PRESENT: ABSENT: Councilmembers Chang, Kovacic, Segal, Wuo and Marshall None AUDIENCE PARTICIPATION None. STUDY SESSION Donna Butler, Development Services Administrator, began her presentation with an historical overview of the City's single-family zoning regulations noting that the zoning regulations have undergone numerous changes since the 1940's. The most recent changes were in 1999 when the City Council adopted new R-O and R-1 zoning regulations relating to the scale, mass and bulk of residential dwellings. The regulations were designed to accomplish this by: restricting the height of the front entry; requiring no portion of a building to encroach through a plane projected from the front property line; and, restricting the number of garage openings fronting on a street. Throughout the past three years, the Development Services Department staff has monitored the construction of new dwellings to determine if the 1999 revisions have accomplished their goal of reducing the overall mass of dwellings. Although there has been an observable change in the street elevation, it is staffs opinion that the codes need to be further refined to better address entries, architectural projections and street side yard setbacks. In addition, staff recommended that new sections be added to both the R-O and R-1 zoning regulations that address circular driveways and non-permanent structures such as tents and canopies. The proposed changes and additions to the R-O and R-1 zoning regulations set forth in the August 20, 2002 staff report included: front yard setbacks/entries; side yards on corner lots; driveway areas; tents and canopies; floor area ratio (FAR); and, design review, Further, in response to a Council member query, staff presented a summary of the City of San Marino's design review process, stating in part that, the City of San Marino adopted residential design guidelines which provides clear and concise design policies for residential projects within the City of San Marino. It was also noted that according to the 2000 census, the City of San Marino is 3.8 square miles with a population of 12,945 and 4,437 housing units. In comparison, Arcadia is 11 square miles with a population of 53,054 and 19,970 housing units. 1 8/20/02 INVOCAllQN (.. \ \ l - .:; PLEDGE OF ALLEGIANCE ROLL CALL 2. However, a combination of things such as development standards, FAR and design review issues have an impact. The northern part of the City has developed a style by the Homeowners Associations, and it has similarity of architecture and similarity of age of construction, but the south side of the City has no predominant theme. The other issues of concern are the narrow and deep lots, typically at the south central and southeastern section of the City, I Considerable discussion ensued. Some ,Councilmembers felt that the City should create reasonable and flexible procedures in order to promote compatible development, better design and high property values, and were in favor of establishment of a design review committee for south Arcadia; others felt that putting restrictions on developments and developers will decrease property values. Following discussion, by Council consensus, directions were given to staff to study a 35% to 50% Floor Area Ratio (FAR) and bring back a report for public review. Also bring back a report on a design review process for Councils consideration on the following three options: 1 - no design review; 2 - establishment of a design review committee; and, 3 ~ standards of design elements incorporated into the Arcadia Municipal Code. It was MOVED by Council member Segal, seconded by Mayor Pro tem Chang and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED, PRESENTATION Mayor Marshall presented the August, 2002 Citizen of the Month Award to Peter Ulrich, stating in part that, Peter and his wife Carol have been residents of Arcadia for over 25 years. During that time, Peter has been involved in civic activities on every level. Mayor Marshall shared a brief overview of Peter's many contributions beginning with his two years on the City Council in 1995 and 1996. Peter was also proclaimed Arcadia Community Volunteer of the Year in 1997. Mayor Marshall expressed appreciation to Peter Ulrich for all his contributions and stated that Peter's life could serve as a model and an inspiration to all. City Clerk June Alford administered the 'Oath of Office to incoming Planning Commission Members; Frank Hsu, Craig Lucas and S. H. Wen. ORDINANCE Consideration of the report and recommendation to introduce Ordinance No, 2165 entitled: "AN NO. 2165 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING (CBD/Central THE ARCADIA MUNICIPAL CODE TO ADD A SUBSECTION 14 TO SECTION 9264,2.9 AND Business Dist. - AMENDING SECTION 9275,1.39.3 TO ALLOW AUTOMOBILE FUELING STATIONS IN THE Automobile CBD/CENTRAL BUSINESS DISTRICT ZONE, SUBJECT TO A CONDITIONAL USE PERMIT," Fueling Station TA2002-001) Text Amendment Application No. TA 2002-001 was initiated by Leon E. Felus, on behalf of (INTRODUCED) Cirrus, LLC to amend the Arcadia Municipal Code to add Automobile Fueling Stations to the list of "Uses Subject to A Conditional Use Permit" (CUP) in the CBD/Central Business District Zone, Olo~D- ,~5 Automobile Fueling Stations are currently allowed in all the commercial and the manufacturing zones with the exception of the Central Business District (CBD) and Commercial Plan Development (CPD), 6. KOVACIC (Ulrich) The applicant intends to convert the Chevron Automobile Service Station building at 102 East Huntington Drive into a convenience mart, However, the proposed text amendment would be applicable to all properties within the CBD Zone as long as they came through the Conditional Use Permit process. Mayor Marshall OPENED the Public Hearing. No one came forward to address the City Council. Mayor Marshall CLOSED the Public Hearing, '. In response to a Council question, Donna Butler, Development Services Administrator, stated in part that, the City's code currently