The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday,
May 21, 2002 at 5:00 p.m., in the City Attorney's Conference Room,

At 5:00 p,m, the City Council RECESSED to Closed Session,
CLOSED SESSION
Pursuant to Government Code Section 54956.9(a) to confer with legal counsel regarding the
worker's compensation case of Kima Kirakosyan.
The Regular Meeting RECONVENED at 5:25 p.m. in the City Attorney's Conference Room.
OPEN SESSION
City Manager Kelly presented an overview of the proposed Statement of Policy concerning "City
Council Protocol/Procedures," At its April 16, 2002 meeting the City Council directed staff to
prepare a policy statement concerning City Council protocol and procedures concerning the
handling of correspondence, City stationery, certificates and related matters, for Council
adoption.
Mr. Kelly reviewed the proposed Statement of Policy which contains: Contact with City staff,
correspondence, legislative correspondence, City stationery, attendance at community events,
certificates, proclamations, City pins and promotion of Individual Council Members.
In his presentation Mr. Kelly noted that City Council mail is opened by the City Manager's staff
daily and delivered to Councilmembers on a weekly basis, Letters addressed to individual
Councilmembers will be given to and signed by said member and if asked, staff will prepare a
response for the Councilmembers review. City staff may provide administrative and clerical
support to Council members with regard to correspondence as long as the issue at hand is
directly related to City business, If a Council member responded to or initiated a letter on their

own, It is expected that the Councilmember will provide a copy of the letter(s) to the City
Manager's office so that staff can accurately respond to a resident's inquiry about the status of
their request and/or answer follow-up questions.

With regard to certificates and proclamations, City Manager Kelly stated that, in general,
certificates of achievement and commendations are to be signed by the sitting Mayor. On
unique occasions, Council members may request that a certificate be prepared for their signature
rather than the Mayor's. Such a request has to be approved by the Mayor or City Manager.
Considerable discussion ensued with regard to correspondence, legislative correspondence and
Council's individual response to a letter or electronic mall. The Council concluded that the City
Manager should receive a copy of all Council correspondence written on City official stationary
and/or response to electronic mail, whether it is an individual or collective~
It was noted that certificates may be given to Arcadia residents, Arcadia businesses, or to an
individual business or organization that has provided service directly to the City of Arcadia. The
City Manager's approval is necessary for issuing certificates requested by Council members and
not related to City business, A proclamation may be prepared for a special occasion or
commemorative event and may be presented at a City Council meeting or an event. The
proclamations should always have some connection to the City of Arcadia and are always
signed by the sitting Mayor.

Mayor Marshall presented the May, 2002 Citizen of the Month Award to Patricia Eicherly, stating
in part that, Patricia has had a long career of service with the City of Arcadia, which includes
twelve years as a member of the Arcadia Beautiful Commission. She also made significant
contributions in the field of education through her work with the Arcadia Teachers' Association.

Councilmember Kovacic congratulated the Arcadia Beautiful Award recipients this evening,
Mr. Kovacic noted on May 14th the Arcadia Board of Education adopted a resolution in
opposition to AB 2115 which is the proposed Assembly Bill concerning athletic team names and
mascots, He would like a similar resolution on a future agenda for Councii adoption, Council
concurred.

Councilmember Wuo congratulated Bob and Jeanne Herrington, the recipients of the Senior
Citizens of the year Award,
Mr. Wuo felt that Mr. Hoherd's suggestion at the last Council meeting with regard to having
readable residential and commercial street numbers would be beneficial for both residents and
visitors,
Mr. Wuo referred to a phone call from an Arcadia resident complaining about the poor lighting on
Lemon Avenue, between Santa Anita and EI Monte, He would like staff to work on this matter
and try to improve the lighting in that area,

Mayor Pro tem Chang congratulated the Arcadia Beautiful Award recipients, stating in part, that
Arcadia is a beautiful City because of their hard work and enthusiasm. He also expressed
appreciation to the Arcadia Beautiful Commissioners for their hard work during the selection
process,
Dr. Chang urged owners of large homes in the City to spend some money and time and make
their front yard beautiful.
Dr. Chang congratulated Patricia Eicherly, Citizen of the Month, stating she contributed a lot to
Arcadia and deserves the award,
Dr. Chang congratulated Longley Way Elementary School on its 50th Anniversary,
Dr. Chang expressed congratulations to Bob and Jeanne Harrington, Senior Citizens of the
Year and thanked them for donating more than a hundred hours of their time every month to
help and care for seniors and the disabled of the community.
Dr. Chang attended the Arcadia Chamber of Commerce Expo 2002, on May 16th, Many
exhibitors participated in that even!. The theme was "Focused on Arcadia".
Dr. Chang noted that a Law Enforcement Appreciation service was held on May 11, at the
Episcopal Church of the Transfiguration, He expressed appreciation to the Arcadia Law
Enforcement Officers for making Arcadia a very safe City. '
Counciimember Segal congratulated the Arcadia High School Baseball team for a great
season,
Mr. Segal encouraged everyone to attend "The May Show", which will be held at the Arcadia
High School, May 29th.
Mr. Segal encouraged everyone to take a moment on Memorial Day and give a little thought
and thanks to those who lost their lives to ensure the freedom that we have now.

