PRESENT: ABSENT: Council/Agency Members Chang, Kovacic, Segal, Wuo and Marshall None AUDIENCE PARTICIPATION None STUDY SESSION Donna Butler, Community Development Administrator, presented an overview of a study which was focused on east and west Arcadia R-3 and R-2 zone properties, stating in part that, there are approximately five-thousand eight-hundred (5800) acres of land within the community of which 69% or four thousand (4000) acres is zoned residential, thirty-six hundred (3600) acres of this are zoned single family residential. The study focused on R-2 multiple family zoned properties which is approximately 14 acres, A 1940 zoning map, Second Avenue to Santa Anita was zoned R-2, Similarly in west Arcadia the properties along Huntington Drive and Duarte Road were zoned R-3, Since 1940 the City tried different ways, such as allowing lot consolidation and high-rise overlays in order to encourage construction of multi-story apartment units, however, it was recognized that these changes were not successful. Since 1949 the zoning ordinance and regulations has been changed progressively, In 1987 Architectural Design Guidelines were adopted, These guidelines allowed the Planning Department and City to review multi-family as well as commercial projects, This year new design guidelines were adopted, which are much more specific and provide comprehensive guidelines. Staff explained in detail the proposed changes to R-3 or multi-family development re9ulations and shared pictures and examples showing existing proposals under current codes as compared to the proposed revisions on a similar size property, The proposed R-3 regulation changes included: building heights, front yard landscape, side and rear yard setbacks, parking requirements, guest parking, turning radius, landscape buffers, driveway requirements, driveway planting and distance between buildings. With regard to building heights it was noted that the proposai is to keep the existing regulations which is 2-stories, 35 feet maximum, with the exception that the entry may not exceed a height 14'-0", The proposed changes will revise the existing requirement of at least 50% of the front yard to be landscaped to 60% and will change the minimum side yard and rear yard setback to 20% of lot width with a minimum 10'-0" and a maximum of 15'-0". The existing code allows below grade or subterranean parking; the proposal 1 7/16/02 44:0142 prohibits below grade or subterranean parking with the exception that the Planning Commission or City Council may grant a modification if there are unique circumstances, Council/Agency Member Kovacic felt that the City has been easy in granting modifications over the years, He agrees that the design elements have improved greatly over the years, however, concerns were expressed about the lack of projects that come before the City Council for approval; he felt that the Council should playa greater role in architectural reviews, He is in favor of increasing the minimum size of the units and also would like to see promoting fewer detached units that look like a single unit development. City Manager Kelly suggested that a tour of the City be scheduled for the Council to physically see what is out there and what is a good or bad project. Council agreed, Considerable discussion ensued, Some Council/Agency Members expressed concem with regard to on-street parking. Staff noted that a lot of the on-street parking is generated by existing non-conforming projects that may have twenty (20) plus units and only one parking space per unit. The proposed change in parking requirements, which is to have one (1) guest parking space for each unit, will mitigate on street parking probiems over the long run, Following discussion, by Council consensus, direction was given to staff to schedule a tour of the City for the City Council and take this item to the Planning Commission for their recommendation and input to the City Council. PRESENT: Councilmembers Chang, Kovacic, Segal, Wuo and Marshall ABSENT; None SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None, It was MOVED by Councilmember Wuo, seconded by Council member Kovacic and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED, PRESENTATION CITIZEN OF Mayor Marshall presented the July, 2002 Citizen of the Month Award to Dorothy Denne and THE MONTH thanked her for all that she contributes to the City and her many ways of volunteering. Dorothy (Dorothy Denne) Denne is a fixture, not only at City Hall but the community in general. She was the driving force behind the Arcadia Weekly, She has consistently used her column to inform Arcadians of activities that they might otherwise have missed out on, ~, -, U\;;-c; IY 2 7/16102 I I I I I I 4. 