The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on
Tuesday, February 17, 1997, at 6:00 p,m. in the Conference Room of the City Council
Chambers.

PRESENTATION
Mayor Harbicht and Mayor Pro tem Kovacic. Council liaison to the Arcadia Beautiful
Commission. presented each member of the commission with the Mayor'S Certificate of
Commendation in honor and appreciation of their work within the City, Arcadia Beautiful
Commission members receiving the award were Gary Brewer; Helen Dahlstrom.
Chairman; Dorothy Denne; Patricia Eicherly; Janice Torrington; Gloria Vertz; and Sandy
Wu, Mayor Harbicht thanked the commission members on behalf of the citizens of
Arcadia for the time and effort they put into this commission, Mayor Pro tem Kovacic

commended the 'commissioners for their dedication and enthusiasm; much of Arcadia's
beauty is a testament to the commission's hard work, Mr. Kovacic announced the I
commission has 'planned an Arbor Day tree planting celebration at Longley Way School '
on Tuesday, March 3.1998 at 10:00 a,m, featuring the students from this school.

SUPPLEMENTAL iNFORMATION FROM STAFF R!:GA~DING AGENDA ITEMS
City Manager Kelly announced that MeditrusUSanta Anita advised staff today that they
would like Agenda, Item 11 b. the Cost Compensation Agreement between the City and
MeditrusUSanta Anita to be continued to the March 3, 1998 City Council Meeting; staff
concurred with the request.
5. QUESTIONS FROM COUNCIU REDEVELOPMENT AGENCY REGARDING AGENDA ITEMS
In response to Council member Chang's request for an update on activity regarding the
Rodeffer Conditional Use Penn it (CUP) staff commented, in part, that the CUP is still
being processed in order to obtain all applicable state and county penn its. The actual
activities of filling the pit have not yet begun; they are still obtaining all legal entitlements
to begin the work.
Regarding Agenda Items 109, and 10h, staff stated, in part, that this will facilitate the
City obtaining vehicles through the State, thus saving money, Seven (7) vehicles will be
purchased through the State, the remaining three (3) outlined in Resolution No. 6035 will
be purchased in fiscal year 1998.1999,

PUBLIC HEARING

WEED/RUBBISH City Clerk June Alford presented the staff report and recommendation for the public
ABATEMENT hearing of the 1997-1998 Weed Abatement Program, On February 3, 1998, the City
(1997.98 Proj,) Council adopted Resolution No, 6034 declaring its intention to provide for the abatement
(APPROVED) of noxious weeds, rubbish and refuse from certain private property within the City.
().., <(,') 5""0 Resolution No, 6034 also set February 17, 1998 as the time and place to hear objections
, - to the proposed removal of such flammable and otherwise noxious material.
As required by the Government Code, the County Agricultural Commissioner mailed the
appropriate notice to all affected property owners, The list attached to the staff report
identified the properties requiring weed abatement by parcel number and street address,
or general location if a street number has not been assigned,
Representatives from the City Fire Department and the County Agricultural
Commissioner's office were present to answer questions,
Mayor Harbicht OPENED the public hearing,
No one came forward to speak in favor or against the weed abatement program.

CDBG FUNDS Community Development Administrator Donna Butler presented the staff report and
1998-99 STMT, recommendations regarding the Statement of Objectives and Proposed Project Use of
OF OBJ, AND 24th Year Community Development Block Grant (CDBG) Funds for Fiscal Year 1998-99,
PROJ, USE - Ms. Butler stated, in part, that the Community Development Commission has advised
24TH YEAR staff that the City will receive $405,975,00 in CDBG funds. Federal regulations require
(APPROVED) that no less than seventy (70%) percent of the grantee's aggregate funds are to be used
OJ:> (J to support activities that benefit persons of low and moderate income; resulting in a
~ (). ..I minimum of $284,182 to be spent for low/mod activities.
Staff recommended the following proposed projects for Fiscal Year 1998-99:

In response to inquiry from Council Ms, Butler responded. in part. that the $15.000 for
ADA Retrofit of City Hall and additional of new bathrooms and additional signage
proposed in the City's Capital Improvement Program. will bring City Hall into compliance
with ADA mandates,
The estimated cost for administering the housing rehabilitation project is $1,000 per
household; however. this does not come out of each $10.000 homeowner grant, the total
budgeted amount of $315,975 is for all housing rehabilitation projects. Staff explained
the administration component and that it has been sent out for bid every three (3) years
and has been awarded to the lowest bidder. The application/participation component
was also explained,
Staff responded that it is expected in Fiscal Year 1998.99 that there will be
approximately 8,000 people assisted through the Senior Citizens Social Services
component of the CDBG funds,

to individual low/moderate income homeowners, and also to the entire community by

