on Tuesday, July 20. 1999. at 7:00 p,m. in the City Hall Council Chambers.

(Revisions-R-1 ard 004, proposed revisions to the R-1 and R-O zoning regulations. The text amendment
R-OZonin;J Reg,) was initiated by the Development Services Department at the direction of the City
0f'PROVED) Council to address revisions to the Arcadia Municipal Code relating to the scale,
mass and bulk of residential dwellings,
The Planning Commission at its June 8, 1999 meeting recommended approval of
Text Amendment 99-004 subject to specific changes outlined in July 20, 1999 staff
report,
In the late 1980's the City began to experience what would soon be coined
"mansionization" in the single-family zoned areas. Dwelling were constructed which
were significantly larger and more massive than the traditional ranch-style homes
that were the predominant architectural style throughout the City. As a result the I
City, in an attempt to address these issues initiated text changes to reduce the scale
and massiveness of the dwellings being constructed. including overall allowable
building height, increasing the setback requirements and including a lot coverage
requirement in the code,
Although these regulations have been effective in increasing the setbacks and
lowering the building heights, the regulations proposed in text amendment 99-004
are another attempt at reducing the mass and scale of Single-family dwellings. In
addition, the proposed regulations incorporate all sections of the code relating to
single-family zones, providing a complete package of regulations that address all
residential requirements,
Following the presentation Mayor Chandler OPENED the public hearing.
Kenneth Schmidt, 534 Workman Avenue, stated in part that he was in receipt of a
recent flyer produced by the Arcadia Association of Realtors which opposed the
proposed regulations under consideration. He questioned the number of realtors in
the Association who actually live in Arcadia, Mr. Schmidt mentioned the newer
"monstrous" homes constructed adjacent to his property and the beautiful old trees
that were torn down, and flower beds which were cemented over. He believes the
Arcadia Board of Realtors is trying to frighten Arcadians by intimating that
homeowners might lose money if tighter zoning laws are approved. Mr. Schmidt
believes the new zoning would enhance property values, along with Arcadia schools
and fine neighborhoods and add to the quality of life.
Terry Earll, President of the Arcadia Association of Realtors, stated in part, a large I
percentage of Arcadia realtors have always been for the preservation of private
property rights, protecting property values and controlling govemment regulation on

private property, The Association agrees with most of the recommendations of the
Planning Commission, Mr. Earll pointed out the Planning Commission
recommendations to which the Association is opposed, and noted changes the
Association would prefer, On behalf of the Board, Mr, Earll said, overall the
Association wished to continue with the 1991 R-O and R-1 regulations. In the opinion
of the board, the proposed new regulations would result in an immediate reduction in
property values in many cases, and would cause almost all properlies in the City to
become non-conforming,
RalDh Bicker, 101 White Oak Drive, member of the Highland Oaks Home Owners
Association, Chairman, Architectural Review Board (ARB). reported the Highland
Oaks HOA Board supports staffs original recommendations regarding 50% Floor
Area Ratio (FAR) and other newly proposed regulations, The Board believes the
new regulations would help the ARB maintain reasonable compatibility with the areas
architecture,

Gordon Maddock, 45 Christina Street, Arcadia realtor, stated in part, the Arcadia
Board of Realtors reviewed the new regulations proposed by staff and the Planning
Commission and agreed with all but five out of twenty-seven proposals, The
Association's greatest concerns are the Floor Area Ratio (FAR) and the increase in
rear yard setbacks, These proposals would drastically reduce the buildable area of a
lot, the value of a residential lot in Arcadia would probably drop 20-40%, according
to Mr. Maddock, It is his belief if these regulations are adopted it would throw 10,000
Arcadia homes into non-conforming status, and impact those homeowners who
purchased such property with the intention of adding additional space to their hDme,
Such owners would have to go before the City's Modification Committee for a
modification, Mr. Maddock questioned the modification process and the guidelines
the Committee might apply to its decision making process,
Mark Dmvtrow, 2506 Greenfield Avenue, realtor, commented that he agrees with the
majority of the Planning Commission recommendations regarding the proposed
regulations, However, in his opinion, the size of a home based on square footage
does not necessarily dictate whether or not a home will look offensive. Architectural
style and geometric makeup has a greater impact on overall appearance.
Controlling setbacks and angle projections can accomplish more and address overall
size of appearance. Mr. Dmytrow suggested the FAR be eliminated. He would also
like to see the garage limitations changed to a 60% front footage and the garage
linear footage at 40% for lots with 75 feet of frontage to allow for three garage
spaces. Mr. Dmytrow was also in favor of new regulations that would require the
addition of mature trees to new home construction sites.
Larry Hasbrouck, 2721 Caroline Way, noted that he agrees with the proposed
changes to the R-O and R-1 zoning regulations, It is his opinion that the new larger
homes being built are basically very ugly. And it is not true that real estate values
will decline if new regulations are imposed, It is projected that Los Angeles County
will have tremendous growth in the future. People want to locate in Arcadia because
the schools are safe and Arcadia is a nice piace to live, The building of the large
homes in his area has created a "serf and lord of the manor" atmosphere which he
does not like.

