ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None PUBLIC COMMENTS — No one appeared CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the Workers' Compensation case of Andy Troncale. b. Pursuant to Government Code Section 54956.9(d)(2) to confer with legal counsel regarding anticipated litigation — one (1) case. There was no reportable action from the Closed Session items. The Closed Session ended at 5:50 p.m. STUDY SESSION (OPEN TO THE PUBLIC) a. Review of Single - Family Architectural Design Review procedures. Assistant City Manager /Development Services Director Kruckeberg presented the staff report. it was moved by Council Member Kovacic, seconded by Mayor Pro Tern Wuo, and carried on roll call vote that staff bring back for consideration a proposed fee increase for single - family Architectural Design Review. AYES: Council Member Kovacic, Wuo, Amundson and Segal NOES: Council Member Harbicht ABSENT: None The Study Session ended at 7:05 p.m. CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Segal called the regular meeting to order at 7:08 p.m. INVOCATION - Reverend Darwin Ng, Police Department Chaplain PLEDGE OF ALLEGIANCE - Jason Kruckeberg, Assistant City Manager /Development Services Director 1 05 -21 -13 55:0045 ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo and Segal ABSENT: None REPORT FROM CITY ATTORNEY ON CLOSED /STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council met in a Closed Session to consider the two (2) items listed on the posted agenda; no reportable action was taken. In addition, Mr. Deitsch reported that the City Council met in a Study Session to hear a report from staff regarding Single - Family Architectural Design Review procedures; and that the City Council directed staff to bring back to the City Council for consideration a proposed fee increase for single - family Architectural Design Review. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that supplemental information was distributed to the City Council relating to Public Hearing item 1.a, and City Council /Successor Agency item 4.b regarding the Expansion of Rusnak Mercedes Benz, which will be discussed in open session under those agenda items. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Amundson, seconded by Mayor Pro Tern Wuo, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of Proclamation to Arcadia resident Debby Singer, honoring her for her 44 years of teaching and as Education Director at Pasadena Jewish Temple and Center b. Presentation by Los Angeles County Metropolitan Transportation Authority on funding for soundwalls along the 1 -210 Freeway 1. PUBLIC HEARING a. Consideration of Sr)ecific Plan No. SP 13 -01, Tentative Parcel Mar) No. TPM 13 -01 General Plan Amendment No. GPA 13 -01 Zone Change No ZC 13 -01 and Architectural Design Review No. ADR 13 -04 for a 4 -story , 70,096 square foot medical office development at 289 West Huntington Drive. (Continued from May 7 2013, meeting). Introduce Ordinance No. 2307 adopting Specific Plan — Santa Anita 1 and the Specific Land Use Regulations contained therein for The Hale Medical Center on the Property located at 289 West Huntington Drive. Recommended Action: Introduce 2 05 -21 -13 55:0046 Introduce Ordinance No. 2308 making certain amendments to the text of the Arcadia Zoning Code: and amending the zoning designation of certain property within the City from "S -1" to "SP -SA1" with respect to The Hale Medical Center Specific Plan Recommended Action: Introduce Adopt Resolution No. 6865 Approving General Plan Amendment No GPA 13 -01 to change the General Plan Land Use Designation of the property at 289 W Huntington Drive from "Santa Anita Park Commercial (0.3 FARM' to "Commercial (0.5 FAR)." Recommended Action: Adopt Adopt Resolution No. 6866 approving Architectural Design Review No ADR 13 -04 for a four -story, 70,096 square foot medical office development at 289 West Huntington Drive. Recommended Action: Adopt City Attorney Deitsch stated that the public hearing conducted at the meeting of May 21, 2013, was opened and closed; and recommended that the City Council not re -open the public hearing; and noted that staff will present a report addressing the issues raised in the letter received during the public comment period from Mr. Matsler on behalf of Windrose Santa Anita Properties. AYES: Council Member Harbicht, Wuo, Amundson, Kovacic, and Segal NOES: None ABSENT: None PUBLIC COMMENTS Erin L. Mayfield appeared and complained about a threat that she and her mother experienced on an MTA bus; and commented on a related issue that she had with an Arcadia Police Officer. