A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, INITIATING PROCEEDINGS FOR THE
ANNUAL LEVY AND COLLECTION OF ASSESSMENTS FOR THE
ARCADIA KAITLYN PLACE LANDSCAPING AND LIGHTING
DISTRICT PURSUANT TO THE PROVISIONS OF PART 2 OF
DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS
CODE AND ORDERING THE PREPARATION OF THE
ENGINEER'S REPORT
WHEREAS, the City Council of the City of Arcadia (the "City "), in fiscal year
2010/11, pursuant to the provisions of the Landscaping and Lighting Act of 1972,
Part 2 of Division 15 of the Streets and Highways Code of California, beginning
with Section 22500 (hereafter referred to as the "1972 Act "), established and
thereafter has levied annual assessments for the Arcadia KAITLYN PLACE
LANDSCAPING AND LIGHTING DISTRICT (hereinafter referred to as the
"District "); and
WHEREAS, the 1972 Act provides for the formation of an assessment
district pursuant to Chapter 2 Article 1 of the 1972 Act, and the levy and collection
of assessments by the County on behalf of the City pursuant to Chapter 4 Article 2
of the 1972 Act; and
WHEREAS, the City Council has determined that it is necessary and
desirable to continue the current levels of maintenance and /or improvements of
the District; and
WHEREAS, to maintain such levels, it is necessary to continue the
collection of assessments as has occurred in the past Fiscal Year.
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to the provisions of the 1972 Act, the City Council
desires to initiate proceedings for the levy and collection of assessments to pay
for the installation, operation, maintenance and servicing of the local landscaping
improvements and appurtenant facilities related thereto during Fiscal Year 2013-
14. Pursuant to Resolution Nos. 6736 and 6737 approved on August 2, 2010, all
parcels in the City are part of the Citywide Street Lighting Assessment District.
Hence, the District's lighting expense will be covered by the Citywide Lighting
Assessment District.
SECTION 2. The boundaries of the District are as defined by the Boundary
Map contained in the Engineer's Report.
SECTION 3. The City Council has retained Willdan Financial Services as
the Engineer of Work (hereinafter referred to as the "Engineer ") for the purpose of
assisting with the annual levy of the District, including the preparation and filing of
the Engineer's Report with the City Clerk in accordance with the 1972 Act.
SECTION 4. The City Council hereby orders Willdan Financial Services to
prepare and file with the City Clerk an Engineer's Report establishing the Fiscal
Year 2013 -14 assessments for the District.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
