REGULAR MEETING
October 1, 2002
The City Council and Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday,
October 1, 2002 at 5:30 p.m. in the Conference Room of the City Council Chambers.

Pursuant to Government Code Section 54956.9(a) to confer with legal counsel regarding the
case of Thomas Cullen, Jr. v. Brian Stanford, et al.- Los Angeles Superior Court Case No.
GC028023.
STUDY SESSION
On May 21, 2002 the City Council adopted a Statement of Policy concerning City Council
Protocol and Procedures. Since that time, there have been some questions about the
application of the Policy relative to certificates and proclamations. In general, certificates of
achievement, commendation and/or service are to be signed by the seated Mayor. Certificates
may be given to Arcadia residents, Arcadia businesses, or to an individual, business or
organization that has provided service directly to the City of Arcadia.
The Council affirmed the present policy with regard to certificates and/or proclamations. It was
noted that Council members might request a certificate for individuals or organizations by
submitting a request for a certificate or proclamation and addressing the connection/relationship
of Ihe recipient(s) to the City of Arcadia. Council concurred.
David Hutcheson, Arcadia Fire Captain, presented basic background informalion on the Arcadia
Fire Department Arson Unit, members and unit layout, staling in part that, the arson unit is
involved in education, fire prevention and case information. The arson investigation education
program "How Do They Do That" has been presented in the Arcadia schools and is targeting fifth
grade sludents at this time. It is a power point program and focuses on arson crimes, how an
arson crime is solved and also on fire prevention issues.

With regard to major cases it was noted thai the Peck Road Water Conservation area has
become a hot bed for small brush and grass fires. Up to this date there has been approximately I
eleven (11) fires in that area. With Ihe assistance of the San Gabriel Valley Arson Task Force,
the Arcadia Fire Department is targeting that area to do saturation patrols in order to stop
nuisance fires in that area.
The City of Arcadia houses an NRT-truck. which is a National Response Team arson truck at
Fire Station NO.6. This is a great resource to Ihe department and is one of two in the State of
California and the only one in Southern California, according to Captain Hutcheson. Chief Lugo
commented that the ATF (Alcohol, Tobacco and Fire Arms) agency investigates any large fire or
any fire of major significance and determines if it is an arson fire or not. The arson fire
investigation is only possible with the support and guidance of the Arcadia Police Department,
they have been instrumental in providing some very specialized Iraining.

Consideration of the report and recommendation for the possible establishment of a new sister
city relationship. Arcadia currently has two sister cities; Tripolis, Greece, since the early 1960's
and Newcastle, Australia, since the early 1970's. Both relationships have been inactive for some
time due to political turmoil, budgetary constraints and a general lack of community interest.
Due to this inactivity, the City Council recently disbanded the Arcadia Sister City Commission.
Councilmember Kovacic suggested that the City consider establishing a sister city relationship
with White River, Arizona. While River is the capital of the White Mountain Indian Reservation
and has an affiliation with Arcadia High School. It was also suggested by persons in the
community that the City consider establishing a sister city relationship with an as yet
undetermined city in the Far East.
Staff suggesled that Council consider Ihe following issues: 1 - is there a need and/or significant I
community inlerest in generating an additional sister city relationship; 2 - what would be the
purpose of having another sister city; 3 - what are the Council's expectations for a new sister
city relationship; and, 4 - if one or more sister city associations are formed, it will be necessary
to allocate staff time and a budget to cover any costs associated with the new partnership(s).
Following discussion, by Council consensus, directions were given to staff to prepare a survey
and conduct an informal poll at the Lucky Baldwin Day Picnic and give the public an opportunity
to comment on whether they want to establish a sister city relationship with another city or not,
and bring back a report for Council's consideration.
The City Council RECESSED at 7:00 p.m. and RECONVENED in the Council Chambers for the
Regular Meeting at 7:10 p.m.

Mayor Marshall presented a proclamation to the Arcadia Lions Club declaring the months of
October and November 2002 as White Cane Days.
Mayor Marshall presented a proclamation to David Lee and announced the Arcadia Feslival of
Bands will take place on November 16, 2002. The Mayor proclaimed the month of November as
Arcadia Festival of Bands Month.
Mayor Marshall presented a Blue Star Award to June and Norman Shafer, the proud parents of
three sons, Jon, Marc and Erik, who are serving their country with honor and distinction. Captain
Jon was recently flying missions as a Blackhawk pilot, and has relurned from posting in
Afghanistan. Captain Marc is currently serving his country as commander of a parachute-rigging
unit in Vincenza, Italy. Both are graduates of West Point. Jon Shafer has been selected to ride
on the Arcadia float in the Rose Parade on New Year's Day.
AUDIENCE PARTICIPATION
Sa'ad Issa, President, Professional Engineers in California Government, presented a plaque to
Council member John Wuo in appreciation of his contribution and help.
Arcadia High School Theatre Arts III Department students invited the City Council 10 attend the
departments' production of California Suite, October 15-18 at 7:30 p.m. at the Arcadia High
School Little Thealre.
Jeffrey Lee, 255 East Santa Clara Street #210, supported the moratorium on R-2 and R-3
projects not currently in the plan check process. He believes that the moratorium is necessary
due to the number of recently filed projects.
Daniel Wono, Coordinator "California Falun Dafa Monlh" in Los Angeles, invited the City Council

