OliO 0 ,It) INVOCATION PLEDGE OF ALLEGIANCE ROLL CALL: MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING March 16, 1999 The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday, March'16, 1999, at 6:00 p.m. in the Conference Room of the City Council Chambers. PRESENT: Councilmembers Chandler, Harbicht, Marshall, Roncelli and Kovacic ABSENT: None AUDIENCE PARTICIPATION None. CLOSED SESSIONS Pursuant to Govemment Code Section 54957.6 to discuss salaries, salary schedules and compensation of all represented and unrepresented employees for purposes of instructing the City's designated representatives, Human Resources Manager, Carol Przybycien, and City Manager, William Kelly. Pursuant to Govemment Code Section 54956.9(b) to confer with legal counsel regarding potential litigation by the Environmental Protection Agency (EPA) concerning the Casmalia Disposal Site and the EPA settlement offer as tendered to several hundred (de minimus) parties including the City of Arcadia. At 6:03 p.m. the City Council RECESSED to the Closed Session. The Regular Meeting RECONVENED at 7:08 p.m. in the Council Chambers. June D. MAYOR'S COMMUNITY SVC. AWARD (M/M Segal) Mayor Kovacic presented the March, 1999 Mayor's Community Service Award to Mickey and Lee Segal, stating, in part, that they are well-known in Arcadia for their involvement with numerous community causes. Mickey Segal has been active in youth baseball, the Arcadia Educational Foundation, the City of Arcadia Citizen's Financial Advisory Committee, the Youth Master Plan Steering Committee and many other organizations. Mrs. Segal's community participation also includes, the PTA President for Highland Oaks School, member of the Assistance League, Vice President of the PTA Council, member of the Methodist Hospital Auxiliary and Tower Power committee and member of the School Site Council at Highland Oaks and Foothills Middle School. Mr. and Mrs. Segal are active supporters of the Methodist Hospital. Even more impressive than the volume of activities and the countless hours Mr. & Mrs. Segal spend on these projects is their attitude and devotion to making things happen. Mayor Kovacic congratulated Mickey and Lee Segal and thanked them for every1hing they have done to make Arcadia a better place. I 4. MAYOR'S Mayor Kovacic presented the March, 1999 Business Recognition Award to Lee Shimmin BUSINESS stating, in part, that Lee Shimmin and his family have lived in Arcadia since 1976. Lee RECOGNITION started his career in Arcadia as a Department Sales Manager for J.C. Penney AWARD Department Store. In 1981 Lee changed careers and has been an exclusive agent for (Shimmin) Allstate Insurance Company since 1984. Lee believes that businesses need to support the local service clubs and city activities. Mr. Shimmin has been a member of the Arcadia Chamber of Commerce for fifteen years, he is the current vice president and will be elected president later this week. He strongly believes that the Chamber is and I should continue to be one of the driving forces behind maintaining Arcadia's high quality of life. Mr. Shimmin served on various committees for the Arcadia Unified School District, including the site committee and the Music Club. Mayor Kovacic congratulated Mr. Shimmin, for his commitment to public service and the City of Arcadia in particular. 5. MAYOR'S Mayor Kovacic presented the March, 1999 Employee Recognition Award to Jesus EMPLOYEE Romero, Arcadia Police Department custodian, stating, in part, that for five years Jesus RECOGNITION kept the police facility clean with the help of a police maintenance worker. Last year the AWARD police maintenance worker was laid off because of the budget problem and he has been (Romero) maintaining the police building by himself since that time. It should be noted that the pOlice facility operates twenty-four hours a day seven days a week. The building is over forty years old and requires constant cleaning and maintenance. In addition to Jesus' duties as custodian he also oversees the inmate worker program and was voted 1998 pOlice employee of the year. His hard work and dedication is also appreciated by the City Council. The Mayor noted that when high quality work is combined with a positive attitude and a commitment to service, the result is excellence and for that he thanked Mr. Romero very much. 6. HIGHLAND OAKS Janice Torrington, member of the Arcadia Beautiful Commission, presented an oveiview SCHOOL of the Arbor Day celebration activities at Highland Oaks Elementary School, which PLAQUE involved the participation and wonderful performance of students. (Arbor Day) Mayor Kovacic, Councilmember Roncelli and Ms. Torrington presented certificates to Highland Oaks Elementary School representative, Mr. Michael Simoniello, Principal, for 2 3/16/99 I I I I 7. 