Tonv Henrich, 431 North Altura Road, Past President of the Rancho Santa Anita
Residents Homeowners Association, stated in part, that the issue before the Council
is the quality and preservation of homes and neighborhoods. Arcadia has always
been a community of beautiful homes and the Village and Lower Rancho HOA's
want to keep it that way, The voice and opinions of the home owners is represented
by a petition signed by 600 residents in these areas, He believes the Homeowners

Associations and ARB's have helped preserve the beauty and harmony of
neighborhoods in these two areas, The zoning changes under consideration will help I
ensure that the expected growth in his area will in fact, be harmonious and help
preserve home values, Mr. Henrich noted that neighboring cities have adopted
similar regulations, some of which are considerably more stringent in some areas
than those proposed for Arcadia, including lower encroachment levels and caps on
square footage of houses. The Village and Lower Rancho Associations strongly
support the Planning Department's recommendations for the FAR, moreover, they
request an additional FAR limitation of 35% which could be specific to these two
HOA's,
Laurie Thompson, 229 Altura Road. Chairperson, Village Association, ARB,
explained in detail the guidelines the ARB must address when considering a
proposed project within its area, Mrs. Thompson advised the Village Association
retained a certified real estate appraiser to perform an analysis of existing homes
within the Village area which she distributed to the Council for review. She noted the
average FAR in the Village area is 19% without a garage and 24% with a garage,
Further, statistics were presented of home size, to lot size, noting that 90% of the
Village homes fall below 40% FAR and almost 95% below a 35% FAR.
Dolores Folev, 320 Cambridge Drive, Vice-President of the Rancho Santa Anita
Residents Association, stated in part that Arcadia should maintain reasonable parity
with surrounding cities with regard to building standards and not become a mecca for
breakneck over building in San Gabriel Valley. Mrs, Foley presented a survey taken
in said surrounding cities which indicated that no comparable city has a FAR as low
as the 50% proposed by the Planning Commission.
Jim Kellv, 946 Coronado Drive, Village ARB, stated in part that the Association
recognizes that Arcadia is a community of neighborhoods and one size FAR does
not fit all when it comes to scale and scope of homes. On behalf of the Association,
Mr. Kelly requested that Council approve a 35% FAR ceiling within the Village and
Lower Rancho HOA boundaries which would still allow for tremendous expansion of
existing homes and construction of new residences while placing some reasonable
limit that would assist the Association in maintaining design harmony. It has been
proven that reasonable control of design and architectural harmony does not reduce
property values, but does in fact bolster values, Mr. Kelly urged Council to adopt the
new residential zoning requirements drafted by the Planning Department, and
commence the process to consider the adoption of a zoning overlay for the
Homeowner Association areas which would reflect reasonable size limits based on
the data presented.

Robert Ho, 51 West Palm Drive, realtor, stated in part, that he do not like some of
the big mansions although there have been some nice looking larger homes built
also, He realized the problem is architectural harmony and design.
Nancv Quon, realtor and Arcadia home owner, expressed concem about the
proposed FAR and garage size for people who have small lots. She hoped Council
would compromise with a 75 foot minimum frontage, 60% building and 40% garage
space, which would accommodate a three car garage,
Bill Spuck. 531 Campesina Road, Board Member, Rancho Santa Anita Residents
HOA, stated in part, that the City needs to recognize that the 1991 R-O and R-1 zone
changes did not fix the problem of huge home building even in areas of homeowner I
associations which have architectural review. The architectural review cannot over
power the size and other restrictions established by the City Council. Mr. Spuck
noted his Association concurs with the staff recommendations and urged Council

