Woolard, Director of Planning SUBJECT: Determination of Billiard Clubs as a Compatible Use in the CPD-1 zone. INTRODUCTION Attached is a packet of information from Jerry Jamgotchian proposing a billiard club at 300 E. Huntington Drive. Mr. Jamgotchian is requesting a determination from the City Council pursuant to Section 9260.1.12.(14) that a billiard club is a compatible • use in the CPD-1 (Commercial Planned Development) zone with an approved conditional use permit. When the CPD-1 regulations were adopted in 1981, they were designed to primarily encourage business and professional office uses, financial institutions, and very limited retail and service oriented businesses. Since adoption of the CPD-1 zone, additional uses have been deemed compatible by the City Council. Attached is a list of all uses allowed in the CPD-1 zone. • ANALYSIS At present, billiard clubs or similar establishments are allowed only in the C-2 (General Commercial) zones with an approved conditional use permit. The C-2 zones provide ample locations for such uses. Mr. Jamgotchian's request is prerequisite to his proposal for a billiard club at 300 E. Huntington Drive. The proposal appears to adequately address the concerns that usually accompany such uses. It should be noted that if the proposed use is deemed compatible for the purposes of the CPD-1 zone, its applicability would not be limited to that particular address. Staff has concerns with this possibility since the CPD-1 zone is intended for business uses and supporting retail and service establishments. Entertainment oriented uses have not yet been contemplated for this area. The CPD-1 zone, at present, applies to the area bounded by the 210 Freeway on the north, Fifth Avenue to the east, the railroad tracks to the south, and Second Avenue to the west. A map of this area is attached. Mr. Jamgotchian's request is the first • LASER IMAGED 106 r � formal proposal for this type of use. Staff has also been contacted in this regard for a similar facility in the new Landmark Development project on the north side of Huntington Drive. Included in the floor plan of Mr. Jamgotchian's proposed billiard club are ten game machines (1 coin operated pool table, 3 foosball soccer tables, 2 pinball machines, and 4 video games). Any place of business with eight or more game machines is defined as a game machine arcade. Arcades are only allowed in the C-1, C-2 and C-M zones with a conditional use permit. Eight or more game machines are not critical to Mr. Jamgotchian's proposal and it is not being requested that a game machine arcade be deemed a compatible use for the CPD-1 zone. The specific scope and operational details are not under consideration. These would be considered as part of any subsequent conditional use permit application. Tonight, the City Council should only determine whether or not a "billiard club" should be allowed within the CPD-1 zone with an approved conditional use permit. ACTION Approval of Request If the City Council intends to approve of the request, the Council should determine that a billiard club with an approved conditional use permit is a compatible use for the purposes of the CPD-1 zone under Section 9260.1.12. Mr. Jamgotchian would then need to submit an application for his specific proposal to be scheduled for a public hearing by the Planning Commission for a conditional use permit. Denial of Request • If the City Council intends to deny the request, the Council should determine that a billiard club, with or without a conditional use permit, is not a compatible use in the CPD-1 zone. In overall "Popular Participant Sports," Billiards ranked number 7, while Golf ranked 21st in the study and Tennis ranked 30th. According to the survey that "denotes percent of people 18 and older who said they loved the sport or called it one of their favorites," the top 10 were: 1. Exercise at home; 2. Swimming; 3. Valet parking, gourmet beer tasting, roast beef, chocolate tasting, and multiple beer & non-alcoholic drink stations. The clientele reminded me of a Hugh Hefner party for some reason. It was a packed house but the 2000 gallon Shark Tank leaps out at you upon entrance to the cavernous playing area that houses 25 Brunswick Gold Crown III's. Robin Bell, current Women's World 9-Ball Champion, took on all challengers in both 8-ball & 9-Ball. Calvin Coker, house pro, put on a trick shot demonstration. Later in the week I managed to get some table time in at The Shark Club and the tables play quite well. The bar area is huge,there is a fireplace and lounge area that includes overstuffed