At 6:47 p,m, the City Council RECESSED and RECONVENED the Regular Meeting in
the Council Chambers at 7:07 p,m,
Mayor Kovacic extended congratulations on behalf of the Arcadia City Council to the
three young ladies from Arcadia who were selected to the Royal Court for the Pasadena
Toumament of Roses, Christina Farrell was selected as queen, and princesses Chaitali
Gala and Olivia Wilson, All three attended Hugo Reid Elementary School, Foothills
Middle School and Arcadia High School, they were selected out of 800 Pasadena area
young women who tried out for the court, The selections were based on public speaking
ability, academic achievement, community involvement and personality,
Mayor Kovacic read and presented proclamations to Christina Farrell, 1999 Pasadena
Toumament of Roses Queen, and princesses Chaitali Gala and Olivia Wilson,

OF ROSES incoming President, Ken Burrows, stating, in part, that Mr, & Mrs, Burrows have lived in

Mayor Kovacic congratulated Mr, Burrows for becoming President of the Toumament of
Roses Association, and expressed appreciation for inviting the Arcadia High School
marching band to participate in the Rose Parade in the year 2000,
Mayor Kovacic presented the January, 1999 Mayor's Senior Service Award to Arthur
Henke stating, in part, that for many years Arthur has been a valuable and active
volunteer in two City Departments, From 1988 to 1998 he worked for the Arcadia
Recreation Department as a Senior Citizen Services computer volunteer; each month he
updated the mailing list and printed the address labels for mailing the Connection
Newsletter to over 900 subscribers, Over the past ten years he donated over 1000
volunteer hours to the Senior Services Department. Since 1993 he also donated 1200
volunteer hours to the Arcadia Police Department as a pawn shop detail. Volunteerism -' ..
runs in Henke family, his wife is a 30 year volunteer at the Arcadia County Arboretum,
Mayor Kovacic congratulated Mr. Henke, staling that, 'volunteers are the glue that keeps
us together, without them we could not accomplish all of the things that we do in
Arcadia:
Mayor Kovacic presented the January, 1999 Mayor's Youth Service Award to Betsy
Burcham staling, in part, that Mrs, Burcham is an active member of the PTA at Camino
Grove Elementary School, serving as PTA president, treasurer, camival chairman and
book fair chairman, she has been in charge of the script program for the last three years
with the school share being approximately $12,000 a year.
Mayor Kovacic congratulated Ms, Burcham and thanked her for taking volunteerism
seriously, and her extensive involvement and interest in Arcadia Youth,

(INTRODUCED) Metricom is proposing to bring a new digital wireless data transfer network called
G "'_~I(l- ~ D "Ricochet' to southern California, This network, when installed in an area, allows the use
f of wireless computer modems to communicate with online services, networks and other
facilities accessible through telephone circuits, It functions as a standard telephone
modem, with the exception that it does not require a phone jack,
On December 15, 1998 the City Councit adopt Resolution No, 6094, setting a public
hearing for this date, for granting a non-exclusive Franchise to'Metricom Inc" for the
placement of radio transceivers on City-owned light poles in the public right-of-way,
Metricom deploys this service through a network of radios which transfer data and
information with radio transmissions, The system utilizes "pole-top" radios designed to
co-locate on street light and utility poles without the need for any power or cable runs,
Metricom proposes to pay the City of Arcadia $60 per pole per year, plus a 5% franchise
fee on gross receipts, as well as any applicable permit or inspection fees, The
agreement shall be for a five-year period with renewal every five years, based upon
staffs review and recommendation, Metricom has entered into an agreement with
Southem Califomia Edison (SCE) to install radios on SCE-owned poles,
Mayor Kovacic OPENED the Public Hearing, No one came forward to address the City
Council.
It was MOVED by Councilmember Harbicht, seconded by Mayor Pro tem Chandler and
CARRIED to CLOSE the public hearing,
City Attomey, Mike Miller, responded to Council's questions stating, in part, that
Metricom has agreed to change the language in the final agreement to allow the city to
have final say over the renewal of the franchise agreement.

CARRIED on roll call vote as follows that ORDINANCE NO, 2097 entitled: "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,

AUDIENCE PARTICIPATION
J, Gomez, representative, Los Angeles County Supervisor, Michael Antonovich,
presented two (2) commendations to the Mayor and City Council for Council's continuous
support of the Senior Festival, hosted by the Supervisor at Arcadia Park on August 21,
1998, and remembering veterans and their families on November 7,1998,