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Kovacic thanked Mayor Segal for honoring Debby Singer; he noted that the construction of the Santa Anita Bridge will begin next week and will continue for about seven months; that some lanes on the Santa Anita Avenue will be closed so everyone should expect delays, and reminded everyone to continue to patronize all of the businesses in that area; and on behalf of the City, he sent heartfelt condolences to the entire town and victims of Moore, Oklahoma. Mayor Pro Tern Wuo congratulated Bob Baines who was recently selected as Senior of the Year; he announced the annual "Remembering Our Veterans" celebration on May 25 at the Arcadia County Park hosted by the Los Angeles County Supervisor's office; and announced that the Historical Society will be honoring Carol Libby on May 30 at the Los Angeles County Arboretum's Peacock Cafd. Council Member Amundson noted that Monday is Memorial Day and encouraged everyone to do something to recognize the day and remember the Veterans. Council Member Harbicht commented on the Rotary Club's Salute to Seniors; he congratulated Bob Baines as Senior of the Year; and congratulated Denise Gilb who was recently named as President of the Altrusa Club. City Clerk Glasco announced that the Arcadia Police Department Ford Galaxy will be on display at the Memorial Day event at the Los Angeles County Park on May 25; he provide information on the "Hats off to Carol" celebration honoring Carol Libby at the Los Angeles County Arboretum; and wished everyone a Happy Memorial Day. Mayor Segal announced that he attended the Arcadia High School Booster Club event where they honored Football Coach Jon Dimalante and inducted him into the Arcadia High School Football Hall of Fame; and he thanked the City Council for assisting him with his Mayor duties by attending various functions that he is not able to attend. 4 05 -21 -13 55:0048 2. CONSENT CALENDAR a. Approve the Special Meetina Minutes of April 30 2013 and Reaular Meeting Minutes of May 7, 2013. Recommended Action: Approve b. Appointments of City Council Members to City Boards & Commissions and outside governmental agencies. Recommended Action: Receive and File C. Waive the formal bid process and approve Quartermaster as the uniform vendor for the Police Department in an amount not to exceed $55,000. Recommended Action: Approve d. Authorize and direct the City Manager to execute a one year purchase order contract extension with Waterline Technologies, Inc. for the purchase and delivery of Sodium Hypochlorite to be used for the disinfection of the City's municipal water supply in the amount of $49,785. Recommended Action: Approve e. Authorize and direct the City Manager to execute a lease agreement with California Domestic Water Company for 3,000 acre feet of Fiscal Year 2012 -13 water production rights in the Main San Gabriel Basin for a total cost of $1,817,100. Recommended Action: Approve f. Selection of Executive Search Firm for Human Resources Administrator Recruitment. Recommended Action: Approve Council Member Amundson noted that he spoke to the Police Chief regarding Consent Calendar item 2.c and recommended looking at domestic manufacturers and purchasing American made whenever possible. It was moved by Council Member Amundson, seconded by Council Member Harbicht, and carried on roll call vote to approve Consent Calendar Items 2.a through 2.f. Authorize and direct the City Manager to execute aMemorandum of Understandin with the Cities of Azusa. Bradbury, Duarte, Monrovia, and Sierra Madre as well as the County of Los Angeles and Los Angeles County Flood Control District regarding administration and cost sharing for the development of the Enhanced Watershed Management Program for the Rio Hondo /San Gabriel River Water Quality Group; and direct staff to prepare and submit a Notice of Intent to the California Regional Water Quality Control Board, Los Angeles Region. It was moved by Council Member Harbicht, seconded by Council Member Amundson, and carried on roll call vote to authorize and direct the City Manager to execute a Memorandum of Understanding with the Cities of Azusa, Bradbury, Duarte, Monrovia, and Sierra Madre as well as the County of Los Angeles and Los Angeles County Flood Control District regarding administration and cost sharing for the development of the Enhanced Watershed Management Program for the Rio Hondo /San Gabriel River Water Quality Group; and direct staff to prepare and submit a Notice of Intent to the California Regional Water Quality Control Board, Los Angeles Region. Approve the First Amendment to Building and Roof Space Lease with Los Angeles Cellular Company (AT &T) for the Arcadia Self Storage Building at 35 West Huntington Drive. Recommended Action: Approve Economic Development Manager Schwartz presented the staff report. It was moved by Council Member Harbicht, seconded by Council Member Kovacic, and carried on roll call vote to approve the First Amendment to the Building and Roof Space Lease with Los Angeles Cellular Company (AT &T) for the Arcadia Self Storage Building at 35 West Huntington Drive. Conditions and Restrictions. and Negative Declaration for the sale of 21 Morlan Place, 101 -111 North Santa Anita Avenue, 121 -159 North Santa Anita Avenue, and Assessor Parcel No. 5775 - 025 -908 by the City of Arcadia as the Successor Agencv to the Former Redevelopment Agency of the City of Arcadia to the Paul P. Rusnak Family Trust, for the Expansion of Rusnak Mercedes Benz. Recommended Action: Approve Negative Declaration, Purchase and Sale Agreement and Escrow Instructions, and Declaration of Covenants, Conditions, and Restrictions Assistant City Manager /Development Services Director Kruckeberg presented the staff report.
