FOOT TUTORING CENTER WITH A MAXIMUM OF 70 STUDENTS AND
3 STAFF MEMBERS AT ANY ONE TIME AT 220 S. FIRST AVENUE.
Recommendation: Conditional Approval
SUMMARY
The applicant, Ms. Janice Yen, submitted Conditional Use Permit Application No. CUP
13 -01 for a 5,775 square -foot tutoring center with a maximum of 70 students and 3 staff
members at any one time at 220 S. First Avenue. An aerial photo and photos of the site
are attached. It is recommended that the Planning Commission approve this application,
subject to the conditions listed in this staff report.
BACKGROUND
APPLICANT: Janice Yen, Owner of Steps Academy
LOCATION: 220 S. First Avenue
REQUEST: Conditional Use Permit No. CUP 13 -01 for a 5,775 square -foot tutoring
center with a maximum of 70 students and 3 staff members at any one
time at 220 S. First Avenue.
SITE AREA: 7,420 square -feet (0.17 acre)
FRONTAGES: The subject property has a 55 -foot frontage on First Avenue and a 135 -
foot frontage on an access alley.
EXISTING LAND USE & ZONING:
The property is developed with a 5,775 square -foot, one -story commercial
building and surface parking lot constructed in 1952. The property is zoned MU —
Mixed Use.
SURROUNDING LAND USES & ZONING:
North: Vacant Retail, zoned MU
South: Tutoring Center, zoned MU
East: Two -story Apartment Building, zoned R -3
West: Day Spa, Retail, and Office Uses, zoned MU
GENERAL PLAN DESIGNATION:
Mixed Use (22 -30 du /ac & 1.0 FAR) — The Mixed Use designation provides
opportunities for commercial and residential mixed -use development that takes
advantage of easy access to transit and proximity to employment centers. Mixed -
use districts support commercial uses that integrate well with residential activity
without creating conflicts.
DISCUSSION
The applicant is requesting approval of a Conditional Use Permit for a tutoring center
with a maximum of 70 students and 3 staff members within an existing 5,775 square -
foot commercial building at 220 S. First Avenue. The applicant currently operates a
tutoring center (Steps Academy) at the adjacent 2,255 square -foot building at 222 S.
First Avenue (CUP 10 -08). This tutoring center is limited to a maximum of 40 students
and 3 staff members at any one time. Student pick -up and drop -off for the existing
tutoring center is accommodated by a 9 -space surface parking lot accessed from First
Avenue. Staff is not aware of any issues or complaints with the operation of the existing
tutoring center.
While under the same ownership, the proposed tutoring center at 220 S. First Avenue
would operate independently from the existing tutoring center at 222 S. First Avenue.
The students will be of different age groups at the two facilities, and the students would
not pass back and forth between the two properties. The applicant states that student
drop -off and pick -up for the existing tutoring center would continue to occur in the front
parking lot on First Avenue and not in the rear parking lot of the subject property. A
condition of approval is recommended for this application stating that the rear parking
lot shall not be used for the pick -up or drop -off of students attending the tutoring center
at 222 S. First Avenue.
A site plan, floor plan, class schedule, and operations plan of the proposed tutoring
center are attached to this staff report. Students will be limited to Kindergarten through
8th grade in age. During the school year, class times are to be from 3:00 p.m. to 9:30
p.m., Monday through Friday; and 9:00 a.m. to 7:15 p.m. on weekends. During the
summer break, classes are to be from 9:00 a.m. to 7:45 p.m., 7 days a week. The
school year and summer class periods will correspond with the calendar of the Arcadia
Unified School District. The applicant proposes to divide the students into 3 sessions of
35 students with no more than 2 sessions occurring at any one time. Class times are
proposed to be staggered with 15 -to -30 minute gaps between classes to facilitate the
changing of class sessions, and the drop -off and pick -up of students.

