MINUTES CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING October 20, 1998 The October 20, 1998 Regular Meeting of the City Council of the City of Arcadia scheduled this date at 5:00 p.m. in the Conference Room of the City Council Chambers was canceled due to lack of a quorum. There being no Councilmembers present, at 5:10 p.m. the City Clerk ADJOURNED the 5:00 p.m, meeting to 6:00 p.m, this date in the Conference Room of the Council Chambers, at which time the Regular Meeting of the City Council RECONVENED, PRESENT: Councilmembers Chandler, Harbicht, Marshall, Roncelli and Kovacic ABSENT: None AUDIENCE PARTICIPATION None CLOSED SESSIONS Pursuant to Govemment Code Section 54957,6 to confer with City labor negotiators Carol Przybycien, Dan Cassidy and William Kelly regarding Teamsters Local 911, AFSCME Local 2264, AFFA, Management and non-represented employees. Pursuant to Govemment Code Section 54956,9(b) to confer with legal counsel regarding a significant exposure to litigation against the City based on existing facts and circumstances (not yet known to potential plaintiffs) - as advised by the City Attomey. MAYOR'S PRESENT: Council members Chandler, Harbicht, Marshall, Roncelli and Kovacic ABSENT: None City Attorney Mike Miller announced a Closed Session had been held earlier this evening to discuss Agenda Item 2a, Pursuant to Government Code Section 54957,6 to confer with City labor negotiators Carol Przybycien. Dan Cassidy and William Kelly regarding Teamsters Local 911, AFSCME Local 2264, AFFA, Management and non-represented employees, Item 2b, was not discussed, PRESENTATIONS Mayor Kovacic presented the October, 1998 Mayor's Community Service Award to Rex 1 10/20/98 COMMUNITY SERVICE AWARD (Dondlinger) , 40:0258 Dondlinger, stating, in part, that through his work with the Arcadia Elks Lodge, Mr. Dondlinger has supported many philanthropic efforts with particular emphasis on programs for children and those conceming public safety. Mr. Dondlinger joined the Arcadia Elks in 1967, immediately became one of their busiest members, He reached the position of State President of Califomia and Hawaii in 1994-95. Mr, Dondlinger started an annual event that has become an Arcadia tradition - City Appreciation Night. On this night in addition to honoring the City public safety departmqnts, the Elk's present the Arcadia Fire and Police Departments with a donation of $1 ,000 each. Mayor Kovacic congratulated Mr. Dondlinger for helping make Arcadia a great City. I ~, 4. "- MAYOR'S Mayor Kovacic presented the October, 1998 Business Recognition Award to Captured BUSINESS Images Photography stating, in part, that Robert Watkins, the owner of Captured Images RECOGNITION has involved himself and his business in a number of civic activities, especially those AWARD involving children, The Apache Football Extra Point Club; the Arcadia High School (Captured Govemment Team; Arcadia High School Music Club, Band and Auxiliary; the Library Images Foundation; Longley Way School; and Our Savior Lutheran Church have all benefited Photography) from jOint fund-raising projects with Captured Images, Mayor Kovacic congratulated Mr. Watkins and thanked him for taking the time and making the effort to participate in the affairs of the city, 5. MAYOR'S Mayor Kovacic presented the October 1998 Mayor's Employee Recognition Award to EMPLOYEE Silva Vergel, secretary in the Planning Division, stating, in part, that in addition to her RECOGNITION duties as a secretary and attending Planning Commission meetings she is the AWARD coordinator of the City's Home Improvement Program, City's Web Page and member of (Vergel) the City's Computer User's Group. Mayor Kovacic congratulated and thanked Ms. Vergel for her commitment to providing the highest level of public service. 6. ARCADIA FESTIVAL OF BANDS (M/M Barrows) 7. 8, ORD, & RES, READ BY TITLE ONLY 9, I Jim Barrows, representing the Arcadia Festival of Bands, stated a brief history of the Festival and expressed appreciation to the City Council for their support and for giving him the opportunity to publicize this event. Mayor Kovacic read and presented a ' proclamation to Jim and Margaret Barrows commending the Arcadia Festival of Bands which will take place on November 21. 1998; and proclaiming the month of November as Arcadia Festival of Bands Month, Mayor Kovacic encouraged all Arcadians to attend this wonderful event. PUBLIC HEARING 9a, on'() .10 I ZONE CHANGE Donna Butler, Community Development Administrator, presented the staff report and 98-003 recommendation to approve Zone Change 98-003 initiated by McMahon Development 2 10/20/98 I I I 40:0259 (South side of Lower Azusa) (APPROVED) Group, LLC to change the zoning from M-2 (Heavy Manufacturing) to M-1 (Planned Industrial District) on the vacant 9.2 acre parcel located on the south side of Lower Azusa Road. Rodeffer Trust currently owns the property, McMahon Development Group is in escrow to purchase the property and develop the site. The Planning Commission at its September 8 meeting voted 5-0 to recommend approval of this zone change. The applicant is proposing to subdivide the 9.2 acre parcel, whicl1 is currently vacant, adjacent to the Public Storage facility located on