves the relocation of the Yard from 35 S. Fifth Avenue to Goldring Road in the Chicago Park area. RECEIVED the results of bids received and AWARDED the contract for traffic signal maintenance, Job No. 591 to Superior Signal Service Corporation in the amount of $38.48 per intersection per month or $22,164 per year for routine maintenance; any informalities or irregularities in the bids or bidding process were waived and the Mayor and City Clerk were authorized to execute the contract in form approved by the City Attorney. 7/l /86 -5- /Jv< :(1 26:0167 71 . -JR AWARD OF f AWARDED a one year's contract for the purchase of propane fuel to CONTRACT Buckeye Gas Products in an estimated amount of $22,585. MATTERS FROM ELECTED OFFICIALS Was advised that the building taking place at the N/W corner of Arcadia Avenue and Baldwin Avenue is to be a small neighborhood shopping center and that in this particular case a design review was not required. Asked about the plans made sometime ago to have Best Disposal make a study of providing a curbside recycling program and the establish- ment of a drop-off bin within the City. Staff advised that a some- what inadequate study was made and the problem was that, due to financial problems, Best could not afford a plot of land for the purpose. It was noted by staff that Best will soon be coming before Council on some matters and this could be addressed at that time. Counci1member Gi1b submitted, in part. that the bins he has seen are not the neatest receptic1es ... people seem to just throw their trash in the bins ... that on Balboa Island the City picks up newspapers which the residents tie up and place them out by their garages. The money is used for recreation facilities in Newport Beach ... it seems to work quite well. Referred to the condition of Orange Grove Avenue ... that he fears someone is going to be hurt and the City could be held liable. He suggested that the Counci1members traverse that street and see for themselves. Staff said, in part, that now with a turnover in Council members in Sierra Madre, a communication might be appropriate asking them to reconsider this. It was noted that this was done in the past to no avail, but it is worth a try again. In response to a question, staff advised that undergrounding utility poles on the north side of Huntington Drive between Second and Fifth has not been discussed, but could be looked into as part of the development process '" they are on site and are included in the take-down. Referred to the so-called horse properties and asked if anyone knew how many horses are kept in the City... that he would just like to know for his own information ... there is so much talk about horse property and yet no one really knows how many horses are kept in the City. Some brief discussion held on a lawsuit which the local press had in- dicated the petitioners were thinking about ... The City Attorney stated, in part, that he did not believe they were in a position to file a lawsuit with regard to the last tentative map which the Council approved in the subject area ... that he did not believe they would succeed because the City acted properly and fairly during those proceed- ings. Commented she would like to know how those large green trash bins get permission to be placed right at the edge of the sidewalk (at Ralph's on Foothill). She did not mind the bins being there, but felt they are an eyesore at that particular location '" they should be away from the public sidewalk. 7/1/86 -7- 26:0169 GILB Some discussion on the changes being made in West Arcadia . shopping area ... Clark's Drug Store is going out as are most of the small stores there. It was submitted that it has been heard that perhaps Builder's Emporium or the like would be going in. The Council meeting adjourned at 8:30 p. m. to 7:00 p. m., July 15, 1986 in the Conference Room to conduct the business of the Council and Agency and any Closed Session necessary to discuss personnel, litigation matters and evaluation of properties. 11.
