The City Council met in a Regular Meeting on Tuesday, June 1, 1999. at 7:00 p,m. in
the City Hall Council Chambers following a reception hosted by the Arcadia Beautiful
Commission for recipients of the 1999 Arcadia Beautiful Awards.

Arcadia Beautiful Awards Chairperson Denne congratulated and thanked the recipients
of the awards.
Mayor Chandler and Mr. Rod Salazar. American Youth Soccer Organization, introduced
and presented certificates to members of two League Soccer Teams.
Mayor Chandler announced a plaque to be presented for distinguished service to
outgoing Senior Citizens' Commission Member, Jayne Bellin. who was unable to
attend tonight's meeting ,

CARRIED that ordinances and resolutions be read by title only and that the reading in
full be WAIVED.
PUBLIC HEARING
Consideration of an appeal filed by Edward Huang of the Planing Commission's denial
of Modification MP 99-007 for a proposed two-story single-family, 5,200 square foot
house at 1327 S. Eighth Avenue.
The applicant proposed to develop the site with an "ECO-HOME" that is energy smart
and ecologically friendly. The proposed design of the house and landscaping
incorporates numerous "sustainable" or "green" development innovations. The proposal
focuses on an atrium, the "Central Court" that is around an existing Chinaberry tree. and
a driveway courtyard. the "Oak Court" around a mature oak tree on the north side of the
property. The Planning Commission, based on a pos'tive evaluation by a certified
arborist, approved an Oak Tree Encroachment Permit.

The Arcadia Municipal Code provides the authority to approve or conditionally approve
Modifications only to secure an appropriate improvement, prevent unreasonable
hardship and/or promote uniformity of development. The Development Services
Department had sign,ficant concerns about the substantial nature of the requested
modifications for a new house. The front yard encroachments would create a I
significant visual impact on the streetscape and would be incompatible with the other
properties in the neighborhood,

Based upon the required findings, as set forth in the June 1, 1999 staff report, staff
recommended denial of the modifications requested. with the exception of the garden
wall which would be set back from the front property line.
Mayor Chandler OPENED the Public Hearing.
Edward Huanq, 69 West Naomi Avenue. the appellant, stated, in part, that a valuable
property always comes with a decent front yard, There is no need to apply for a
modification to reduce the required front and side yard setbacks unless there are
compelling reasons. The compelling reasons for this eco-home proposal are to
preserve three existing mature trees; development of a responsive design with site
specific assets; and creation of an oak-based "Central Cooler" to facilitate the function
of natural cooling mechanisms. Mr, Huang noted when this project is completed, the
door to his house will be open to anyone who is interested in tree preservation. green
building and in sustainable development. Mr. Huang submitted and displayed exhibits
of a revised modified proposal which showed a reduction to all originally requested
setback encroachments and explained in detail the changes to the original proposal.
It was MOVED by Councilmember Kovacic. seconded by Council member Roncelli and
CARRIED to CLOSE the Public Hearing.
Councilmember Roncelli appreciated the work being done by Mr. Huang in preserving
trees and energy, He felt this could possibly be the beginning of a lot of similar houses
built in Arcadia, Mr. Roncelli is in favor of the proposed modification.

Mayor Pro tem Harbicht commented that he applauds Mr. Huang's objectives and what
he is trying to accomplish, but what is being asked are significant variances of the
Municipal Code requirements. Mr. Harbicht stated, in part, that this project revolves
around one Chinaberry tree. In order to preserve a tree the building has been pushed
all the way to the front of the property and out to the sides. He felt taking the tree out
and planting a new one accomplishes everything the owner wants to accomplish and
does it within the City's Municipal Code requirements without encroaching on the front
yard setback or southerly and northerly yard setbacks.
Councilmember Kovacic stated. in part, that he is very impressed with Mr. Huang's
concern of the ecological nature of Arcadia's property. He felt that the Council is being
asked to tweak the codes too much in order to accommodate one Chinaberry tree.
Council member Marshall also applauded Mr. Huang for his hard work and wonderful
project. Ms. Marshall agreed with Councilmember Kovacic,
Mayor Chandler stated, in part, that Mr. Huang himself stated if it were not for the fact
that this home proposes a merit of ecological components which could be on the
cutting edge of perhaps new home building, he would probably vote no himself. The
Mayor felt this is essentially setting aside and overruling the building codes in eight
instances in favor of an ecological issue which in this case is one tree.
It was MOVED by Mayor Pro tem Harbicht, seconded by Councilmember Kovacic and
CARRIED on roll call vote as follows to DENY the applicant's appeal of the Planning
Commission's Denial of Modification No. MP 99-007 for a proposed two-story single-
family residence at 1327 South Eighth Avenue.