approval. He noted also, the Association prefers a 35% FAR which, as
demonstrated to Council, is quite adequate for the homes within the area of these
Associations.
Nancv Dom, 1410 Rancho Road, realtor, stated in part that not all realtors agree with
the Realty Board, She believes the realtors who have spoken at this meeting mostly
represent builders, Mrs, Dorn does not believe that limiting the size of Arcadia
homes would be detrimental to property values. The majority of her clients come to
Arcadia because they like the mature trees, landscaping, the view of the mountains,
the privacy of their own backyards, the conformity of the neighborhoods,.. these are
the amenities that make Arcadia so popular. Mrs. Dorn noted neighboring cities
have more strict building codes which has not hurt their property values at all, in fact,
this has increased property values, Mrs, Dorn urged Council to vote for the staff
recommendations,
Svlvia Bartlett. 910 Hampton Road, Past President of Rancho Santa Anita Property
Owners Association, realtor, stated in part that she supports the staff
recommendations because she believes the changes will help retain the qualities
that make Arcadia a special place to live, Ms. Bartlett does not believe stricter
zoning regulations will reduce property values, conversely, property values will
increase,
Julie Swab, 1717 South Second Avenue, noted she does not like what has happened
on Second Avenue, the 1991 zone changes did not prevent big monster houses from
being built. Ms. Swab expressed concern that the large houses build adjacent to her
home will hurt the value of her property when she decides to sell her home.

Robert Tono, 141 West Naomi Avenue, designer, noted that he is basically happy
about the zone changes recommended by the Planning Commission, He noted that
'his clients want to build large homes and garages facing the street. They also like
two story houses, Mr, Tong further explained his experience with the design of
homes for small lots and clients who wish to have three car garages and two-story
entrances.
Bob Franklin, 255 West Las Flores, noted that, of all the issues mentioned by other
speakers, the privacy issue was not part of the discussion, He feels the new mega
two-story houses destroy the privacy of the neighbors backyards. He has planted
sixteen trees in his backyard in order to block the view from his neighbors second
story .
Miles Naoasaki, 427 Old Ranch Road, a new resident in Arcadia, stated, in part, that
it took him sixteen years since graduating college to be able to afford a home in
Arcadia, He is proud that he is able to provide a good school system and nice
community living for his family. Mr. Nagasaki urged the City Council to adopt staff
recommendations and vote yes for a 50% FAR, or even go further with the
recommendation of the Village Association of having a %35 FAR in order to
preserve the human and natural element of community.

Ginoer Jerosz, 46 North Golden West, expressed her appreciation to the
Homeowners Association representatives for representing her interest very well,
however, she is concerned about the south Arcadia residents who donl have
Homeowners Association, These citizens pay their taxes, lived in Arcadia for years
and raised families, now they have found their rights as homeowners have been
encroached upon and their privacy has been affected, Ms. Jerosz noted, she is in
favor of restricted FAR and she would like to see Arcadia, with the help of the
people's elected officials, maintain not only for represented areas but also for entire

City and for people that have invested their entire lives in the City,

Ron Eilev, 242 East Newman Avenue, expressed his disagreement with the required
additional parking space for dwellings with five (5) or more bedrooms, stating, in
part, that he has four children and would like to have five bedrooms but because of
the lot width he will not be able to have a' three car garage, Also he expressed
concem in regard to rear yard setbacks, reducing pedestrian walkways, vehicular
accessways and paved areas from 50% to 40%, He felt pUlling all these restrictions
on will generate problems and would become increasingly difficult to fit all situations,
Ji Han, 436 Catalpa Road. commented tonight is the real reason why he moved to
this great country twenty-five years ago. The process is working. we hear both sides
of issues, debate it, argued it, now it is up to the City Council to make a wise
decision, We need to move on and live with the outcome, so don't come back in
year 2005 and say 1999 did not work, just move on and we will live with it.
Pamela Olender, 1000 Coronado Drive, President of Santa Anita Community
Homeowners Association, stated in part, the Village HOA is asking for 35% FAR
because of the larger lots in the area, The Village area is meant for people that
have small young children, the area is not meant to be mansionized, She is not in
favor of the three car garages facing the front of the property and in her opinion a
solution to that problem is to make double deep garages by putting two cars in front
and one in the back, Mrs, Olender noted during the past ten days when she was
walking the street to collect signatures for the petition she noticed that 99% of the
Village residents are in favor of 35% FAR, and reducing not only the size in math,
but the actual size of the homes in their neighborhood,
No one else came forward to address the Council.

