HomeMy WebLinkAboutItem 1a: Regular Meeting Minutes of March, 5, 2013.55:0017 CITY COUNCIL /SUCCESSOR AGENCY TO THE ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING MINUTES TUESDAY, MARCH 5, 2013 CALL TO ORDER - Mayor Harbicht called the meeting to order at 6:00 p.m. in the Council Chamber Conference Room. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Kovacic, Segal, Wuo, and Harbicht ABSENT: None PUBLIC COMMENTS — No one appeared STUDY SESSION d. Report, discussion, and direction on Massage Therapist Regulations - Arcadia Municipal Code Sections 6418 et seq. Assistant City Manager /Development Services Director Kruckeberg presented the staff report. It was the consensus of the City Council that the City's Massage Therapist Regulations be amended to comply with State law; but the City retain the ability to regulate massage therapy to the fullest possible extent. The Study Session ended at 6:35 p.m. CITY COUNCIL REGULAR MEETING Mayor Harbicht called the regular meeting to order at 7:00 p.m. INVOCATION - First Reader Kristin Bennett, First Church of Christ, Scientist PLEDGE OF ALLEGIANCE — Robert Guthrie, Police Chief ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Kovacic, Segal, Wuo, and Harbicht ABSENT: None REPORT FROM CITY ATTORNEY ON STUDY SESSION ITEM City Attorney Deitsch announced that the City Council met in a Study Session to hear a report from staff regarding Massage Therapist regulations; that it was the consensus of the City Council that staff amend the City's Massage Therapist Regulations in accordance with State law. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that there was an error in the January 15, 2013 City Council minutes which were corrected; he noted that Shelly Romo was referred to as "Kelly" Romo. 55:0018 MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Amundson, seconded by Mayor Pro Tern Segal to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Mayor Harbicht announced that April 2, 2013 was designated as Arbor Day. 1. PUBLIC HEARING a. Adopt Resolution No. 6860 approving the issuance by The California Statewide Communities Development Authority of Multifamily Housing Revenue Bonds for Naomi Gardens. Recommended Action: Adopt Assistant City Manager /Development Services Director Kruckeberg and Economic Development Manager Schwartz presented the staff report. Mayor Harbicht opened the public hearing. No one appeared. A motion to close the public hearing was made by Mayor Pro Tern Segal, seconded by Council Member Wuo, and seeing no further objection, Mayor Harbicht declared the public hearing closed. It was moved by Council Member Wuo, seconded by Council Member Kovacic, and carried on roll call vote to adopt Resolution No. 6860 approving the issuance by The California Statewide Communities Development Authority of Multifamily Housing Revenue Bonds for Naomi Gardens. AYES: Council Member Wuo, Kovacic, Amundson, Segal, and Harbicht NOES: None ABSENT: None PUBLIC COMMENTS — No one appeared REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). City Clerk Glasco announced that the Arcadia Historical Society will be presenting a guest speaker at their meeting on Saturday, March 9, who will discuss the courageous story of an American family interred in Japanese prison camps in the Philippines. Council Member Amundson encouraged everyone to attend the Downtown Business Association meeting at the Arcadia Chamber of Commerce on Thursday, March 7; he addressed pedestrian safety awareness, and commended the Police Department for hosting "Pedestrian Safety Enforcement Day" at Arcadia High School. Mayor Pro Tern Segal briefly commented on his vacation and meeting other Arcadians on the cruise ship when he 11,000 mile away from home. 55:0019 City Council Member Kovacic solicited essays for the "More Visions of Arcadia" book; he announced the deadline was extended, he noted the requirements for the essay; and invited everyone to submit an essay topic by April 1. Council Member Wuo announced that February 23 was opening day for the Little Leagues in Arcadia, he thanked Recreation & Community Services for providing good programs for the youth of the community; he reminded everyone that the Mayor's Community Breakfast is March 8; and discussed the dangers of using cell phones and text messaging when driving. Mayor Harbicht announced that Tuesday, April 16 is the unveiling of the Lucky Baldwin statute and placement of an Historical Marker by the Arcadia Historical Society, and invited everyone to attend; he attended Little League opening day ceremonies over the weekend and commented on the great condition of the ball fields; and announced that he also attended the Arcadia Girls Softball opening day at Camino Grove School, the Arcadia High School Orchestra dinner, and the Dana Music Club fundraising. 