Consideration of the report and recommendation to approve Zone Change 99-001.
This zone change was initiated by Daryl Christian on behalf of American Stores
Properties, Inc., for a zone change from C-l (Limited Commercial) and PR-l (Single-
Family Residential with a parking overlay) to C-Z (General Commercial) for the property
at 188 West Las Tunas Drive, currently a vacant bowling alley,

The Planning Commission at its April z7'" meeting, by a majority vote, voted to
recommend approval of this zone change.
Currently the westerly 60 feet of the subject property is zoned PR-l; the remainder of
the property is zoned C-l (Limited Commercial). The PR-l is a parking overlay on a
residential zone. The parking overlay allows "open air temporary parking of transient
automobiles", In addition. the site could be developed per the underlying zone. i.e. R-l
single-family if it met all zoning requirements.
The Z.7acre site has frontage on Las Tunas Drive, Live Oak Avenue and EI Monte
Avenue. Property to the east is developed with commerciai uses (Marketowne) and'
zoned C-Z. Properties to the south are developed with mixed commercial and light
industrial and an electrical sub-station and zoned C-M (Commercial-OManufacturing)
and C-Z. Property to the north across Las Tunas Drive and the west, across EI Monte
Avenue are zoned R-l and developed with single-family residences.
On April 13, the Planning Commission approved Conditional Use permit 99-006 for a
15. 5Z0 sq. ft. Sav-On Drug Store with a drive-through pharmacy at this location.
The June 1, 1999 staff report noted that it is the Development Services Department's
opinion that the requested zone change is appropriate for this site and that there are I
adequate provisions in the C-Z zoning regulations to ensure minimal impact on
adjoining residential properties,
Following the staff report, staff responded to Council's questions regarding the proposed
zone change. Council member Kovacic questioned the design review process in respect
to drive-through and fast food restaurants.
Mayor Chandler OPENED the Public Hearing,
Darvl Christian, 18Z0 E, First Street, Santa Ana. representing the American stores
Properties, Inc, stated, in part, that the main reason for the requested zone change is
for future development of this site. His company is in negotiations with the property
owners to the east to possibly purchase their property, in doing so that would allow both
properties to be zoned C-Z. Also, it is consistent with the general plan and American
stores would like to have more flexibility for any other type of uses.
Mr. Christian responded to Council's questions regarding a drive-through fast food
restaurant, stating, in part, that the site plan was designed by taking into consideration a
fast food restaurant at the northeast corner of the property, However, that is not part of
the application at this time.
It was MOVED by Mayor Pro tem Harbicht, seconded by Councilmember Marshall and
CARRIED to CLOSE the Public Hearing.
In the discussion Mayor Pro tem Harbicht noted this would be an upgrade for the
subject area. The City Council's concerns for a long time has been Live Oak Avenue I
and he felt this could be a start to revitalizing that area. He is in favor of the zone
change.

Jenny Tsouvales, 300 West Wistaria Avenue, President, Baldwin Stocker Elementary
School PTA. introduced Baldwin Stocker Principal Mr. John Pisula and some of the
talented students of Baldwin Stocker Elementary School. Ms. Tsouvales expressed
appreciation to the City Council for considering and discussing a Youth Coordinator
position in next year's budget.
MATTERS FROM ELECTED OFFICIALS
Councilmember Marshall hoped everyone enjoyed the Memorial Day weekend, and
took time to reflect on the lives past and present who have protected the freedoms our
country is blessed to enjoy,
Ms. Marshall congratulated the Arcadia Beautiful Award recipients and thanked the
Arcadia Beautiful Commission for their outstanding reception which was held earlier this
evening.
Councilmember Marshall congratulated the Holly Avenue School for becoming a "Blue
Ribbon School". Two of Arcadia's Schools were chosen to be Blue Ribbon Schools
among 243 schools in the United States.
MARSHALL Council member Marshall shared a "gem of the day" written by, Thomas Paine in 1783.

Councilmember Kovacic announced that the Library Board adopted an Internet policy at
their last meeting. The Internet station in the Children's Room is filtered. The Internet
work stations for adult are not filtered. Library requires that everyone using the Internet
be registered for a library card and sign an Internet Users Agreement form.
Mr. Kovacic read a speech by Sgt. Ed, Bacon, Retired, United Stated Army entitled:
"Ode to the American Flag" about Flag Day which will take place on June 14.
Mayor Chandler noted that both he and Mrs, Marshall represented the City of Arcadia at
Memorial Day services held at Live Oak Cemetery.