MATTERS FROM ELECTED OFFICIALS

Council member Wuo attended the Arcadia Traveiers Club celebration of their 10th Anniversary
on Friday September 27, 2002. He encouraged all seniors to join the Ciub and take advantage
of their wonderful programs.
Mr. Wuo hopes residents will attend the races and enjoy the racing season.
Mr. Wuo expressed congratulations to Arcadia's Chinese Community for celebration of the 53rd
anniversary of the People's Republic of China National Founding Day on October 1, 2002; and,
the Republic of China 91st National Founding Day on October 10, 2002.
Council member Kovacic complimented the June and Norman Shafer family, and noted that Jon
will be one of riders on the City's Rose Parade float, the two other riders, a boy and girl will be
selected in a drawing at the Lucky Baldwin Day Picnic.
Mr. Kovacic complimented Mike Lamb, drama leacher at Arcadia High School, and former
School Board member for his tremendous work with the Drama Department at Arcadia High
School.
Mr. Kovacic noted that all four Arcadia school marching bands would march down the Baldwin
Avenue on Arcadia Festival of Bands day. It is a great opportunity to see Arcadia High School,
First Avenue, Foothills and Dana Middle Schools marching bands performances.
Mr. Kovacic noted that the Arcadia High School Constitution Team started a new season. The I
firsl practice was held in the Council Chambers on Monday. The Constitution team considers
practicing in the Council Chambers to be good luck and requested one more practice in the
Chamber prior to the Council Chambers renovation project.
Councilmember Segal attended a ceremony for the completion of the final piece of steel framing
for the new police slation on September 26, 2002. Former Council member Roger Chandler, who
was the "recent father of the cause" for building a new police facility, was in attendance.
Mr. Segal encouraged everyone to attend the Methodist Hospital Foundation Annual Crystal Ball
on October 5, 2002.
Mr. Segal reminded everyone of the Lucky Baldwin Day Picnic, Oclober 27, 2002, and
encouraged youngsters to fill out an application for the drawing 10 select two Arcadia children to
ride on the City's 2003 Rose Parade float.
Mayor Pro tem Chang congratulated the Arcadia Lion's Club, the reclpienls of a proclamation

Dr. Chang introduced the Arcadia Public Library Board of Trustees and read some facts and
statistics from the Arcadia Public Library Annual Report. Dr. Chang expressed appreciation to
the Library Board of Trustees and the Arcadia Public Library Foundation for their support and
wonderful job.
Dr. Chang would like to see an item on a future agenda, and prior to the discussion of the Live
Oak Avenue project, with regard to Low and Moderate Income Housing and a Master Plan.
City Manager Kelly noted that Council will receive a report outlining a menu of alternative
housing programs in the near future.
Mayor Marshall congratulated Councllmember Wuo for his recognition by the Professional
Engineers in California Government.
Mayor Marshall attended the first Whiskers 'n Tails Animal Care Adoption Day. It was a
successful event. Ms. Marshall expressed appreciation to Kristen Olafson, the City's Community
and Marketing Specialist, for coordinating this event. .
Mayor Marshall noted that the Centennial Flag reservation deadline is October 7,2002. To date
356 flags have been sold. The sponsorship is $125.00.
Mayor Marshall encouraged everyone to watch a three part television series on Lucky Baldwin
hosted by Huell Howser, which will air on October 2nd, 3rd and 4th. The October 4th episode
was filmed at the Arboretum and features Lucky Baldwin's Arcadia roots.

Chamber project, the City Council will meet in the Mortenson Auditorium at the Arcadia Public Library.

SKATE PARK & On May 21, 2002, the City Council rejected all bids for the construction of a skate park and

Window) Staff negotiated a $5,500 contract amendment with the landscape architectural firm of Purkiss
Rose RSI to review the original design's construct-ability and to re-design the project while
maintaining most of the uniqueness of the original design. Based on this, project alternatives
have been developed for Council's consideration, set forth in the October 1, 2002 staff report.
Design modifications were made to require less labor and materials to accomplish similar results
without any physical changes to the project. These changes reduced the amount of concrete
required to construct the foundations for the benches and ledges, and provided details that
would allow the contractor to construct these features with less forming and fewer individual
concrete placements.
Staff recommended that in the next solicitation of bids the contractors be allowed flexibility in the
scheduling of the start date for the project with a fixed completion date once the work has

actually started. This will allow contractors to bid the project regardless of their current
workload, and to fit this project into a timeframe that accommodates their schedule. The
duration of the construction will still be determined by the completion schedule of the contract.

