PRESENTATION PASADENA Mayor Chandler read and presented a proclamation to Pasadena Tournament of Roses TOURNAMENT Princess Mariasol Peiia, Mariasol Pen a was seiected out of 900 Pasadena area young OF ROSES women who tried out for the year 2000 Rose Court, The selection was based on public (Princess speaking ability, academic achievement, community involvement and personality, Mayor Peiia) Chandler proclaimed January 4, 2000 to be Mariasol Peiia Day, 3. AUDIENCE PARTiCiPATION Randv Rizzi, business owner, 400 North First Avenue, is endeavoring to acquire a Conditional Use Permit to construct a building at his automotive repair shop location, Mr. Rizzi explained to Council the steps he took to comply with City requirements. He believes the City is business unfriendly and no longer wants his business at this location. Mr. Rizzi noted that due to the problems that he has had with the City he lost 95% of his City business, Mayor Pro tem Harbicht asked for a copy of the Planning Commission staff report on this Conditional Use Permit, he also asked the City Manager to investigate this malter. City Attorney Deitsch noted that there is a code enforcement matter pending in the court at this moment regarding this business and the City Attorney's office is prepared to review the case after the January 11, 2000, Planning Commission Meeting, 1 1/4/00 3. 42:0002 Betsv Burcham, President of the Camino Grove Elementary School PT A was present this evening to present the topic "What's Right with Arcadia Kids'. Ms. Burcham stated in I part, that the community witnessed and was proud of the 426 examples of "What's Right with Arcadia Kids" who marched down Colorado Boulevard on January 1st in the 2000 Tournament of Roses Parade. Ms. Burcham invited everyone to attend the 'Arcadia Music Club, 33'" Annual Spaghetti Dinner" on January 22, 2000, which will take place at the Arcadia High School from 4:30 p.m. to 9:30 p.m. Ms. Burcham stated that once again the students of Arcadia schools participated in the 'White Christmas Food Drive" in December and the White Christmas Committee was able to provide food, toys and gift certificates to 132 Arcadia families. MATTERS FROM ELECTED OFFiCIALS ALFORD City Clerk, June Alford reminded everyone that the City election will be held on April 11. (NOMINATION 2000. Nomination for this election was opened for two members of City Council and a PAPERS) City Clerk on December 20, 1999 and nomination papers were issued to Mr. Gino Roncelli, Mr. Mickey Segal. Mr. Vince Foley and Mr. Robert Harbicht. Nomination papers were also issued to June Alford for City Clerk. The nominations will be open until January 14, 2000, if an incumbent does not file by this date the nomination period will be extended to January 19, for people other than incumbents. RONCELLI (New Year) (Arcadia PD, FD and Red Cross) (Invocation) (Financial Report) (Downtown Parking) (Redev. Dept.) MARSAHLL (Holidays) (Waste Mgt.) (Disaster) (Htg. Dr. Parking) Councilmember Roncelli wished a Happy New Year to the Mayor, City Council and all citizens. Mr. Roncelli thanked the Arcadia Police, Fire, Paramedics and Red Cross for their great job during last week's fire in the Angeles National Forest, at the northern part of Arcadia. Mr. Roncelli stated that he is pleased with the City inviting all denominations to pray and bring the invocation at the beginning of each Council meeting. I City Manager Kelly responded to Council member Roncelli's questions with regard to the Summary of Expenditures Report. In response to Mr. Roncelli's concern with regard to the parking problems in the downtown area, City Manager Kelly stated, in part, that in the near future the Council will receive a full report with regard to the parking issue in the Downtown 2000 area. In response to Councilmember Roncelli's query, City Manager Kelly stated, in part, that the Redevelopment Department's cost of operation would be incorporated in the budget presentation and will be presented to the City Council at the end of April or the beginning of May. Councilmember Marshall hoped that everybody had a wonderful holiday. Ms. Marshall thanked the Waste Management Company for their kind consideration and generous donation of $500 to the Arcadia Chapter of the Red Cross. Ms. Marshall thanked the Arcadia Red Cross and John Murphy for their help during the fire disaster last week. She also expressed appreciation to the Arcadia Police Department, Fire Department, City Manager, volunteer citizens and restaurants who contributed and helped during thaI