Butler, Assistant Director of Planning SUBJECT: Determination of a Wine Cellar and Tasting Room as a Compatible Use in the CPD-1 zone. INTRODUCTION Attached is a proposal from Mr. Gilbert Navarro for a "Private Reserve Wine Cellar" with a tasting area at 411 E. Huntington Drive, unit #122. Mr. Navarro is requesting a determination from the City Council that a wine cellar with tasting room is a compatible use in the CPD-1 (Commercial Planned Development) zone. When the CPD-1 regulations were adopted in 1981, they were designed to primarily encourage business and professional office uses, financial institutions, and very limited retail and service oriented businesses. Since adoption of the CPD-1 zone, additional uses have been deemed compatible by the City Council. The CPD-1 zone r' applies to the area bounded by the 210 Freeway on the north, Fifth Avenue to the east, the railroad tracks to the south, and Second Avenue to the west. A map of this area and a list of all uses allowed in the CPD-1 zone are attached. ANALYSIS At present, retail sales of liquor for off-site consumption are allowed in the C-1, C-2 and C-M zones. A conditional use permit is required if the liquor store is open more than 16 hours per day or is open any time between 12:00 midnight and 6:00 a.m. and is located less than 150 feet from residentially zoned property. This particular proposal differs from general liquor stores in that only wine and wine service accessories will be sold. A wine cellar with tasting room should not include the sale of grain alcohol or non-grape beverages, and the sale of food items should not to be a significant portion of the business's activity. Because this particular type of business is not readily defined in the Code and may be an appropriate use, subject to specific conditions, staff recommends that if the City Council determines that a wine cellar with a tasting room is a compatible use in the CPD-1 zone, that it be permitted only with an approved conditional use permit. The City Council may approve this request by determining that a wine cellar with tasting room is a compatible use with an approved conditional use permit for the purposes of the CPD-1 zone under Section 9260.1.12.(14), or 2. The City Council may approve this request by determining that a wine cellar with tasting room is a compatible limited retail use (without a conditional use permit) for the purposes of the CPD-1 zone under Section 9260.1.6.(24). The highest quality and most age worthy table wines of France, Spain, Portugal , Germany , Italy , Australia, and the United States has to offer , The noble and elegant wine labels that I will sell are For example; From the Bordeaux region of France , Chateau Margaux , Chateau Lafite Rothschild , and Chateau Mouton Rothschild , and From the California wine region, Robert Mondavi ' s Private Reserve , Stag 's Leap Wine Cellar Cask 23, and Duckhorn Three Palms . Wine labels that one will not Find in my shop are; jug wine like Carlo Rossi , or alcohol fortified wines like Boone ' s Farm , Thunderbird, and Ripple . To sell such a low quality wine as previously stated will • dishonor my noble Family name . I would like to offer to the customers the opportunity to taste the wine , the customer may purchase . A great number of wines I intend to sell are very expensive . To buy any wine blind may be a very expensive risk . Any customer buying such an expensive wine , must be very well assured oF the quality and palatability oF that wine . OF DESIGN REVIEW The Agency's actions do not supersede Building or Zoning Regulations. Such regulations must be complied with unless modified in accordance with the procedures set forth in the Arcadia Municipal Code and need not be considered by the Agency in this review. The purpose of the Agency's review is as follows: 1. To give the Agency the opportunity to determine if new private projects are in conflict with any Agency projects which are being considered or developed in the same area. 2. To provide the opportunity to incorporate the private project with the Agency project and/or to eliminate or to mitigate any conflicts at the earliest stage of the design process. 3 . To afford the Agency an opportunity to review the preliminary architectural plans of private projects to insure that these projects are not so out of character with the area as to be a hinderance to future development. ANALYSIS A. Design Features: The Applicant proposes to remodel the commercial building at 9-11 E. Huntington Drive (See plans, Attachment No. 2) . Formerly this building contained retail uses (Martin's) . The proposed remodel is very similar in design to the current home of Country Oaks Escrow located at 17 E. Huntington Drive. The Huntington Drive street level facade will be faced with a red brick veneer and contain paned windows encased in a black anodized aluminum frame. The windows will be ringed by brick . course work. Dark brown double wide wood entry doors will be positioned