chairs,couches,and booths to get comfortable in while waiting for your table. One table near the Shark Tank has a video camera directly overhead and is hooked up to all the numerous monitors around the room. Rates are $5 for one and $8 for two or more. A dress code is enforced after 8 pm. The bar is well stocked with numerous bottled and draft imports,sandwiches and nachos are available from the kitchen.In fact,on draft is Anchor Steam,Moosehead, Carlsberg, Bass, Guinness Stout, Spaten Munich, Bud & Coors. You really have to try the Firestone non-alcoholic beer as it is great. If you want to see the "classiest" pool room or just want to impress your pool playing friends, drop in at The Shark Club,841 Baker Street, Costa Mesa, CA. The upscale decor package was designed to attract the female player and discourage the "Pool Hustler/Gambler" from loitering and waiting for a game. SHOOTERS/MONTCLAIR features Liquor, Beer and Wine in addition to Basic Foodservice and has 22 tables for customer use. It employes approximately 30 people and its peak operating hours are between 7 : 00PM - MIDNIGHT. The concept was greatly improved by input from the City of Montclair Planning Department and the Montclair Police Department. Their guidelines are outlined in the Application to Operate (Case Number 86-30) which I have provided herein for your review. As referenced therein, this permit can be "REVOKED AT ANY TIME" by the City of Montclair and to date no operational concerns have been experienced. - The "SHOOTERS" customer is either male or female and usually between 24 - 59 years old. They stay about 1 1/2 hours, have two (2 ) drinks and usually come with at least one or two other people to play Pool or just relax after work. SHOOTERS features full waitress service to each table and is always kept very neat and clean. An I.D. is required to play pool and is retained at the Ball Counter until the Time Charge has been paid. This insures better internal control of customers and a mechanism to identify problem customers . Dress codes and other entrance control measures haven't been necessary because of the "upscale" nature of the SHOOTERS customer and on weekends , it is not uncommon to have a two (2 ) hour table wait. Pool rates are usually about 25% higher than the normal "Beer Bar" male oriented facility. Both tournaments and leagues have further improved the upscale customer base in addition to spreading out the table waiting period and helping to attract the female player. SHOOTERS/MONTCLAIR has very successfully provided another form of reasonably priced entertainment for the adult population of the Inland Empire and we 'feel confident that we can provide the residents of Hawthorne and other nearby communities with the same enjoyable experience. AB265 permits the Agency to make findings that it is not able to set aside all or part of the 20% into the Low/Moderate Income Housing Fund if existing Redevelopment Agency obligations, projects, programs or activities in any fiscal year prior to FY 1996-97 do not permit such. Redevelopment Agencies are required to make findings annually regarding the availability of funds to be set aside in that fiscal year for the Low/Moderate Income Housing Fund. Resolution No. ARA- 166 (attached) makes findings that due to existing Agency obligations, projects and activities (e.g. , Southwest Corner Project, Northwest Corner Project, Economic Development Department operations and administration) , no funds can be set aside into a Low/Moderate Income Housing Fund for FY 1991-92 . A copy of the approved Resolution shall be mailed to the State Department of Housing and Community Development within 10 days after adoption. Connors7Economic Development Associate SUBJECT,: Joint Public Hearing - Consideration of Conveyance of Parcel D Encroachment (Northside Project) . to Chandler Investment Properties, L.P. 7 In August, 1988 the Redevelopment Agency sold the Kiewit West Parcel (Northside Project Parcel D, See Location Map) to Emkay Development Company. The ALTA land Survey done as. part of that acquisition indicated that the block wall located on the south property line of the City's St. Joseph Street Reservoir encroached slightly into the property being conveyed. As a result of this encroachment and at the request of Emkay Development Company, the civil engineer for the project (Woolsey Engineering) wrote a legal description detailing the encroachment (Attachment No. 2) and the Agency transferred Parcel D to Emkay with the exception of the encroachment. The Agency's "sliver" encroachment totals approximately 167 square feet