difficult time. I Ms. Marshall referred to a letter that the Council received from the owner of John's Discount Bowling Shop with regard to the parking problem on Huntington Drive. Ms. 2 1/4/00 I I I 42:0003 Marshall requested that staff schedule a study session for Council's discussion on the options and alternatives to this matter. (Quote) RONCELLI (Traffic Signs) KOVACIC (Disaster) (Goals) HARBICHT (Fire) (Sexton) (Lancaster) Council member Marshall shared a saying by Elizabeth King Night, "I find that it is not the circumstances in which we are placed but the spirit in which we meet them that constitutes our comfort." In response to Councilmember Roncelli's concern with regard to the Highland Oaks area traffic sign, staff stated, in part, that the traffic committee of the City met with the School District and reviewed different alternatives. Some of the suggestions such as street striping could be implement quickly but some of the others such as signalization need more study. Council member Kovacic commented on the excellent service rendered by both man and woman of Arcadia's finest line of defense and congratulated all of them for keeping the City safe not only at disaster time but on a daily basis. Mr. Kovacic reported his New Years resolutions. stating, in part. shop Arcadia whenever possible, the sales tax revenue is extremely important to the City; do not look to the City to solve all your problems, pick up trash, return shopping carts, report graffiti; in this diverse community, meet your neighbors, plan street parties or other events for your neighborhood, set up neighborhood watch groups; get involved, there are many opportunities for civic involvement, there is great need for volunteers, especially for the youth and senior citizens; support and promote school and community events. Mr. Kovacic mentioned some of the goals that were accomplished in 1999, such as open discussions about the City budget; support the efforts of the Youth Master Plan Committee; sponsoring community events; improve the -City'S management/labor relationships; financing of a new police station and facilitate the development of the race track to preserve live horse racing and the quality of life in Arcadia. Councilmember Kovacic concluded his comments with a saying and stated. in part, "When each of us ran for this important position we entered into a social contract with Arcadia's voters that we would work hard, attend events, be positive, keep an open mind and be respectful to the City, its residents and each other. And as we face another critical year in the life of our City I hope all of us will remain true to this commitment". Mayor Pre) tem Harbichf comm'enaed Jerry Collins, Recreation Department Director and staff for opening the Community Center and assisting the Red Cross and the fire evacuees. Mr. Harbicht expressed appreciation to the Pasadena Humane Society for their help with the evacuee's pets. Mr. Harbicht suggested the possibility of using scout groups or any other groups to help with some of the work that needs to be done after a big fire. Mr. Harbicht welcomed Philip Sexton as Interim Finance Director. Mr. Harbicht announced the passing of Mr. Bill Lancaster, a long time State Assemblyman. Mr. Lancaster never represented Arcadia, but part of the district which Arcadia is now in, was part of his district. Bill was an outstanding legislator and before that he was City Councilman and Mayor of the City of Duarte. 3 1/4/00 42:0004 CHANDLER Mayor Chandler thanked all of the fire fighters and announced that on the moming after the Angeles National Forest fire started he attended a meeting held by a major task force, I on the top of their priority list was dislocation and removal of the residents along with their own safety. 5. In response to a Council question with regard to the number of ballots cast at the November 2, 1999 Bond Election and the number of ballots voted, City Clerk Alford stated, in part, that some people turn the ballots in without voting them. MUNICIPAL LITIGATION (Amicus Brief) I()~{)~~~O 42:0005 CITY MANAGER City Manager Kelly explained the fire activities during the recent fire in the Angeles National Forest above the Highland Oaks Area of the City. He expressed appreciation to Arcadia Fire, Police, Recreation and Public Works employees for doing their job very professionally and efficiently. The City is now coordinating with the U.S. Forest Service, County Public Works, County Fire, City of Sierra Madre. City of Monrovia, on what to do now with the burned