RESIDENTIAL Consideration of the report and recommendation regarding adjustments to service rates

and/or changes in landfill disposal costs.
In a letter from the Los Angeles County Sanitation District dated March 25, 1999. City
staff was informed that solid waste disposal rates at Puente Hills, Spadra and other
regional landfills would be increased by $1.10 a ton for refuse with no increase for
sorted green waste, The notification indicated that the rates will become effective July
1,1999,
Newco's request indicated that the indexed adjustment representing the change in the
landfill disposal rates is .92% for single family and 1.4% for multi-family residential
service, The landfill adjustment has a slightly greater impact on multi-family service vs.
single-family service due to the fact that green waste is not segregated at multi-family
residences. .The combined impact of these adjustments on a typical single-family
household with standard 90-gallon collection service will be an adjustm~nt of 2.64%,
bringing the standard monthly service rate to $11.06, Standard bin service (3-Yard bin
one a week) for multi-family residences will be adjusted by 3,12%, bringing the standard
monthly service rate to $68.05.

WATER RATE Pat Malloy. Pubic Works Director, presented the staff report and recommendation
ADJUSTMENT regarding a Proposed Water Rate Adjustment., and displayed photographs of day to

Hearing)
Based upon the Public Works Services Department proposed 1999-00 budget and the
Water Master Plan, it is recommended that the City Council consider adjusting the
water rate by 2,2%, from $1.07 to $1,09 per 100 cubic feet. The Department also
recommended a 10% adjustment in the bimonthly service charge. With the proposed
Capital Improvement Plan for the next two years resulting in capital expenditures of
$3,891,260 in 1999-00 and $4,925,622 in 2000-01, it is necessary to adjust the water
rate by 2,2% in order to continue transferring funds from the Operating Fund to the
Facilities Replacement Fund. As shown in a staff survey, Arcadia's new average
bimonthly water bill would be $73,52 as compared to the current average bill of $71.34
(an annual increase of $13.08).
The June 1, 1999 staff report explained in detail the 1999-00 Water fund Budget with
and without a water rate adjustment, the revenue and operating expenditures for 1999-
00, and a survey of the water rates of eight neighboring water agencies.
Council ember Roncelli commented that people do not realize how important water and
sewers are until they start travelling. Mr. Roncelli noted that he has been in 25
countries in the last fourteen months, and at least half of those countries had water that
was undrinkable,
Councilmember Harbicht commented that about two and half years ago the City
adopted a Water Master Plan which would guarantee the operation and maintenance of
a reliable water system. At the end of the 20 year plan the City's water system will be in
better shape than it is today, He felt that this has been a very responsible approach,
and it is one of the few times that the C,ty took a real long range view of plans.

SEWER SVC. The Sewer Master Plan was approved by the City Council on May 5, 1998, a
CHARGE comprehensive report outlining a long range program of capital improvements and
ORDINANCE preventative maintenance measures to upgrade and maintain the City's sewer system.

review and adjustment of rates if necessary. Ordinance No, 2086 called for a July to
July Consumer Price Index (CPI) adjustment. Staff recommended this be changed by
Ordinance No, 2107 to a March to March index in order to facilitate the implementation I
of the sewer rate adjustment for July 1. .
In order to fund the Capital Improvement Program and future projects as outlined in the
Sewer Master Plan, staff recommended that the City Council approve a 2.2% sewer
rate adjustment based upon the March Consumer Price Index (CPI). This would raise
the sewer rates from the existing $2,00 to $2,04 per month per connected residential
property and from $6.00 to $6,13 per month per connected business property. The
proposed Capital Improvement Program for the next two years will result in capital
expenditures of $276,700 in 1999-00 and $263,000 in 2000-01. The long-range Master
Plan proposes over $3,8 million in future capital projects.

Deputy City ManagerlDevelopment Services Director Don Penman presented the staff
report and recommendation to adopt Resolution No. 6111, entitled: "A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING A POLICY
THAT PROJECTS IN PLAN CHECK PRIOR TO THE EFFECTIVE DATE OF NEW
CODE REVISIONS MAY BE CONSTRUCTED CONSISTENT WITH THE CODE
REQUIREMENTS IN EFFECT AT THE TIME OF PLAN CHECK:

Mr, Penman stated, in part, that in the past when the City has undergone revisions to
the zoning, building, safety and fire code regulations, the policy of the Development
Services Department has been to allow property owners and developers to submit plans
for plan check under the existing regulations until such time as the new regulations
became effective,
There are several reasons the City has practiced this policy including: 1- plans for
remodels and new dwellings can cost from 10% to 15% of the construction cost; 2-
unless a moratorium is placed on development. there is no way of advising persons
what standards to utilize when designing a project (either a remodel or new dwelling);
and, 3- persons with plans in plan check may be unable to get through the plan check
process and secure a building permit prior to the effective date of a new ordinance.
The City Attorney researched the issue of "Vested Rights" and case law in order to
formally address this matter. Vested rights doctrine states that "if a property owner has
performed substantial work and incurred substantial liabilities in good faith reliance
upon a permit issued by the government agency, a vested right is acquired to complete
construction in accordance with the terms of the permit".
The June 1. 1999 staff report set forth the Development Services Department specific I
guidelines for plan check review. The Building Services will not accept plans for plan