and CARRIED to CLOSE the Public Hearing,
Following the public hearing staff responded to concerns expressed by the Council
regarding building height, front yard setback and number of parking spaces,
Mayor Pro tem Harbicht commented that most of the proposed restrictions affect
smaller lots, A 7500 sq, ft, lot, which is a standard lot size in Arcadia, these various
restrictions, in terms of setbacks. angles from the street, already addresses some of
this floor area (FAR) concern, Codes that are currently in place have some
restrictions on lot coverage and angles,
Councilmember Kovacic felt that the City is ignoring landscaping, which goes a long
way in mitigating the impact of the size of a structure, Staff is hoping that by
reducing the size of a structure, somehow compatible architecture will follow.
Mayor Chandler felt that residents within Homeowners Association areas have a way
to meet and share ideas and therefor they are more united, Mr. Chandler expressed
concern in regard to south Arcadia residents. who do not belong to any association.

Counilmember Kovacic stated, in part, that two of the homeowner associations
requested that the City Council adopt overlays affecting properties within their
association areas. Mr. Kovacic requested the City Council direct staff to bring back
information for Councils consideration at a future date in regard to a procedure that a
homeowners association should follow in order to request an overlay on property,

Mayor Pro tem Harbicht stated, in part, that the City has rules and regulations in
regard to forming a homeowners association. He felt the City should initiate an
apparatus in regard to requested overlays affecting properties within homeowner
association areas and he would like to see that issue put to a vote of the affected
people.
Councilmember Roncelli requested the Santa Anita Oaks Homeowners Association
be included in this study of overlay on properties within a homeowner association,
Hearing Council consensus, the Mayor said this was direction to staff to prepare the
appropriate document for Council's consideration,
Councilmember Roncelli expressed appreciation to tonight speakers and thanked
staff for their hard work, Mr. Roncelli stated, in part that the problem we are facing
tonight started few years ago, We have homeowners associations and architectural
review boards and they have succeeded in not letting over-sized homes to be built.
Mr. Roncelli suggested all residents form homeowners association and have their
own architectural review board to protect their neighborhoods.

Council member Marshall commented that stricter building controls would lead to
better neighborhood appearance and consistency. She felt the Planning
Commission and staff did an excellent job of addressing the requested zone
changes. Ms, Marshall stated, in part, although the City can not limit property
owners on the style of a structure, but could adjust codes to force architects to make
these homes more harmonious in the neighborhoods. Ms. Marshall prefers a sliding
scale type regulation for both. small and large lots in the City to address each lot
individually.
In consideration of staffs summary of R-1 and R-O regulations, the City Council
discussed and determined as follows:
R-1 Zoning Regulations: Minimum lot dimensions: Width - 75 feet, Depth - 100
feet. Minimum lot sizes: 7,500 s,f.; 10,000 s.f,; 12,500 s,f. and 15,000 s.f.

Councilmember Marshall thanked citizens for their participation this evening.
Ms, Marshall announced that Gunderson Chevrolet of EI Monte donated a van to the
Arcadia Police Department, DAR.E program in exchange for advertising
acknowledgment.
Ms, Marshall requested that staff prepare a report with regard to installation of
"talking traffic lights" for blind residents in Arcadia. Council concurred,
(Gem of the Day) Councilmember Marshall shared a "gem of the day". "Never loose sight of the fact
that old age needs so little, but it needs that little so much".

High Schaal to Santa Anita, He felt that changing the schaal pick-up area could
partially resolve this unsafe problem. Staff will provide a report in this matter for the
Council,
KOVACIC Council member Kovacic shared a greeting from the Library Board, stating, in part,

Stonebridge submitted an invoice with supporting documentation requested
reimbursement of $168,058.22 after the $25,000 payment. Staff has reviewed the
materials submitted, and after meeting with all the utility representatives,
recommended approval of the reimbursement. Staff also recommended
reimbursement to the developer of $10, 000, approximately one-half the cost of
replacing older, but functionally acceptable sidewalk adjacent to the hotel site,
The costs are summarized in detail in the July 20, 1999 staff report.
