CITY COUNCIL PROCEEDINGS ARE TAPE RECORDED AND ON FILE IN THE OFFICE OF THE CITY CLERK MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING December 3, 2002 Pursuant to the foregoing adjournment of the November 19, 2002 Regular Meeting of the City Council and Arcadia Redevelopment Agency, the City Clerk appeared at the time and place of adjournment at 5:30 p.m. and announced that no quorum will be present until 6:30 p.m., at which time the Regular Meeting will convene in the Cay Mortensen Auditorium, Arcadia Public Library, 20 West Duarte Road. CLOSED SESSION 1a Pursuant to Government Code Section 54956.9(b)(1) to confer with legal counsel regarding potential litigation - one (1) case. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None. City Attorney Deitsch announced the subject discussed at the Closed Session held earlier this evening. PUBLIC HEARING 2a. 0 If 'if 0 - / 0 RESOLUTiON On November 5, 2002 the City Council adopted Ordinance No. 2163 adding a new division to the NO 6333 Arcadia Municipal Code providing regulations for massage therapists. The ordinance provided (Massage for the regulation of massage therapy activities that is consistent throughout the County of Los Therapists Fee) Angeles and included standards for issuance of permits as well as restrictions on operations that (ADOPTED) serve to reduce the risk of illegal activities. The Development Services Department proposed a permit fee of $265.00 to cover the cost of processing an application for a massage therapist. The fee includes; Police Department investigation fee, including background check ($223.00); Police fingerprinting fee ($10.00); and, Department of Justice fingerprinting processing fee ($32.00). Mayor Marshall OPENED the Public Hearing. No one came forward to address the City Council. and Mayor Marshall declared the Public Hearing CLOSED. ' . In response to a Council question staff stated in part, that there is no limitation on the number of massage therapists that can operate out of a day spa. I It was MOVED by Council member Segal, seconded by Council member Kovacic and CARRIED on roll call vote as follows to ADOPT RESOLUTION NO. 6333 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING AN APPLICATION FEE FOR MASSAGE THERAPISTS (SECTION 6418.7(F)) PURSUANT TO CITY COUNCIL ORDINANCE NO. 2163". AYES: NOES: ABSENT: Councilmembers Chang. Kovacic, Segal. Wuo and Marshall None None AUDIENCE PARTICIPATION None. 3. MATTERS FROM ELECTED OFFICIALS SEGAL (Holiday Home Decoration Award) Councilmember Segal announced that judging for the Holiday Home Decoration Awards will take place on December 15th and 16th. He encouraged residents to have their holiday lights on from 6:00 p.m. to 10:00 p.m. (High School Mr. Segal congratulated the high school football coach for being the "Coach of the Week". He Football Team) also expressed congratulations to the players for a great season. (Holiday Time) Mr. Segal asked everyone to be extra careful during the holiday rush. I 2 12/3/02 I I I WUO (Library Family Night) (Arcadia Float) (Holiday Festival) 44:0241 Councilmember Wuo encouraged everyone to attend the Arcadia Public Library's Holiday Family Night on December 5, 2002. Mr. Wuo encouraged everyone interested to participate at one of two sessions of decorating Arcadia's float on December 21, 2002. Mr. Wuo announced, the City of Arcadia Holiday Festival will be held on December 10, 2002 from 4:00 p.m. to 6:00 p.m. in the parking lot of Westfield ShoppingTown, north of Fire Station #2. on Baldwin Avenue. (Senior Citizen Mr. Wuo also announced that the Annual Senior Citizen Holiday Party, sponsored by the Senior Holiday Party) Citizen Commission, will be held on Friday December 6, 2002 at the Community Center. KOVACIC Council member Kovacic complimented the Arcadia Interfaith Action Group for their Annual (Thanksgiving) Thanksgiving Service held on November 25, 2002. (Daniel Fox) CHANG (Methodist Hospital) (Homeowners & Renter Assist) (Sewer Problems) (Recycling) MARSHALL . (Yard Waste) (Interfaith) (Seabiscuit) (Food for Thought) Mr. Kovacic referred to a newspaper article with regard to Daniel Fox's homecoming. Daniel Fox, a former star member of the Arcadia High School Band, was involved in a very serious traffic accident in New York. He finally recovered and came home to Arcadia. Mr. Kovacic noted that the Arcadia Chinese community collected donations to provide plane tickets for Daniel's family to fly back and visit him. Mr. Kovacic felt that the newspaper article demonstrated what love and concern there is in Arcadia. Mr. Kovacic extended best wishes to Daniel and his family. Mayor Pro tem Chang congratulated the Methodist Hospital of Southern California for being named as one of the best cardiovascular hospitals among six thousands hospitals in the nation. Mayor Pro tem Chang announced that the Office of the State Board of Equalization will provide free Homeowners and Renter Assistance claim preparation forms for eligible applicants. Dr. Chang referred to an article in a newspaper with regard to the sewer problem in the City of Pasadena and explained the City of Arcadia's responsibilities in a similar situation. Dr. Chang noted that residents