Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation
in order to participate in a meeting, including auxiliary aids or services, may request such modification or accommodation from Planning
Services at 628-574-5423. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure

You are hereby advised that should you desire to legally challenge in court any action taken by
the Modification Committee regarding any Public Hearing item, you may be limited to raising only
those issues and objections you or someone else raised at the public hearing or in written
correspondence delivered to the Modification Committee at, or prior to, the public hearing.

618 E. Live Oak Avenue
Applicant: Yana Lin
The applicant is requesting a Parking Modification of 55 spaces in lieu of 62 spaces
required to permit a new dental office within an existing 1,175 square -foot commercial
unit that is part of an existing 9,239 square -foot, multi - tenant budding at 600 — 618 E.
Live Oak Avenue.
Conditionally approved. 3-0:
1. The property owner shall construct a new roofed trash and recyclables enclosure
within the rear parking lot, which shall comply with the stormwater pollution
prevention requirements. The location and design of the enclosure shall be subject
to approval by the Development Services Director or designee prior to issuance of
a building permit, and shall be installed prior to opening of the dental office.
2. Recycling service shall be added to this commercial center to comply with the
City's Mandatory Commercial Recycling requirements prior to issuance of a
Certificate of Occupancy for this dental office.
3. The property owner shall upgrade the parking areas to comply with current
handicap accessibility requirements. The parking plan shall be subject to approval
by the Building Official prior to issuance of a building permit, and completed prior
to opening of the dental office.
There is a five working day appeal period. Appeals are to be filed by 5:30 p.m. on
Wednesday, May 22, 2013.

The applicant is requesting the following approvals for a 148 square -foot addition to an
existing 4,468 square -foot, single -story residence:
1. A Modification to allow a 21' -3" rear yard setback in lieu of the required 25' -0" required
(AMC Sec. 9252.2.4); and
2. Architectural Design Review for the addition to the rear of the residence.
Approved, 3 -0
There is a five working day appeal period. Appeals are to be filed by 5:30 p.m. on
Wednesday, May 22, 2013.
PUBLIC COMMENTS (5 minute time limit per person)
Each speaker is limited to five (5) minutes per person, unless waived by the Modification
Committee. Under the Brown Act, the Members are prohibited from discussing or taking action
on any items not listed on the posted agenda.
ADJOURNMENT
The Modification Committee will adjoum this meeting to May 28, 2013, at 7:45 a.m. in the Council
Chambers Conference Room, 240 W. Huntington Drive, Arcadia.
