Huntington Dr. with Chairman Lucas presiding. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Olson to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON-PUBLIC HEARING MATTERS (5 MINUTE LIMIT PER PERSON) None CONSENT ITEMS 1. PLANNING COMMISSION DETERMINATION Finding that the proposed Capital Improvement Program for 2006-2007 is consistent with the General Plan. 2. PUBLIC HEARING CUP 5-9 & ADR 4-28 625 W. Las Tunas Drive Alex G. Cuevas Consideration of a one-year time extension for a new Arco automobile fueling station. 3. RESOLUTION NO. 1746 A Resolution of the Planning Commisssion of the City of Arcadia, California, granting an amendment to Resolution No. 1726 for the 24-hour operation of the gas pumps at the automobile service station at 3 E. Duarte Road. Motion: To adopt Resolution No. 1746 4. MINUTES OF 5/23/6 RECOMMENDATION: Approve Commissioner Baderian commended staff for the excellent report on the Capital Improvement Program. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Beranek to approve the items on the Consent Calendar. ROLL CALL: AYES: Commissioners Baderian, Beranek, Hsu, Olson, Lucas NOES: None Chairman Lucas noted that there is a five working day appeal period after the adoption of the resolution. Appeals are to be filed by June 19th 5. CONTINUED PUBLIC HEARING CUP 6-3, ADR 5-16 & TM 64609 650 W. Huntington Drive Jeff Lee Consideration of a Conditional Use Permit, Architectural Design Review, and Tentative Map for a new 76-unit senior housing project that requires the following modifications: 1) to permit approximately 44% of landscaping in lieu of 60% required within the front yard; 2) a 10'-0" westerly side yard setback in lieu of 15'-0" required; and 3) to permit a 3-story development in lieu of 2.5 story limitation permitted by the site's Architectural Design Overlay. RESOLUTION NO 1744 A Resolution of the Planning Commission of the City of Arcadia, California, approving Conditional Use Permit No. 6-3, Architectural Design Review No. 5-16, and Tentative Map No. 64609 for a new 76-unit senior condominium project at 650 W. Huntington Drive. Arcadia City Planning Commission 2 6/12/6 The staff report was presented. Commissioner Lucas asked if the city uses a standard agreement for occupancy requirements on this type of project. Ms. Flores replied that each project requires a customized agreement per the Planning Commission. Mr. Kruckeberg noted that although the language used in this type of agreement is usually similar, each agreement is tailored to the specific project. Commissioner Lucas stated that he was especially concerned with the occupancy requirements for tenants under 55 years of age and whether the city has specific guidelines for the developer concerning the agreement between the seller and buyer of a particular unit. He also asked if the age requirement was imposed in a legally binding way. City Attorney Jeff Ballinger stated that most cities do not have these requirements but instead, rely on the developer to provide them. However, Attorney Ballinger agreed to have his firm review the options. Commissioner Baderian said that although it appears the staff report covers most concerns he hopes that feedback will be available on the parking plan once the project is complete. Mr. Kruckeberg replied that upon completion of the project, a review of the parking plan can be done, however, it may be difficult to add parking at that time. Commissioner Lucas asked for clarification on the city's responsibilities in a tenancy agreement. Commissioner Beranek said the city becomes involved when a neighbor complains to the Homeowner's Association, is not satisfied with their response and takes the complaint to the city. Commissioner Olson noted that page 4, section 3 of the resolution allows a disabled child or grandchild to reside with their relatives at the senior housing project. He suggested that the wording should be changed to allow any disabled person who the senior citizen has legal guardianship over to reside with them at the project. Attorney Ballinger said that the Planning Commission can have the disabled requirement removed from the resolution. Commissioner Lucas noted that the resolution referred to three streets abutting the project site and asked if this was correct. Mr. Kruckeberg answered that there is only one street; that it is adequate in width and that the resolution will be corrected. The public hearing was opened. Mr. Scott Yang, 828 Pamela Place, representing Nevis Construction, thanked the staff for their efforts and noted that the applicant agrees with all the conditions of approval. No one else spoke in favor or in opposition to this item. The motion passed by voice vote with no one dissenting. ROLL CALL: AYES: Commissioners Baderian, Beranek, Hsu, Lucas and Olson NOES: None Commissioners Baderian and Olson suggested, that for clarity, the word "Disabled" should be removed. Commissioner Lucas recommended adding a"child, grandchild or person for whom the senior citizen is a legal guardian"in place of the word "disabled". Commissioner Baderian asked that the conditions of approval require a review of the parking plan within twelve months of occupancy as he is concerned about the possible impacts of the increase in parking. The Commissioners discussed a target date for parking review and Mr. Kruckeberg suggested adding condition 23 to the resolution requiring a parking plan review at eighteen months after the occupancy certificate is issued. MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Baderian to approve CUP 2006-03, Architectural Design Review 2005-16, TM 64609 subject to the conditions, as amended, in the staff report and adopt resolution 1744. Appeals are to be filed by June 19th 6. PUBLIC HEARING TM 66551 306-310 S. First Avenue George Liang, property owner Consideration of a proposed tentative map for a mixed-use condominium project consisting of eight (8) residential units and ground level commercial space. The staff report was presented. Commissioner Lucas noted that this project had been previously approved by the Planning Commission and Mr. George Liang, the property owner, confirmed this. Mr. Liang explained that the project had been delayed due to sales and complications in finding a contractor. Arcadia City Planning Commission 4 6/12/6 The public hearing was opened. Mr. Jack Lee, CalLand Engineering, civil engineer, represented the applicant. Mr. Lee stated that the applicant is willing to accept all conditions of approval. No one else spoke in favor or in opposition to this item. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Hsu to close the public hearing. The motion passed by voice vote with no one dissenting. PUBLIC HEARING MP 6-6 1328 Rodeo Road Paul Kalemkiarian Consideration of a front entry height modification for the rebuild of an existing single-family residence. The staff report was presented. The public hearing was opened. Mr. Paul Kalemkiarian, 1328 Rodeo Rd., the applicant, said he felt this was the best design for this project and offered to answer any questions for the Commissioners. No one else spoke in favor or in opposition to this item. Appeals are to be filed by June 19th MATTERS FROM CITY COUNCIL AND PLANNING COMMISSION Councilman Amundson noted the scoping meeting on the EIR and development of Santa Anita Race Track was scheduled for Tuesday, June 13 at 6:30 pm, at the Community Center. Commissioner Lucas stated that there will be no Planning Commission meeting on June 27, 2006. MODIFICATION COMMITTEE MEETING ACTIONS Commissioner Olson summarized the action taken by the Modification Committee. MATTERS FROM STAFF 1. CITY COUNCIL ACTIONS 2. PLANNING COMMISSION AGENDA ITEMS Mr. Kruckeberg introduce Billie Tone, the new Senior Administrative Assistant. The Planning Commission had expressed interest in a City Council study session on senior citizen housing. The agenda will be e-mailed prior to the June 20th study session.
