The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on
Tuesday. May 2, 2000 at 7:00 p,m., in the Council Chambers,

PRESENTATIONS
Fonner Mayor Roger Chandler presented a City plaque to Mrs, June Fee in appreciation
of fifteen years of outstanding community service to the Mayor's Prayer Breakfast
program,
Mayor Kovacic presented the May, 2000 Mayor's Youth Service Award to Chris McClain
stating, in pari, that Mrs, McClain has participated in community affairs for years specially
those involving children, In addition to being active in her churCh. the boy scouts, the girl
scouts, Red Cross and the Assistance League, Chris has also been an executive director
of the Arcadia Child Health Council, an Arcadia Education Foundation Trustee and a
member of Auxiliary of Methodist Hospital.
Mayor Kovacic congratulated Mrs, McClain for her service to Arcadia,

Mayor Kovacic presented the May, 2000 Mayor's Senior Service Award to Martha
Maynard stating, in part, that since November 1996, Martha has contributed over fifteen
hundred hours of service to the senior citizens of Arcadia and surrounding communities.
Mayor Kovacic congratulated Mrs, Maynard for being an extraordinary volunteer.

ORDINANCE Text Amendment 2000-001 was filed by the Los Angeles Turf Club (LATC) in,December
NO.2119 of 1999, requesting changes and additions to the S-l (Special Use) zoning regulations,
(Permitted Uses which included: a request to allow horseracing and other events to be telecast via satellite
S-l Zone and feed seven (7) days a week until no later than 1 :30 a,m,; and, the addition of a new code
Performance section to allow for year-around usage of the restaurant located in the grandstand for non-
Stds, For horseracing activities, and to use the big screen monitor in the infield for code permitted

On March 7, 2000, at a duly noticed public hearing, the City Council received public
comments concerning proposed amendments to certain S-l zoning regulations (T ,A,
2000-001), After considering all public testimony, it was the consensus of the Council
that rather than the Conditional Use Permit process (recommended by the Planning
CommiSSion), performance standards should be established in the code that would
address the neighbors concerns regarding nighttime noise, amplified sound and use of
the out door grandstand area during the evening hours, The City Council directed staff to
prepare the appropriate ordinance setting forth the specific performance standards,
Ordinance 2119 was submitted to the City Council on April 4, 2000, This ordinance
allowed for the expansion of hours and days for the satellite feed, as well as types of
activities that may be telecast, and extended the use of the big screen monitor to events
other than horseracing activities, The ordinance also established very specific
performance standards as set forth in the May 2, 2000 staff report,
At the City Council's April 4, 2000 meeting Frank DeMarco, representing the Los Angeles
Turf Club (LA TC) noted that there had been some miscommunication as to the exact
nature of LA TC's request and requested a continuance of the proposal to amend the
applicable ordinance in view of questions raised by members of the public and members
of the Council with respect to the interpretation of the proposed amended ordinance, The
City Council continued its consideration of Ordinance 2119 to this date, and directed staff
to notice this item for public hearing at its May 2, 2000 meeting, Public hearing notices
were mailed to all property owners within a 1,000 radius of the race track (992 property
owners),
A report, submitted by Frank DeMarco, Jr., was included in the May 2nd staff report which
provided further information regarding LA TC's request to utilize the box seats and Turf
Club areas, along with the small screen TV's located at each table during the evening
hours, the noise study and a letter sent to the residents within the area,

Following the presentation, staff responded to questions and concerns expressed by the
Council with regard to performance standards and outdoor activities stating, in part, that I
the proposed ordinance establishes very specific performance standards. In response to
Mayor Kovacic, staff recommended that performance standards "a" and "c" within