in the center of the front facade. A cloth awning (maroon) will hang from the existing canopy. The existing parapet wall above the canopy will be painted "Pale Chamois" The rear elevation (facing the Parking District) will be faced in brick, have dark brown double wide entry doors and a maroon canopy similar in theme to that on Huntington. Decorative brick course work will be employed around windows and entry door as well as along the top edge of the rear parapet. B. Departmental Comments: Planning Department - The Applicant will be required to provide the following as a condition of approval: 1. Curb enclosed landscape planters shall be built at the north end of each row of parking adjacent to the alley. Additionally, detailed landscape and irrigation plans must be submitted for approval prior to issuance of building permits. 2 . A block wall trash enclosure with solid metal gate shall be constructed along the northern edge of the building adjacent to the west property line (next to Denny's) . The trash enclosure is to be painted to match the building stucco. 3 . All handicapped access requirements shall be met by the Applicant. 4. The on site parking lot shall be sealed and stripped per the City Code. Public Works Department - If the on site parking area is removed with the intent to repave, the Applicant shall provide a grading/drainage plan prepared by a registered civil engineer. Economic Development Department - Any Design Review approved by the Agency is valid for a period of one year consistent with the provisions of Resolution No. ARA-126. A copy of this report has been transmitted to the Applicant. Gribble (the "Developer") , the Agency is required to issue a Certificate of Completion following the completion of construction and development of the project and following written request therefor by the Developer. Mr. Larry Lathrop of The Gribble Company wrote to the Agency requesting a Certificate of Completion for the entire project (see letter, Attachment 1) . Staff concurs that the Developer has met all of the requirements under the DDA and that the issuance of a Certificate of Completion is warranted. The draft Certificate of Completion has been reviewed by Agency Special Counsel, Steve Deitsch. Recommendation That the Arcadia Redevelopment Agency authorize issuance of a Certificate of Completion to the Developer of the Southside Project, subject to minor revisions in form and content by Agency General Counsel (see draft Certificate of Completion, Attachment 2) . Gilb, Chairman and June D. Alford, Secretary of the Arcadia Redevelopment Agency (the "Agency") hereby certify as follows: Section 1. The improvements required to be constructed in accordance with that certain Disposition and Development Agreement dated May 6, 1986, by and between the Agency and Stanley W. Gribble and Associates, a sole proprietorship (the "Developer") , as amended by Amendment Number One to the Agreement dated August 4, 1987, as further amended by Amendment Number Two to the Agreement by and between the Agency and Arcadia Gateway Centre Associated, LTD. (the "Successor Developer") , a California limited partnership, dated December 4, 1989, as further amended by Amendment Number Three to the Agreement dated November 13 , 1990 (collectively the "Agreement") , on that certain real property (the "Property") more fully described in Exhibit "A" attached hereto and incorporated herein by this reference, have been completed in accordance with the provisions of said Agreement. Section 2 . This Certificate of Completion shall constitute a conclusive determination of satisfaction of the agreements and covenants contained in the Agreement with respect to the obligations of the Developer, and its successors and assigns, to construct and develop the improvements on the Property, excluding any normal and customary tenant improvements and minor building "punch-list" items, and including any and all buildings and any and all parking, landscaping and related improvements necessary to support or which meet the requirements applicable to the buildings and their use and occupancy on the Property, whether or not said improvements are on the Property or on other property subject to the Agreement, all as described in the Agreement, and to otherwise comply with the Developer's obligations under the Agreement with respect to the Property and the dates for the beginning and completion of construction of improvements thereon under the Agreement; provided, however, that the Agency may enforce any covenant surviving this Certificate of Completion in accordance with the terms and conditions of the Agreement and the grant deed pursuant to which the Property was conveyed under the Agreement. Said Agreement is an official record of the Agency and a copy of said Agreement may be inspected in the office of the Secretary of the Arcadia Redevelopment Agency located at City Hall, 240 West Huntington Drive, Arcadia, CA 91006, during regular business hours.
