Following the conclusion of the 5:30 p,m, Special Meeting of the Arcadia City Council on
Tuesday February 15, 2000, the City Council met at 6:14 p,m, in the Conference Room
of the City Council Chambers with all five members of the City Council in attendance,
The City Council discussed agenda item No.1, Closed Session. at a Special Meeting at
5:30 p,m. February 15, 2000,
STUDY SESSION
PRESENT: Councilmembers Harbicht, Kovacic, Marshall, Roncelli and Chandler

AUDIENCE PARTICIPATION
John Nobreaa, John's Discount Golf, 2811, East Huntington Drive, expressed his
displeasure with regard to the inadequate parking on the southside of Huntington Drive
between Santa Anita and First Avenue, Mr. Nobrega commented on the lack of parking
spaces at the rear of the stores on the southside, stating in part, that he received many
complains from customers, especially ladies who do not like to use the rear parking in
the evenings, Further, Mr. Nobrega suggested that Council consider removal or re-
design of some of the landscaped bowouts on Huntington Drive to create more parking
spaces in front of the retail shops..
Russ Simsarian. Senior Citizen Commissioner, referred to the complains received from
some of the residents with regard to the parking situation at the shopping center at the
southeast corner of Huntington Drive and Santa Anita Avenue. Pulling out of the parking
space into the traffic is extremely difficult because of the planter areas at this comer.
Mr. Simsarian felt removal of the planter areas at the comer of the side streets from
Santa Anita to the East City limit would make it easier for motorist to make a right-hand
turn,
Discussion and direction regarding' parking issues in the downtown commercial district.
Don Penman, Assistant City Manager/Director Development Services, began his
presentation by explaining in detail the alternatives relative to the parking space in the
first block of Huntington Drive, east of Santa Anita, which included: leaving the parking
as it currently exists; re-design the size of the bowouts on Huntington Drive to create a
few more spaces; and, work to create a public parking lot at the rear of the buildings on
the south side of Huntington Drive,
Mr. Penman noted that street curbside parking space is generally considered to be 22 It,
long, Costs to create a new space would include asphalt removal, reconstruction of the
street/curb/gutter, reconstruction of utilities, relocation of landscaping and related costs,
Mr. Penman further explained that removal of the planter area between 16 and 38 East
Huntington Drive would include the additional cost of relocating a fire hydrant at an
estimated cost of $4,000. Preliminary estimates of the cost are approximately $7,000
per 22 It. of removal and replacement.

Considerable discussion ensued around the issue of creating additional parking spaces,
the cost and the period of time needed for completion of the project. Mr. Penman noted I
that the Parking District Commission recommended that the Council consider creating
additional parking along Huntington Drive and also recommended that staff look at the
possibility of decreasing the parking time limit from two (2) hours to one (1) hour.
In the discussion, Mr. Phillip Venzke, Brothers Photography stated, in part, that the
businesses at the north side of Huntington Drive were originally designed with rear
access in mind and they all have nice and presentable rear entrances, The buildings at
the south side where never meant for rear entrances, This in reference to parking the
rear of businesses on the southside,
Referring to possible changes of the parking regulations in the area, Council member
Kovacic suggested additional parking enforcement on Huntington Drive, and stated, in
part, that he is not interested in removing the fire hydrant or creating just one space, He
prefers redesign of the planter area in front of 38 East Huntington Drive and creation of
2-3 parking spaces on each side of Huntington Drive in this area, The City's goal is to
make the downtown area look beautiful and be as accommodating as possible to the
business people.
Following further discussion it was MOVED by Council member Kovacic, seconded by
Councilmember Marshall and CARRIED on roll call vote as follows to create 2-3 parking
spaces on each side of Huntington Drive in the 00 block by redesigning the bowouts in
that area; and, survey the existing parking spaces along the south side of Huntington, re-
stripe to maximize spaces,

Mayor Chandler presented a proclamation declaring March 2000. as Arcadia Red Cross
month to JoAnn Scott. Ms, Scott introduced Gall Jensen, member of the Board of
Directors of the Arcadia Chapter of the American Red Cross and David Stegner, Director
of Emergency Services and Health and Safety, -
Ms, Jensen presented a Red Cross Flag, to be flown over City Hall during the month of
March, to Mayor Chandler and thanked him for his support during the Santa Anita II fire,
Ms, Scott expressed her appreciation to Mayor Chandler for agreeing to be the honorary
Chairperson of the Community Support Campaign, Ms, Scott invited everyone to
support the Arcadia Red Cross by attending the Arcadia Chamber of Commerce Mixer,
February 29, 2000, and BJ's Restaurant first anniversary celebration, March 16" 2000,
Proceeds will benefit the Arcadia Chapter of the American Red Cross,

