Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, August 22, 2006 at 7:00 p.m. in the Arcadia Council Chambers of the City of Arcadia, at 240 W. Huntington Dr., with Chairman Olson presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Baderian, Beranek, Hsu, Parrille and Olson ABSENT: None MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Parrille, to excuse Commissioner Beranek from tonight's meeting. The motion passed by voice vote with none dissenting. Chairman Olson noted that Commissioner Beranek arrived at 7:04, in time to hear the first item on the agenda. OTHERS ATTENDING Community Development Administrator Jason Kruckeberg Planning Services Manager Corkran Nicholson Senior Planner Lisa Flores Senior Administrative Assistant Billie Tone City Attorney Megan Starr Councilman Peter Amundson SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Community Development Administrator Jason Kruckeberg distributed a copy of a letter of protest against Agenda Item 4, Tentative Tract Map 67480, signed by eleven residents. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Parrille to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. PUBLIC HEARING CUP 06-08 AND ADR 05-29 2607 Santa Anita Avenue Nextel Communications, Inc. Nextel Communications, Inc., has submitted an application for a Conditional Use Permit for the installation of an equipment shelter and a 50' high, unmanned wireless communications facility designed as a monopalm. RESOLUTION NO. 1748 A Resolution of the Planning Commission of the City of Arcadia, California, approving Conditional Use Permit No. 2006-08 and Architectural Design Review No. 2005-29 for the installation of an equipment shelter and a 50' high unmanned wireless communications facility designed as a monopalm. There is a five working day appeal period after the adoption of the Resolution. Appeals are to be filed by August 29th The staff report was presented by Senior Planner Lisa Flores Commissioner Parrille noted that the proposed site is near a preschool and asked about the safety of radiation levels. Ms. Flores explained that the wireless facility will not exceed allowable radiation limits in accordance with FCC regulations. The public hearing was opened. Mr. Vincent Radzicki represented the applicant, Nextel Communications, Inc. Mr. Radzicki said that Nextel is registered with, and regulated by the FCC and PUC. He further stated that Nextel uses an all digital, high-frequency system operating at 800-900 megahertz and they are in full compliance with the American Standards Institute to maintain a harmless level of emissions. In addition, he pointed out that this project would provide the push-to-talk service often preferred by emergency services groups. Commissioner Baderian asked Mr. Radzicki if he read the staff report and was in agreement with the conditions of approval. Mr. Radzicki replied that he had read the report and had no objection to the conditions. Reverend Jolene Codenbach, of Arcadia Congregational Church, 5346 Huddart Avenue, Arcadia, expressed support for the project. Reverend Codenbach said she assisted the applicant in choosing the best site for the facility which she feels will provide improved service to the community. Reverend Codenbach also mentioned that she canvassed all the groups currently using the campus and found no opposition to the project. Mr. James E. Jillson, 5346 Huddard Avenue, Arcadia, is a member of Arcadia Congregational Church. Mr. Jillson also expressed support for the project as he anticipates a stronger and more reliable signal will result. PUBLIC HEARING GPA 06-01 Citywide General Plan Amendment A General Plan Amendment to modify Performance Standard #44 of the General Plan, which provides guidelines related to noise caused by proposed projects. The purpose of the Amendment is to replace existing criteria within Performance Standard #44 that currently does not accurately reflect noise impacts of projects. No additional safeguards, noise attenuation techniques, or performance standards will be altered as a result of this amendment and the criteria will be replaced by new language that better evaluates noise impacts. The Planning Commission will make a recommendation to the City Council. The staff report was presented by Community Development Administrator Jason Kruckeberg. Commissioner Baderian asked if future growth had been taken into consideration in the development of this General Plan Amendment, i.e., expansion of the mall or development of the Blue Line. Mr. Kruckeberg explained that cumulative impacts were considered and addressed. Commissioner Beranek said that he understood the General Plan required updating every ten years and the Arcadia General Plan is dated 1996. Mr. Kruckeberg acknowledged that this is correct and added that there are a number of elements of the General Plan that need updating. He explained that the need to modify the Noise Element had become particularly pressing so rather than wait for the update of the entire General Plan, the Noise Element is being addressed now. PC MINUTES 8-22-06 Page 3 Commissioner Beranek asked if this Amendment would provide an effective tool for management of noise. Megan Starr, from the City Attorney's office, stated that the Amendment would indeed strengthen the regulations related to noise management. The public hearing was opened. No one else spoke in favor or in opposition to this item. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Hsu, to close the public hearing. ROLL CALL: AYES: Commissioners Baderian, Beranek, Hsu, Pan-ille and Olson NOES: None Commissioner Baderian noted that the General Plan Amendment appears to provide staff with more authority to monitor noise problems and that the General Plan is always a work in progress. Commissioner Parrille commended staff on the high quality of the report. Commissioner Beranek asked Ms. Starr if this Amendment will be more "enforceable" than the present regulations. She replied that the revision will strengthen the standards and that it is compatible with the standards already in effect. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Hsu, to recommend approval to city council of GPA 06-01, as recommended by staff. PUBLIC HEARING MP 06-09 501 Campesina Road Greg Welborn Greg Welborn has submitted a Modification application for a two-story addition to the main dwelling. The modifications involve first and second story setbacks, lack of a second-story architectural offset, and to allow a portion of the second-story addition to encroach within the 40-degree plane as measured from the street-side property line. The public hearing was opened. Greg Welborn, the applicant, commended Ms. Flores on her work on project. Commissioner Baderian asked the applicant if he had reviewed the conditions of approval and if he was in agreement with the conditions. Mr. Welborn replied that he accepted the conditions. No one else spoke in favor or in opposition to this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Beranek, to close the public hearing. PUBLIC HEARING TM 67480 119-121 Alta Street Trademark Development Company, LLC Trademark Development Company, LLC, has submitted an application for a TentativeTract Map for a six-unit residential condomimium subdivision. There is a ten day appeal period period. Appeals are to be filed by September 5th The staff report was presented by Community Development Administrator Jason Kruckeberg. PC MINUTES 8-22-06 Page 5 Commissioner Baderian pointed out that the City Council and Redevelopment Agency had already approved the project and that the Commission was charged with only a review of the Tract Map at this time. Mr. Kruckeberg said the letter of opposition to the project was signed by eleven people and asked if any of them were present but there was no response. The public hearing was opened. Joel Bryant, representing the applicant, offered to answer any questions about the project. He stated that the applicant was pleased to offer this high quality project to the city. Commissioner Baderian asked the Mr. Bryant if the applicant had reviewed the conditions of approval and if they were in agreement with the conditions. Mr. Bryant replied that the applicant accepted the conditions. No one else spoke in favor or in opposition to this item. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Beranek, to close the public hearing. Commissioner Parrille asked if anyone could clarify the comment in the letter of opposition that the group will legally challenge the project. Mr. Kruckeberg explained that they can appeal the decision of the Planning Commission to the City Council up to September 5. He further noted that they may not understand that this entitlement is for the subdivision only, not for the project as a whole. Chairman Olson pointed out that none of the people who signed the letter were present and that the letter did not detail their objections. RESOLUTION NO. 1749 A Resolution of the Planning Commission of the City of Arcadia, California, approving Conditional Use Permit No. 2006-07 for a 340 sq. ft. Tea Room with 20 seats including outdoor seating at 229 S. First Avenue. There is a five working day appeal period after the adoption of the Resolution. MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Parrille to approve Resolution No. 1749. MINUTES OF 8-8-06 RECOMMENDATION: Approve MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Parrille to approve the minutes of August 8, 2006, as submitted. ROLL CALL: AYES: Commissioner Baderian, Beranek, Hsu, Parrille and Olson NOES: None MATTERS FROM CITY COUNCIL AND PLANNING COMMISSION Commissioner Beranek expressed disappointment that the City Council reversed the decision of the Planning Commission on the Singing Wood project. Commissioner Baderian agreed and suggested a joint meeting of the City Council and Planning Commission or perhaps a workshop to review objectives particularly with regard to Home Owners' Association and Architectural Review Board responsibilities. MODIFICATION COMMITTEE MEETING ACTIONS There was no Modification Committee meeting held this morning.
