At 6:04 p.m. the Arcadia Redeveiopment Agency entered the Closed Session, pursuant to Government Code Section 54956,9(a) to confer with legal counsel regarding the case of County of Los Angeles v, All Persons Interested in the Maller of Amendment Number 5 to the Central Redevelopment Plan, Los Angeles Superior Court Case No, BC258029, The Closed Session concluded at 6:20 p.m, and the Regular Meeting RECONVENED. 2, STUDY SESSION 2a lRANSPCRfAllCJNI Donald Penman, Assistant City Manager/Director of Development SeIVices, presented an lRAffIC ovelView of the Transportation Master Plan and Transportation Impact Fee Program study which MASTERPlAN was developed by the City of Arcadia in an effort to develop assurances that its transportation 0'" J infrastructure will accommodate future growth and transportation needs, The Transportation Master Plan study presented a detailed evaluation of a potential traffic congestion mitigation fee program for the City of Arcadia, A transportation fee program wouid require that all new growth throughout the City which contributes to future transportation system deficiencies (via added traffic on the roadways) should pay its fair share of improvements required to alleviate those deficiencies, In accordance with California law, a city-wide traffic congestion fee program must establish a reasonable relationship (often called the "nexus test") between the fee being levied on new development, the impacts of that development, and facilities paid fcr by the fee program. Specifically, it must be proven that the need for transportation system improvements results from new developments, and not simply from existing deficiencies, 1 10/2/01 INVOCAI1ON PLEDGE OF ALLEGIANCE ROLL CALL 3. WHITE CANE DAYS (Arcadia Lions Club) 143:01,98 The study included an in-d.;pth technical analysis, as well as rn"etings and coordination, with . - '.City staff: The analysis ro(;us~d on 23'key intersections, in' the City representing the'signalized I intersections of arterial st(eets. Year 2015 PM peak hour levels of service have been estimated for the study intersections to identify deficient:locations based on the Generai Plan, For the intersections that are expected to operate at a deficient level of service, improvements have been identified to return the intersections to an acceptable level of service and a traffic impact fee has been caiculated based upon the grow1h forecast in the City. Further, the Level of Service (LOS) was reviewed for the Council and some discussion ensued on achieving the acceptable LOS at the five deficient study intersections. Ed Cline, City Traffic Engineer, stated in part, in order to bring deficient intersections back to an acceptable Level of Service (LOS), a physicai change to the intersection is needed. Typically, adding lanes to increase the capacity at an intersection is the most simple and logical way of alleviating congestion, The study illustrates additional lanes and the approximate right-of-way needed to rriitigate the five deficient study intersections, The October 2, 2001 staff report explained in, detail improvements that should be included in the fee program and the physical improvements. Considerable discussion ensued, By general consensus the City Council DIRECTED staff to agendize right-of-way Issues and the fee structure issue at a future date. This grant is administered by the Bureau of Justice FUNDS - PD Assistance (BJA), U,S, Department of Justice (DOJ) and is provided to assist local government (APPROVED) with programs to reduce crime and improve public safety, c: As part of the multi-phased grant process, local jurisdictions are required to conduct a public hearing to receive input on the use of the proposed funds and the DOJ recommends proceeding with the public hearing while the review is in process. When funds have been formally approved, staff recommended that the grant in the amount of $38,980 (plus a required match by the City of $4,331) be used in partnership with the Arcadia Unified School District to continue the position of Youth and Educational Support (Y.E.S.) Officer at Arcadia High School. Mayor Segal OPENED the public hearing, No one came fOlWard to address the City Council. It was MOVED by Council member Chandler, seconded by Mayor Pro tem Marshall and CARRIED to CLOSE the Public Hearing, It was MOVED by Council member Chang, seconded by Council member Kovacic and CARRIED on roll call vote as follows to APPROVE the utilization of the proposed LLEBG funds for the Y.E.S, Officer Program; and, the APPROPRIATION of $4,331 from the General Fund as required by the DOJ; and, AUTHORIZE the City Manager to EXECUTE the appropriate agreements, subject to approval as to form by the City Attorney, AYES: NOES: ABSENT: Council members Chandler, Chang, Kovacic, Marshall and Segal Nooe . ' AUDIENCE PARTiCIPATION Fawaz Elm3sri, Arcadia resident for'22 years, spoke on behaif of the Arcadia American Muslim community and expressed concern with regard to the safety and welfare of Muslim families and their children, since the September 11th tragic attack in New York, The American Muslims felt the pain and were part of the suffering, and are very worried about the uncertain future. He suggested that the City Council consider holding a town hall meeting with participation of law enforcement agencies and people from different faiths and backgrounds, The meeting would give an opportunity to everyone to express and discuss their concerns, Linda Noureldin, Arcadia resident for 10 years, was present to convey the message of one- miilion American Muslims, in particular, the Arcadia Muslim community, Arcadia Muslims are eager to come together with all Arcadia citizens as a community, in order to heal the wounds that sensitized the thoughts about Islam, and to unite in order to contribute to the positive growth and development of Arcadia, They are united with all Americans in striving to make America a 3'~ 10/2/01 7. 