who wish to have extra green waste containers could contact the City's trash hauler, Waste Management Inc. He aiso urged everyone to follow the recycling rules and help the City improve its refuse diversion numbers. Mayor Marshall reminded everyone that yard waste and trash cannot be swept into the streets. It should be removed from driveways and gutters and piaced into the correct solid waste containers for regular trash pickup. Mayor Marshall apologized for not being able to attend the Interfaith Program. Mayor Marshall is participating in the filming of "Seabiscuif at the race track, a movie about a famous racehorse. She encouraged interested Arcadians to be part of this project. Mayor Marshall shared a saying by Felix Frankfurter: "We have enjoyed so much freedom for so long that we perhaps are in danger of forgetting how much blood it cost to establish the Bill or Rights". 3 12/3/02 44:0242 4. PUBLIC HEARING 5a. 0 ~'10- qO CENTRAL REDEV. PROJ. AREA & 5-VR IMPLM'T PLAN & HOUSING PROGRAM ( 1999-2004) (RECEIVE & FILE REPORT) Peter Kinnahan, Economic Development Administrator, summarized some of the major achievements of the Agency and CIP projects that have been completed in the period of 1999- 2002 set forth in the December 3, 2002 staff report. The projects included completion of the REI building on Santa Anita Avenue; completion of the Northside and Fifth Avenue Projects; Second/Huntington Railroad Bridge Safety Lights; sidewalk improvement - Colorado Place; planters improvement, south side Huntington Drive, mid-block; traffic signal upgrades on Santa Anita/Santa Clara; Huntington/Second; Huntington/Santa Anita; and, First Avenue/Santa Clara. The Agency also contributed $100,000 to the Gilb Historical Museum, which was completed this year. The California Health and Safety Code Section 33000 et seq. (Redevelopment Law) requires that redevelopment agencies prepare and adopt a detailed statement of their goals and objectives, and their redevelopment and housing projects and programs, between the second and third year after the adoption of the Five Year Implementation Plan, and to conduct a Public Hearing to allow public testimony on the Agency's performance under the Agency's Redevelopment Plan and Housing Program. The Agency will be required to adopt its next Implementation Plan in 2004. I With regard to Housing Programs and Affordable Senior Housing it was noted that staff has met with several senior housing developers over the past three (3) years on various sites in the City. Pursuant to Agency Board direction. the Agency requested proposals from three (3) developers on three (3) separate sites that emerged as offering the best opportunity for development. After review of the submittais and discussions with the developers, the Agency Board authorized staff to negotiate an agreement with American Senior Living (ASL) for a fifty-four (54) unit 3-story senior building (20% affordable) at the Marketowne site on Las Tunas Drive. These negotiations are currently underway under the constraints imposed by AB 975 - Prevailing Wage, and AB 637 - Proportionaiity. The Implementation Plan stated that the Agency will proceed to implement some or all of the programs included in the original Implementation Plan, which included: Home Rehabilitation Loan Program; First Time Home Buyers Program; Mortgage Assistance Program; Free Market Housing Participation Program; Rental subsidy; Section 8 program through Los Angeles County Housing Authority; and, Administrative. Agency Chairperson Marshall OPENED the Public Hearing. No one came forward to address the Agency Board and Chairperson Marshall CLOSED the Public Hearing. In response to an Agency question, staff noted that the project, specifically with regard to the staff recommendation of financially assisting in the development of a new fire station on Santa I Anita Avenue will be brought forward at a later date. With regard to the Redevelopment Agency's obligation for a very low income non-senior housing project, staff stated in part that the 4. 12/3/02 I I I 44:0243 Agency is required to replace the twenty-three (23) units removed as part of the Fifth Avenue Office Project (Hale/Waken) within four (4) years. Further, it was noted that because of the passage of AB 637, the Agency would accelerate its efforts to assist or develop non-senior affordable housing, possibly on the former Mounted Police site or the Alta Street lot. By doing this the Agency will also assist the City in meeting its RHNA housing goals (forty-seven) units total: thirty-five (35), very low; and, twelve (12) low income .family units. I 6 12/3/02 I, I I 44:0245 In response to a Council query, Patrick Malloy, Public Works Services Director, presented an overview of the Chapman Well NO.7 Wellhead Facilities Project, stating in part that, the City received a $6,650,065 grant from the U.S. Environmental Protection Agency (USEPA) to improve seismic reliability of the water system. This grant will cover three projects: Rehabilitation of the Santa Anita Reservoir (completed); Water System Pipeline Interconnection with the City of Sierra Madre (completed); and, Construction of a Water Supply Well at the Chapman Water Facility.