Lower Azusa Road and develop it into an industrial park. The M-1 (Planned Industrial District) zone allows light industrial manufacturing firms, processing, assembling and other light industrial uses, the developer does not intemf-to utilize the property for heavy industrial uses. In the Community Development Section of the General Plan. it notes that the property is "intended for light industrial use that is to be designed and operated so as to be compatible with adjacent residential neighborhoods." The M-1 zoning would accomplish this goal. Pursuant to the provisions of the Califomia Environmental Quality Act. a Negative Declaration has been prepared for this zone change, Mayor Kovacic OPENED the Public Hearing, No one came forward to address the City Council. None 9b, 1) ~fi?} -6:.- TA 98-003 An application was filed by McMahon Development Group, LLC, requesting a text (Govemmental amendment (98-003) to amend section 9266,1.4 of the M-1 zone (Planned Industrial offices in M-1 District) zone to allow govemmental offices in the M-1 zone. Zone) (APPROVED) The McMahon Development Group, proposes to develop the vacant 9.2 acre parcel located on the south side of Lower Azusa Road with an industrial complex. A potential user for one of the lots adjacent to the residential properties located in the City of EI Monte is a governmental office use. The existing code only allows offices for architects and engineers and local offices for State and/or Federal Governmental officials and does not permit general governmental offices, but offices only for government officials, The applicant is requesting that this section be amended to allow "local offices for City, County, State and/or Federal governmental officials and/or agencies." The Planning Commission voted 5-0 to recommend approval of text amendment 98-003 with the changes suggested by the Development Services Department as follows: Conditional Use Permit Section of the Arcadia Municipal Code, Section 9275,1,52.4. OFFICE USES. Office uses shall be allowed in the M-1 or any less restrictive industrial zone when said lot is adjacent to residentially zoned property. Parking requirements shall comply with the parking standards set forth in Division 9 of this Chapter. 3 10/20/98 10, 11, MARSHALL (Dondlinger, Vergel, Captured Image) (1999 Rose Queen, Farrel)1 (Youth Master Plan Survey) (Asian Pacific Clinic Forum) (Holiday 40:0260 Mayor Kovacic OPENED the public hearing, I Russell Pierce, the Senior Vice President for McMahon Development Group thanked the staff for their preparations and Planning Commission for their recommendations, Mr. Pierce responded to Questions from Council stating, in part, the Objective is initially to sell individual buildings to users, the group may elect, depending on/the tenancy. to keep one or more of the buildings. It was MOVED by Councilriimnber Harbicht, seconded by Council member Roncelli and CARRIED to CLOSE the public hearing. Councilmember Harbicht commented that this Text Amendment would effect all M-1 zone properties in the community not just this particular property, Allowing office use in an industrial zone which abuts residentially zoned property is a good recommendation, however, he expressed concern about the wording of the proposed Text Amendment, he would like to approve the Text Amendment if the word "abut" could be replaced by "adjacent to", Council concurred. Two of the princesses are also from Arcadia. Ms, Marshall announced the Youth Master Plan Committee is doing a survey at Arcadia Middie Schools and asked the students to list their desired activities, The committee will prepare the priority list, they are moving forward and progressing in a very positive manner. Councilmember Marshall announced that the Asian Pacific Clinic, which serves the San Gabriel Valley, will conduct a forum to be held at the Litlle Theater of Arcadia High School on October 27 from 7:00 to 9:00 p,m, The Asian Pacific Clinic services are free and include counseling for students, parents and families, and differences in the educational system between the United States and the Asian culture, I Ms. Marshall invited everyone to attend the 1998 Holiday Festival and Tree Lighting 4 10/20/98 I I I 40:0261 Festival) ceremony which will be held at City Hall on Tuesday, December 8th, In the event of rain it will be held on Thursday, December 10th, There will be Santa, snow and a train ride. (City of Hope) This is the breast cancer month and the City of Hope Medical Center is having their yearly walk-a-thon fund raiser on Sunday October 25 in Duarte, (Peacocks) (Quote) CHANDLER (Red Ribbon Week) RONCELLI (Fall Clean-Up Week) (Permit) (Real State Signs) HARBICHT (Public Library Foundation) Ms, Marshall assured the nation that Arcadians are not in any peaQOck danger, This in reference to the CNN headline news information which stated "Arcadia, a suburb of Los Angeles County, over run bt:lOe thousand peacocks." ~, Councilmember Marshall's q'uote of the day, "God made you as you are in order to use you as he planned," by S,C. McCauley, Council member Chandler encouraged everyone to wear a red ribbon, which is the symbol of unity against drugs for Red Ribbon Week, which begins Monday, October 26. The