At its September 11, 2002 meeting the Recreation and Parks Commission moved to recommend
the bidding of alternative 2 and 3 (modified to include lighting 3M) and the conceptual six-month
schedule forwarded to the City Council for final approval.
Following the staff presentation considerable discussion ensued. Councilmember Segal
suggested that the Recreation and Parks Commission find out if the much delayed project is still
a priority for local youths.
It was MOVED by Council member Kovacic, seconded by Council member Segal and CARRIED
on roll call vote as follows to DIRECT staff to bid the skate park in October, with alternatives 2
and 3M and a six (6) month window to begin construction, and a 90-day completion schedule
once construction begins.

URGENCY Consideration of the report and recommendatio; to adopt Interim Urgency Ordinance No. 2169
ORDINANCE relating to all R-2 and R-3 zoned properties in the City of Arcadia. The proposed ordinance will
NO. 2169 temporarily prohibit the processing of multiple-family projects located on R-2 and R-3 zoned
(R-2 and R-3 properties, with the exception of plans that have been accepted for formal plan check. The I
Zoned Urgency Ordinance would remain in effect until such time as new R-2 and R-3 zoning regulations
Properties) have been adopted by the City Council and become law. The new R-2 and R-3 zoning
(ADOPTED) regulations will address the changing needs in the multiple-family zones related to parking, open
spaces, setbacks and other regulations.
Due to the number of recently filed R-2 and R-3 projects (approximately 84 units), staff is
concerned about the impact that these projects will have on the neighborhoods where they are
proposed, especially with regard to parking. Additionally, since the text amendment is well
underway (the Planning Commission public hearing was held on September 24 and the City
Council hearing is scheduled for November 5, 2002), it will be difficult to review these projects
during this transition period as staff may be working with different standards. Therefore, the
Development Services Department recommended that an urgency interim ordinance imposing a
moratorium on R-2 and R-3 projects not currently in plan check, be adopted for a forty-five (45)
day period. The moratorium would preclude the processing of all architectural design review
applications and prohibit the filing of any multiple-family plans for design review or plan check.
This 45-day period would allow the City time to provide the appropriate public hearing notice to
extend the interim ordinance for up to ten (10) months and 15 days. Both the urgency ordinance
and extension of the interim ordinance requires a "four-fifths" vote of the legislative body for
adoption.
Further, it was noted that the City Council may consider the following options in regard to what
projects, if any, would be exempt from the moratorium: 1 - Projects that have already received
design review approval by the Planning Commission or Development Services Department staff,
but have not been submitted for plan check; 2 - projects that are scheduled for public hearing
before the Planning Commission for modification and design review approval; and, 3 - projects I
that have been submitted for Architectural design review to the Development Services
Department, but have not been approved.

Following the presentation staff responded to concerns expressed by Council with regard to plan
check fees, subterranean parking, projects that are currently seeking the design review process
(9 with 48 units) and projects that are currently in the plan check process (19 with 148). With
regard to the fees, staff noted that plan checks are the most expensive portion of the process. It
was also noted that there has been a "significant" increase in the number of plans for multiple-
family projects submitted for architectural design review and code modifications in order to
obtain approval of the projects prior to the implementation of new regulations. None of these
plans submitted would comply with the proposed new zoning regulations.
It was MOVED by Councllmember Segal, seconded by Mayor Pro tem Chang and CARRIED on
roll call vote as follows to ADOPT URGENCY ORDINANCE NO. 2169 entitled; "AN INTERIM
URGENCY ORDiNANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROHIBITING
THE PROCESSING OF MULTIPLE-FAMILY PROJECTS LOCATED ON R-2 AND R.3 ZONED
PROPERTIES WITH THE EXCEPTION OF PLANS THAT HAVE BEEN ACCEPTED FOR
FORMAL PLAN CHECK WITH THE CITY'S DEVELOPMENT SERVICES DEPARTMENT
PENDING THE COMPLETION OF AMENDMENTS TO THE CITY'S R-2 AND R-3 ZONING
REGULATIONS."
City Attorney Deitsch suggested the following addition to the motion, to read as follows: "Staff be
directed to schedule a public hearing for November 5, 2002 to possibly extend the term of the
interim ordinance".

Mayor Marshall adjourned the meeting in memory of Anita J. Santo. "She is a long time resident
of Arcadia who died September 25th in Sacramento, California at the age of 95. Mrs. Santo was
active in the Native Daughters of the Golden West, Los Fiesteros de California. was a docent at
the San Gabriei Mission, and a Charter Member of the Arcadia Historical Museum".