8. Prog.) 41:0065 hosting the Arbor Day celebration and also, the 1999 essay contest winners who wrote essays about the need for trees in our environment. Students receiving this award were: Lindsey Jahnke, Josh Chang, Kyle Jacobsen, Brittany Chew, Mitalee Khilnani, Amber Bogue, Ingrid Pierre, Andrew Shin and Nathan Shin. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS City Manager, Kelly, noted modifications to Agenda Item 12e. The title should read, 'Lease Agreement with Coordinate Construction Provisions"; and Section 3. changing a word from or to and; also Section 11. changing the personal injury requirement from three million dollars ($3,000,000) to two million dollars ($2,000,000). QUESTIONS FROM CITY COUNCIUREDEVELOPMENT AGENCY REGARDING AGENDA ITEMS None. It was MOVED by Mayor Pro tem Chandler, seconded by Councilmember Marshall and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED. AUDIENCE PARTICIPATION Susan Meikle, President of the First Avenue Middle School PTA. stated, in part, that she was present this evening to present the topic 'What's Right with Arcadia Kids'. Ms. Meikle stated, in part, that all three Arcadia middle schools are recognized as distinguished schools by the State of Califomia. Ms. Meikle highlighted some of the programs and activities at First Avenue Middle School, which included a 'Talent Show", an 'Orchestra Vertical Concert' and the First Avenue Open House. The First Avenue Middle School has provided, for nearty one hundred years, an environment in which to learn and grow as a whole person, making mistakes and leaming from them, having the opportunity to be successful in an atmosphere which is safe and filled with harmony. MADERS FROM ELECTED OFFICIALS Council member Marshall expressed congratulations to all the recipients of the Mayor's awards this evening. Councilmember Marshall's quote of the day: 'The appeaser is one who feeds the crocodile hoping it will eat him last", Winston Churchill. Councilmember Roncelli directed a remark to Councilmember Harbicht for a newspaper quote that stated 'Mr. Roncelli spends almost all of his time there, he practically lives at Santa Anita". Mr. Roncelli took exception to this and stated that he does have some interest in horses at the track, and he does spend some time there, but that it a long way from living there. Mr. Roncelli also noted that Mr. Harbicht's comments on Mr. Roncelli's vote regarding the balanced budget were in error. Councilmember Roncelli noted, he was displeased with the City Council vote of 3-2 for expansion of the Commercial Facade Rehabilitation Program. Mr. Roncelli commented, this program will cost the Redevelopment Agency almost $400,000 and in ,his opinion there are better places for the City to spend it's money. He is totally against this program. 3 3/16/99 41:0066 (Farmers Mkt.) In reference to the records of the Arcadia Business Association, the City Council approved an allocation of funds to the Farmers Market for promotion in the Downtown Area, Mr. Roncelli felt that it is the City's right to at least audit the Association's expenditures. I Councilmember Roncelli expressed appreciation to the Arcadia Beautiful Commission members for their information regarding Code Enforcement Officers. Mr. Roncelli noted that the City of Arcadia has one officer at this time. More are needed. He compared the neighboring cities, which are less in population but employ more than one Code Enforcement Officer. He would like to see the City add another Code Enforcement Officer position in the near future. Council member Roncelli noted, the City Council reorganization will take place at the April 20'h meeting, at which time the Council will decide on who will be the next Mayor and Mayor Pro tem. Mr. Roncelli invited citizens to attend this meeting. He stated, in part, that it is interesting to know that some of the current Councilmembers have already been Mayor. Mr. Harbicht has been Mayor twice and Mr. Chandler has been Mayor once. There are two members of the Council who have never been Mayor and both he and Councilmember Marshall received more votes than other members in the last election. Councilmember Roncelli further noted that he is unhappy with the fact that the Council did not implement the suggestions of the Citizen's Financial Advisory Committee. Mr. Roncelli felt if the City would like to make some real policy changes, it would have to cut back on redevelopment and in particular, not expand the redevelopment project area to south Arcadia, which will cost a lot of money and create a loss of revenue to the City. Operating a Redevelopment Agency itself is very expensive. These funds could be used I for other programs such as the Youth Master Plan, street sweeping and raises for City employees. Mr. Roncelli urged Arcadia citizens to get involved and run for election to the City Council in April, 2000... and change the Council's vote on redevelopment projects. HARBICHT COuncilmember Harbicht referenced a letter from Mr. Kenneth Yee commending City employees Bob Santana and Randy Diez. 