Arcadia DAR.E officers will be giving out red ribbons to local schools and neighborhood watch groups. Council member Roncelli announced that the City of Arcadia and Newco Waste Systems will sponsor a Fall Clean-Up week, October 26 through October 30th, Mr. Roncelli requested staffs respond for clarification, regarding the number of employees a person can have when running a business from home? How often can one have a yard sale? Also, how often one can get a permit to have filming in their own house, Mr. Roncelli expressed concem regarding the posting of real state signs on weekends, He feels the City needs a Code Enforcement Officer on duty Saturdays and Sundays, because that is when realty signs are put out. In respond to Councilmember Roncelli's questions, City Manager Kelly stated, in part, that the City permits two yard sales in a one year period per site, As for the filming, Mr. Kelly stated that filming at a single family home is allowed every day by appropriate permit, every time an application is submitted the applicant must obtain approval from the surrounding neighbors, The City did a survey several years ago and a number of residents indicated they did not have any problem with movie companies in the city" Regarding the realtor signs Mr. Kelly stated, in part, the City is trying to be realtor friendly and home seller friendly, if the signs are unsafe and dangerous a police officer could remove them at any time, To have a Code Enforcement Officer on weekends Mr. Kelly noted he will ask the staff to modify work schedules to analyze weekend worl<ing conditions, In respond to a Council question regarding home businesses, the Community Development Administrator, Donna Butler, stated, in part, that with a home occupation permit you are not allowed to employ anyone that does not live on the premises, Councilmember Harbicht announced the Arcadia Public Library Foundation, for the purpose of furnishing the Public Library, has to-date raised over $800,000, Mr. Harbicht invited everyone to visit the Library and take a look at the new furniture, shelves and computers, He encouraged everyone to make a pledge to the foundation, Mr. Harbicht noted there will be a fundraising dinner Thursday, November 5th., between the hours of 5:00 and 8:00 p.m, at the Souplantation, of which %20 of the price of a dinner will go to Public Library Foundation, The flyers are available at the Library, City 5 10/20/98 KOVACIC (Census Bureau) (Santa Anita Shopping Mall Holiday Sale) (Pasadena Rose Queen) 12, 40:0262 Manager's Office and the Chamber of Commerce. I Mayor Kovacic announced that the Census Bureau will be conducting a survey in 2000, to provide estimated projections on populations, geographic distribution, social and economic characteristics. This data are then used to plan for the future of our nation. It is important for everyone to participate and that the information given to the census workers is correct, Federal funds are awarded to cities and copnties based on the numbers compiled by the census. The Santa Anita Mall will De-conducting a special evening of holiday shopping;--B fund raising event for non-profit organizations on Sunday November 22 from 7 to 10 p.m, The Mayor encouraged everyone to purchase tickets from the PACE 2000 office in the mall or at the Police Station. All proceeds from the sale of the tickets will go to support the DAR.E program, The Mall will be closed to the general public. The merchants will be featuring special discounts holiday shopping. The Mayor extended congratulations to the three young ladies from Arcadia who were selected to the Rose Court. Christina Farrell was selected as queen and princesses Chaitali Gala and Olivia Wilson. Mayor Kovacic knows all three girls personally and noted they are wonderful representatives of Arcadia. In accordance with the per parcel discretionary grant program provision of Proposition A, the City of Arcadia is eligible to receive $242.438 for use on capital projects to acquire, develop. improve and/or restore property for parks and recreational purposes, The grant is non-competitive and does not require local matching funds. Since there is not enough grant money available to light the field at Foothills, the Recreation Commission contacted various civic organizations and received offers from Arcadia A YSO, the Santa Anita Soccer Club and the Arcadia Rotary Club to cover the potential cost of the lighting at these fields. Doing so would enable the field at Foothills to be designated as a practice field for football and soccer and all recreational/sports activities, In the discussion following presentation of the staff report, the $95,000 in private donations was removed from the estimated total cost, The October 20th staff report noted that objections from residents in the neighbomoods of Foothills and Dana Middle Schools have been received relative to the installation of playing field lights at those locations; petitions have been circulated in the Foothills area and an attomey retained to represent a group of Foothills residents, In view of such controversy over the proposed improvements neighbomood meetings to present the proposals to residents in the affected areas were conducted by the