Student pick -up and drop -off will occur in the rear parking lot. Parents will be required
to park when picking -up or dropping -off students, and not to queue in the parking lot
area. There is an existing easement between the subject property and the property at
234 S. First Avenue which requires vehicular access to remain open between the two
parking lots. To ensure that vehicular traffic does not queue into the adjacent parking
lot at 234 S. First Avenue, a condition of approval is recommended stating the operator
of the tutoring center shall require drivers to enter the on -site parking lot from the alley
only. Vehicles leaving the parking lot would have the option to exit back through the
access alley or through the adjacent parking lot at 234 S. First Avenue.
The striping of the parking spaces of the on -site parking lot has faded and is no longer
visible. The parking lot will be restriped as part of this project. To comply with all of the
City's current parking standards would limit the parking to a total of 12 spaces, and
require new 5 -foot landscaped buffers to be installed in the parking lot along the east
and north property lines. The applicant is requesting the following modifications from
the City's parking standards to accomodate 14 on -site parking spaces:
• Two 11' -0" wide parking spaces along the north property line, and one 11' -4"
wide parking space along the south property line in lieu of 11' -6" required for
parking spaces adjacent to alleys or fences;
• Seven 8' -10" wide parking spaces along the east property line in lieu of 9' -0"
required;
• 18' -0" deep parking spaces along the east property line in lieu of 20' -0" required.
This modification is needed to accommodate a new trash enclosure in the
unutilized southwest corner of the parking lot while still maintaining an
approximate 25' -0" driveway aisle.
• To allow the existing paved area of the parking lot to remain without landscaping.
Adding a 5 -foot landscape buffer would require the existing asphalt to be
removed and a new landscaped area and irrigation system to be installed along
the north and east property lines.
Because this is an older existing parking lot originally constructed with substandard
dimensions, no landscaping, and no area for a trash enclosure, it is staffs opinion that
the above Modification requests are appropriate.
The proposed tutoring center requires one parking space for every 5 students, and one
parking space for every staff member. Based on the proposed 70 students and 3 staff
members at any one time, the tutoring center has a parking requirement of 17 spaces.
If the above Modifications to the parking lot are approved to allow 14 on -site parking
spaces, approval of the tutoring center will result in a parking deficiency of 3 spaces.
Staff has some concerns about the cumulative impacts of approving a 70 student
tutoring center adjacent to the existing 40 student tutoring center at 222 S. First Avenue.
The existing tutoring center at 222 S. First Avenue is approved with a condition that

requires the students to be divided into two sessions of 20 students with a gap of one
hour between the pick -up and drop -off times of the two sessions. The proposed tutoring
center would divide students into sessions of 35 students with a gap of 15 -to -30 minutes
between the pick -up and drop -off times of the sessions. Combined, there would be up
to 55 students being picked -up or dropped -off between the two tutoring centers during
certain 15 minute time periods. There is also potential for overlap between pick -up and
drop -off times of the different class sessions for the proposed tutoring center given the
short 15- minute gap between pick -up and drop -off times of the different sessions.
The applicant has stated that if staff or the Planning Commission has concerns about
the on -site parking and student pick -up and drop -off of the proposal, she would be
amenable to reducing the maximum number of students to 60 at any- one -time to
facilitate approval of this application. Reducing the number of students to a maximum
of 60 students at any one time would decrease the total parking requirement to 15
spaces, and reduce the parking deficiency from three spaces to one space.
Given the concerns outline above, it is recommended as a condition of approval that the
maximum number of students be reduced to 55 students at any one time, which along
with a maximum of three staff members will reduce the parking requirement of the
tutoring center to 14 spaces, thereby eliminating the parking deficiency. In addition, to
avoid potential overlap between the pick -up and drop -off times of the class sessions, a
condition of approval is recommended that the class schedule be revised to provide a
minimum of 30 minutes between the pick -up and drop -off times of the different
sessions. Finally, a condition of approval is recommended stating that this Conditional
Use Permit shall be subject to periodic inspections, after which the provisions of this
Conditional Use Permit (including the maximum number of students, specific class
schedule, etc.) may be adjusted after due notice to address any adverse impacts to the
adjacent streets and /or the neighboring businesses or properties.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the public
health or welfare or injurious to the property or improvements in such zone or
vicinity. The proposed tutoring center is consistent with the zoning and land use
designation of the site and area, and will not have any adverse impacts to the
neighboring businesses or properties.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized. A tutoring center is allowed in the MU zones
with an approved Conditional Use Permit per Section 9268.10 of the Arcadia
Municipal Code.

