BUTLER, ASSISTANT PLANNING DIRECTOR SUBJECT: NUISANCE ABATEMENT AND ORDER FOR REHABILITATION 515 LAS TUNAS DRIVE This hearing has been scheduled pursuant to Section 9407 of the Arcadia Municiipal Code to allow the City Council to determine whether a public nuisance exists and what action is necessary to abate the nuisance on property located at 515 Las Tunas Drive. As per the above Section a "Notice of Public Nuisance and Order to Abate" was mailed on November 27, 1990 to Alice Wang, owner, for the property located at 515 Las Tunas Drive. A notice was also posted on the property on the same day. The following violations have been cited on the property: 1. Weeds and dead vegetation on the premises and in the parkway. 2. Overgrown dry vegetation. 3. Lack of adequate irrigation and overgrown vegetation which is out of conformity with adjacent residential properties. 4. All trash, debris, discarded items (i.e., water heater, appliances, etc.) shall be removed from the premises. 5. Vehicles parked and stored on unpaved areas. The purpose of the property maintenance ordinance is to ensure maintenance of property within the City so that the public health, safety and welfare are not endangered by substandard properties and the blighting effect such properties have on the entire community. The City Council in adopting the ordinance determined that the City "has a widely recognized history and reputation for well-kept properties and that the general welfare of the City is founded, in part, upon the appearance and maintenance of properties." i 515 Las Tunas Drive December 18,'1990 Page 1 LASER IMAGED 4 The Council further determined that "the keeping or maintaining of properties,at variance with the level of maintenance of surrounding properties will result ins substantial diminution in the enjoyment, use, aesthetic and property values of the surrounding properties. It is desirous to enhance and promote the maintenance of property and the enhancement of the liveability, community appearance and the social economic conditions of the community." The Property Maintenance Ordinance states: "That unless corrective measures of the type set forth in this chapter are undertaken to alleviate such existing conditions, the public health, safety and general welfare, and the property values and social and economic standards of this community will be substantially depreciated; that the abatement of the conditions will enhance the environment of the residents of the City." HISTORY This property has had a maintenance problem (primarily landscape maintenance) since 1986 when it was owned by Mr. Grothe. In 1987 the current owner, Alice Wang was cited for maintenance problems, including the driveway which is in need of repair and landscape maintenance. Since 1987, Mrs. Wang has been cited six times. There has never been any significant long term change on the site and in addition to the landscape maintenance and driveway repair problems, there are now the other violations cited above. An office conference was held on November 16, 1990 at which time Mrs. Wang was advised that abatement procedures would be initiated. Mrs. Wang indicated that she has plans in plan check for a new home. These plans were submitted to the City on May 5, 1990 and have expired. The purpose of the abatement procedure is to provide a way in which the city can resolve property maintenance problems that are uncared for over extended periods of time with the exception of landscape maintenance. As noted above, since 1987 the property has been an eyesore and continuing problem.Wang since 1987. During this time there has been minimal attempt to bring the property into conformance with the code. Although some of the violations cited on page 1 (i.e., removal of trash, debris and large weeds, etc.) can be handled through the abatement procedure, the problems regarding lack of adequate irrigation and maintenance of landscaping are not appropriate for the abatement procedure. 515 Las Tunas Drive December 18, 1990 Page 2 LASER IMAGED Landscape maintenance has been an ongoing problem on this property since 1986. The abatement procedure does not provide for long term landscape maintenance of property. Even if new lawn is planted, there is no guarantee that the owner will continue to maintain the lawn (i.e., watering, mowing, etc.) and the City does not have the ability to provide the continued upkeep that is necessary to maintain a lawn. It is the Planning Department's opinion that on properties where there are continued landscape maintenance problems, the owners should be filed on for a midemeanor and taken to court. This may discourage property owners from continuing to violate the property maintenance ordinance and encourage long-term maintenance of their properties. The City Attorney's