Commission, to solicit public input. Minutes of these meetings were previously provided to the City Council. The October 20, 1998 staff report noted also that questions have been raised as to which 7 1 0/20/98 40:0264 govemment agency, the City or School District. has final approval of the proposed improvements referenced in the report, Since the proposed lighting and bleacher projects are located on School District property, and not subject to City zoning laws, the ultimate authority to approve or disapprove the projects lies with the School District. The City is the funding source (using Proposition A funds), the School District must formally accept the funds and agree to construct the improvements, after compliance with the Califomia Environmental Quality Act (CEQA) and other provisions Qf State law affecting school construction, The City has jurisdiction over the proposed improvements at Newcastle Park. ~. The staff report noted that'the County will also provide the City with an additional allocation of Proposition A funds to be used to help the City maintain and operate the improvements constructed with the $242,438, Specifically, the City will receive $66,205 every year for twenty-two (22) years to assist with the cost of maintaining and operating all projects, past and present, constructed with Proposition A funds. Mayor Kovacic opened the meeting for public comment. Michael Montoomerv, 10501 Valley Blvd, EI Monte, attomey for the "Home Owners for Protecting Our Environment" (HOPE), residents in the area of Foothills Middle School, emphasized some of the issues; a potential Environmental Impact Report may be required of the School District if the Foothills School project is approved; the HOPE group has noted eighteen (18) areas of concern which are included in the staff report; if the project goes forward there could be a potential need for an amendment to the Arcadia General Plan; the Foothills athletic field is zoned R-1; the proposed field lights are not permitted under the City's code. The area residents requested that the City defend and uphold it's own codes at every opportunity, including the proposed project at Foothills Middle School. Stewart Gibson. 1234 Louise Avenue, stated in part that many of his neighbors did not receive notice of the meeting this date or those conducted by the Recreation Commission regarding the proposed field lighting at Dana Middle School. Nearty all of his neighbors oppose the project for the following reasons: There is only on-street parking; players and parents will walk in the streets after the games for safety reasons; the lights will be bothersome as well as the trash and noise; the proposed parking is ill- 'conceived; there would be an adverse effect on property values; soccer is played at Dana on Saturday and Sunday, the residents do not need this seven nights a week also, Mr. Gibson suggested the Recreation Commission investigate other sites such as Bonita Park, Arcadia High School, the County Park, the former National Guard site, and property on Second Avenue between the water tanks and the freeway, Rod Salazar, 15 North Altura Road, Commissioner of Region II, A YSO Soccer, stated in part that A YSO is the largest youth organization in Arcadia with many volunteers who put in countless hours working with the children of the community, With the growth of the soccer more lighted fields needed, Region II strongly supports the City's Youth Master Plan, the recommendations of the Recreation Commission, and the Proposition A project for the proposed improvements with public/private partnership funds. Mr. Salazar presented petitions signed by over 500 Arcadia residents and parents in support of the Youth Master Plan. He urged the Council to do what is best for the City, Mr. Salazar confirmed A YSO's commitment to donate $75,000 for lighting the fields recommended by the Recreation Commission, and that it is his understanding that this is a No, 1 project with AYSO, the Youth Master Plan committee and the Recreation Department. Peooy Brav, 314 East Sycamore, presented background information on the formation of HOPE and their efforts to explain the concerns of area residents about the proposed lighting of the Foothills athletic field, Mrs, Bray presented a copy of petition recently 8 10/20/98 I I I 40:0265 I given to the City Council. The HOPE petition states that the signers do not want field lighting installed at Foothills now or in the future; field lighting nightly to 10:00 p.m. or later will bring disruption and child safety concerns, noise, vehicle parking problems, trash, and additional property damage, It is Mrs, Bray's opinion that if their property rights are at risk, everybody's property rights will be at risk in the audience, not just the Foothills area, Mrs. Bray confirmed on behalf of Foothills area residents, there are no areas of compromise regarding the installation of field lights at Fqothills School. Mrs. Bray noted there are altemative fields in the city that could be used, Allen Gillespie, AYSO boara-member and former commissioner, Mr. Gillespie stated in part, his primary goal has been to provide safe, quality playing fields at the schools, During the past two years AYSO has spent in