44:0143 PUBLIC HEARINGS 4a, ZONE CHANGE Consideration of the report and recommendation to approve Zone Change Z-02-001 to rezone Z-02-001 northerly 23.4' wide portion of the property located at 1510-1516 South Baldwin Avenue from C- (1510-1516 2 to R-3 to be consistent with zoning on the southerly portion of the property and consistent with S, Baldwin Ave) the recent General Plan change that the City Council approved in March of 2002. (APPROVED) 05$'0-10 The Planning Commission at its June 11, 2002 meeting voted 5 to 0 to recommend approval of the requested zone change, The northerly 23.4' wide portion of the property is zoned C-2 and is currently developed with a cleaners. The southerly 100' of the property is currently zoned R-3 and developed with four multi-family units constructed in 1950, The applicant is proposing to demolish the existing cleaners and multiple-family units and develop the site with nine (9) condominium units that would be consistent with the zoning and the general plan. Mayor Marshall OPENED the Public Hearing, No one came forward to address the City Council. Mayor Marshall CLOSED the Public Hearing, It was MOVED by Mayor Pro tem Chang, seconded by Councilmember Segal and CARRIED on roll call vote to APPROVE Zone Change Application No. Z 02-001 to change the zoning for th'e northerly 23.4' portion of the properties at 1510-1516 South Baldwin Avenue from C-2 to R-3; and, ADOPT the Negative Declaration; and, DIRECT the Development Services Department to prepare the appropriate Ordinance for adoption at a later meeting. RESOLUTION Consideration of the report and recommendation to ADOPT RESOLUTION NO, 6317, entitled: A , NO, 6317 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA. CALIFORNIA. MAKING (Use of ARA FINDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 33445. AND Funds for AUTHORIZING THE USE OF REDEVELOPMENT AGENCY FUNDS FOR PUBLIC Public Imprvm't IMPROVEMENTS". FY 2002-2003) (ADOPTED) The Redevelopment Law (Health and Safety Code Section 33445) requires that. if o /.;" () _ -:>:: redevelopment funds are to be used to pay for improvements which will be publicly owned, both ,I within and outside of the project area, the City Council and the Agency Board must make three findings: a) That the proposed improvements are of benefit to the Project Area or the immediate neighborhood in which the project is located, b) That there are no other reasonable means of financing the proposed project available to the community, c) That the project will assist in the elimination of blighting conditions in the Project Area and is consistent with the adopted Implementation Plan, The July 16. 2002 staff report included a report summarizing the proposed Agency Capital Improvement Projects for FY 2002-2003 such as; a new Huntington Drive Median ($150.000); an Amended Santa Anita Entry Corridor Project ($50.000); it also included a Preliminary Exemption Assessment and a Notice of Exemption for the proposed properties. 3 7/16/02 4c. WEED ABATEMENT 2001-2002 CHARGES (CONFIRMED) Oqt\t1,V' 7, KOVACIC (Denne) Ollv q 44:0144 Following the presentation staff responded to questions raised by Council members, stating in part, that the improvement of the Santa Anita off-ramp is CalTrans responsibility; the City has not I been satisfied with the condition and maintenance of that area, The idea is to come up with a landscape plan, where CalTrans can maintain the off-ramp within its budget and look attractive for the City, Mayor Marshall OPENED the Public Hearing. No one came forward to address the City Council. Mayor Marshall CLOSED the public hearing. It was MOVED by Council member Kovacic, seconded by Mayor Pro tem Chang and CARRIED on roll call vote as follows to APPROVE a Notice of Exemption; and, ADOPT Resolution No, 6317 making findings pursuant to Health and Safety Code Section 33445 authorizing the use of Redevelopment Agency funds for Public Improvements. AYES: NOES: ABSENT: Councilmembers Chang, Kovacic, Segal, Wuo and Marshall None None Consideration of the 2001-2002 Weed Abatement Charge List. On July 3,2002 the Los Angeles County Agricultural Commissioner's Office delivered the list of private properties within the City on which the County has abated weeds, rubbish and refuse, thirty-nine (39) of the forty-two (42) properties listed incurred a minimal charge of inspection only of the property by County personnel. The