SUBJECT: AUTHORIZE AND DIRECT THE CITY MANAGER TO EXECUTE A
CONTRACT WITH VARGAS OLSON ENTERPRISES, INC. FOR THE
WILDERNESS PARK RESTROOM PROJECT IN THE AMOUNT OF
$144,000
Recommendation: Approve
SUMMARY
The Public Works Services Department was notified by the Department of Justice
regarding the inaccessibility of the restrooms at Wilderness Park for people with
disabilities. In response, the City included the Wilderness Park Restroom Remodel
Project as part of the Fiscal Year 2012 -13 Capital Improvement Program. The goal of
the project was to provide access to the existing restrooms that conform to Americans
with Disabilities Act (ADA) standards. After considering several design options, it was
concluded that the most effective way to achieve the ADA requirements for access and
use of the restrooms would be to construct a new restroom facility at the same level as
the existing park shelter.
Plans and specifications were distributed to local contractors and Vargas Olsen
Enterprises, Inc. responded with the lowest responsive bid for the project. Therefore, it
is recommended that the City Council authorize the City Manager to execute a contract
with Vargas Olson Enterprises Inc. for the Wilderness Park Restroom Project in the
amount of $144,000.
DISCUSSION
The Americans with Disabilities Act (ADA), enacted in 1990, is landmark legislation
intended to extend civil rights protection to people with disabilities. A result of this act
has been the creation and implementation of design standards intended to provide
access to publicly available buildings, facilities, and rights -of -way, regardless of the
individual's physical abilities.

Wilderness Park is a unique City facility located in the Santa Anita Canyon and the
facilities at the park were constructed prior to the enactment of the Americans with
Disabilities Act. The existing restroom for the park is located next to the park shelter, on
a small hill about five feet higher in elevation than the shelter. Access to the restrooms
is achieved by walking up several steps; however, this access does not meet ADA
standards. In addition, the facilities within the restrooms do not meet ADA standards
(Attachment "A ").
Several designs including sloped walkways, and ramps were considered, as well as
ways to modify the existing restrooms to meet the ADA requirements. All of the designs
considered were very expensive, or reduced the existing capacity of the restrooms. The
design to construct a new restroom at the same level as the existing park shelter was
the only design that met all of the requirements of cost, ADA compatibility, and providing
a continued level of service to the public (Attachment "B ").
Plans and specifications were prepared to construct a 525 square foot restroom facility
that includes ADA compliant space and railings. The men's restroom will include two
urinals, one toilet, and two sinks. The women's restroom will include three toilets and
two sinks. The facility includes a janitor's closet that provides access for mechanical
and plumbing maintenance. The bid package was prepared including a base bid, which
involved the construction of the restroom structure and all of the interior finishes, and a
bid alternate which involved construction of the connection for utilities, such as
electricity, water, and sewer. Since the lowest bid received is within the budgeted
amount for the restroom, the bid alternate will be included in the contract.
Notices inviting bids were published in the City's adjudicated paper and bid packages
were distributed to area contractors. The City Clerk publicly opened three (3) sealed
bids on February 19, 2013. The following bid results are listed for the City Council's
review and consideration:

Bid documents were carefully reviewed for content and the contractors' backgrounds
and recent projects were investigated for competency. It has been determined that
Vargas Olson Enterprises, Inc. is the lowest responsive bidder to perform the
construction of this project.

ENVIRONMENTAL ANALYSIS
The Wilderness Park Restroom Project involves the replacement of existing utility
systems and is therefore categorically exempt per Section 15302 of the California
Environmental Quality Act Guidelines.
FISCAL IMPACT
The Wilderness Park Restroom Project was budgeted in the Fiscal Year 2012 -13
Capital Improvement Program (CIP) for construction cost of $150,000.
RECOMMENDATIONS
It is recommended that the City Council authorize and direct the City Manager to
execute a contract with Vargas Olson Enterprises, Inc. for the Wilderness Park
Restroom Project in the amount of $144,000.