excess of $50,000 on improving the playing fields at Arcadia public schools, A tremendous amount of volunteer effort has been expended on these projects also, Mr, Gillespie explained the process to get the Foothills field ready for use in the fall, and many other school projects and funds donated to Arcadia schools, He strongly believes the children need and deserve better facilities and fields, His vision is quality, and fields available to the children on a year round basis, The final step to reach this goal is field lighting for night practice during winter months, A YSO has raised a substantial amount of money toward the proposed project. On behalf of AYSO Mr. Gillespie requested Council's support. I Joseph Nunez, 139 East Sycamore, speaking on behalf of HOPE, stated in part that to his knowledge everyone directly affected by the proposed lighting at Foothills school is opposed to this project. He is not against the youth of Arcadia, Mr. Nunez commented that he moved into his dream home and now he is being asked to contend with a major change in his environment. He believes lighting this field would be against the current R-1 zoning in the area, The proposed stadium lights would not only light the field but would be seen from blocks away. He believes there will be liability issues if such lighting is installed. HOPE was formed as a statement in favor of the neighborhood children who live and attend Foothills Middle School. Don Kaplan, 1315 Linda Way, stated in part, he has been an Arcadia resident for 43 years and has coached A YSO for 26 years, From the speakers this evening he believes it sounds as though they are saying they want to protect their homes and put the lights in the back yard of the homes of people in other areas. The soccer program has volunteers who work with the players... some of the volunteers cannot leave their work place in the middle of the afternoon, they may have to come to A YSO in the early evening.., the AYSO program needs evening lighting and facilities. The proposed lighting of these fields would be a win-win situation for the children. I Geor'Qia Masanovich, 250 Whispering Pines Drive, stated in part the residents of the Foothills area support all the sports programs at Foothills Middle School... only, in daylight hours. The residents do not want to push these lights on any other area. No one in the audience lives as close to any school grounds in Arcadia as the residents in the Foothills area, Ms. Masanovich described the traffic, ringing bells, yelling and screaming of the youth in play and competition at Foothills. The residents are exposed to loud noises all day and they accept them without exception and without complaining, After school there are more activities, more practices, and more vehicles, Saturday and Sunday the facilities are used by other organizations and also during the summer. Now the residents are being asked to endure this five to seven nights a week, This would mean approximately 14 straight hours of which four to five of those hours would be in the bright reflection of illumination and additional noise and trash, The serenity of the Foothills neighborhoods and environment would be greatly compromised with the addition of the lighted fields, the extended hours of play and the increased hours of noise. 9 1 0/20/98 40:0266 The Foothills area residents want the youth to have fun in all sports but not at night nor at Foothills, No one would want this in their backyard. Buzz Spellman, 1236 Oakglen Avenue, stated in part that while he agrees with the need for facilities and practice time, he does not want lighting installed at Foothills Middle School. The lights would be a distraction. The traffic and parking are already notorious, The quality of live in the area would change. He would hope the Oity Council would be open to the concems of the residents. Dennis Smith, 1245 Oakhaven Road, stated in part that although he would be very much impacted by the proposed 'Foothills project he believes it is much needed and long overdue. Ten to fifteen years ago when he coached youth soccer field space was a problem. He paid large fees to the County Recreation Department for a little piece of outfield at the Arcadia County Park for four or five soccer teams to practice on, Soccer has since grown. Playing fields are a major problem, Arcadia has the poorest practice facilities of any area, according to Mr. Smith. Only one field is dedicated to soccer.., the field at City Hall. This field is used seven days a week. He also referees soccer in many other cities that have facilities, Arcadia does not have the space. The facilities at Arcadia schools should be utilized. Garv Jacobsoen, 1201 Oaklawn Road, stated in part that he is very involved in AYSO and is now a board member, He has first hand knowledge of the facility problems and lack of lights in the fall season, The vast majority of children and coaches cannot begin practice until 5:00 p,m, Other after school activities use the fields also, In earlier years the County Park could be utilized for a limited number of soccer games, for the last few years County has catered to adult baseball and youth football with limited access for soccer. There are now 2,500 children