SUBJECT: Request for Authorization of Contracts with GSX/Laidlaw
and US Ecology; Exception from Bid Process
As you know, both SCS, Kiewit's consultant and McLaren/Hart, the.
Agency' s consultant have excavated and stockpiled soils
contaminated with lead and petroleum hydrocarbons. Recently,
McLaren also discovered buried asbestos in Trench 21.
Due to the hazardous nature of these materials which are now
exposed to the elements (e.g. , Santa Ana winds) and trespassers,
it is essential that the Agency remove them to the proper
landfill quickly without going through the normal bid process.
McLaren has assisted the Agency in preparing specifications and
making the contacts for hauling and disposing of the hazardous
waste.
PETROLEUM/HYDROCARBONS
While this material can be transported to GSX/Laidlaw in Kern
County, it is cheaper to send the material to the US Ecology
landfill in Beatty, Nevada (east of Death Valley) since we do not
have to pay California's disposal fees/taxes (we save about
$57/ton) . Because of the dangerous nature of the petroleum
hydrocarbons/lead and the possibility of spreading these
hazardous wastes due to September-October weather conditions, it
is crucial to expedite removal.
US Ecology can also chemically treat the material if tests
indicate that such is necessary. US Ecology is only a landfill
site. Hauling of the hazardous waste itself would be handled by
a licensed qualified trucker subcontracted through Three-D
Services, the Agency's clearance contractor.
Total cost is unknown but could be as much as $100, 000, pending
receipt of TCLP (Toxic Characteristic Leaching Procedure) tests
later this week, review of these and of estimated waste amounts
provided by McLaren, and a firm quote by US Ecology next week.
Haulage/transportation costs will be paid through Three-D to one
of their licensed approved sub-contractors

ASBESTOS
McLaren has advised that the closest and cheapest landfill which
accepts asbestos is the GSX/Laidlaw facility in Buttonwillow,
California (west of Bakersfield) . GSX/Laidlaw is not only a
disposal facility but will haul the asbestos contaminated
material to their site (see Attachment 2) . Because of the
dangerous nature of the asbestos and the possibility of spreading
these hazardous wastes due to Santa Ana winds, it is crucial to
expedite removal.
Total cost is unknown pending the actual volume excavated and the
time required but is estimated about $10, 000.
The City Attorney has reviewed both Attachment 1 and 2, and
approved them as to form. He has also provided the required
statement to authorize the Agency's contracting for these
services without following the routine purchasing requirements.
AUTHORIZATION FOR SERVICES
Pursuant to Arcadia Municipal Code Section 2844.1, I hereby,
approve of the above purchase of services because of an emergency
situation arising out of the finding of asbestos and
petroleum/hydrocarbons on the above property. The hazardous
nature of these materials in relation to its location and the
potential for winds during September and October, requires" the
retention of services to remove this material to assure the
preservation of health and property.

SUBJECT: Request for Change Order to Approve Two Subcontractors
to Demolition Contractor, Three-D Services, for Kiewit-
East Site
The Agency has bid out and contracted for site clearance work
with Three-D Services for the Northside Project, which includes
the Kiewit-East site.
Three-D is not licensed by the State to transport hazardous waste
(e.g. , TPH/lead/asbestos) , nor are they licensed to excavate the
asbestos discovered in Trench 21. As a result, specifications
for the asbestos excavation were prepared by McLaren/Hart, the
Agency' s environmental consultant and forwarded to three asbestos
abatement companies recommended by McLaren/Hart. Based upon the
bids submitted, which were reviewed by Three-D, McLaren and
staff, we all recommend use of Precision Works, Inc. (PWI) as a
subcontractor for the asbestos excavation and abatement work (see
Attachment 1) . PWI ' s work is estimated to cost around $15, 000.
Please note that the actual hauling of the asbestos from the site
to the disposal facility in Buttonwillow, California and its
disposal there will be handled by GSX/Laidlaw under a separate
contract with the Agency (see accompanying memo and Item 3bb on
the Agency Agenda) .
Bids for the hauling of the TPH/Lead were prepared by Three-D and
forwarded to several licensed haulers. Three-D has not yet
advised who they are recommending, nor forwarded the bids for
staff review. We should have this information at the Agency
meeting - costs are estimated about $10, 000.
Both of these contracts will be subcontracts to the Agency's
basic contract with Three-D. As such they require Agency
approval.
Because of the shortage of time to prepare specifications and
obtain bids, staff is requesting that since these have not been
agendized, the Agency make an exception to the Brown Act and
approve these subcontracts.

CITY ATTORNEY STATEMENT
Because this item is not on the Agenda, to take action at the
meeting of September 17, 1990, the City Attorney has advised that
pursuant to Government Code Section 54954 . 2 (b) (2) the Council
should determine that the need to take action arose subsequent to
the Agenda being posted.
The Change Order information was not received until after the
Agenda was posted and therefore this approach is necessary.
The City Attorney shall advise as to the required motion at the
meeting. _
RECOMMENDATION
That the Agency approve Change Orders for Three-D Services as
described above.,

$10 million. .

Respiratory Protection •
Powered air purifying respirators(PAPAS)equipped with organic high efficiency particulate air(NEPA)fitters shall be
employed whenever abatement activities may reasonably be expected to produce airborne fiber conceitrations in
excess of 2 fibers/cc(10X permissible exposure limit). in all other abatement contexts, employees shah be required to
wear, as a minimum,half-mask air purifying respirators equipped with HEPA filters. In addition,protective clothing.shall
be employed in all abatement context.
Air Monitoring
Per OSHA requirements, all phases of the abatement project will include personal/area air monitoring o.i Precision
I Works, Inc.personnel. Final/clearance air monitoring by the Certified industrial Hygienist shall not exce xi the
statistical limit of detection using Phase Contrast Microscopy(PCM)of 0.01 fibers/cc.
Clearance
After surfaces have been wet wiped of suspect residues,post-removal encapsulation(Residual Fiber Lodcdown)is
performed on all surfaces of abatement. After thorough review of final clearance air monitoring data and a visual
inspection. verbal clearance shall be given by the Certified Industrial Hygienist. The barriers may then be removed and
the site turned over to the client.
Disposal •
All waste materials generated in regulated areas will be double-bagged in properly labelled, impermeable asbestos
bags, HEPA vacuumed,passed through the decontamination airlock for wet wiping, and placed in a designated
temporary holding area for final transport to the designated landfill. in order to comply with Tale 40. CFA Part 61,
Subpart M(USEPA National Emissions Standard for Hazardous Air Pollutants). an EPA generators number and
state/tax identification number must be secured by the owner/generator of the asbestos waste for regu'atory agency
accounting purposes. To ensure expeditious and legal disposal, these numbers are assigned to a proPct's waste on
our Uniform Hazardous Waste Manifest before transport to the designated landfill. An accurate count o:'the bags and
copies of the Uniform Hazardous Waste Manifest's "Generator Sends'and Generator Retains"documomts shall be
furnished to the Customer by the designated landfill. The EPA generator and state/tax identification nu.nbers can be
issued to you immediately over the phone. You may obtain an EPA generator's number for this project by calling(916)
324.1781 and the state/tax identification number by calling the Board of Equalization at(916) 739-2582.