properties listed on the charge list were posted and noticed of the public hearing this date, as required, Mayor Marshall OPENED the Public Hearing, No one came forward to address the City Council either in favor or in opposition to this item. It was MOVED by Council member Wuo, seconded by Council member Kovacic and CARRIED on roll call vote as follows to CONFIRM the charge list as submitted and DIRECT that the County Auditor be instructed to enter the amounts of the assessments against the respective parcels of land as they appear on the current property assessment roll. AYES: NOES: ABSENT: Council members Chang, Kovacic, Segal, Wuo and Marshall None None AUDIENCE PARTICIPATION Beverly Rauch, Sycamores Organization, Pasadena, presented a brief overview of the organization and association which filed an application with the City of Arcadia to put up street banners advertising and promoting the organizations one hundred year anniversary, The Sycamores was the first orphanage established in Pasadena, Today Sycamores treats boys between the ages of 6 and 17, Currently 66 boys are living within the organization and receiving residential and behavioral help, MATTERS FROM ELECTED OFFICIALS Council member Kovacic congratulated Dorothy Denne and endorsed the Mayor's selection of her as Citizen of the Month, 4 7/16/02 I I I I I (Penman, Butler, Nicholson) 44:0145 Mr. Kovacic complimented Don Penman, Assistant City Manager/Development Service Director; Donna Butler, Community Development Administrator and Corky Nicholson, Planning Services Manager for their excellent work and presentation at the study session held earlier this evening with regard to the current R-3 regulations and proposed changes, (Sierra Madre) Mr. Kovacic thanked the City of Sierra Madre for including the Arcadia City Council in their Fourth of July celebration, (Joint Meeting) Mr. Kovacic noted that the Arcadia City Council met in a productive joint meeting with the Sierra Madre City Council, Juiy 9, 2002, and discussed many issues of common concern. He suggested conducting similar meetings with the Monrovia City Council. He felt it is very important for neighboring cities to meet on occasion and discuss issues of common interest. (Storm Water) Mr. Kovacic referred to a seminar given by the Independent Cities Association and the upcoming storm water regulations. (Centennial Celebration) WUO (Denne) (Independ~nt Cities Assoc,) (Arcadia Transit) (Parks) (Trash Containers) CHANG (Denne) (Segal) (Community Notification) (Vanson and Bufkin - PWD) City Manager Kelly noted that at the next meeting the Council would receive updated information on the litigation regarding the storm water regulations, Mr, Kovacic encouraged any organization that is pianning activities for 2003, to keep in mind that there will be a number of centennial celebration events, In order to have a full but not conflicted calendar during the centennial celebration, it might be a good idea for organizers to contact the City Manager's office and clear their calendar. , Councilmember Wuo congratulated Dorothy Denne, Citizen of the Month Award recipient. Mr. Wuo noted that the Independent Cities Association meeting was very educational. The meeting covered different topics such as: the Brown Act, conflicts of interest, city and state relations and city and media relations, Mr. Wuo referred to phone calls he received with regard to Arcadia Transit on-time passenger pick-ups, Mr. Wuo expressed appreciation to Arcadia Transit for their service improvement. Mr. Wuo referred to phone calls from Arcadia residents complaining about the poor maintenance of City neighborhood parks, He mentioned the situation to the City Manager. The matter is under observation and has been taken care of, Mr, Wuo contacted the Arcadia Association of Realtors requesting that they inform real estate offices and agents to not leave trash containers out in the street on listed properties, Mayor Pro tem Chang congratuiated Dorothy Denne for the well-deserved Citizen of the Month Award. Dr, Chang Welcomed Councilmember Segal back from his vacation. Dr. Chang referred to an article in the Pasadena Star News, entitled, "Notification Sought Regarding Sex Offenders", Supervisor Mike Antonovich wants law enforcement to be more proactive in notifying residents about sex offenders, He is sure in such a case the Arcadia Police Department will notify the community immediately. Dr. Chang referred to a letter from Mr. & Mrs, Wood complimenting two Arcadia Public Works employees, Tom Vanson and Mark Bufkin, for a job well done, They removed a heavy tree root which was left by a contractor. 