in youth soccer, 172 of which are Arcadia children, Mr. Jacobsen urged Council to install the proposed lights at the three fields and support the .AYSO program. In response to Mayor Kovacic. Mr. Jacobsen noted that soccer people have discussed playing opportunities at County Park for a long time, The Mayor suggested AYSO officials speak with Supervisor Antonovich about AYSO's problems in securing soccer access to this facility. Ed Littv, 236 East Sycamore Avenue, expressed his concems regarding traffic and safety issues at Foothills school. Two deadend streets create traffic problems; there are no street lights on Sycamore next to the athletic field; no sidewalks on either side of Sycamore; there is usually a fair amount of traffic through the intersection at Sycamore and Second Avenues, which is a major route for people who live in the area to get to the shopping centers on Foothill Boulevard, It has been suggested that with the increased use of the field if the project is approved, people would park in the shopping areas, which he believes is inappropriate, People walk in the street at night, this could be a risk to the children, and a legal liability. If there is a clear need for a lighted playing field, there may be ways to reduce the risk to the children, I I Don Coulter, 1656 Wilson Avenue, was present to urge Council to support the Youth Master Plan as it has been recommended to the Council, including the proposed lights, Many of Mr. Coulter's neighbors support the proposed lighting project at Foothills school. They do not believe there will be a negative impact on the quality of life by lighting this field, He urged Council to consider the benefits to the City in the Youth Master Plan and lighting the three school playing fields. Mr. Coulter stated the playing fields in the City are an embarrassment and not up to par. He leaves his work at 4:00 p,m., two days a I week to coach soccer, other coaches cannot do this, After day-light savings time changes it will be too dark to finish practice, There is no space available at County Park or Bonita Park, The youth involved in soccer are not involved in negative behavior that 10 10/20/98 40:0267 I some have mentioned. Approval of the project will promote positive activities for the youth of the City. E.A, Thistlewaite, 220 East Sycamore Avenue, expressed his opinion that property values in the area of Foothills school would diminish if stadium lighting was installed at Foothills. Mr. Thistlewaite provided a letter from Mr. Kan Yao, a licensed property appraiser, stating the experience of Temple City. EI Monte and MOijrovia when stadium lights were installed... there was a 7% to 10% drop in area property values, Michael Mav. 909 Volante 'Drive, Executive Vice-President, Santa Anita Soccer'Club, stated in part that the numbe'r one priority of this soccer club is lighted fields, When the time changes it is difficult to find a place to practice. Soccer people who have regular jobs to 5:30 or 6:00 p.m., have a difficult time getting out to soccer practice. The Soccer Club's position is more difficult than A YSO because the County Park generally gives their permit to AYSO, which leaves the Club program without a field for practice, according to Mr. May. He believes the facilities in Arcadia are second class at best, with respect to practice fields. The Soccer Club is donating $10,000 to the Youth Master Plan and they would like the Council to support the lighting plan as recommended. In response to Council, Mr. May advised that the Soccer Club, which has 22 teams, plays year round, I William ASri, 321 Hillcrest Boulevard, stated in part that it is not a question of homeowners against soccer players, He bought his dream home in Arcadia after searching for two years. Then he discovered the drawbacks of living so close to a school. His home backs up to the Foothills playing field, He is willing to put up with the daytime parking and noise, but at night it is too much to ask of the residents. Mr. Asri asked why Proposition A funds were committed to Dana and First Avenue schools and not Foothills, Keith Pipes, 265 Arbolada Drive stated in part that he was not told that he was present to support stadium lights. He understood that the proposed lights at Foothills would have limited spill-over, designed and engineered specifically for practice only, and that practice time would last to 9:00 p.m, And, the proposal was to only extend the time for practice through November and the first week in December when AYSO season is over. He agrees that it is not fair to residents around the middle schools to accept stadium lighting, or trash or parking problems, He would propose something less obtrusive, for practice only, The Mayor referenced a recent report stating game lighting at Dana Middle School; activity to end by 9:30 p.m. year round at Foothills with lights off by 10:00 p.m.; schools/City allowed a maximum of twelve additional events to exceed that time limit, and a maximum of six play-off games under the lights, if needed. Councilmember Harbicht noted the request for play-off games at Foothills suggests that these are game level lights, The Recreation Director, Mr. Collins, commented that the practice lights