Ordinance No, 2119, be amended to read as follows:

a) No persons, other than employees of the racetrack, shall be allowed in the
unenclosed areas of the grandstand and racetrack between the hours of 10:00 p,m,
and 8:00 a,m. (changed from 6:00 p,m,)
b) There Shall be no outdoors sound amplification or use of outdoor loudspeakers
between the hours of 6:00 p,m, and 8:00 a,m,
c) Windows in the enclosed restaurant located within the grandstand structure shall be
closed between the hours of 10:00 p,m, and 8:00 a,m, (changed from 6:00 p,m,)
d) During the non-racing season, the northerly parking lot shall not be utilized for patron
parking,
Further, staff noted that LA TC's request only addresses telecast via satellite feed for
special events and sporting events and the fact that they will be reviewed by the
Development Services Director/Assistant City Manager will provide the City with enough
ability to monitor the types of proposed uses, This will not commit such things as infield
concerls,
Mayor Kovacic OPENED the Public Hearing,

Frank DeMarco, Secretary and General Counsel of the Los Angeles Turf Club, stated in
part, that LA TC would like everyone to understand the definition of events; this is a
request to use the outdoor TV screen and little 9" monitors on individual TV units located
at the tables in the Turf Club and box seat areas, and_ not a request for live or rock
concerts,
In connection with Santa Anita's expressed desire to communicate more closely with the
homeowners in the area, Santa Anita's representatives have met with the President and
other representatives of four major Homeowners' Associations,
With regard to the noise issue, Mr, DeMarco noted that the Arcadia Municipal Code
(AMC) has established sound levels, which can not be violated whether Ordinance 2119
is adopted or is not adopted, All the conditions set forlh in the proposed ordinance are
acceptable to LA TC except for the time, the 6:00 p,m, is not workable, Staff suggested
10:00 p.m, to 8:00 a.m" LATC's application is 1:30 a.m. to 6:00 a.m,
In response to Councilmember Marshall's question, Mr. DeMarco stated, in part, that
there will be no change in the race track's security system and the security officers,
Mr. Brant Latta, General Manager, LA TC, responded to the questions and concems
expressed by the Council with regard to patrons noise and parking problems, Mr. Latta
stated, in part, that the cleaning process will be faster. The race track has three cleaning
crews that work at night. The cleaning of the area in front of the grandstand will start
immediately after the last live race, Mr. Latta reassured the City that they want to be
good neighbors and would work with the City should a problem arise,

Mr. Hans Giroux, representing Giroux & Associates, explained in detail the noise analysis
which was conducted of existing racing activity noise levels as a prototype for evaluating
the noise implications of the proposed Turf Club evening use, Mr. Giroux stated, in part,
that on a Saturday aftemoon, with 25,000 people present, the total noise level from all
activities was a high of 50 dBA, there were other days that the noise level was below 55
dBA. Further, he noted that the excitement or the noise generation from a crowd after
10:00 p,m, is hard to predict, but it is probably not anywhere near what it is from 25,000