John Winn, representing Pasadena Star News, San Gabriel Vailey Tribune and Los
Angeles Daily News addressed agenda item 14a, Ordinance No, 2117 regarding the
regulation of newsracks, Me Winn questioned the number of newsracks to be pennitted,
the color of the panels and business license fee,
In response to Me Winn's questions, City Attorney Deitsch stated, in part, that the
proposed ordinance provides that not more than four newsracks shail be instailed on any
one base, it is a matter of first come, first serve at any location. and the City does not
have any control in tenns of who instails newsracks, With regard to wood grain panels
and the business license fee, the City Attorney clarified that those are not new
provisions. they can be found in the existing ordinance governing newsracks,
Richard Parker, 315 Arbolada Avenue, referred to a newspaper article regarding the City
of Oakland's Mayor being barred by the Fair Political Practices Commission from acting
on a proposed project involving property within 2500 feet of his residence, Me Parker
fell that this might affect City Council candidate Foley, who lives within 2500 feet of the
Santa Anila property, He requested the City Council, Cil)' Attorney or Mr, Foley himself
pursue this matter to its conclusion prior to the April 11 , 2000 election,

Ms. Marshall announced that the Methodist Hospital Foundation is having a Mardi Gras
fund raiser on March 7 from 6:30 to 10:30 p,m.. at Santa Anita Race Track, Proceeds
will benefit the Neonatal LC, Unit at Methodist Hospital.
Council member Marshall shared a saying by an anonymous writer, "Fire is the test of
gold, adversity is the test of strong men",
Councilmember Kovacic noted that interested people could work as volunteer ushers at
the Pasadena Playhouse and enjoy the plays for free,
Mr. Kovacic thanked Officer Pete Gallardo and Lt. Ed Winter from the Arcadia Police
Department for accommodating him on a ride-along in a Police car.
Mr. Kovacic urged everyone to join him in the first Communities Reaching Out to People
(CROP) walk, which will be on March 26. 2000, from 1:00 p,m, to 4:00 p,m, A large part
of the proceeds will benefit local food banks,
Mayor Pro tem Harbicht highlighted a report with regard to the Arcadia dial-a-ride
program and stated he is pleased to see that new vehicles are on order and will be
delivered in March, Those new vehicles will provide an additional 108 seats, Mr.
Harbicht stated, in part, that City staff met with School District staff to look for solutions
and ways to address dial-a-ride problems and serve all segments of the community,
Mayor Chandler announced that Council candidate forums sponsored by American
Association of University Women will be held on Tuesday, March 7th at 2:00 p,m" and
Wednesday, March 29th, at 7:00 p,m. at the Arcadia Community Center.

No. 6159 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

Mr. Kovacic stated that he is in favor of the Proposition 12, He felt the Council made
a wise decision by taking no position on this matter.
Councilmember Roncelli suggested everyone read the arguments against Proposition 12
in the voters pamphlet for the March 7. 2000 Primary Election, He believes in safe
neighborhood parks and clean water and air, but the way it is funded does not make any
sense.
Councilmember Marshall felt that the original staff report on Proposition 12 was
completely one sided and did not give the Council an option to make an intelligent
decision on this issue,

Consideration of the report and recommendation to award a professional services
agreement to WMM Associates for architectural services for a new police faciiity, Staff
prepared a Request for Proposal (RFP) for architectural services for the new poiice
facility, the RFP called for the provision of comprehensive services, meaning that
respondents were required to provide all services required for the design of this facility
including mechanical, electrical, structural, civil, security, interiors and landscaping, In
total, twenty-four (24) architectural firms received copies of the RFP, A total of thirteen
(13) finns submitted proposals in response to the RFP, Based on the review and
ran kings of the qualifications of the various finns, four (4) were invited to participate in
the interview process. During this process. each was provided with an opportunity to
make a presentation and then discuss their qualifications and respond to questions from
the interview panel. The panel consisted of representatives from the Police, Public
Works Services and Development Services Department.
Based on the review process, staff recommended that the firm of WMM Associates be
retained as Police facility architects, The proposed fee for WMM is 9,25% of the cost of
construction and furnishings and would be fixed at the end of design development. This
fee would apply to all basic services provided by the architect. including all their
consultants, design of the building, preparation of plans, specifications, and construction
and post construction services, Though the final fee will be fixed at a later date, it is
estimated that it will be in the range of $1,1 to $1.2 million based on prior estimates and
the Needs Assessment. The initial needs assessment called for a 42,000 square foot
building and a secondary structure of 16,000 square feet, which would include a new
firing range and ancillary structures, WMM will prepare the final building configuration,
develop its design and prepare construction specifications,
The Redevelopment Agency has previously appropriated $1 million toward these design
services as well as other predevelopment cost, such as soils and geotechnical studies
and a site survey,