'It is always great and far too rare to see good processes and good people working jointty, and to see it in our government agencies gives all us citizens reason to rejoice'. This, in reference to a water problem at Mr. Yee's home. Mayor Kovacic invited everyone to attend the second Town Forum, which will be held on Tuesday, March 30'h, at 7:00 p.m., to discuss the subject of cultural diversity as it relates to Arcadia. The following people will be on the panel: Martin Plourde, Arcadia High School Principal: Derek Epps and Erik Tong,' Arcadia High School students; David Cheung and Palavi Gala, Community Volunteers;' Ed Huang, City Planning Commissioner; Eileen Hubbard, Community Volunteer of the Year and also Senior Citizens Commissioner; John McClain, School Board Member; Roberta White, City of Arcadia Assistant Recreation Director; and Judge Patrick Hegarty. (Mayor's Prayer Mayor Kovacic invited Arcadians to attend the 25'h Annual Mayor's Prayer Breakfast, Breakfast) which will be held on Friday April 2, 7:00 a.m., at the Arboretum. () 1) :}(.) ~b 9 RECRUIT AND Councilmember Harbicht suggested giving staff blanket authorization to fill previously FILL POSITION authorized positions of Firefighter and Police officer as expeditiously as possible. (Firefighter) Waiting for the City Council's approval and using regular staff on overtime until the (APPROVED) vacant position is filled costs the City money. By consensus Council agreed to place this issue on a future agenda. In response to Council's question, staff stated, when a position becomes vacant it regularly takes one month to obtain Council authorization to fill the position. It was MOVED by Council member Harbicht, seconded by Mayor Pro tem Chandler and CARRIED on roll call vote as follows to AUTHORIZE staff to fill the position of Firefighter in the Fire Department. Califomia in 1954 and has been actively involved in the history of Arcadia since that I & Construction) time. City Manager Kelly presented an update on the 'potential development of a new police CITY IMPRVMT. station and modifications to Fire Station No.1, as well as certain Civic Center PROJECT improvements. The deficiencies of the current police station are well known and (Police Station, thoroughly documented to the extent that there is little question that a new facility is Fire Station #1, needed. The initial step in the process is to conduct a Needs Assessment. Once the Civic Center) space needs for the Police Department are identified, a preliminary budget estimate can (NO ACTION) be established. The March 16, 1999 staff report included a flow chart which provided information in regard to schedule, addressing the timeframe for development of a new station, and provided a general review of the process to project completion. As the Police facility project moves forward, the City will have to address the entire Civic I Center relative to architectural compatibility and site planning for parking, circulation and landscaping. 6 3/16/99 I I I 41 :0069 Since Fire Station No. 1 is proposed for some renovation, staff would include the analysis of what is required for that renovation in the Needs Assessment at the same time as the Police facility. The fire station assessment will encompass an analysis of the cost to bring the facility up to current seismic code, as well as other necessary renovations. It is difficult to determine at this time the cost to conduct the Needs Assessment for the Police Station and Fire Station NO.1. Fire and police facilities are considered essential facilities by the State and as such must meet the highest standards to withstand these types of events. New essential .facilities constructed today must be designed at 1.5 times the typical building code standard for structural integrity. Staff suggested the City Council appoint a citizen's committee in the near future to work with the Council and staff on these projects. Staff will present a recommendation to the Council at the first meeting in May for the selection of a consultant to perform a Needs Assessment. ' 13b. t~f ; 1,) RESOLUTION Consideration of the report and recommendation to adopt Resolution No. 6105, NO. 6105 amending Resolution No. 5269 and various sections of the Arcadia Senior Citizens (Senior Citizens' Commission By-Laws. Comsn. By-Laws) (ADOPTED) The amendments to the By-Laws will affect the procedure for nominating members to the Commission by including persons from the Senior Men's Club and the Arcadia Travelers Club. Amendments will increase membership of the Commission from seven (7) to eight (8). First, Marguerite Towsley, stating, "Earl and Marguerite Towsley were residents of Arcadia for many years and if we go back aways Marguerite was very active in the PTA, Assistants League and any number of other things in our City. Also we had another tragic loss in our community, Judie Draper past away on Saturday. Judie and her husband Chartie were very active in our community for many years and we regret her passing.'
