SUBJECT: ACCEPT ALL WORK PERFORMED BY CJ CONSTRUCTION, INC. FOR
THE REPAIR OF STREETS WITH STONE PINE TREES AS COMPLETE
AND AUTHORIZE THE FINAL PAYMENT TO BE MADE IN
ACCORDANCE WITH THE CONTRACT DOCUMENTS, SUBJECT TO
RETENTION OF $2,919.09

SUMMARY
On December 18, 2012, the City Council awarded a contract to CJ Construction, Inc. in
the amount of $60,780, for Repair of Streets with Stone Pine Trees (Phase 3). The
terms and conditions of this project have been complied with and the work has been
performed to staff's satisfaction for a total project cost of $58,381.75. This amount
reflects the original contract amount of $60,780 minus quantity changes totaling
$2,398.25, or 4% less than the original contract amount. It is recommended that the
City Council accept all work performed by CJ Construction, Inc. as complete and
authorize the final payment to be made in accordance with the contract documents,
subject to retention of $2,919.09.
DISCUSSION
The Stone Pine trees in the Highland Oaks area north of Elkins Drive caused significant
damage to City streets, curbs and gutters, sewer laterals, sprinkler systems, and private
property hardscape. These conditions resulted in safety concerns for motorists and
pedestrians in addition to several instances when trees or tree limbs have fallen due to
the size and age of the trees. In response to problems associated with these massive
trees, the Public Works Services Department had an arborist review the Stone Pine
trees in the Highland Oaks neighborhood and asses the condition of each tree.

At the August 3, 2010, Study Session, the City Council directed the Public Works
Services Department to move ahead with its plan to rehabilitate the City streets
damaged by the Stone Pine trees that included removing the Stone Pine trees in the
Highland Oaks neighborhood north of Elkins Drive. The project was broken up into
three phases based on the level of damage: Phase 1 was streets with the most extreme
damage; Phase 2 was streets with severe damage; and Phase 3 is streets with the least
or moderate street damage. Phases 1 and 2 were completed in July of 2011.
The work to complete Phase 3 was awarded under two separate contracts. One
contract included the removal of the Stone Pine trees and replacement with trees that
were indentified in the Urban Forest Master Plan. The second contract (Streets), which
is the work considered in this staff report, included the replacement of damaged
pavement, curbs, and gutters.
On December 18, 2012, the City Council awarded a contract to CJ Construction, Inc. for
Repair of Streets with Stone Pine Trees (Phase 3) in the amount of $60,780. The work
was completed under budget due to the contractor having to do less removal and
replacement work than was anticipated. As a result, there is a savings of $2,398.25, or
4% less than the original contract amount.
FISCAL IMPACT
Phase 3 of the project has a total approved budget of $140,000. This portion of the
work was completed for $58,381.75, which is a 4% savings from the authorized contract
amount.
RECOMMENDATION
It is recommended that the City Council accept all work performed by CJ Construction,
Inc. for the Repair of Streets with Stone Pine Trees as complete and authorize the final
payment to be made in accordance with the contract documents, subject to retention of
$2,919.09.
