The City Council and the Arcadia Redeveiopment Agency met in a Regular Meeting on
Tuesday, February 1, 2000, at 6:00 p.m. in the Conference Room of the City Council
Chambers,

STUDY SESSION
Philip Sexton, Interim Director, Administrative Services, presented the mid-year budget
review, Mr. Sexton stated that continuing economic growth is having a very positive
impact on the City's 1999-2000 budget. The City's projected revenue estimates are
$1,525 million higher than the original projections from last June, Major increased
revenue contributors to the budget are all revenue sources that are directly related to a
healthy economy such as: property tax; sales tax; property transfer tax; plan check;
building permits; motor vehicle fees and miscellaneous revenues,
Reviewing expenditures, Mr. Sexton stated, in part, that all departments are expected to
be at or below their authorized budget allocations, The collective budget savings of the
individual departments are expected to be approximately $256,000.
The higher than expected revenue, and the less than authorized expenditures, will have
a projected positive change in the City's Fund Balance of approximately $1.781 million
this fiscal year.
Increasing interest rates for the remainder of the current fiscal year, and the 2000-2001
fiscal year, may have an effect on the California economy to the point of negatively
impacting the same revenue categories that generated the largest projected surpluses
this year. The February 1, 2000 staff report included a mid-year revenue and
expenditure update, restatement of the Annual Budget General Fund Balance, and
graphics of major revenue sources,
Following the presentation staff responded to questions and concerns expressed by the
Council with regard to revenues and expenditures stating, in part, that in order to better
handle the expenditures staff conservatively estimates revenues every year. The
amount of expenditures for each department is not one-twelve of its budget every
month, Each department is different in its expenditures; which could be payroll,
furniture, vacancies, etcetera...

budgeted and projected amount of expenditures in a six month period and in a one year I
period, Mayor Chandler suggested staff meet with Mr. Roncelli, when all the information
is available and respond to his questions at that time, in particular, expenditures related
to payroll periods which are every other week rather than monthly,

PUBLIC HEARINGS
Consideration of the report and recommendation to adopt Resolution No. 6161. to
authorize the Arcadia Police Department to use funds allocated from the Citizens' Option
for Public Safety-Supplemental Law Enforcement Services Fund (COPS-SLESF) for the
purpose of "Front Line Police Services:
Each year, the State Legislature considers supplemental funding for local police
departments under the COPS program, The annual decision to fund the COPS program
is based upon budget priorities and available funds, The COPS program distributes
State funds to local cities on a per capita basis. Recipient cities are required to deposit
the State funds in a local Supplemental Law enforcement Services Fund (SLEF) to be
expended only for equipment and services requested by the chief of police approved by
the City Council.
This year Arcadia received $118,136 in COPS funds. There is also $90,000 remaining
in the SLESF (Supplemental Law Enforcement Services Fund) as the result of project
postponement, cost savings and interest from the previous three years, Staff proposed
to spend those funds on the following items; 1 - Continue the existing Crime Analyst
position ($50,000); 2 - Continue the existing Court Liaison position ($15,000); 3 -
Purchase of Backup File Server & Software ($21,000); 4 - Mobile Digital Computer
Support ($32,000); 5 - Reallocation-Field Report Writing System (Resolution #6030)
($32,000); 6 - Reallocation-Computer Systems Support (Resolution #6100) ($58,000),
for a total of $208,000,
Mayor Chandler OPENED the Public Hearing, No one came forward to address the City
Council.

