HomeMy WebLinkAbout6867RESOLUTION NO. 6867 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DETERMINING THAT THE VOCATIONAL TRAINING PROGRAM AS PROPOSED TO BE OPERATED BY SOCIAL VOCATIONAL SERVICES, INCORPORATED, AT THE FIRST FLOOR OF 225 EAST SANTA CLARA STREET, SUBJECT TO CERTAIN CONDITIONS OF APPROVAL IS COMPATIBLE WITH THE PURPOSES OF THE COMMERCIAL PLANNED DEVELOPMENT -1 (CPD -1) ZONE WHEREAS, a determination of use was requested by Ms. Susan Copley- Leonhardt of Social Vocational Services, Incorporated, to have a proposed vocational training program deemed compatible with the purposes of the Commercial Planned Development -1 (CPD -1) Zone to allow the proposed vocational training program to be operated at the first floor of 225 East Santa Clara Street; and WHEREAS, on May 7, 2013, a public hearing was held before the City Council on said matter, and at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the associated staff report are true and correct, including the conclusion that this project is categorically exempt from further environmental assessment per the provisions of the California Environmental Quality Act (CEQA) as a Class 1 Categorical Exemption per Section 15301 of the CEQA Guidelines. SECTION 2. That for the foregoing reasons this Council deems as compatible with the purposes of the Commercial Planned Development -1 (CPD -1) Zone, the vocational training program to be operated as follows by Social Vocational Services, Incorporated, at the first floor of the office building at 225 East Santa Clara Street: employ up to 20 service professionals and three administrative staff to train a maximum of 60 developmentally - disabled adults that will be transported to and from the site in a maximum of eight passenger vans for the vocational training that will be held from 7:00 a.m. to 4:00 p.m., Monday through Friday, with the facility being closed evenings, weekends, and State holidays, subject to the following conditions: 1. Any changes to the existing facility may be subject to permits after having fully detailed plans submitted for plan check review and approval such that all City requirements regarding disabled access and facilities, occupancy limits, building safety, fire suppression and prevention, health code compliance, emergency equipment, environmental regulations, and parking and site design shall be complied with to the satisfaction of the Building Official, City Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director. 2. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and /or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and /or land use decision and the City shall cooperate fully in the defense of -2- the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 3. Noncompliance with the plans, provisions and conditions of approval shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the training center. 4. Approval shall not take effect until the property owner(s), applicant(s), and business owner(s) and operator(s) have executed and filed an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of any and all conditions of approval.