people in the middle of the day,
Vincent FOlev, 320 Cambridge Drive, expressed his concem with regard to the noise I
generated from 3,500 football fans sitting in front of the 9" TV monitors, He felt fans are
rooters, and 3,500 fans can make a serious sound, Mr. Foley stated he moved to Arcadia
knowing what a race track brings, He did not move next to a 3,500 seat football stadium,
baseball stadium or boxing arena,
Steven Reed, 458 Cambridge Drive, expresses his objections to the procedures followed
this evening which he noted, are not due process in that staff deviated from the staff
report and presented an opinion not incorporated in the report, Mr. Reed further, stated in
part, that he is opposed to the extension of hours at the track because of the noise, Also
he is opposed to telecasting horse racing and other events via satellite feed, He did not
move to that area, and live there for 25 years, to be next to an outdoor arena, which
would operate until 1 :30 a,m,
Mr, Reed referred to a letter that he sent to the City Council. He wrote that letter one
aftemoon while he was listening in his house to a plus 55 dBA sound of the race track
during the afternoon, When events are conducted in the infield the noise can be heard
inside his home even when the windows and doors are closed. Mr, Reed further
commented on Santa Anita Race Track's desire to be a good corporate neighbor. He felt
if the track was concerned about its neighbors, they might at least inform the neighbors of
any proposals they want to make before the Council, prior to the hearing date and not at
the last day,
Dennv Boullinahouse, Fairview Avenue, stated in part, that he and his wife live a hundred
yards from Santa Anita and have never experienced the feeling that tonight's speakers I
indicated, and have never had a problem with the noise level. He felt there are four
community efforts in Arcadia that are very positive: the Santa Anita Race Track, the Mall,
the Arboretum and Pavilions, He further stated that Arcadia is a well-managed City, He
looks forward to the positive effects the development of Santa Anita will have on Arcadia,
Bob Kimball, 140 Santa Cruz Road, stated, in part, that he enjoys Santa Anita and
appreciates the fact that they sponsored venues for various events, however, he felt that
the Conditional Use Permit should be seriously considered because that is the teeth the
City Council needs, and must have, to maintain City rules and laws, The fact that Santa
Anita is here, has been here, and brings a lot of money to the City does not necessarily
mean that they can buy privileges... it's just bad business, Mr. Kimball noted also that
the traffic running through the Gardens area when the races are over is dangerous to the
children, This area does not have sidewalks or street lights,
Dennis Cosso, a resident of the College Street area, stated, in part, that he has been part
of this City for about twenty years, and worked with Santa Anita for years in raising
money for kids at the school. In his opinion Santa Anita is a great place and he is
honored to live near Santa Anita, It has brought national prestige to the City. He felt that
the City Council should have faith in Santa Anita, let them do what they think is
appropriate, If they don't do it right, and the discomfort to the neighbors is too bad, and
its violates the law, the City has the ability to stop it and shut it down, Which he believes
will never happen, .
DirK Hudson, Stanford Drive, stated in part, the real thing that residents should be
concerned with, more than the level of noise, is the hours of operation, He is in favor of
what Santa Anita stands for, but there are times when the noise becomes oppressive, I
generally when they are having music, rather than the crowds, In his opinion 10:00 p,m,
is a reasonable limit to what they are proposing,

Tom Kocava, 137 Santa Cruz Road, an Arcadia resident for twenty years, expressed his
concerns with regard to safety, He felt that the proposal to allow nighttime activities at
Santa Anita until 1 :30 a.m" and letting 400-500 gamblers drive around the City at that
late hour, should be the Council's major concern, Mayor Kovacic referred Mr. Kocaya to
Chief Hinig for information on crime in that area.
John Mc Cawlev, 109 San Miguel Drive, stated in part, when nighttime events are
conducted at the race track the noise can he heard inside his home even when the
windows and doors are closed, In the past he tried to call the track and the Arcadia
Police with regard to the noise issue, but before anything could be resolved the event was
over. Mr. Mc Cawley would like to see that some quick action be taken for such things
that are bothersome to the people,
John MacDonnell, 155 E. Laurel Avenue, felt there are some unanswered questions with
regard to the cleaning of the race track after each race and nighttime activity; the noise
level projected from the Frontrunner Restaurant; and, Santa Anita's offer to provide free
parking, stating in part, that unless there is a patrol at the gates, people who are not
attending any of the race track events can park their vehicles in the race track parking lot
and just hang-out.
Tonv Henrich, 431 N, Altura Road, President, Lower Rancho Homeowners Association,
stated in part, that he thinks that Santa Anita is a great asset to Arcadia both historically,
architecturally and financially, He agreed with Councilmember Chandler that the main
concern is the noise from the crowd and not the little monitors, Mr. Henrich felt that the
race track wants to cooperate with the residents, He would like to know what is
considered an appropriate level of sound from early evening to late at night; the
enforcement that is going to take place and how well it will be monitored,

Mr. DeMarco, representing the Los Angeles Turf Club (LATC) , responded to the
comments and questions mentioned by the public and stated in part, that it seems that
the main concern the residents have is the proposed closing time, which is 1 :30 a,m, He
is willing to request, from race track authorities, a 10:00 p,m, cut off time, because in his
opinion, there would not be any major sporting events after 10:00 p.m,
In response to Councilmember Chandler's question with regard to an 11 :00 p.m. cut off
time, and if this will open LA TC's opportunities to run a profitable business in town, Mr,
Latta, General Manager, LA TC, stated that he personally.does not see any sporting
events running until 1 :30 a,m, However, he requested that Santa Anita have the
opportunity to ask for a special permit or a conditional approval, and be able to approach
City staff and the Council in order to get permission for any special events that would
need longer hours and would pass the 10:00 p,m, cut off time,' '.' -