office is preparing to file a criminal complaint the week of December 17. Attached for the City Council's review is the Notice of Public Nuisance and Order to Abate. The City Council should open the hearing to receive public input. Based upon information submitted and the public input the Council may: 1. Determine that the property is not a public nuisance and take no further action; or 2. NICHOLSON, ASSOCIATE PLANNER SUBJECT: A REQUEST FOR A BUILDING CODE VARIANCE TO PERM A 4'-0" SIDE YARD SETBACK IN LIEU OF 5'-0" REQUIRED FO AN EXISTING SCREENED PATIO ENCLOSURE AT 914 WEST FAIRVIEW AVENUE. Attached for your consideration is a letter from Joseph Taldeddine, on be alf of the property owner, Ann Durandette, requesting a Building Code Varianc for a recently constructed aluminum screened patio enclosure at 914 West Fairview Avenue, Unit No. 10. The letter states that the subject structure was approved by the Planning Department, and was built in accordance with the approved p ans. The subject location (No. 10) is within a 16-unit residential condo inium complex, as shown on the attached Plot Plan; and the new screened patio enclosure is attached to the rear of this unit. Section 9255.2.6.D., of the R-3 Multiple-family Zone Regulations permits trellis structures, patio covers, or awnings not exceeding eight feet in height to extend or project into a required rear or side yard provided that such projection shall comply with the provisions of the • Building Code. The subject structure is considered to be a patio cover as defined in the U iform Building Code Appendix, Chapter 49. This type of patio structure must maintain a. minimum setback of 5'-0" from the property line, for two reasons: 1) the structure does not provide for one hour fire resistive construction; and 2)there are openings in the exterior walls. Chapter Five, Table 5-A of the Uhiform Building Code requires exterior walls of multiple-family structures to be of one hour fire resistive construction when located 5'-0" or less from the proper y line, and prohibits any openings in exterior walls located less than 5'-0" fro m the property line. • The structural plans for the patio endosure were approved and a building permit was issued on May 10, 1990. The plans consisted of a copy of a set of st:ndard plans, entitled "Screen. Enclosures", and a site plan. The site plan (at ached) specifies that a 10' x 15' aluminum roof, located 3'-0" from the side •ro.er line would cover a proposed 8' x 13' enclosure. The dimensions on the site plan clearly indicate that the proposed roof would extend 2'-0" beyond the patio structure's westerly exterior wall, which therefore makes the setback to the wall 5'-0" which would comply with the required setback. 1 , LASER th the• On June 6, 1990, the final inspection of the patio enclosure was made by City inspector. He found that the structure was not built in accordance wi h the approved plans, that it was built too close to the side property line. The factual distance between the subject unit and the westerly property line was 112'-0'; whereas the approved site plan indicated a distance of 13'-0".. Therefore, the structure's roof is only 2'-0" from the site's westerly property line and its westerly exterior wall is setback 4'-0" from said line, instead of 3'-0" and 5'-0" respectively, as indicated on the approved site plan. On June 7, 1990, Rudy Franta, Building Official, contacted the contractor, Mr. Robert Huth, and informed him of the problem. Mr. Huth said that he would contact the property owner to resolve the matter. It is staff's opinion that the applicant's request should be a eme dJ because the applicant's failure to adhere to the approved plans is not jus'if'cation to permit the encroachment which will be in violation of the requirements of the Uniform Building Code. MILLER, CITY ATTORNEY II IV) SUBJECT: MORATORIUM ON HILLSIDE DEVELOPMENT The attached ordinance imposes a moratorium . on hillside development. For purposes of meeting concerns of an immediate nature and conducting a complete review and study of hillside development, a moratorium is authorized by City Charter Section 415 and California Government Code Section 65858. The City Charter requires that subject ordinance be read in full prior to adoption. Procedurally, pursuant to Government Code Section 65858, the - ordinance is in effect for 45 days from the date of its adoption. Subsequently, the City must issue a written report describing measures taken to alleviate conditions which lead to adoption of the ordinance, and then conduct a noticed public hearing to extend the ordinance. This extension. may be for a period of up to 10 months and 15 days. Subsequently, if necessary, it may be extended for an additional period of 1 year following a noticed public hearing. c:.