would not allow this kind of use in the CBD zone. Zoning can only be amended as a broad in the CBD zone, but the waiver can apply to a specific situation only. If was also noted that each project is evaluated based upon a particular location. AYES: NOES: ABSENT: Council members Chang, Kovacic, Segal, Wuo and Marshall None None AUDIENCE PARTICIPATION William Conrad, 9359 Shrike, Fountain Valley, expressed concerns on a proposed condominium project at 42 Alta Street. He was present at the public hearing before the Planning Commission but misunderstood the appeal process. Mr. Conrad stated that unfortunately it seems that we are doing everything we can to build up every piece of property that we have. He was present this evening to support the City Council's possible consideration on increasing the length of garages and the width of driveways, Rav Pevev, President, Arcadia High School Alumni Association, encouraged everyone to attend the associations fundraising event on September 21, 2002 at the Arcadia Community Center. MATTERS FROM ELECTED OFFICIALS Council member Kovacic congratulated Peter Ulrich and endorsed the Mayor's selection of him as Citizen of the Month, stating in part that, Peter has been a tremendous benefit to the City of Arcadia for many years. 3 8/20/02 (Planning Commission) (Conrad) (AHS Alumni Assoc, Fundraiser) WUO (Ulrich) (Planning Comsn.) 44:0165 Mr. Kovacic congratulated the incoming new Planning Commissioners; Hsu, Lucas and Wen. It was a great opportunity for Council members to talk to some very well qualified people ,during the interview process and get some good ideas about planning issues in Arcadia. Mr. Kovacic expressed appreciation to Mr, Conrad for coming back to Arcadia and addressing his concerns. Mr. Kovacic felt that it is a good idea for a City Attomey to periodically review the quality of public notices and make sure that it contains full and accurate information. Mr. Kovacic thanked Dr. Pevey, the Arcadia High School Alumni Association and encouraged everyone to attend the fundraising event on September 21, Councilmember Wuo congratulated Peter Ulrich, Citizen of the Month Award recipient. Mr. Wuo welcomed and congratulated the new Planning Commissioners. Mr. Wuo encouraged parents to fill out an official entry form and place It in one of the entrY boxes, The winners wiil be selected at the Lucky Baldwin Day Community Picnic on Sunday, October 27, Mayor Pro tem Chang congratulated Peter Ulrich, Citizen of the Month Award recipient. Dr. Chang congratulated Frank Hsu, Craig Lucas and. ROLL CALL 8, 44:0166 Mayor Marshall complimented staff for the Arcadia Newsletter. It was very informative, well written and easy to read with lots of information, Mayor Marshall referred to letters and phone calls she received commending the professionalism exhibited by members of fire, police and public works, on the August 12th fire in the north side of Arcadia. The Mayor thanked City employees for their hard work and fast response. Mayor Marshall attended the 105th birthday party for Bertha Kurz at the California home for the Adult Deaf in Arcadia on August 18, The Mayor encouraged everyone who is, or knows anybody older than Bertha, to let the City know so they can be incorporated in the City's Centennial Celebration. Mayor Marshall shared a "food for thoughf'. "Peopie forget how fast you do the job but they remember how well you did it". CITY MANAGER Consideration of the report and recommendation relative to offering a reward for information leading to solving crimes, specifically to the identification and apprehension of the person(s) responsible for the murder of Charlotte Cole ($20,000) and the person responsible for the deaths of Fuzhi Ji and Vincent Ji ($5,000). The specifics of both cases set forth in the August 20, 2002 staff report, In the mid 1980's, the City of Arcadia participated with other Los Angeles County cities to offer a reward in the "Nightstalker" case. Also, on March 1992, the City Council approved the offering of a $1,000 reward for information leading to the arrest and conviction of individuals for acts of damage and vandalism to mail boxes in the City of Arcadia. The offering to reward for information leading to the arrest of a criminal is a relatively common practice among cities and counties, Law enforcement agencies believe that offering rewards increases the likelihood that a member of the public will come forward with information that can potentially lead to the arrest and conviction of a criminal. State Law mandates that, except in the case of a crime against a peace officer, rewards must be tied to the "identification and apprehension" rather than the "arrest and conviction" of the responsible party, 7 8/20/02 44:0169 It was also noted that consistent with State law, the Reward Program is structured such that the money is not actually dispensed until after the person or persons responsible for the crime are apprehended and a -criminal complaint has been filed. Depending upon the case involved the I funds for the reward could come from the Federal Narcotics Seizure Fund. In others, it will be necessary to appropriate money from the General Fund. In response to a Council question, staff stated in part that, Los Angeles County offered a $5,000 reward for the Ji case and staff recommended that the City Council offer a reward at the same amount, but if the City Council wishes they could decrease or increase this amount. Council member Kovacic wants to see both crimes solved. He felt that the City should offer $20,000 for both heinous crimes, Mayor Pro tem Chang echoed Councilmember Kovacic's comment and suggested offering a $15,000 reward along with the $5,000 from the Los Angeles County for the hit-and-run case of Fuzhi and Vincent Ji. It was MOVED by Council member Segal, seconded by Mayor Pro tem Chang and CARRIED on roll call vote as follows to ADOPT RESOLUTION NO. 6323 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING A REWARD FOR INFORMATION ON CRIMES PROGRAM."