proposed for Foothills would be the minimum level used for a regular soccer game, I Randy Fowler, 1033 Paloma Drive, offered to respond to Council's request for clarification; the proposed lighting level at Foothills could be raised for games, and soft for practice; the play-off games are held in December, scheduled from 2:00 p,m, to 6:00 p,m,; A YSO is asking for field and lights from September through the middle of December; A YSO is not asking for play-off games at any of the proposed fields; he believes the School district would issue permits and schedule the fields, The A YSO plan presented for Foothills addresses concems for trash; the plan turns the public street into a permit-only parking street which will reduce the amount of traffic; A YSO will put in trash bins and porta-potties that will be shielded from the neighborhood; A YSO will also continue to spend funds to improve the fields, Gail Jensen, 1958 Alta Oaks Drive, Chairperson, Youth Master Plan, stated in part, the 11 1 0/20/98 40:0268 Youth Master Plan is in favor of the proposed lighting at all three middle schools, Mrs. I Jensen presented background of the formation and goals of the Youth Master Plan, Mrs. Jensen mentioned also that the Committee has developed a new student survey of updated desired, free time activities. Govind Kotecha, 11 East Leroy Avenue, stated in part that he lives across the street from Dana Middle School. Mr. Kotecha opposes the installation or field lights at Dana because of the late hours the lights will be on; the weekend games. Also. he did not receive notice of the meetings conducted by the Recreation Commission or this meeting tonight; area residents have-not been informed of the proposed field lights and-'nours, this is unfair. h, Gerald Mies, 1037 Louise Avenue, Arcadia resident for 43 years. Mr. Mies stated in part that he was unaware of the Youth Master Plan and its goals. He noted the evening soccer game this date at the City Athletic Field and wondered when the soccer players do their homework. In the past athletics were played after school until dinner time after which the students did their homework, He believes society is becoming more sports oriented and less educationally oriented, If a lot of the sports time and money was put toward educational purposes it might be a greater benefit to the youth. Kids should use evening hours for study... they will become better educated in the long run, Stella Guiwits, 238 East Sycamore Avenue, stated she was a resident on Sycamore before Foothills school was built, Mrs, Guiwits stated the noise produced by the school children during the day is very loud, she does not want the evening hours to be the same, Mrs, Guiwits raised four children who did their homework in the aftemoon and did not stay up until 10 or 11 o'clock on school nights, She asked, if Arcadia has enough playing fields for Arcadia children, why are more needed? Mayor Kovacic explained the program, She is opposed to night games at Foothills for reasons mentioned. I Timothv Risk, 409 East Camino Real, an A YSO soccer player, stated in part that he did not think trash would be a problem at Dana Middle School. Timothy stated the reasons that he is in favor of lighting the three playing fields, extended hours and additional fields and practice time. Collin Hill, 752 West Huntington Drive, Associate Professor, U,S,C. School of Medicine, Region 13 Commissioner in Pasadena, Mr. Hill spent two and one-half years putting through a plan to install lights at three Pasadena schools, They went through a similar process and succeeded in getting lights installed. Many compromises had to be made to do this. These lights have been in place for one and one-half years without any complaints from area residents. Mr. Hill commented that most of the coaches have to work all day and that is why they have to have practice in the evening. Frank Derzic, 160 East Sycamore Avenue, stated his concems about safety and security in the Foothills area, Crime increased in his area when all sorts of people came in for the games, other damages occurred also, Mr. Derzic implored Council not to put lights in and create an unsafe neighborhood for seven days and nights a week, Carol Hack, 230 Whispering Pines Drive, spoke on behalf of HOPE. The members of HOPE support the youth programs. Mrs, Hack referenced the survey in the Youth Master Plan and the recommendations of the various segments of the City, none of which recommended night field lights, The Youth Master Plan suggested that the County Park be used for a lighted soccer field which would not interfere with resident's privacy, and lights and noise levels would not be objectionable, The HOPE group of residents feel I that Arcadia High School is also a workable site for soccer evening play and practice. Linda Klein, 234 East Sycamore, referred to the public parking permit program 12 10/20/98 40:0269 I suggested by a previous speaker, on Sycamore Avenue, Mrs, Klein and her neighbors do not believe this would be a workable solution to the traffic problems If night soccer games and practice were implemented, Parking at nearby business establishments is not available either. Mrs, Kelin supports the concept of Arcadia High School