hills. Further, with the help of the Homeowners Associations, the City will hold a public meeting to give the correct information out. City Manager Kelly designated Fire Chief, Peter Bonano, as the City's media spokes person to distribute information. Fire Chief, Peter Bonano displayed pictures and a map of the area and gave a brief power point presentation on the fire which was identified as Santa Anita II by the Forest Service. The original fire started at 2:46 p.m. December 27,1999 and was under control until 5:00 p.m. At that time due to high winds the fire started spreading south and west. once that happened the Forest Service requested additional resources for back up. At 8:00 p.m. the fire had grown to approximately 300 acres. Initial involvement was about 20 acres, and it was contained at 5:00 p.m. December 30, 1999. Chief Bonano concluded his presentation by thanking residents, City employees, outside agency's, restaurants and retail stores for their help, support and cooperation. City Manager Kelly presented for ADOPTION and read the title of RESOLUTION NO. 6156 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, RATIFYING THE PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY WITHIN SAID CITY PERTAINING TO A FIRE AND RELATED MATTERS COMMENCING DECEMBER 27.1999". AYES: NOES: ABSENT: Councilmembers Harbicht, Kovacic. Marshall, Roncelli and Chandler None None CITY ATTORNEY The City Attorney periodically receives requests from either the League of California Cities or other law firms representing municipalities in specific litigation, to either prepare an Amicus Brief or to join other parties who have already prepared such briefs pertaining to legal issues of significance to California municipalities. Most recently, the City Attorney and the Chief of Police each received from the law firm of Manning, Marder & Wolfe, representing the Los Angeles County Sheriffs Department, a request that the City of Arcadia join as Amicus in the matter captioned Cruz vs. Briseno, Case No. S076167, currently on appeal before the Supreme Court of the State of California. City Attorney Deitsch recommended that the City of Arcadia join in an Amicus Brief (to be prepared by another party without cost to the City) supporting Deputy Sheriff Briseno in this appeal; that the City Council consider authorizing the City Manager and City Attorney to approve the City of Arcadia joining as Amicus in other future litigation, upon request from the League of California Cities or other appropriate parties, if such litigation involves municipal issues of concern and potential applicability to the City and is without cost to the City. Councilmember Kovacic is in favor of the City's policy with respect to the Mayor sending letters in support or opposition to legislation. 5 1/4/00 42:0006 It was MOVED by Mayor Pro tem Harbicht, seconded by Councilmember Kovacic and CARRIED on roll call vote as follows to AUTHORIZE the City of Arcadia to join as amicus in Cruz v. Briseno, at no cost to the City; and, AUTHORIZE the City Manager and City Attorney to screen the various amicus requests and if they feel the Council may want to file, bring to the City Council for approval. I In response to a Council question Mr. Deitsch stated, in part, that a California Appellate Court determined that a peace officer has an absolute duty to activate his/her lights and siren as a warning to the general public immediately upon commencement of pursuit of a suspect. According to Librarian, Kent Ross, she was a fantastic employee; loyal to the library and all the people she served. And, so I request that we adjourn in the memory of Joan Hallett. "Also a personal friend of mine died on December 30'h and I request that the City Council meeting be adjourned in the memory of Coriene Luke, a former long time resident of Arcadia, and until her last day an active member of Arcadia's Church of the Good Shepard. Coriene died in San Marino on December 30, 1999 from cancer, after spending a marvelous Christmas with her husband Ted, daughter Nancy, son Scott, daughter in- I law Ann and her four grandchildren. Coriene will be remembered for her uncompromising love of family and friends. Her quick wit, her constant smile and her brave battle against cancer. Services celebrating Coriene's life will be held at the Church of the Good Shepard on Sunday, January 9, 2000 at 2:00 p.m. So, Mr. Mayor I request that we adjourn tonight's meeting in memory of both Joan Hallett. a long time employee of the City and Coriene Luke, a long time friend of mine."