It was MOVED by Councilmember Chandler, seconded by Mayor Pro tem Segal and
CARRIED to CLOSE the public hearing,
At 9:00 p,m. the City Council RECESSED and RECONVENED at 9:08 p.m,
With regard to concerns raised about late night crime, Arcadia Police Chief Hinig,
reported that crime statistics do not indicate any increase of activity around the race track
with patrons leaving the track late at night or during the periods that racing is active,

In response to City Manager Kelly's query, Chief Hinig explained in detail the steps that
the police department is taking in the event of noise complaints concerning the race
track, which included: giving notification to Chief of Security at the race track, and also
initialize a response from the police department with a sound meter to gage the level of
activity, Chief Hinig further noted, most of the readings the police department has taken

over the years have shown no violations over the allowable sound levels,
In response to Mayor Kovacic's comment regarding the question of due process for these I
entire proceedings, City Attorney Deitsch stated in part, that the notice of public hearing
was dated and mailed April 14, 2000, The notice clearly indicated the LA TC requests for
changes and additions to the zoning regulations, Mr. Deitsch pointed out that any
member of the public, by law, had an opportunity to review the agenda and the attached
staff report and correspondence in full. Finally, Mr. Deitsch noted that the Council has
the right to alter the provisions of any draft ordinance following the public hearing, to
consider written evidence submitted and testimony at the public hearing, In his opinion
the City has followed all the requirements of due process under law,
In the discussion Councilmember Chandler said, LATC should be allowed to expand their
business to include limited seating for 3,500 outdoors, However, he would like to see that
outdoor seating be operated under the City's terms and conditions which includes that no
loud entertainment and loud speakers be allowed. Mr. Chandler felt considering the race
track's wagering business 11 :00 p,m, is all-inclusive,
Mayor Pro tern Segal believes that Santa Anita is extremely important to the community,
As a method of compromise, he would like to see a 10:00 p,m, cut off time with a very
simplified notification process to request a little extension if they need to go beyond 10:00
p,m, Mr. Segal felt that it is important for the community to help support what is right for
the track,
Councilmember Marshall agreed with Mayor Pro tern Segal on the 10:00 p,m, cut off
time, and would like to put emphasize on a simple process if Santa Anita is going to need
an extension of the hours, She also felt comfortable in reviewing this issue in a year and
addressing complaints made by citizens, if any, to the events at Santa Anita,
Councilmember Chang agreed with the concerns expressed by tonight's speakers and
citizens with regard to the noise, traffic, parking and safety of the community, He would
like to limit the outdoor activities to 10:00 p,m; try this for one year, and take it under
consideration at the end of the year.

Mayor Kovacic felt that the Council has to assume a worse case scenario, Once Council
adopts these performance standards do we want to give the race track the ability to get a
variance from the performance standards or are we basically saying it's this or nothing,
F:rom his perspective it is not the track's fault, it is not staff's fault, it is just that Council is
embarking on an enterprise that is sort of new for the track and for the City, Mayor
Kovacic felt, as a result of adoption of Ordinance 2119, the track will have the opportunity
to have outdoor activities every night for up to 3,500 people until 10:00 p,m, The
question is are we prepared t.o do this on a nightly basis for people to watch a sporting
event; should we have a review period; should we have some kind of a special permit
process for events that will go beyond a certain period of time; what about enforcement;
when can trash be cleaned up; will the outdoor activities include only events that can be
shown on the big screen; should Council require free parking for everyone at night; and,
should we require no parking in the northerly parking lot during the racing season at night;
and once the performance standards are adopted do we give the track the ability to get a
variance from the standards; and is the Council prepared to allow these activities on a
nightly basis till 1 0:00 p,m,
The discussion concluded by the following motion, It was MOVED by Councilmember
Chandler to INTRODUCE ORDINANCE NO, 2119 entitled: "AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION I
9273,1,10.1 AND ADDING SECTIONS 9273,1,18 AND 9273,2,10 TO THE ARCADIA
MUNICIPAL CODE RELATING TO PERMITTED USES IN THE S-1 ZONE AND

