Agency Members Chandler, Kovacic, Marshall, Segal, and Wuo ABSENT: None AUDIENCE PARTICIPATION - (5 minutes per person) STUDY SESSION Mary Dorothey appeared to speak in favor of the grade separation at Santa Anita Avenue. a. Report, discussion and direction regarding "financing options for GoldUne grade separation at Santa Anita Avenue." Recommendation: Provide discussion and direction. CLOSED SESSION a. INVOCATION Sill Kelly, aty Manager, and Phil Wray, Oty Engineer, provided an update to the City Coundl regarding a variety o.f finandng options for the GoJdline Grade separation at Santa Anita Avenue. The finanang options presented and discussed induded: 1) General Obligation Bonds, 2) Assessment District Bonds, and 3) Community Fadlltles District Bonds. This matter will come before the Coundllater In the agenda during the Regular COundl Meeting. In addition, the oty Coundl met in Closed Session to discuss one matter pertaining to the potential initiation of litigation. There was no reportable action taken by the City Council in Closed Session. MOTION TO READ ALL ORDINANCES/RESOLUTIONS BY TITLE ONLY AND WAIVE READING IN FULL A motion was made by Council Member Chandler, seconded by Counol Member Marshall, and carried without objection to read all ordinances/resolutions by title only and waive reading In full. Staff Report Public Testimony a. Recommendation: Introduce Ordinance No. 2213 amending Section 9295, an Ordinance of the City Council of the CIty of Arcadia, california, amending certain sections of Article IX, Chapter 2, Part 9, Division 5 of the Arcadia Municipal Code relating to Architectural Design Review 2 Direct staff to prepare a resolution adopting the Single Family Design Guidelines 3 Direct staff to schedule a pubUc hearing for consideration of adopting proposed fees for processing applications for single-family design review 4 Authorize the Assistant Oty Manager/Development Services Director to begin recruitment of an Associate Planner,for the Community Development Division I 5 Appropriate from the unreserved general fund $46,000 to the Development Services Department/Community Development Division 2005-06 budget for compensation and benefits for an Assodate Planner position for the remaining six months of fiscal year 2005-06. (This amount also indudes the one-time cost of approximately $6,000 for office furniture and a computer.) Don Penman, Assistant Oty Manager/Development services Director, and Donna Butler, Community Development Administrator, presented the report. Staff noted that the proposed Text Amendment was initiated to add regulations 'to the Arcadia Municipal Code to require design review for single-family residential uses and also tol adopt related design guidelines. The Planning Commission recommended approval of this item to the City Council at its September 13, 2005 meeting. Staff also recommends approval of this item. I Oty Attorney Deitsch darrilied that Mayor Wuo is a member of Arcadia Association of Realtors but does not have any finandallnterest In this matter. He is entitled to partidpate in this public hearing and is able to vote on the issue under the California Polltical Reform Act. Ronald Thee 926 Encanto Drive, appeared to express his concerns with regard to "masionlzatlon" of homes in Arcadia. He felt that Arcadia must take an aggressive policy of code enforcement and should have citywide Architectural Design Review. Chic Ahlswede. Government Affairs Director, Arcadia Assodation of Realtors, noted that the Association IS not against the proposal but they want to make some amendments and improvements to the Guidelines. ARB Chairman, Rancho Santa Anita Residents Assodatlon, appeared to speak In support of the proposed Architectural Design Review. lrY...IQ.ns, Chainnan, Political Action Committee, Arcadia Association of Public Realtors, submitted letters from several city residents regarding the public hearing matter. , Martin Funo appeared to speak In favor of the Architectural Design Review. Marv Rovarino 57 West Camino Real, Executive Vice President, Arcadia Association of Realtors, noted that she is in favor of design review but would like clarifications on some areas of the Guidelines. James Kellv 946 Coronado Drive, supported the adoption of the proposed guidelines. , Raloh Bickers. Motion to Close It was moved by Council Member Marshall, seconded by CounaJ Member Chandler and carried without objection to Public Hearing close the public hearing. City Council Deliberation Motion Roll Call Staff Report Public Testimony In response to an inquiry from Mayor Wuo, staff responded that the responsibility for design review will remam with the HOA's, however, the guidelmes may be used to assist the associations In their design review process. None of the City's proposed guidelines are in conflict with the HOA guidelines. City Attorney Deitsch read the revisions to the proposed Ordinance No. 2213. In respond to an inqUiry from Mayor Pro Tern Chandler, staff clamfied that the guidelines will be adopted by Resolution allowing for easy modification and changes as necessary. Staff noted that the City Council adopted a resolution that established procedures and requirements for development agreements; the regulations require adoption of a development agreement fee by separate resolution of the Council. Staff is recommending adoption of Resolution No. 6492 which establishes fees for the filing and processing of applications and related documents for development agreements. None. . Motion to Close It was moved by Council Member Chandler, seconded by Council Member Segal, and camed without objection to Public Hearing close the public hearing. Report, discussion and direction regarding "financing options for Goldline grade separabon at Santa Anita Avenue." Recommendation: Provide direction. I Bill Kelly, Oty Manager, Tracey Hause, Administrative Services Director and Phil Wray, CIty Engineer, provided an update to the City Counal regarding a variety of financing options for the Goldlme Grade Separation at Santa Anita Avenue. The financing options presented and discussed induded: 1) General Obligation Bonds, 2) Assessment Distnct Bonds, and 3) Community Facilities District Bonds. Staff also reviewed a Power Point presentation and a traffic Model based on traffic volumes projected on the Santa Anita Corridor up to the year 2030. Staff estimated the total cost of the grade separation project to be between $12 to $13 million. Currently the City has set aside approximately $5 million in transportation related funding in ProposItion A and C reserves. As a result, the CIty needs to consider approximately $8 million in debt issuance proceeds to fund this project. James Sabien, the City's financial consultant, explained in detail the General Obligation Bonds and Assessment District Bonds election process and the cost to the City. A two-thirds (2/3) majority vote would be required for approval of the General Obligation Bond. The property tax would be added to the property tax rolls of all homeowners and commercial property owners within the City. Motion ~ It was moved by Council! Agency Member Segal, seconded by Council! Agency Member Marshall and carried on roll call vote to offer to the voters on the April 11, 2006 Election ballot, a General Obligabon Bond.