AUDIENCE PARTICIPATION
Stella Ross, 881 Huntington Drive. commented. in part. about her distress with some
comments made in recent months attempting to place blame for the City's fiscal
problems, Mrs, Ross expressed various reasons for the City's reduced revenues, and
that the City Council is doing it's best under the current circumstances and always has
Arcadia's best interests at the forefront She suggested that citizens put their best selves
forward by attempting to be positive, appreciative and productive, Mrs. Ross also
commented on future projects to be proposed by Santa Anita which could provide
additional tax revenues to the City. She encouraged a yes vote on Measure A (Utility
User Tax increase),
MATTERS FROM ELECTED OFFICIALS

City Clerk June Alford commented, in part, that she has been working on the upcoming
General Municipal Election obtaining polling locations. election workers, There is one
area of the City that she and the County have not been able to secure a polling place,
precinct #17 (the western half of the Santa Anita Village area). Mrs. Alford requested
anyone living in that area that could provide a site for a polling place (election workers
are already secured) contact the City Clerk's office at City Hall. A small monetary
compensation is provided for use of property for this purpose,
Councilmember Chang commented that he has received many requests from Arcadia
citizens to reopen the Arcadia Public Library on Fridays, He promised the citizens he
would bring that request to the City Council again. Council member Chang estimated
that for $40,000 per year this could occur. and believes the City can now do this without
waiting for the citizens to approve an increase of the Utility User Tax, Dr. Chang
requested this item be put on the next City Council Agenda, There was no Council
consensus,
Councilmember Chang shared a thank you letter addressed to Mayor Harbicht from the
California Arboretum Foundation expressing their gratitude for assistance provided by
by Linda Garcia, Administrative Coordinator in the City Manager's office, The letter
conveyed that Ms, Garcia has always provided cheerful. efficient assistance in many
matters concerning situations that needed City staff involvement to facilitate the
foundation's annual Los Angeles Garden Show,

Councilmember Chang shared a letter sent by the Lu family of Lemon Avenue thanking
the Arcadia Fire Department for extinguishing a fire in their kitchen, stating that the fire
fighters did a very professional job. The family asked Dr. Chang what their costs were
and how to thank the fire fighters for these services, Councilmember Chang told them
there were no costs, but that they could take a basket of fruit & candy to fire station as
thank you if they so desired.
Councilmember Chang reminded residents that sandbags can be obtained from Arcadia
Fire Station #3 at 79 W, Orange Grove Avenue free of charge with a lilnit of twenty-five
(25) sandbags per resident
Mayor Pro tem Kovacic reminded residents of the Arbor Day Celebration at Longley
Way School on Tuesday, March 3, 1998 at 10:00 a,m, The Arcadia Beautiful
Commission has planned an excellent program involving the students at the school.
Mayor Pro tem Kovacic mentioned two events that took place in celebration of the
Chinese New Year, the Year of the Tiger. On February 6, 1998 the Arcadia Chinese
Association held a luncheon with entertainment to thank the City employees, Mr.
Kovacic commended the Association and their President, Teresa Huang for taking the
time to treat the employees and recognize the work they do throughout the year.
Also, on Saturday. February 7. 1998 there was another celebration at the Community
Center to raise funds for the courtyard at the high school. This event was sponsored by
the Arcadia High School Chinese Parents Boosters Club, Foothill Middle School Chinese
Parents Club, Dana Middle School Chinese Parents Club, and the First Avenue Middle
School Chinese Parents Club. There was a lot of good entertainment, with a lot of funds
raised for this cause. Mayor Pro tem Kovacic thanked Yvonne Chin, organizer of the
event Mr. Kovacic also thanked the Fire Department for their prompt response in
bailing out the Community Center due to some unexpected flooding that occurred during
this event
Councilmember Kuhn commended Mayor Harbicht on the recent State of the City
Address; stating it was very informative and well done,
Council member Kuhn reminded those interested in becoming part of the Sister City
activities that the next Sister City Commission meeting will be a brainstorming session of
how to celebrate the 25th anniversary of the sister city relationShip with Newcastle,
Australia. Volunteers are needed to work on this project and should attend the next
commission meeting to be held on Thursday, February 26 at 7:00 p,m. in Council
Chambers or call the Sister City Chairperson Dick Cordano,
Councilmember Young announced that the former Bennigan's Restaurant site will soon
become TGIF Restaurant, and a March 17 public hearing is scheduled for the new Hilton
and Marriott Hotels, A positive effect on the City's overall revenue should be seen in the
next couple of years from these businesses,