The Redevelopment Law (Health and Safety Code Section 33445) requires that, if
redevelopment funds are to be used to pay for improvements which will be publicly
owned, both within and outside of the project area. the City Council must make three

findings: a) that the proposed improvements are of benefit to the Project Area or the
immediate neighborhood in which the project is located; b) that there are no other I
reasonable means of financing the proposed project available to the community: c) that
the project will assist in the elimination of blighting conditions in the Project Area and is
consistent with the adopted Implementation Plan,
The February 1, 2000 staff report summarized the proposed Police Facility project which
has been prepared pursuant to Health and Safety Code Section 33679 setting forth the
amount of tax increment to be used to fund the proposed capital improvements,
including interest (up to $6 million), the facts to support the three findings and describing
the redevelopment purposes for which the funds are being used (design and construction
of the Police Station).
The Agency currently is projecting a fund balance of approximately $2,300,000 on June
30, 2000 after deductions for housing set-aside, operations, bond debt service and
approved projects, Therefore, the $1 million needed now is available to fund pre-
construction cost and would become part of the Agency's contribution to the project. The
Agency will contribute between $4 million and $6 million to the Police Facility Project,
An appropriation of $1 million from the Agency's Unallocated Fund Reserve is necessary
for architectural/engineering and other future predevelopment expenses, which would be
part of the total agency contribution
Mayor Chandler OPENED the Public Hearing, No one came forward to address the City

AUDIENCE PARTICIPATION
Torri McEntire Miller, 2122 Bella Vista Drive, representing the Dana Middle School PTA.
Ms, Miller mentioned achievements, awards and programs which have taken place at
Dana Middle School in her 'What's Right With Arcadia Kids' presentation. Ms, Miller
expressed appreciation on behalf of the PT A members and parents to the City Council
for continuing to make decisions that make everyone believe that young students are
important.
Linda Nasco, 446 Oakglen Court, San Dimas, related her personal observations of
Arcadia Dial-A-Ride. Ms, Nasco stated, in part, that she is working with elderly clients
and often see them out in the street waiting for an hour or two to be picked up by Dial-A-
Ride, She urged Council to find a way to make the use of the transit services easier for
senior citizens,
Councilmember Kovacic suggested Council review the Arcadia Transit contract and their
performance on future agenda, Council concurred,

Transit and urged citizens to address the Council on any concerns or suggestions they

City Clerk, June Alford encouraged everyone to vote at the March 7th Primary Election,
She reminded everyone that the City election will be held on April 11, 2000,

Mr. Roncelli stated, in part, that at the last City Council meeting the Council voted 4-1 to
adopt a Resolution supporting Proposition 12, which is called the Safe Neighborhood
Parks, Clean Water, Clean Air and Coastal Protection, He believes that this is another
way for the State to take large amounts of money from Cities, Mr. Roncelli urged
Council to change their vote and not support Proposition 12.
Councilmember Marshall agreed with Mr. Roncelli's suggestion, She too would like to
have further discussion on the resolution supporting Proposition 12,
City Attorney Deitsch explained that pursuant to the Brown Act the Council could not
make a substantive vote on an item which is not on the agenda. The City Attomey
further advised that the Council could take a vote on a procedural motion tonight which
would include directing staff to place the issue on the Agenda for the next City Council
meeting,

Council member Marshall noted that the Council received the Huntington Drive parking
study prepared by staff. She suggested scheduling a study session for Council's
discussion and consideration,
Councilmember Kovacic suggested notifying the businesses along Huntington Drive of
the study session with regard to the parking problems on Huntington Drive, He felt it
would be more heipful for Council to have the business owner's point of view, in order to
make a final decision,
Mayor Pro tem Harbicht expressed his opposition to the idea of spending more money to
create more parking in order to promote retail business on Huntington Drive in the

Councilmember Marshall shared a saying by Albert Einstein, "The most
incomprehensible thing about the world is that, it is all comprehensible."
Councilmember Kovacic wished good luck to the Arcadia High School Constitution Team
at the state final competition in Sacramento on February 3'" and 41h He also thanked the
City and the City Council for permitting the team to use the Council Chambers for the
team's mock hearings,
Mr. Kovacic referred to an article in Sunday's Star News and stated, "if anybody read
that article and believed what was said, they'd get a total misconception of how this City
handles large projects." The Planning Commission doesn't make final decisions about
big projects and they do not hold the only hearings that are held, they are an advisory
board and when they advise the Council we do not rubber stamp their recommendation.
The Council holds its own set of hearings and makes its own independent judgment,
because that is Council's job,