ESTABLISH PERFORMANCE STANDARDS FOR CERTAIN NIGHTTIME ACTIVITIES";
and that the race track be allowed to operate their outdoor grandstand small TV sets until
10:00 p,m, seven days a week for one year at which time it will be reviewed for a
permanent ordinance of this type,
Councilmember Chandler noted he does not want special permits for every event. He felt
that is far too bureaucratic, The Council does not do that to other people who do
business in the City, If the track wants to come in for some special event that they think
is going beyond 10:00 p,m, that is fine if there is some simplified staff process that can be
worked out. Councilmember Chandler noted, if this matter is reviewed in one year he
would not like to keep on issuing one year permits every year after that.
City Attorney Deitsch suggested adding the following language to the first reading of
Ordinance No, 2119 for Council's consideration:
Arcadia Municipal Code Section 9273,1.10,1., add at the end of the section: "except
between the hours of 1 :30 a,m, and 8:00 a.m.; provided that such events are displayed by
telecast, telephone, satellite and/or cable feed, or similar transmission and are not events
conducted live at the race track". Mr. Deitsch also suggested adding/amending AMC
Section 9273.2.10 a, c, and d, to read as follows:

a, No persons, other than employees of the race track, shall be allowed in the
unenclosed areas of the grandstand and race track between the hours of 6:00 p,m,
and 8:00 a,m,; except that between 6:00 p,m, and 10:00 p,m" up to 3,500 patrons of
the race track may occupy the outside box seat, Club Court and Turf Club areas
existing at the race track as of May 2, 2000, in order to watch and listen to non-
amplified sound on individual televisions each having a screen of 9" or less located
at tables therein or to view the big screen monitor in the infield of the race track.
c, Windows in the enclosed restaurant located within the grandstand structure shall be
closed between the hours of 10:00 p,m, and 8:00 a,m,
d, The northerly parking lot shall not be utilized for patron parking, and a minimum of
300 spaces shall be provided at the perimeter of the race track parking lots free of
charge to patrons of the race track for events held after 6:00 p.m.
"Finally, adding Section 4, renumbering current proposed Section 4 to 5 which will deal
with the question of a one year sunset provision and it could read: "Section 1 of this
Ordinance shall remain in effect for a period of one (1) year following the effective date of
this Ordinance, at which time Section 1 of this Ordinance will terminate unless extended
by ordinance of the City of Arcadia following a noticed public hearing, "Then in order to
deal with non-conforming grandfathered uses, add the following language: In determining
that a one (1) year amorlization for the termination of the uses setforth in Section 1 of this
Ordinance is reasonable and appropriate, the City Council has taken into consideration
the following: that this amortization period is made known to all owners of property in the
S.1 Zone in advance of the adoption of this Ordinance, and that the owners of property in
the S-1 Zone will likely not, and will not be reasonably required to, expend significant
funds in installing permanent improvements solely for the purpose of pursuing the uses
set forth in Section 1 of this Ordinance, and which could not also be used for other uses
permitted in the S.1 Zone."

In the discussion Mayor Pro tem Segal felt in the event that the race track desires to
conduct an event an additional hour beyond 10:00 p,m,. the race track may submit a
. written application to the Development Services Director for approval. Council
concurred,

During discussion Council decided to not utilize the northerly parking lot for patron
parking and closing the windows in the enclosed restaurant located within the grandstand
structure between the hours of 6:00 p,m, and 8:00 a,m,

