Agency Members Chandler, Kovacic, Marshall, Segai, and Wuo ABSENT: None STUDY SESSION AUDIENCE PARTICIPATION - (5 minutes per person) a. CLOSED SESSION Discussion and Direction regarding Cable TV matters, Bill Kelly, City Manager, and Steve Dietsch, City Attorney, introduced the City's special counsel on cable matters, Jeff Ballinger, Best Best and Krieger, to the Council and staff; Mr. Ballinger provided an update regarding current cable franchise agreements, in particular the agreement between Altrio Communications, rnc; Mr. Ballinger noted that Champion Broadband of California (Champion) had acquired one hundred (100%) percent of Altrio's assets including its franchise rights with the City of Arcadia; City staff is proposing the potential execution of a new franchise agreement between the City and Champion; staff is also recommending an updated version of the City's current Ordinance governing cable franchises; the proposed Ordinance will include language that will add provisions authorizing the City to regulate not only cable operators, but also video and telecommunications seIVice providers to the extent provided by federal and state law, Council Member Kovacic noted residents' concerns regarding seIVice levels provided by the cable companies and the obtrusiveness of the accompanying infrastructure that must be installed on the public right of way to support cable, video and telecommunications systems, a. Pursuant to Government Code Section 54957,6 to confer about labor contract negotiations' California Teamsters Public, Professional and Medical Employees' Union 911 (Confidentiai, SupeIVisor, Professional and General Employee Unit and Public Works Employee Unit), Arcadia Police Officers' Association, Arcadia Firefighters' Association, and unrepresented employees: Department Heads, Division Managers, SupeIVisors, and Part-time Employees (City Negotiators: William W, Floyd and Tracey Hause), b. REPORT FROM STUDY AND CLOSED SESSION The City Attorney, Steve Deitsch, announced the items that were discussed at the meeting's Study Session and noted that no reportable action was taken by the City Council during Closed Session, PRESENTATIONS a. Presentation of Proclamation to the American Legion Auxiliary, Arcadia Unit 247 in honor of Poppy Day 2 05-03-05 I I I I I I 1, Staff Report Public Testimony 47:0046 PUBLIC HEARINGS a. Consideration of oarkino and minimum lot size modifications for the construction of a new 4.427 sa, ft. industrial buildina at 133 St. Joseoh, Recommendation: Approve Don Penman, Assistant City Manager/Development Services Director and Donna Butler, Community Deveiopment Administrator, provided the staff report to the Council; staff noted that an application was filed requesting ten (10) parking spaces in lieu of eleven (11) parking spaces required and to permit an industrial development on a lot that is iess that 15,000 square feet at 133 St. Joseph Street; the City Council may approve an industrial development on a lot less than 15,000 square feet where a hardship by reason of surrounding developments, location or configuration is c1eraly demonstrated; it is staff's opinion that a unique hardship exists in that the applicant's lot is currently a legal lot and it was created prior to the establishment of the minimum 15,000 sqaure foot lot size in 1975; the site is also surrounded by existing industrial developments; staff feels that the deficiency of one parking space is minimal and it will not have an adverse impact upon the available on-site parking since the primary use of the building is warehousing; staff is recommending approval of this item. The Design Engineer of the project appeared in support of Council's approval of the Modification, Motion to Close A motion was made by Council/Agency Member Chandler, seconded by Council/Agency Member Public Hearing Marshall, and noting no objections, the Mayor closed the public hearing, Council Deliberation Motion Roll Call Staff Report None, A motion was made by Council/Agency Member Kovacic, seconded by Council/Agency Member Segal, finding appropriate improvement and carried on roll call vote to approve MM 05-01, subject to conditions of approval and based on the finding that this modification would prevent an unreasonable hardship, Ayes: Noes: b, Council/Agency Member Chandler, Kovacic, Marshall, Segal, and Wuo None An aooeal of the Plannina Commission's denial of CUP 2005-02 for a iob trainina center at 19 E. Live Oak Avenue, Recommendation: Continue to a future Council meeting, Mr, Penman noted that the application on this project requested a postponement of the public haring pending the outcome of Conditional Use Permit 2005-007, a request to operate a tutoring school in the same building; notices advising property owners of the postponement of this public hearing have been mailed to everyone within a 300 foot radius of the subject property; staff noted that when a new date is scheduled for the City Council hearing, notices will be sent to all property owners, The Mayor ordered the continuance of the public hearing on this item, 3 05-03-05 47:0047 AUDIENCE PARTICIPATION - (S minutes pet person) Ed Fuoate. Arcadia resident, appeared to express their concerns regarding code enforcement issues at their Arcadia home, I Elisa Clifford, Southern California Edison, new region manager for the City of Arcadia, appeared to introduce herself to the City Council. Brent Beckwith. owner of Red Rock Chili Co" appeared to express his concerns about the retail environment in themaii in light of the potential Caruso development.