43:0200 ,better place for everyone to iive, She felt that the destructive events that took place on September 11, should in no way be associated with Isiam, Islam gives,a very, clear message in all aspects of life and it is a religion of peace, love, charity, forgiveness and much more, Mayor Segal requested that the City Manager look into Mr. Elmasri's suggestion. . Peter Atkins, Chief Executive Officer, Los Angeies County Arboretum, offered an annual membership to each of the Arcadia public safety officers and their families. He felt that the Arboretum is a jewel located in the City of Arcadia, which gives opportunity to all the citizens of this region to enjoy a place of solitude, beauty, peace and education, MATTERS FROM ELECTED OFFICIALS CHANG Council member Chang commended the efforts of the Arcadia Firefighters and Police Officers for (Donation Drive) conducting a drive for donations for the victims of the September 11th terrorist attacks. He urged Arcadia residents to make donations at the Arcadia Fire or Police Stations. -, - ~ CHANDLER (Police Station Ground Breaking) MARSHALL (Speakers) (New Police Station) (Domestic Violence) (Food for Thought) -~'j ~) -' KOVACIC (Police Station Ground Breaking & AHS 50th Anniversary) (Speakers) Councilmember Chandler complimented City Manager Kelly for a wonderful ground breaking ceremony for the new police station, He also noted that he was on the City Council when the Armory land was purchased from the state, It was a proud day for him and made all of this work with the City Council worthwhile, I Mayor Pro tem Marshall thanked tonight's speakers for taking the time to express their concerns. She hoped that uneducated residents do not put all Muslims on the same level as the September 11 th attackers; that would not be fair to the good examples of the fine American Muslims that live in Arcadia. Mrs, Marshall expressed appreciation to everyone who made the construction of the new police I station possible, She felt that it was made possible because of all the Arcadia citizens, It was not just the hard work of staff, Councilor Commissions; but the citizens who recognized the need and stepped up to help pay for this project. Mrs. Marshall read a statement from Senator Margett's office in reference to a local collection program of used cellular phones to help fight domestic violence, The collection will begin on September 24th at various locations. Also, Santa Anita Race Track is offering free Club House admission for those donating phones on October 13th and November 3rd, Mrs. Marshall shared a statement from Doctor Phil, a television show guest, with regard to the September 11th tragic terrorist attack, "you can't make sense out of nonsense". Council member Kovacic expressed appreciation to City employees and the many volunteers for their hard work on the ground breaking ceremony for the new Police Station, and the celebration of the 50th Anniversary of Arcadia High School. The vehicle was a new design concept, created to comply with anticipated new EPA regulations and National Pollution Discharge and Elimination Systems (NPDES) permit requirements. Unfortunately, this street sweeper has spent the majority of its time in the vendors shop for I ~ 0, 10/2/01 I I I 11, 11a, WINE & BEER RETAIL SALE (CPD-1 Zone) (DENIED) (;f".,' };-'07 ; t',' . 1 " 'I ' ;'r,~. , , 43:0203 repairs and has been unreliable due to mechanical problems, It was MOVED by Mayor Pro tem Marshall, seconded by Council member Chandler and CARRIED on roll call vote as follows to AWARD a contract for the purchase of one (1) 2002 , Elgin Crosswind J Series Sweeper and replacement of one (1) 1999 Elgin Air Sweeper with one (1) 2002 Elgin Crosswind J Series Sweeper to the Haaker Equipment Company in the amount of $112,890.32; and, WAIVE the competitive bidding process and award a contract in accordance with the above recommendation; and, AUTHORIZE the City Manager to EXECUTE a contract in a form approved by the City Attorney. ) AYES: NOES: ABSENT: Councilmembers Chandler, Chang, Kovacic, Marshall and Segal None None CITY MANAGER Consideration of a Request for Determination of Use, Retail Sale of Wine and Beer, in the CPD- 1 Zone, Connie Hernandez, who operates a retail tobacco business located in the CPD-1 zone requested a determination from the City Council, per Section 9260.1,4,(24) of the Arcadia Municipal Code, that the sale of beer and wine become a compatible use in the CPD-1 zone, Currently the CPD-1 zone does not permit the sale of alcoholic beverages other than in conjunction with a restaurant, which requires a Conditional Use Permit. The CPD-1 regulations were adopted in 1981 and were designed to encourage business and professional office uses, financial institutions, limited retail facilities and service-oriented businesses, The CPD-1 zone encompasses the general area north of the MTA railroad tracks; east of Second Avenue; south of the 210 Freeway and west of Fifth Avenue, In 1985 the City Council re-visit the code and expanded the uses relating to retail sales, however, they did not include the sale of alcoholic beverages, The Development Services Department staff has recommended denial of Ms, Hernandez request. The Department does not believe that the retail sale of beer and wine is a compatible use in the CPD-1 zone, In addition, if the retail sale of beer and wine is permitted with the sale of tobacco products, it becomes very similar to a "liquor store" or a "convenience-type" store, Redevelopment Agency staff has reviewed the proposal and does, not believe it is consistent with the intent and goals of the Agency when financial support is provided for redevelopment projects in this area. Ms, Hernandez, owner of Sphinx Tobacco, stated in part, that she has received many requests from customers wanting to buy wine or beer, so they can go home and enjoy a glass of wine or beer with their cigar. Following discussion it was MOVED by Council member Chandler, seconded by Councilmember Chandler and CARRIED on roll call vote as follows to DENY the request and DETERMINE that the "sale of beer and wine" is not a compatible use in the CPD-1 zone and, therefore, not a permitted use.