2. CONSENT CALENDAR a. Approve the Regular Meeting Minutes of January 15, 2013, February 5, 2013, February 19, 2013, and the Special Meeting Minutes of February 5, 2013. Recommended Action: Approve b. Adopt Resolution No. 6857 approvina Fair Political Practices Commission Form 806 regarding the appointment of City Council Members to outside compensated positions to conform with Section 18705.5 of Title 2 of the California Code of Regulations, as amended by the Fair Political Practices Commission. Recommended Action: Adopt Adopt Resolution No. 6862 accepting a dedication for street purposes as set forth in Parcel Map 71791 at 609 South Second Avenue. Recommended Action: Adopt Accept all work performed by Arc - Accucon Construction Inc. for the Sidewalk Accessibility on Colorado Street between Colorado Place and Harvard Drive Project as complete. Recommended Action: Approve e. Authorize and direct the City Manager to execute a Professional Services Agreement with Civiltec Engineering, Inc. for Flow Analysis and Design of Sixth Avenue Sewer Project in the amount of $23,320. Recommended Action: Approve Authorize and direct the Citv Manaaer to execute a Professional Services Aareement with John L. Hunter & Associates, Inc. for Inspection, Monitoring and Program Management Support Services for the Municipal Stormwater and Industrial Waste Programs, with optional annual extensions, in the amount of $68,635. Recommended Action: Approve Authorize and direct the City Manager to execute a contract with Dash Construction Company, Inc. in the amount of $346,777 for the City Hall Exterior Renovation Project and approve a 10% contingency. Recommended Action: Approve 55:0020 Authorize and direct the City Manager to retain the services of the Workshop Printers for services related to the printing and publishing of the book "More Visions of Arcadia" in the amount of $18,729. Recommended Action: Approve Approve the purchase of 16 Motorola handheld radios and accessories for the Police Department from Day Wireless Systems in the amount of $73,915.78; and waive the formal bid process. Recommended Action: Approve It was moved by Council Member Amundson, seconded by Council Member Wuo, and carried on roll call vote to approve Consent Calendar Items 2.a through 2.i. AYES: Council Member Amundson, Wuo, Kovacic, Segal, and Harbicht NOES: None ABSENT: None ABSTAIN: Council Member Segal (February 5, and February 19 City Council Minutes) 3. CITY MANAGER ITEMS a. Report, discussion, and direction concerning establishment of the "Thoroughbred Racing Walk of Champions" on City sidewalks and right -of -way. Recommended Action: Approve in Concept Assistant City Manager /Development Services Director Kruckeberg presented the staff report. Beth Costanza appeared and announced that a committee was established to develop a "Thoroughbred Racing Walk of Champions "; that the goal would be to honor and promote thoroughbred racing in Arcadia; she introduced committee members Sandy Snider and Gail Marshall, and Matt McSweeny who was not present; she indicated that the committee has been working with the Arcadia Historical Society, the Arcadia Downtown Business Association, Santa Anita Park, and the Arcadia Chamber of Commerce who support the concept; she then presented a power point presentation, which explained the process and concept. It was moved by Council Member Kovacic, seconded by Council Member Wuo, and carried on roll call vote to approve in concept the establishment of the "Thoroughbred Walk of Champions" on City sidewalks and rights -of -way. AYES: Council Member Kovacic, Wuo, Amundson, Segal, and Harbicht NOES: None ABSENT: None b. Approve the Revised Statement of Investment Policy. Recommended Action: Approve Administrative Services Director Quach and Financial Services Manager /Treasurer Shannon Huang presented the staff report. It was moved by Council Member Wuo, seconded by Mayor Pro Tern Segal, and carried on roll call vote to approve the revised Statement of Investment Policy. AYES: Council Member Wuo, Segal, Amundson, Kovacic, and Harbicht NOES: None 55:0021 ABSENT: None Report, discussion, and direction concerning release of Design /Build Request for Proposals for the Museum Education Center. Recommended Action: Approve Release of Request for Proposals Assistant City Manager /Development Services Director Kruckeberg presented the staff report. It was moved by Council Member Kovacic, seconded by Council Member Amundson, and carried on roll call vote to approve the release of the Design /Build Request for Proposals for the Museum Education Center and consider the use of Park and Recreation Impact Fees toward funding the project.