Report and recommendation to appoint Alternate Director to serve on the Board of Directors of
the Los Angeles County Sanitation District. Section 4730 of the California Health and Safety
Code stipulates that the presiding officer of a City, all or part of which is in a Sanitation District, is
a member of the Board of Directors of that District. Therefore, when Mayor Marshall took office
on April 16, 2002, she automatically became a Director and no appointing action was necessary,
However, the Health and Safety Code does require action by the City Council to appoint an
Alternate Director to this Board,

The City Charter requires an annual audit of the City's financial statements by a certified public
accountant. In 1999, the City solicited proposals from qualified Certified Public Accounting
(CPA) firms to audit the City and Agency's financial statements for fiscal year ending June 30,
2000 with the option to renew for four subsequent fiscal years. After an extensive evaluation
process, Conrad and Associates, LLP was selected and completed the audit for fiscal years
99/00 and 00/01 .
Staff found the services performed last year to be satisfactory, and in order to provide continuity
for a period of time, recommended the City and Agency once again contract with Conrad and
Associates to complete the audit for the period ending June 30, 2002, The cost proposed for
audit services is $44,100.00, an increase of $8,555,00 over the prior year. The cost increase is
a result of a COLA and from major changes in reporting requirements (GASB 34),
It was MOVED by Agency Member Chang, seconded by Agency Member Segal and CARRIED
on roll call vote as follows to APPROVE an agreement with the firm of Conrad and Associates,
LLP, in the amount of $44,100.00 for Agency audit services; and, DIRECT the Executive

In response to a Council question City Manager Kelly stated in part, that many years ago the
City formed an Assessment District in the Chicago Park area to pay for certain public
improvements. The property owners paid for those bonds over time and at the end of the bond
term the dollar amount was available for use within that project area,
The project will consist of installing new traffic signal poles, mast arm street name signs, vehicle
and pedestrian LED indications, intersection lighting, new wiring throughout the system, a new
service enclosure, and vehicle detection loops,

RESOLUTION Consideration of the report and recommendation to adopt Resolution No, 6302 supporting the

In 1993, the City of Arcadia lobbied the Metropolitan Transportation Authority (MTA) to extend
light rail service into Arcadia. In the fall of 2000, the San Gabriel Valley Council of Government
(COG) and the Blue Line Construction Authority chose to aggressively pursue the extension of
the Gold Line through ten San Gabriel Valley cities and secure federal funds to begin Phase II
development beyond the Sierra Madre Villa station in Pasadena, Furthermore, the Arcadia City
Council in October 2001, unanimously voted to designate the southwest corner of St. Joseph

Street and First Avenue as the potential site for a multi-modal transit station, and committed to
the Authority its support and participation in the construction of the Gold Line Phase II light rail.

In response to Council's questions staff clarified that an Environmental Impact Report will be
prepared following local, state and federal procedures. Issues not resolved in the Analysis
Study will be addressed during the environmental assessment stage, including local impacts,
The City of Arcadia and its residents and businesses will have an opportunity to review and
comment during this stage.
Staff noted that under the current planning, the Blue Line Construction Authority is looking at
building the rail above grade at Santa Anita Avenue and at grade at First Avenue.
Considerable discussion ensued. Some Councilmembers were in favor of having the rail above
grade, even if this means dropping the street level below the existing rail level; others supported
running the, rail as an underpass throughout town. Following discussion Councilmembers
agreed that they want a grade separation throughout the City of Arcadia and they would like to
amend the proposed resolution specifying the City's interest in a grade separation.
City Attorney Deitsch suggested the following amendments to proposed Resolution No. 6302:
re-number item No.2 of Section 1, to No, 3; and, add item NO.2 to read as follows; The City of
Arcadia strongly recommends that the final project include grade separations, Preserve the
grade crossings at Colorado Avenue and Second Avenue and include grade crossings at Santa
Anita Avenue and First Avenue,