5 7/16/02 (Sanitation District) (Water Safety) SEGAL (Welcome) MARSHALL (Trash Cans) (July 4th Parade) 44:0146 Dr, Chang congratulated the Los Angeles Turf Club, Inc" for participating in the Los Angeles County Sanitation Districts Certificate of Recognition Program for Qualifying Industries and being I named on the .Sanitation Districts Good Cooperation Citizen's List". The program encourages industries to be in full compliance with all of the Sanitation Districts industrial waste requirements, Dr. Chang read a press release from Fire Chief David Lugo, with regard to "water safety tips. and encouraged residents to follow all the safety rules, Council member' Segal thanked Council members for a warm welcome. He traveled to seven European countries over the past three weeks. Mayor Marshall advised residents who did not receive their recycling trash cans or have any problem with the trash cans to phone Chris Ludlum, Public Works Services, Mayor Marshall thanked the City of Sierra Madre for a wonderful July 4th Parade, (Time Capsuie) Mayor Marshall encouraged citizens to share their suggestions and ideas for the CitY's Centennial Celebration Time Capsule with the Centennial Celebration Committee. (Newsletter) (Blue Star) (Quote) 6, ROLL CALL Mayor Marshall requested that one or two City codes be included in the next Newsletter, She felt the majority of Arcadians are wiiling to obey the codes if \h~y know what they are. Mayor Marshall encouraged everyone who has a family member on active duty in the United States Armed Forces, and would like to display a Blue Star window sign, to contact the City. Mayor Marshall shared a saying by Wayne Gretzky, "you miss one hundred percent of the shots I you never take". Councilmember complaints with Chambers, Kovacic is opposed to the proposed project. He has never heard any regard to televising the Council meetings or the condition of the Council Considerable discussion ensued. Some members did not feel comfortable with spending half a million dollars on this project; others feit the building is old and in need of renovation, It was suggested that staff go through the re-bid process and prepare a detailed staff report and that Council members get public input on the Council Chamber situation and telecommunication system, It was MOVED by Council member Kovacic, seconded by Council member Segal and CARRIED I on roll call vote as follows to REJECT all bids for the Renovation of the City Council Chambers and Conference Room and the HVAC System Modifications; and, AUTHORIZED re-bidding the project. AYES: NOES: ABSENT: Council members Chang, Kovacic, Segal, Wuo and Marshall None None Mayor Marshall adjourned the meeting in memory of Sergeant Louis MacDonald, "Louis MacDonald, known by friends as "Mac" began his career as a police officer in Arcadia on April 10, 1963. Previously he had served in the Army from 1961-1962. Mac was promoted to sergeant on February 23, 1969, He worked in every section of the Department during the course of his career, but he was particularly noted for his work in narcotics and with juveniles, Mac had an Associate Degree from Pasadena City College and a bachelor's Degree from Pepperdine University. He also attended the prestigious Delinquency Control Institute at the University of Southern California in 1971 and his work with youth in the community kept a lot of kids from drifting into trouble, Mac was one of the best-liked supervisors in the Department. He was dedicated to the community and always willing to give of himself, He retired on December 27, 1991 after 28 years of service. Mac passed away in Mammoth Lakes, California, Memorial services were held at Saint Rita's Church in Sierra Madre on June 28, 2002. Mac is survived by his wife Pat, son Kirk, and daughters Christina and Kelley," Council member Kovacic adjourned the meeting in memory of Merrilyn Gilchriest a long time resident of Arcadia and a long time life member of the Assistance League, "Merrilyn Gilchriest passed away on Monday, July 8 from complications of Waggener's disease which is an uncommon autoimmune disease, A memorial service was held on Friday, July 12th at the home I 8 7/16/02 I ,"' 44:0145 of Ruth Bell in Arcadia, in memory of Merrilyn, We extend our thoughts and prayers to Merrilyn's husband Carl and daughter Heather in the loss of a wonderful wife and mother, She will be long remembered for her wonderful wit and sense of humor, Her gift of laughter will be missed by all who knew her."