REGIONAL WATER QUALITY CONTROL BOARD ORDER NO, 96-054,"
The Federal Clean Water Act was amended in 1987 to include a requirement for storm
drain operators to obtain a National Pollutant Discharge Elimination Systems (NPDES)
penni\. Under the umbrella of Los Angeles County, Arcadia obtained its first permit by
the Los Angeles Regional Water Quality Board (Regional Board) in 1990 and a
second in 1996 (Order No, 96-054) requiring the development and submission of six
(6) model programs for operation of local storm drain systems. After minor
modifications, the plan submilled to the Regional Board Executive Officer was approved,
This plan includes a requirement for Standard Urban Storm Water Mitigation Plans
(SUSMP) for new development and significant redevelopment projects. Subsequently,
Regional Board staff released its own version of SUSMP requirements two months after
Los Angeles County developed and submilled i1s SUSMP in July 1999.
On January 26, 2000, the Regional Board adopted a SUSMP Program proposed by their
own staff ignoring the recommendations of Cities and Los Angeles County which
included a number of provisions that were not agreed to by the Cities under the existing
Permi\. Specifically. and most importantly, the proposed SUSMP Program included the
requirement that the Cities impose a numerical mitigation measure on the retention
and/or treatment of storm water runoff of ,75 inches within a 24-hour storm event for
some project categories, The February 15, 2000 staff report set forth in detail the most
significant elements of the approved SUSMP which were not included in the cities/county
original submillal and the reasons that the action taken appear to be in violation of the
Permit, the Clean Water Act and the Porter Cologne Ac\.
The February 15. 2000 staff report stated that there is enough information to conclude
that the changes will have a definite economic impact on cities, Every development
project will be required to install and maintain permanent retention/treatment controls,
The Regional Board indicated that the municipalities would have six (6) months to revise
all of their codes to comply with the mandatory retention/treatment requirements,

CITY ATTORNEY
City Attorney Deitsch presented for ADOPTION and read the title of ORDINANCE NO,
2117: 'AN ORDINANCE OF THE CITY COUNCiL OF THE CITY OF ARCADIA,
CALIFORNIA, AMENDING AND RESTATING IN ITS ENTIRETY ARTICLE VI OF
CHAPTER 4, DIVISION 8 OF THE ARCADIA MUNICIPAL CODE PERTAINING TO
THE REGULATION OF NEWSRACKS:
In response to a Council question City Attorney stated, in part, that under the new
ordinance adult newsracks selling material legally defined as 'harmful matter" must
have blinders shielding the content from public view and shall be operated by tokens or
cards. which would be distributed at other locations to people 18 and over.
In response to Mayor Pro tem Harbicht query with regard to a comment that was made in
tonight's meeting regarding the newsracks having wood grain panels and the mount
being painted gloss black. City Manager Kelly stated, in part, staff will reinvestigate this
issue and in a near future will submit a full report on choices and alternatives with regard
to the newsrack panels for Council's consideration,

City Attorney Deitsch presented for ADOPTION and read the title of RESOLUTION NO,
6163: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, APPROVING AND ADOPTING AN AMENDED APPENDIX TO THE
CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM ACT OF
1974",
The City has recently revised and reclassified various City employee positions, As a
result, the City is required to revise the City's list of Designated Employees and assigned
Disclosure Categories in order to cover the revised and reclassified employee positions
who must file Statements of Economic Interests pursuant to the City's Conflict of Interest
Code, The February 15, 2000 staff report set forth versions of the revised Appendix to
the City's Conflict of Interest Code,
In addition to the current amendment of the Appendix, Section 87306,5 of the Act
requires that no later than July 1 of each even-numbered year, the City Councii must
direct the review of the City's Conflict of Interest Code. The Act further requires that the
City Manager file a statement regarding the results of the review no later than October 1
of the same year. If a change in the Code is necessitated by this review, it must be
submitted to the City Councii for approval within ninety (90) days of the filing of the
statement of review,