It was MOVED by Council member Chandler, seconded by Councilmember Chang and
CARRIED on roll call vote as follows to DIRECT the City Attomey to develop an
ordinance along the lines that had been discussed at the May 2, 2000 Regular Meeting
with appropriate conditions and restrictions,
Mayor Kovacic noted for the record that he is still concemed about the number of events
and also the timing of the events, He believes Santa Anita is a great neighbor, and a
great asset to Arcadia. He preferred a six month review period but is willing to go along
with the motion for a one (1) year review period, To the extent these activities have on
the neighborhood.., an increased impact on the neighborhood, he would be less inclined
to permit such activities to go beyond the one year test period,
Mayor Pro tem Segal stressed the fact that he is not sure it will take a year to make that
decision, If Council finds that the activities that occur do not fit in the spirit of those
anticipated by the Council, Council will be able to make the change long before a year.
The City Attomey clarified the motion, to bring back an ordinance that includes most of
the language, if not all of the language, which the City Attomey has read for the record;
plus the provision that deals with the application process for an event to take place past
10:00 p.m, but not past 11 :00 p.m, which would be considered and approved by either
the City Manager or his/her designee,
Mayor Kovacic noted that the public will have the opportunity to review the proposed
ordinance, Thursday, May 11, 2000.

AUDIENCE PARTICIPATION
Don Huahes, Chief Financial Officer, invited the City Council to attend the ground
breaking ceremony for construction of two twin office buildings at Santa Clara and
Second Avenue, on May 16, 2000 at 4:30 p,m, Mr. Hughes expressed appreciation on
behalf of the Hart, Mieras, Morris & Peale LLP and the Church of the Nazarene to the
City Planners and especially Mr. Pete Kinnahan and Mr. Don Penman for their
assistance,
Forrest Besocke, 416 N. Old Ranch Road, representing "Friends of Anoakia", a support
group to save the Anita Baldwin historic Anoakia mansion, urged all interested persons to
attend a hearing with regard to this matter which will be held May 10, 2000 at 9:30 a,m,.
Los Angeles County Superior Court, Department 86, 111 N, Hill Street, Los Angeles,
Kurt Tavlor, General Manager, Adelphia Communications, gave an update on the
progress of upgrading the system and noted the new programs, products and
communication plans, Mr. Taylor expressed appreciation to City staff for their
cooperation,
Lanv Hasbrouck, 2721 Caroline Way, appreciated the Council's effort last year trying to
address the massive home sizes in south Arcadia, He is concerned about all the I
apartment size homes developing in his area, Mr. Hasbrouck stated, in part, the way this
City is going, in 10 years we will have over crowded schools which is not what this

community needs,
Mayor Kovacic stated, in part, that the City adjusted the building requirements three
different times and there was some discussion with the past Council about the FAR and
that was not passed, He would like an up-to-date report on the current regulations on a
future agenda,

Council member Marshall offered a "saying" by Winston Churchill: "Never give in, never,
never, never, in nothing great or small, large or petty, never give in except to the
convictions of honor and good sense,
Councilmember Chang referred to a complaint expressed by a resident at the April 18,
2000 Council meeting, He thanked the Police Department staff and the Police Chief for
the time and effort they spent on this matter.
Mr. Chang noted that he attended a function by the Highland Oaks Designing Dads on
April 28, 2000, The Designing Dads of Highland Oaks School have raised funds through
various activities in the past. He commented on the enthusiasm and efforts of the
parents for making Highland Oaks School different.
Councilmember Chandler referred to a newspaper article with regard to the race track
workers and their life in the back stretch of the race track, He noted that Santa Anita
Park has agreed to improve some conditions that are under protest,
Mayor Kovacic thanked Westfield Shoppingtown for their donation of two custom-made
patrol saddles for the Arcadia Mounted Enforcement Team, The donation was presented
to the Arcadia Police Department by Mr. Terry Walton, Westfield Shoppingtown General
Manager, for the fine service they received from every officer in the department.

