SUBJECT: FILING FEE TO FILE "NOTICE OF INTENT"
It has come to my attention that the City has not established a filing
fee for those who wish to file a Notice of Intent with the Clerk to
circulate an initiative petition.
The 1988 Elections Code states in:
DIVISION 5 - Measure Submitted to the Voters
CHAPTER 3 - Municipal Elections
ARTICLE I - Initiative
SECTION 4002 (b)
"Any person filing a Notice of Intent with the Clerk shall pay a fee to
be established by the legislative body not to exceed two hundred dollars
($200) to be refunded to the filer if, within one year of the date of
filing the Notice of Intent the Clerk certifies the sufficiency of the
petition."
RECOMMENDATION:
The City Council establish a filing fee of $200 for those who file a
Notice of Intent with the Clerk to circulate an initiative petition.