as an altemative site to the Foothills playing field. Bill Hurley, 2727 Caroline Way, AYSO Boys Vice-President and COllch. related his years of service to this soccer organization, and his family accomplishments, Mr. Hurtey infonned Council of the problems gaining access to playing fields at County Park. which must be shared with other sports teams. The soccer team also shares facilities sf'Bonita Park. A YSO and the Soccer. Club play at First Avenue Middle School. Mr. Hurley stated that the soccer teams are only asking for an additional hour of play time for six weeks on lighted fields. Mr. Hurley explained the soccer conditions/regulations at Arcadia High School; Bonita Park and the County Park. Pat Gibson, Arcadia Recreation Commissioner. spoke to the question of County Park. Dennis Smith and Mr. Gibson have been soccer coaches for 15-20 years and have been negotiating with County Park for all of that time for soccer use. There are four lighted fields at County Park... three for softball and one for baseball. When an adult team commits to baseball or softball and offers the County $30,000 a season. the soccer teams lose the fields. A YSO only has the use of one field at County Park, some nights of the week. This is the reason the Recreation Commission recommended lights at Dana and Foothills Middle Schools. Mr. Gibson clarified the request of the Recreation Commission that field play end at 9:30 p.m. on all three fields. one light tower would stay on until 1 0:00 p.m, to enable the fields to be cleaned, Practice field activity could end at a different time. I Following the conclusion' of public comment, considerable Council discussion ensued. Mayor Pro tem Chandler expressed objections to an offensive letter received from AYSO which, he noted, was not signed, Mr, Chandler mentioned the City's many efforts with regard to the soccer program long before the Youth Master Plan was completed. The letter. he feels. is a veiled threat which the Council and the City does not deserve. Mayor Kovacic expressed his objections to the A YSO letter also, which he feels promotes cynicism of local govemment. He finds the comments in this letter to be insulting, although, he does not question A YSO's commitment to the youth of Arcadia. The Mayor stated in part that he feels there is still room. for compromise with the residents in the Foothills area, This can be explored, And, an altemate site is possible. Councilmember Harbicht stated he is well aware of the need for soccer practice fields. The impact of the proposed lighting at First Avenue school would be minimal to area residents. He is in favor of the project at First Avenue. The negative impact at Dana School is outweighed by the positive benefits of lighting that field. Councilmember Harbicht is in favor of lighting Dana, The situation is different at Foothills School. The residents did not foresee nighttime activities, Special circumstances should be considered; the traffic circulation is poor; the field is elevated; the lack of parking, These situations make the impact of a lighted field greater to the residents than the benefits they may accrue, If the field was lighted it would be used for all kinds of activities, also, He will vote against lighting Foothills. I In reference to Foothills School, Councilmember Roncelli noted that the entire situation; traffic, noise, and parking have become too much for the area. He believes there are other altematives to placing IightlJS at Foothills, He is not in favor of lighting Foothills or Dana. Councilmember Marshall said taking all matters discussed under consideration, she 13 1 0/20/98 40:0270 concurs with her colleagues, Mrs, Marshall noted she can appreciate the work involved by all parties in the issue under discussion, and that the best progress is made when I everyone involved in a major decision is responsive and respectful of each other. The School Board, all commissioners, City departments, the City Council and the citizens need to work together to accomplish the needs of the community. Council Marshall stated that she is for the lighting of Dana and First Avenue Middle schools, and an alternative site instead of Foothills. Harbicht, Marshall, Roncelli and Kovacic None None In reference to the $95,000 commitment of private funds, Councilmember Harbicht noted the Soccer Club has expressed a desire to put their $10,000 donation in lights at First Avenue; the Rotary Club contribution came with no strings attached, this could be , used for lights also; the $75,000 donation from A YSO could either go to lights at Dana or First Avenue or possibly an alternative site. These contributions would have some impact on the amount of Proposition A funds for which the City will soon send an application. Council could present the concept of lighting Dana and first Avenue with Proposition A funds to the School Board for their decision. In the discussion to use Proposition A funds for improvement of the bleachers at I Foothills Middle school, Mayor Pro tern Chandler said he feels that Foothills has a significantly different location situation than Dana; Sycamore Avenue is dark, a dead end street, there is a hill; a couple of fire hydrants; and the parking is a fiasco.
