PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Falzone, Parrille and Chiao ABSENT: Commissioner Beranek MOTION: Commissioner Baerg moved to excuse Commissioner Beranek and Commissioner Parrille seconded the motion. Without objection, the motion was approved. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS There was none. PUBLIC COMMENTS There were none. 1. PUBLIC HEARING a. Conditional Use Permit No. CUP 12 -22 and Architectural Design Review No. ADR 13 -08 Ms. Candice Doyle, Architect for Starbucks Coffee 733 W. Naomi Avenue, Units A & B The applicant is requesting a Conditional Use Permit with a Parking Modification and Architectural Design Review to expand the existing 893 square -foot Starbucks Coffee into the adjacent comer unit for a proposed area of 1,513 square feet, remodel the exterior storefront, and extend the business hours to 5:30 a.m. to 11:30 p.m., daily. RESOLUTION NO. 1872 A Resolution of the Planning Commission of the City of Arcadia, Califomia, granting Conditional Use Permit No. CUP 12 -22 with a Parking Modification and Architectural Design Review No. ADR 13 -08 to expand the existing 893 square foot Starbucks Coffee into the adjacent comer unit for a proposed area of 1,513 square feet, remodel the exterior storefront, and extend the business hours at 733 W. Naomi Avenue, Units A & B. Recommended action: Approve Conditional Use Permit No. 12 -22 and Architectural Design Review No. ADR 13 -08 and adopt Resolution No. 1872 5 -28 -13 Senior Planner, Lisa Flores presented the staff report. Chairman Chiao opened the public hearing and asked if anyone would like to speak in favor of this project. There were none. Chairman Chiao asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to approve Conditional Use Permit No. CUP 12 -22 and Architectural Design Review No. ADR 13 -08 based on the findings in the staff report and subject to the conditions recommended in the staff report and to adopt Resolution No. 1872. Baldwin Avenue The applicant is requesting a Conditional Use Permit with a Parking Modification and Architectural Design Review to allow a new restaurant within the existing 7,260 square foot commercial unit, remodel the exterior storefronts, and add a new outdoor dining area that fronts Baldwin Avenue. The proposed business hours are from 11:00 a.m. to 1:00 a.m. daily. RESOLUTION NO. 1873 A Resolution of the Planning Commission of the City of Arcadia, Califomia, granting Conditional Use Permit No. CUP 12 -20 with a Parking Modification and Architectural Design Review No. ADR 13 -10 for a new Asian Fusion restaurant in an existing 7,260 square foot commercial unit, remodel of the exterior storefronts, and add a new outdoor dining area that fronts Baldwin Avenue at 1227 S. Baldwin Avenue. 5 -28 -13 MOTION MOTION Recommended action: Approve Conditional Use Permit No. 12 -20 and Architectural Design Review No. ADR 13 -10 and adopt Resolution No. 1873 Senior Planner, Lisa Flores presented the staff report. Chairman Chiao opened the public hearing and asked if anyone would like to speak in favor of this project. Ms. Patsy Ma, leasing agent for the shopping center spoke in favor of the project. Chairman Chiao asked if anyone would like to speak in opposition to this project. There were none. It was moved by Commissioner Falzone, seconded by Commissioner Parrille, to close the Public Hearing. Without objection the motion was approved. It was moved by Commissioner Baerg, seconded by Commissioner Parrille, to approve Conditional Use Permit No. CUP 12 -20 and Architectural Design Review No. ADR 13 -10 based on the findings in the staff report and subject to the conditions recommended in the staff report and to adopt Resolution No. 1873. HOA Decision Appeal No. HOA 13 -01, Oak Tree Encroachment Permit Application No. THE 13 -27 and Modification No. MP 13 -06 2081 Carolwood Drive Mr. Surendra Thakral The appellants have appealed the Highlands Homeowners' Association's Architectural Design Review Board's approval of the applicant's architectural design of a 5,159 square -foot, two -story, single - family residence. Concurrently, the applicant is requesting an Oak Tree Encroachment Permit to allow the proposed new home and garden walls to encroach upon two oak trees, and a Zoning Modification to allow a 20' -0" front yard setback in lieu of the 25' -0" requirement. Recommended action: Denial of appeal, and approval of the Oak Tree Encroachment Permit and Modification Applications Associate Planner, Tom Li presented the staff report. 5 -28 -13 MOTION MOTION Chairman Chiao opened the public hearing and asked if anyone would like to speak in support of this appeal. Ms. Karin Hansen, a neighbor whose property is adjacent to the subject site, spoke in support of the appeal. Mr. Ka Ming Pang, a neighbor whose property is across the street from the subject site, spoke in support of the appeal. Chairman Chiao asked if anyone would like to speak in opposition to this appeal. Mr. Surendra Thakral, the owner, spoke in opposition to the appeal. Mr. Ralph Bicker, Architectural Review Board Chairman for the Highlands Homeowners' Association, spoke in opposition to the appeal. Chairman Chiao asked if anyone would like to speak in rebuttal. There were none. It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to close the Public Hearing. Without objection the motion was approved. It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to deny HOA Decision Appeal No. HOA 13 -01, and approve Oak Tree Encroachment Permit Application No. THE 13 -27 and Modification No. MP 13 -06 based on the findings in the staff report and subject to the conditions recommended in the staff report. Recommended action: Conditional approval Associate Planner, Tom Li presented the staff report. Chairman Chiao opened the public hearing and asked if anyone would like to speak in favor of this project. 5 -28 -13 MOTION MOTION Mr. Hank Jong, Civil Engineer on the project, spoke in favor of the project. Chairman Chiao asked if anyone would like to speak in opposition to this project. Ms. Lynn Snetsinger, a neighbor of the project site, spoke in opposition to the project. Chairman Chiao asked if anyone would like to speak in rebuttal. Mr. Hank Jong spoke in rebuttal. It was moved by Commissioner Falzone, seconded by Commissioner Parrille, to close the Public Hearing. Without objection the motion was approved. It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to approve Tentative Parcel Map No. TPM 13 -06 (72274), Modification No. MP 13 -04, and Multi - Family Architectural Design Review No. MFADR 13 -02 subject to the conditions in the staff report. Planning Commission Determination Finding that the proposed Capital Improvement Program for 2013 -2014 is consistent with the General Plan. Recommended action: Approve b. Minutes of the Mav 14, 2013, meeting Recommended action: Approve MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone to approve the determination for the Capital Improvement Program for 2013 -14 and to approve the minutes of the May 14, 2013 meeting. 5 -28 -13 ROLL CALL AYES: Commissioners Baerg, Falzone, Parrille and Chiao NOES: None ABSENT: Commissioner Beranek MATTERS FROM COUNCIL LIAISON, JOHN WUO Councilman Wuo expressed concem about the parking deficiencies at the sites of the two Conditional Use Permits approved at the meeting. MATTERS FROM PLANNING COMMISSIONERS There were none. MATTERS FROM MODIFICATION COMMITTEE Chairman Chiao said that the Modification Committee meeting was cancelled. MATTERS FROM STAFF INLCUDING UPCOMING AGENDA ITEMS Mr. Kasama said that the June 11 meeting will include the review of an application for a Conditional Use Permit for a thrift store replacing Ralphs Grocery store on Live Oak Avenue.