Consideration of the report and recommendation regarding the construction of a Skate Park and
park rehabilitation area at Bonita Park.
In summary, City Manager Kelly, presented an overview of the previous actions taken on the
proposed project, stating. in part that, on March 19, 2002, the City Council rejected the single bid
of $566,308 received from 4-Con-Engineering, Inc. from the first bid process. On April 29, 2002
three bids were received from the second bid process. Subsequent to preparation of the staff
report, the low bidder requested that his bid be withdrawn. At its May 7, 2002 meeting, the City
Council directed staff to return to the next meeting with more information on the construction of a
Skate Park and Tot Lot Area in Bonita Park, Several options or alternatives were prepared for
the City Council's consideration and direction as outlined under Alternatives in the May 21, 2002
staff report,
It was noted that the Parks and Recreation Commission recommended alternative No.3. which I
indicates to reject all bids and redesign the skate park, eliminate special features, lower the

construction cost and re-bid mid to late summer. The Commission is not in favor of awarding the
contract to the second low bidder, for an amount of $611,112, of which $349,972 is for the
skating structure itself. Commission members felt that this action will reduce funding set aside
for other park projects,'
In response to a Council question, Patrick Malloy, Public Works Services Director, stated in part
that all of the City's construction projects have a contingency of 18% to 20% beyond the bid
price, The contingency portion is to make sure that there are enough funds available to finish
the project in case of foreseen problems, Construction of a Skate Park is a difficult project;
Public Works staff does not have any experience in constructing a skate park. Therefore, there
is a need to have a consulting firm assist staff with administration and inspection services.
The City of Monrovia recently awarded a construction project for a skate park at a cost of
$308,000, Arcadia's park is approximately %7 larger than Monrovia's, twice as deep, and has
many special features included in the skate facility and it requires the relocation and re-wiring of
existing ball field iighting conduits and the construction of 220 feet of a 15 foot tall chain link
fence to protect the skaters from fiy balls from the ball diamond, plus the relocation of the
existing tot lot.
Considerable discussion ensued, concluded by the following motion; It was MOVED by
Council member Wuo, seconded by Mayor Pro tem Chang and CARRIED on roll call vote as
follows to DIRECT staff to approach Purkiss-Rose and discuss modifying their design of the
skate board park; and, if the charge for this redesign by Purkiss-Rose is more than $30,000 the
matter will come to the City Council for consideration and approval.

Councilmember Kovacic adjourned the meeting in memory of Caro'l Odell, "Carol was a long
time resident of Arcadia and a long time member of the Arcadia Assistance League, She is
survived by her husband David, and children Joy Mutschler and Jason Odell, her sister Joanne
Tuber and several grandchildren, She battled breast cancer for many years, Services will be
held on Thursday, May 23 at 2:00 p,m. at Arcadia's Church of the Good Shepherd,
Contributions may be made in Carol's memory to the American Cancer Society, 50 North Hill
Street, Pasadena, California 91106, or the City of Hope, 1500 East Duarte Road, Central
Processing Department, Duarte, California 91010, And, place on that, "Restriction breast cancer
research". Fellow Assistance League member Sharon Novell provided these words about Carol,
'I have always admired Carol for her graciousness and handling herself through these last
challenging years. She was always so positive in her attitude and exuded such warmth and joy
to all who were around her. I remember at the Assistance League Christmas Party one year
shortly after her first surgery, where she arrived with little hair and one of her new hats, she was
beautiful. I caught myself thinking, I wonder if I could have done that? In the years that followed
I watched her month after month, year after year as she was challenged, she was confident and
positive all the way to the end, Her courage, kindness. words and smile will be forever ingrained
in my memory, May she rest in peace. And, on behalf of the City Council I would like our
thoughts and prayers to be extended to the Odell family in the lost of a beautiful and loving wife,
mother and grandmother."
ADJOURNMENT City Manager Kelly adjourned the meeting in memory of Burton "Bernie" Bernstein, "Bernie
(In Memory of retired from the City of Arcadia Pollee Department. He was born in 1936 in Los Angeles, He
Burton "Bernie" began his law enforcement career with the Los Angeles County Sheriffs Department in 1958,
Bernstein) After four years with the County he went into private practice for a short time and then re-entered
(), ',j' , " .) law enforcement as a police officer for Arcadia in February 1968. Bernie promoted to the rank of
agent, a position he held until his retirement in July of 1992, During Bernie's 24 years with the
City, he was responsible for establishing the 'Officer on Campus' program at the High School
and gained a reputation as one of the finest fraud investigators in the Valley, After retiring from
Arcadia, Bernie worked as a Deputy United States Marshal in the Federal Courts in Los
Angeles. Bernie is survived by his wife, Joyce, and sons Alex and Jeffrey. Services were held
on Tuesday, May 7th at Mount Sinai Memorial Park in Glendale.