3. That the site for the proposed use is adequate in size and shape to accommodate
said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and
other features required to adjust said use with the land and uses in the
neighborhood. Based on the proposal and the parking availability, this site is
adequate for the proposed project.
4. That the site abuts streets and highways adequate in width and pavement type to
carry the kind of traffic generated by the proposed use. The proposed tutoring
center will not significantly increase traffic to and from the subject commercial area
and the surrounding streets are all adequate for more than the traffic expected to be
generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan. The proposed tutoring center is a commercial use
that is consistent with the General Plan Land Use Designation of the site.
The proposed project satisfies each prerequisite condition.
ENVIRONMENTAL ANALYSIS
If it is determined that no significant physical alterations to the site are necessary, then
this project, as a conversion of an existing facility is categorically exempt from the
provisions of the California Environmental Quality Act (CEQA) pursuant to Section
15301 of the CEQA Guidelines. A Preliminary Exemption Assessment is attached to
this staff report.
PUBLIC NOTICE /COMMENTS
Public hearing notices of Conditional Use Permit Application No. CUP 13 -01 were mailed
on March 1, 2013 to the property owners, tenants and occupants of those properties that
are within 300 feet of the subject property (see attached radius map). Because staff
considers the proposed project exempt from the requirements of the California
Environmental Quality Act (CEQA) the public hearing notice was not published in a local
newspaper.
In response to the public notice, staff received the attached e-mail from the owner of the
property across the street from the subject site, Mr. Scott Delahooke. Mr. Delahooke
states he does not object to the proposal for a tutoring center, but does have concerns
about potential traffic congestion and pedestrian safety resulting from student pick -up and
drop -off activities. Mr. Delahooke states he has observed similar traffic congestion and
pedestrian safety issues with the existing tutoring center at 222 S. First Avenue.
RECOMMENDATION
It is recommended that the Planning Commission approve Conditional Use Permit No.
CUP 13 -01 subject to the following conditions:

1. There shall be no more than 55 students and 3 staff members at any one time.
Students shall be divided into multiple class sessions with no more than 30 students
attending any one class session.
2. Class times shall be limited to 3:00 p.m. to 9:30 p.m., Monday through Friday, and
9:00 a.m. to 7:15 p.m. on Saturday and Sunday, except for a 9 -week period during
the summer when the class times shall be limited to 9:00 a.m. to 7:15 p.m., seven
days a week.
3. There shall be a minimum of 45 minutes between the starting and ending times of
the different class sessions, and a minimum of 30 minutes between the pick -up and
drop -off times of the different class sessions. The specific class schedule shall be
subject to the approval of the Development Services Department.
4. Students shall be limited to Kindergarten through 8th grade. No students of driving
age shall be permitted at this tutoring center.
5. To avoid any queuing in the adjoining parking lot, the operator of the tutoring center
shall require all vehicles picking -up or dropping -off students to enter the on -site
parking lot via the access alley. The parents or guardians of the students shall be
required to sign a form agreeing to this provision to be kept on file at the tutoring
center.
6. Students and staff of the tutoring center shall park or be dropped -off and picked -up
in the on -site parking lot only. Drivers shall park their vehicles when picking -up and
dropping -off students.
7. The on -site parking lot shall be used for pick -up and drop -off of students attending
the tutoring center on the subject property only. The parking lot shall not be used to
pick -up or drop -off students attending the adjacent tutoring center at 222 S. First
Avenue.
8. This approval of CUP 13 -01 includes a parking modification for reduced parking stall
sizes and waiving of the landscaping requirements. This is not an approval of a
general reduction of the parking requirements for the subject commercial space, or
the subject site, but only for the tutoring center that is approved by this Conditional
Use Permit.
9. The access easement between the subject property and the adjoining property at
234 S. First Avenue shall remain in effect as long as this tutoring center is in
operation. Access between the two parking lots shall remain open and unblocked.
10.A new trash /recyclables enclosure shall be constructed on -site in the rear parking
lot. The enclosure shall be fully roofed to comply with NPDES requirements. The
design, size, and specific location of the enclosure shall be subject to the review and
approval of the Development Services Department.