Dominao Delaatto, expressed appreciation and presented a plague to the City of Arcadia
Fire and Police Departments for their support and participation in the Senior Festival
hosted by Los Angeles County Supervisor, Michael Antonovich on August 21, 1998 at
the Los Angeles County Park,
Ph vilis Wilbum, President of the Arcadia High School PTA, stated in part that she was
present this evening with other supporters of the youth of Arcadia to inaugurate a new
program called "What Is Right With Arcadia's Kids." This program, designed by the ten
(10) PTA units in Arcadia, and supported by the Administration of the Arcadia Unified
School District, is a way to let the community know what great things are happening with
City children, There will be a representative from one of Arcadia's ten (10) public
schools at each City Council meeting to highlight the achievements and upcoming
activities of the student population in Arcadia,
MATTERS FROM ELECTED OFFICIALS
Council member Marshall wished all citizens of Arcadia, staff, and Councilmembers the
healthiest new year,
Ms, Marshall expressed congratulations to all the recipients of the Mayor's awards, and
thanked the Rose Queen and Princesses for representing Arcadia in the 1999
Toumament of Roses parade

Ms, Marshall encouraged the Council to direct staff to put the sound wall issue on a
future meeting agenda for discussion, Ms, Marshall noted this was an important issue, '
for certain areas during the campaign forums, Council concurred,
Ms, Marshall noted that there was a massive traffic jam on Baldwin Avenue during
Christmas week due to a contracted job on the street. Ms, Marshall was reassured that
this would not happen again and there will not be any street work during the holidays,
Ms, Marshall noted receiving a complaint from a library user regarding the Library being
closed on the Saturday after Christmas, Ms, Marshall would like to discuss that issue for
the 1999 holiday season, to possibly open the Library on Saturday after the holiday,
Councilmember Marshall's quote of the day: "The measure of success is not whether
you have a tough problem to deal with, but whether it is the same problem you had last
year: by John Foster Dulles, Secretary of State during President Eisenhower's
administration,
Councilmember Roncelli thanked Arcadia High School PTA president, Phyllis Wilburn,
for the infonnation,
Council member Roncelli mentioned some of the goals that he would like to accomplish
this coming year. which are; making the Citizen's Financial Advisory Committee

recommendations, policy; add another code enforcement officer; make sure that the City
is not paying for selVices that are unneeded or over priced; implementation of the Youth
Master Plan; looking forward to the wage and salary sUlVey; working strongly with the
new owner of Santa Anita Race Track, and, he would like to make the public realize that
the City Council is here to listen to their suggestions and to make Arcadia a better place
for people to live,
Mr, Roncelli noted the owner of the Foulger Ford site raised the price of the property
after council approved an "H overlay' for the site,
Council member Roncelli questioned the Fire Department overtime costs listed on the
monthly expenditure summary, He requested additional information about this matter,
The City Manager noted that expenditures do not always take into account offsets in
funds received,
HARBICHT Councilmember Harbicht noted the City Council made almost no cuts this year to
(Citiz's Financial balance the budget. The tough cuts were made the previous year, The first balanced
Advisory budget for the City of Arcadia in six years was passed on a three to two vote, Mr,
Comte,) Roncelli and Ms, Marshall voted against the budget. Mr, Harbicht thinks it is important
for people to understand some of the facts in evaluating some of the suggestions that
were made by Citizens Advisory Committee,

Mayor Kovacic announced the second annual State of the City Address has been
tentativelr, scheduled for February 10'., Also, the second Town Forum will be held on
March 30. ,
Mayor Kovacic reported his New Years resolutions, stating, in part, they are to shop
Arcadia whenever possible, the sales tax revenue is extremely important to the City; do
not look to the City to solve all your problems, pick up trash, report graffiti, help to keep
the City clean; Arcadia is a diverse community, meet your neighbors, plan street parties,
set up neighborhood watch programs; get involved, there are many opportunities for
civic involvement, there is a great need for volunteers, especially for the youth and
senior citizens; support and promote school and community events,
Mayor Kovacic conveyed his goals for the new year, stating in part, continue open
discussions about the City budget; aggressively pursue and review development
standards; continue the efforts of the Youth Master Plan Committee and seriously
consider their proposals when they come before the Council; continue to initiate and
sponsor community events such as the Town Forum, the tree lighting ceremony and
summer evening concerts; continue to improve City's managementllabor relationship;
pursue available methods to finance both a, new police station and community
auditorium; and, preselVe live horse racing and the quality of life in Arcadia,
In response to Council member Harbichl's comment Council member Marshall responded
that she and Mr, Roncelli voted no on the balanced budget because they want to spend
more time on the budget, to dig in deeper to see if the City can even do better with the
budget. That did not mean they were not pleased with the balanced budget.