check which are incomplete. Persons must secure a building permit within 180 days
from the date an application for plan check is submitted to the City. The Building Code
allows the Building Official upon good cause to grant a 180 day extension of this time
period. The Development SeNices Department recommended in order to avoid
prolonged delays by the applicant for projects pending under regulations that have been
supplanted. no time extensions be granted on either plan checks or building permits
when new regulations are in effect at the time of the request for an extension.
In response to Councilmember Kovacic's inquiry regarding the definition of "plan
check". staff responded that plan check is the actual form of process in the Building
Department of the Community Development Division. where formal plans are submitted
for Plan Check Engineer review.
In response to Council's concern in regard to developers rushing to file plans in order to
not comply with the new regulations staff indicated that the City did not experience any
rush when it went through the mantionization process few years ago.
Councilmember Harbicht is in favor of having a waiting period before the adoption of

PROF, SVC, At its May 18,1999 meeting. the City Council was presented with a recommendation to
AGREEMENT execute a Professional Services Agreement with R & D Transportation SeNices LLC, to
(R & D provide operations and maintenance of the Arcadia Transit System over a five (5) year

received for the operations and maintenance of the Arcadia Transit System.
The June 1. 1999 staff report detailed the objective of presenting each offeror's
experience, facility location, proposed equipment and financial information on a
quantitative basis. Staff has also included in the matrix the findings on reference
checks. The City Council is the finai decision-maker with regard to weighing the factors
set forth in the evaluation process and in the selection of the contractor,
Mayor Chandler announced the Council will now allow time for a representative of each
firm who wished to address the City Council on the Arcadia Transit issue,

Scott Schaffer, San Gabriel Transit, IOtroduced the project team, Mr. Schaffer stated,
in part, that the real focus is the evaluation process and criteria, City Staff prepared a
matrix by breaking down the experience into three (3) different categories. He fell his

categories, after running the program for 24 years and running it well. San Gabriel
Transit is now running on a 98% on-time window. Mr, Schaffer also stated, in part that
he really believes San Gabriel Transit can put the best program on the street and I
continue to provide the best service,
Duke Perrin, explained in detail the operation of Access Services which are the ADA
mandated services throughout the Los Angeles and San Gabriel Valley.
Esther Robles, Driver. R & D Transportation, spoke in favor of granting the contract to
R & D Transportation Services,
Dave Dalev, General Manager, R & D Transportation Services, stated, in part, that the
company is prepared to work with City staff to develop specific performance objectives
for reservation reliability, improvements in waiting time, improvements in equipment
maintenance and in safety,
Richard Dootson, 53 Woodland Lane, Bradbury, stated. in part, that his company was
the only bidder who has a location in the City of Arcadia. He felt that his company has
very good management and the scoring on the staff's matrix was unfair, Mr, Dootson
noted, by choosing his company, they will show the City a very good product and also,
will save the City and taxpayers in excess of $30,000,
Dan Bartz, representing ATCNancom, presented a brief background of ATC which is a
family owned corporation from Chicago with 74 years experience in transit business,
Mr. Jerry Walker presented a personal view of the history of the San Gabriel Transit
Dial-a-ride service to the City Clerk and City Council for archive purposes,
Mr. Schaffer, San Gabriel Transit representative, responded in detail to Council member
Kovacic's inquiry regarding some of the problem areas with San Gabriel Transit over
the past year which was mentioned in the June 1, 1999 staff report and are still
unresolved, such as number of accidents, State gasoline tax rebate and Federal Transit
audits,

In the ensuing discussion staff responded to Council's question that the R & D
Transportation, has more management experience in providing public transportation.
Further, as part of the RFP process, applicants were requested to provide a separate
section on Compressed Natural Gas experience and cost proposal impacts. R & D
Transportation received an "Excellent" reference rating,
Mayor Pro tem Harbicht commented that after listening to all the testimonies, he
believes that the City went through a very fair process, The evaluation panel conducted
interviews of the four most qualified firms, during the interviews each firm was asked
the same questions. Based on the preliminary evaluation and interviews the evaluation
panel selected R & D Transportation Services, Mr. Harbicht is in favor of granting the
professional service contract to R & D Transportation to operate the Arcadia Transit
system.
Councilmember Marshall suggested that the City Council postpone voting on the
Arcadia Transit system issue for two more weeks. She felt the best way to find out
about the R & D dial-a-ride service is to go directly to the people who utilize this service
and find out what their complaints are or if they are happy with the service,
Councilmember Kovacic stated, in part, that staff went through what was a I
combination of subjective and an objective review of the four major bidders and came
up with a preference. He felt the process was very educational for both the citizens