Hacienda Drive Mayor Harbicht clarified information conveyed at the February 3, .1998 City Council
Oak Trees Meeting regarding oak trees cut down on Hacienda Drive. An impression was left that
the City was not aware of it. nor did anything about it To the contrary, the City was
aware of the tree removal. In August 1997 the Modification Committee met; as a
condition for approval of the new home being constructed, four (4) new oak trees would
be planted to replace those removed,

Mayor Harbicht provided additional information regarding Resolution No, 6038, Consent
Agenda Item 101. this meeting, This resolution opposes Assembly Bill (AB) 252 which
would preclude cities from giving any consideration to the impact on the schools of a
development, thus removing an important element of local control. When the City
considers any development many factors must be considered, such as the impact of
traffic circulation, sewers, etcetera. AB 252 would not allow cities to consider the impact
of a development on schools; cities should be able to consider any and all impacting
factors of a development. This item points out how things that happen in Sacramento
ca,n have a fairly major impact on the local government. '

City Attorney Miller presented the staff report and recommendation regarding
RESOLUTION NO, 6041, entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA. SUSTAINING THE PLANNING COMMISSION'S
DENIAL OF TENTATIVE PARCEL MAP 98-002 (PARCEL MAP NO. 24947 - 270 W.
ORANGE GROVE AVENUE) WITH FINDINGS:
Mr. Miller stated, in part. that the City Council considered an appeal of the Planning
Commission's denial of TPM 98-002 at a public hearing held on February 3, The City
Council voted 3-2 to sustain the Planning Commission's denial and directed staff to
prepare the appropriate resolution. Resolution No, 6041 sets forth the findings of the
City CounCil relative to TPM 98-002, a request to subdivide two lots into three lots at 270
W, Orange Grove Ave" as follows:
a) The site is not physically suitable for the density of development based on
the design submitted by the applicant because the three (3) lots fronting on
Caballero Road will increase the density of said road. and.
b) The requested subdivision injuriously affects the neighborhood wherein said
lot is located because of the impact caused by the density factor in relation
to the configuration of the lots as set forth in the application,
The findings set forth in the resolution were prepared by Community Development
Administrator Donna Butler and City Attorney Miller. A document with findings "A"
through "D" was subsequently presented to Ms, Butler, Mr. Miller and the City Council by I
Mayor Pro tem Kovacic this date, Attorney Miller's review of these findings are
reasonably consistent with the findings staff gleaned from the record and appear to be
derived from the record,

Mayor Pro tem Kovacic addressed some concern regarding the findings stating, in part,
that the findings in the proposed resolution are adequate, however not as specific as he
would prefer. Mr. Kovacic noted that his proposed findings "A" through "D" were based
on the administrative record, the testimony and comments made at the public hearing,
Mr, Kovacic read his proposed findings as follows:
A. The applicant proposes three (3) lots that all front on Caballaro Road. None
of the proposed lots fronts on Orange Grove along the 300 plus feet of
Orange Grove frontage. The applicant stated at the hearing that he did not
want to consider any subdivision that resulted in one (1) or two (2) of the lots
fronting on Orange Grove, '
B. The neighborhood is characterized by large lots that front on both Orange
Grove and the streets off of Orange Grove, From Oak Meadow Road to
Santa Anita Avenue there is a lot fronting on Orange Grove within a range of
approximately 87 feet to 220 feet from each comer. A variety of lots facing
both Orange Grove and the various side streets enhances the compatibility
and balance of the lots in the neighborhood.
C, The site is not physically suitable for the density of development based on
the configuration of lots submitted by the applicant because all three (3) of
the proposed lots front on Caballaro Road, This increases the concentration
or density of lots facing the side street and disrupts the balance of lots facing
Orange Grove,
D. The configuration of the proposed subdivision injuriously affects the
neighborhood wherein the subject property is located because of its
unreasonable impact on the compatibility and balance of lots in the
neighborhood. This impact can be mitigated by a revised configuration that
provides for one (1) or two (2) lots fronting on Orange Grove,

with proposed new findings "A-, "B", "C', and -D" substituting findings "a" and "b" on the
proposed resolution,
Mayor Harbicht expressed some concems regarding the proposed findings; that he did
not remember this issue being brought up at the Council meeting; the findings are
supposed to be based on the discussion and testimony at the meeting, Considerable
discussion ensued regarding the findings. Mayor Harbicht stated he would not vote in
favor of the resolution; he did not see how anything supports denying the application,