An Arcadia Mounted Enforcement Team member presented a statue of a Mounted officer
to Mr. Terry Walton on behalf of the A,M,E.T, for his generous donation.
The Mayor noted that on March 14, 2000 Ruth and Charles Gilb challenged the
community to help raise funds for the new museum by offering to match contributions by
giving two dollars for every one dollar donated up to a $100,000 through the end of May,
Since that challenge a total of $35,935.00 has been received by the Arcadia Historical
Society for the project, Mr, Kovacic thanked Charles and Ruth Gilb for their tremendous
support of the museum and urged everyone to make donations,

(formerly Steerburger Restaurant), In May 1996, the Arcadia Redevelopment Agency
Board approved the project, The applicant is now ready to proceed with the
improvements but must again receive Agency Board approval in accordance with ARA
Resolution 126 which states that Agency Board approval for a design review is only valid
for a period of one (1) year,
The new plans are similar to these approved in 1996. The applicant is proposing to make
substantial modifications to the existing structure, The building will be divided into 2,116
square feet of retail space on Huntington Drive and 2,361 square feet of dental office
space of which 1,366 square feet will be new construction located at the north end of the
existing building,

Patrick Malloy, Public Works Service Director, stated in part, that the Clean Water Act
(Act) is the primary authority for water pollution control programs, The National Pollution
Discharge Elimination System (NPDES) permit, along with state and local responsibilities,
are key provisions of the Act, Arcadia is a co-permittee under the NPDES permit issued
by the California Regional Quality Control Board (RWQCB) to Los Angeles County,

The existing NPDES stormwater permit was issued by the RWQCB in 1996 to Los
Angeles County as'the permittee and eighty.four cities as co-permittees, expiring on July
30, 2001, As part of the renewal requirements for another permit, the City must provide
the RWQCB a report indicating what actions it has taken to mitigate surface water
pollution and what further steps it plans to take in the future to address the situation, The
RWQCB recently emphasized strong concems about the adequacy of municipal
stormwater program enforcement after February storms washed hundreds of tons of trash
into Long Beach Harbor and beaches, The RWQCB has taken several aggressive and
potentially costly actions in the last two months to require municipalities to improve their
stormwater programs,
The contract with the John L. Hunter and Associates, Inc, (JLH) will allow the completion
of the implementation of the City's municipal stormwater NPDES program, allowing the
City to comply with permit requirements and continue providing Industrial Waste (IW)
program support, It will also include expanding the City's IW program enforcement
authority by developing a Sanitary Sewer and Industrial Waste Discharge Ordinance,
The proposed IW ordinance will be crafted to provide for cost recovery through inspection
fees, permit fees and plan checking fees for operation and administration of the annual
NPDES inspection programs,
Following the presentation staff responded to Council's questions, stated in part, that
John L. Hunter has successfully designed and administrated NPDES and Industrial Waste
Programs for several Los Angeles County municipalities,

the Longden Avenue project. It is anticipated that in one week the final paving should be
done and the project will be completed, Anyone with questions or concerns with regard to

Lorraine Spuck who passed away on April 22, 2000, Lorraine served on the Arcadia Senior Citizens
And Max Bengel) Commission, She was bom August 29, 1914, in Hartford, Michigan, After her marriage
to William H. Spuck, she settled in the Pasadena area where Bill accepted the position of
Executive Director of the Pasadena Chapter of the American Red Cross, Lorraine joined
Allstate Insurance Company in 1954 and worked there for twenty-two years, Lorraine and
Bill retired in 1976 and they enjoyed eight years of active retirement together until his
passing in 1984, Lorraine was a member of Lake Avenue Church in Pasadena for nearly

50 years, She recently served as a docent for the Pasadena Historical Society and was
active in the Arcadia Travelers, Arcadia Senior Friendship Club and the Voyagers Sunday
School Class, Her sons Dr. William H, Spuck 111, Dr. Dennis W, Spuck and their families
survive Lorraine,
"Our second Arcadia resident, and I would like to also adjoum tonight's meeting in
memory of Mr. Max Bengel. Max was a former City of Arcadia employee, who passed
away on April 10, 2000, Max started his career with Arcadia in December 1957, He was
a gardener in the Water Department after obtaining his Bachelor of Science Degree in
Omamental Horticulture from Cal Poly San Luis Obispo, he was promoted to the Public
Works foreman position in 1961 and to Park Superintendent in 1966,the position from
which he retired in 1988, Max leaves his wife, Sandy, his son Mike who spent several
years as a Reserve Police Officer for the City of Arcadia, two grandchildren and two
great-grandchildren, And I hope that the loving memories that these families have will
offer them some consolation in their loss."