11. Existing minor damage to the front of the building shall be repaired and /or repainted
so no damage or discoloration is visible from the public right -of -ways.
12. The use approved by CUP 13 -01 is limited to this tutoring center, which shall be
operated and maintained in a manner that is consistent with the proposal and plans
submitted and approved for CUP 13 -01, and shall be subject to periodic inspections,
after which the provisions of this Conditional Use Permit may be adjusted after due
notice to address any adverse impacts to the adjacent streets and /or the neighboring
businesses or properties.
13.AII City requirements regarding disabled access and facilities, occupancy limits,
building safety, emergency equipment, and parking and site design shall be
complied with to the satisfaction of the Building Official, City Engineer, Community
Development Administrator, Fire Marshal, and Public Works Services Director.
14. Noncompliance with the plans, provisions and conditions of approval for CUP 13 -01
shall be grounds for immediate suspension or revocation of any approvals, which
could result in the closing of the tutoring center.
15. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its
officers, employees, and agents from and against any claim, action, or proceeding
against the City of Arcadia, its officers, employees or agents to attack, set aside,
void, or annul any approval or condition of approval of the City of Arcadia concerning
this project and /or land use decision, including but not limited to any approval or
condition of approval of the City Council, Planning Commission, or City Staff, which
action is brought within the time period provided for in Government Code Section
66499.37 or other provision of law applicable to this project or decision. The City
shall promptly notify the applicant of any claim, action, or proceeding concerning the
project and /or land use decision and the City shall cooperate fully in the defense of
the matter. The City reserves the right, at its own option, to choose its own attorney
to represent the City, its officers, employees, and agents in the defense of the
matter.
16. Approval of CUP 13 -01 shall not take effect until the property owner(s), applicant(s),
and business owner(s) and operator(s) have executed and filed an Acceptance
Form available from the Development Services Department to indicate awareness
and acceptance of these conditions of approval.
PLANNING COMMISSION ACTION
Approval
If the Planning Commission intends to approve this proposal, the Commission should move
to approve Conditional Use Permit No. 13 -01; state the supporting findings and
environmental determination; and direct staff to prepare a resolution for adoption at the next
CUP 13 -01

meeting that incorporates the Commission's decision, speck determinations and findings,
and the conditions of approval.
Denial
If the Planning Commission intends to deny this proposal, the Commission should move
to deny Conditional Use Permit Application No. CUP 13 -01; state the finding(s) that the
proposal does not satisfy with reasons based on the record; and direct staff to prepare a
resolution incorporating the Commission's decision, and specific findings for adoption at
the next meeting.

Dear planning department,
We would like to apply for a CUP at the above referenced address. The following is a description
of our program.
Steps Academy, Inc. has been operating at our current location since March 2009. Our learning
center is founded on a mission to help children in Kindergarten through 8th grade improve their math,
reading, and writing skills. We have prepared a comprehensive curriculum, and offer each student
individualized instruction in a group setting. We emphasize a step -by -step approach to learning, so as to
foster in the student a solid foundation. We believe that no child should have limits in learning, and should
be challenged to reach their fullest potential.
At our new proposed location (220 S. 1st Ave.), we will have two instructors and one teacher's
assistant/receptionist (total of 3 employees). Other than the three classrooms, there is an office, an
assessment room for student placement exams, a conference room, and a waiting area for parents.
Our office hours are from 9:00 A.M. to 10:00 Y.M., seven days a week. When no classes are in
session, we will use the office for parent/staff meetings and /or administrative duties.
We feel that our staggered schedule will assist in a smooth pick up and drop off routine, since we
will not have more than 35 students arriving or leaving at the same time. Parents will enter the parking
area from the south entrance to the parking lot, and leave via the north exit of the parking lot after picking
up or dropping off the students. They will be required to park in designated parking spaces, and walk their
children to and from the entrance of our building. We will not allow anyone to pull into the parking lot
and drop off or pick up students without first parking. Therefore, we do not anticipate any problems with
traffic.
For your information, the First Avenue Middle School schedule is as follows:
Mon, Wed, Fri: School ends at 3:10 Y.M.
Tue, Thu: School ends at 2:15 Y.M.
Minimum days: School ends at 12:15 P.M.
As you can see, on Mondays, Wednesdays, and Fridays, our students will arrive before First Ave. students
are released from school. On Tuesdays and Thursdays, our students will arrive much later than when First
Ave. students are released. Therefore, we will not be adding to the traffic during school hours.

I will be unable to attend the hearing on 3/12/13, but I did want to submit a few comments for consideration. I own the
building directly across the street from this facility. I have no problems with the operation of a tutorial facility. However, I
do have concerns regarding traffic congestion at peak drop -off and pick -up times. The property directly south of 200 S.
First is also a tutoring center, and drivers are moving in and out of the small parking lot on that facility during times when
students from the middle - school (just south) are walking the sidewalks. There have been several near - misses, and I am
concerned that an additional use -heavy tutoring center with limited onsite parking will create congestion /safety issues. If
the traffic issues are properly addressed, I do not have a problem with the planned use, per se.