So anybody out there who is laboring under the misconception that the Planning
Commission is going to make all the decisions conceming the Santa Anita project and
the City Council is going to rubber stamp that, is sadly misinformed",
Mayor Pro tem Harbicht stated that he was pleased to see the various City departments
getting the recognition that they deserve for their great job during the fire at the northem
part of Arcadia, in particular, Public Works personnel who, he believes, are unsung
heroes.
Mr. Harbicht thanked the residents of the northem part of Arcadia for their contributions
to the DAR.E program, This is a great program and a great deal of that program is
sponsored by contributions from various fund raising efforts,
Mayor Chandler announced in coordination with the Highland Oaks Homeowners
Association, the City of Arcadia will host a meeting on February 24, 2000 at 7:15 p,m, at
the Highland Oaks School Auditorium, located at 10 Virginia Drive. The purpose of the
meeting is to report on the impacts of the recent Santa Anita II fire,
Mayor Chandler referred to an article in the Pasadena Star News, and took exception to
Council member Roncelli's comment with regard to the roll of the City Council in decision
making, especially concerning large projects, Mayor Chandler stated, in part, that
Councilmembers are elected by the people, and are expected to do the bidding of the
people, to make and spend the budget and to make decisions about major projects, The
Mayor noted that he takes that roll very seriously and is not a part of a rubber stamp
process, The Council appoints the Planning Commission which does volunteer service I
on Council's behalf and on behalf of the citizens to final down information and help take
care of a lot of matters so that we can deal with prudent issues, He does not want to be

part of a misperception and will not acknowledge that he is part of a stamping process,
Councilmember Roncelli responded to the Mayor's comments and stated, in part, that in
his comments he suggested that the City's General Plan and zoning calls out what type
of businesses are allowed on different properties, The General Plan and zoning have
already been finished and some of the Councilmembers were involved in making that
decision, He is not suggesting this is a rubber stamp Council at all.

In response to Agency Member Roncelli's query, staff stated, in part, in response to the
Request for Proposals (RFP) prepared by staff, six (6) firms submitted proposals,
Review of the qualifications was based on a number of factors, including professional
qualifications of the key members of the engagement team; capability of handling all
aspects of the engagement and providing ongoing support and technical assistance;
ability to provide continuity of staff from year to year; a clearly defined schedule of the

audit plan and completion dates; and reasonableness and competitiveness of the fee
schedule, Based on the evaluation criteria, staff recommended the firm of Conrad and I
Associates be retained as the City and Agency auditor. They are located in Irvine and
currently serve as independent auditor for 35 Southern California cities and their
redevelopment agencies,
The Citizens Financial Advisory Committee found that the current audit process was
adequate and appropriate, though they did recommend to the City Council that a RFP
process be initiated since the City had been utilizing the same firm for several years,
The City requested that Mr, Mickey Segal, fonner Chairman of the Financial Advisory
Committee, review the proposals,
Mr. Segal explained in detail the reviewing process and noted that he concurred
independently with the staff recommendation,
Agency Member Harbicht stated, in part, that he does not need ratification from an
outside source because. in his opinion City staff are very professional, disciplined and
handle these issues to the highest standards,
It was MOVED by Agency Member Harbicht, seconded by Agency Member Kovacic and
CARRIED on roll call vote as follows to APPROVE an agreement with the firm of Conrad
and Associates, LLP, for Agency audit services; and, DIRECT the Assistant City
Manager to EXECUTE said agreement on behalf of the Agency.

In 1996, the United States Court of Appeals upheld a decision which expanded the
authority of California cities to regulate newsracks containing adult materials, The City
of Arcadia currently has in effect an ordinance regulating newsracks, however, it does