The City Council and Redevelopment Agency Board on November 3 and December 1,
1998 directed staff to begin the formal redevelopment plan amendment process to
reauthorize the power of eminent domain for 12 years (January 1,1999 - December 31,
2010), A determination was made at that time to exempt certain residential properties
from the amendment process,
Pursuant to the City Council's direction, three community meetings for project area
residential owners and tenants, commercial owners and tenants, and community
organizations were held, The primary purpose of the meetings was to solicit interest
from area residents in participating on the Project Area Committee (PAC), as well as
provide information about the amendment process, Six individuals filed applications for
membership on the PAC, Three residential PAC positions are still available and can be
filled as applications are submitted and accepted by the PAC,

Consideration of the report and recommendation to award a professional services
agreement to Americlean Environmental Services Inc" in the amount of $25,095,00 to
develop and implement a citywide commerciallindustrial waste reduction program and
direct staff to collect $2,310,00 from the City's pennitted commercial waste haulers as
reimbursement for costs related to a disposal/diversion audit. '
The Califomia Integrated Waste management Act (AB 939) requires that all California
cities send 50 percent less waste to landfills by the year 2000 or face fines of up to
$10,000 per day, In the 1997 AB 939 Annual Report, the City reported to the Integrated
Waste Management Board (IWMB) that currently 35 percent of the City's waste is being
diverted, which is in compliance with the initial benchmark goal of 25 percent diversion
by 1995,
Nearly the entire City's reported diversion is the result of residential waste reduction
programs such as the commingled curbside and greenwaste recycling programs,
Disposal/Diversion reports for Calendar Year 1997 from the City's pennitted commercial
refuse h'aulers indicates that 18,519 tons of commercial waste was collected last year.
The reports further indicate that only 435 tons of this waste was diverted away from
landfills. This results in a commercial diversion rate of less than 2,5 percent for the City
of Arcadia,

The Arcadia Municipal Code (AMe) and the Commercial Refuse Collection Pennit
requires that by the end of calendar year 1997 all commercial pennittees were to be
diverting 30%, 40% by 1998, 45% by 1999 and 50% by year 2000, As of July 1998, all
the commercial pennit holders with the exception of Zakaroff Recycling were operating
in violation of their permits and the AMC (recent data indicates Zakaroff is now non- I
compliant also), In July, 1998, staff sent letters to the commercial haulers notifying them
of their status and indicating the City was initializing enforcement efforts to ensure
compliance with the AMC,

The January 5, 1999 staff report outlined objectives to be accomplished by the
consulting finn recommended by staff to receive the award of the proposed professional
services agreement.
Mr, Louis Ippolito, spokesman, Americlean Environmental Services Inc" stated, in part,
that this company has been providing recycling service for over nine years starting with
the City of Torrance, Costa Mesa, Newport Beach and about 13 other cities,
Following the discussion It was MOVED by Councilmember Harbicht, seconded by
Mayor Pro tem Chandler and CARRIED on roll call vote as follows to AWARD a
professional services agreement in the amount of $25,095,00 to Americlean
Environmental Services, Inc" to develop and implement a citywide

and City Clerk to EXECUTE a contract in a fonn approved by the City Attomey, and;

The Engineering Division received four proposals from consultants to prepare the City's
Transportation Master Plan and Impact Fee Program, As development occurs within the
City based on the General Plan, certain future projects will result in traffic volumes that
exceed the capacity of the existing citywide arterial system, Failure to expand the
capacity of the existing arterial system may cause unacceptable levels of congestion on
streets and intersections,
In respond to Council's question staff stated, when the Race Track proposal comes in a
separate traffic impact analysis would be done specifically for that project, The law is
very specific, cities are pennitted to implement impact fees that can be assessed or
charged to development projects specifically related to the impacts from said project,
there is also an analysis that could be done to detennine how much additional traffic
would be generated from a project, The proposed Fee Program is designed to generate
sufficient revenues to finance the needed improvements to facilitate better traffic
movement such as traffic signal upgrade and/or a street widening,
After a brief discussion it was MOVED by Councilmember Harbicht. seconded by Mayor
Pro tem Chandler and CARRIED on a roll call vote to AWARD professional services
agreement in the amount of $29,860 to Meyer, Mohaddes Associates, Inc" for the
development of a Transportation Master Plan and Impact Fee Program, and
AUTHORIZE the City Manager and City Clerk to EXECUTE the contract agreement in a
fonn approved by the City Attomey,

The Califomia Vehicle code in Section 40802(b) defines a speed trap as a section of
highway with a prima facie speed limit not justified by an engineering and traffic survey
conducted within the last five years and where enforcement involves the use of radar or
other electronic devices used to measure the speed of moving objects, Section 40802
declares that evidence obtained from the use of a speed trap is inadmissible in court in
prosecuting under the Code,

The current Engineering and Traffic Study, which was adopted by the City of Arcadia in
1993, will expire on February 19, 1999, This proposed Speed Zoning Survey establishes
recommended speed limits on portions of 34 City streets and is required for continued
radar enforcement. The traffic and engineering survey is defined in the Vehicle Code as
a survey of highway and traffic conditions in accordance with methods detennined by the
Department of Transportation (CAL TRANS) FOR USE BY State and local authorities,
The survey must include; prevailing speeds as detennined by traffic engineering
measurements; accident record; and, highway, traffic and roadside conditions not readily
apparent to the driveL The January 5, 1999 staff report setsforth speed limit
detenninations on 34 City streets and justifications for further reductions,