spread out along the 597+ feet of the property line. Subsequent to the Agency's sale to Emkay, Emkay sold the property to Chandler Investment Properties, L.P. (Chandler) as assignee of record for the development. Unfortunately, Emkay did not except from the legal description the encroachment nor did their title company notice the error. Chandler has proceeded with the project using the wrong legal description. Even the parcel map recorded for the property is incorrect since it erroneously includes the Agency-owned "sliver" . The error in the legal description was only discovered recently as part of a property refinancing by Chandler. Due to the differences in the legal descriptions and the fact that the recorded parcel map indicates that all of the land was subject to the. sale, Chandler has now requested that the Agency deed the balance of the property (the exception) to them. Health and Safety Code Section 33433 indicates that prior to the transfer of any land from a redevelopment Agency, a duly noticed public hearing must be held. Notice of the Hearing was published in the Arcadia Tribune on May 19 and 26 and June 2, 1991. J LASER IMA , PA Arcadia Redevelopment Agency June 4,1991 Page 2 Attachment No. 3 is a brief Disposition Report prepared by staff which sets forth the cost and benefits of the proposed sale to Chandler. Briefly, the sale is one which was anticipated in the approved Emkay DDA (November, 1987) . Additionally, when Emkay acquired Parcel D, no adjustment to the sale price was made for the "sliver" because this issue came up just before the then scheduled close of escrow and Emkay was anxious to conclude the sale. The Agency was therefore compensated $1, 920.50 ($11. 50 per square foot) for the "sliver" . Chandler's request has been reviewed by the Public Works Department.. They have no objections as long as the City has a recorded unrestricted right of entry to cross Chandler' s property to maintain or replace the block wall around the St. Joseph Street Reservoir (ie, a prescriptive easement) . Chandler has agreed to execute and record such a covenant. Further, Chandler has agreed to pay the Agency a $1, 000. 00 processing fee ($5.88/sq. ft. ) . This report has been reviewed and approved by Agency General Counsel Michael Miller and Special Counsel Steve Deitsch. RECOMMENDATION: That the Arcadia City Council and the Arcadia ,Redevelopment Agency conduct a Joint Public Hearing to obtain testimony concerning the proposed conveyance of the exempted property ("sliver") to Chandler Investment Properties, L.P. Upon closing the Joint Public Hearing, the Arcadia City Council and Arcadia Redevelopment Agency respectively adopt the following resolutions (Attachment Nos. 4 and 5) : 1. The DDA was subsequently assigned to Chandler Investment Properties, L.P. (the "Developer") by Agreement dated June 29, 1989, as amended. 1. . GENERAL PROJECT DESCRIPTION The DDA (approved by the Agency on November 17, 1987 provides for. the development of property shown in the attached Location Map (Attachment No. 1) generally referred to as Parcel `"D" . The Developer currently owns the majority of Parcel "D" through acquisition from Emkay. At the time of the Agency sale to Emkay, a small portion of Parcel "D" (the "Encroachment" , See Attachment. " No. 2 ; Legal Description. and Engineering Detail) was excluded from the sale at Emkay's request. Parcel "D" was excluded from the sale to Emkay as a result of an ALTA survey which indicated that the southern block wall to the City's St. Joseph Street Reservoir encroached into the property. The area of the Encroachment is approximately 167 square feet. Subsequent to the Agency's sale to Emkay, Emkay sold Parcel "D" to the Developer for development, pursuant to the DDA. The Emkay conveyance to the Developer contained all of Parcel "D" including the previously excluded Encroachment. The Developer has requested that. the Agency;now convey the Encroachment. They would like legal title to all of Parcel "D" as originally intended in the DDA. In return for conveying the Encroachment to the Developer, the City of Arcadia (the "City") and the Agency will require that a prescriptive easement be imposed on Parcel "D" which allows access by City personnel to maintain the block wall. Agency conveyance of the Encroachment will not affect the development schedule of Parcel. "D" . The Developer has until March 31, 1992 to complete the approved improvements. 2. COSTS TO THE. AGENCY All costs to the Agency have previously been detailed in the original Disposition Report for the Northside Project and the DDA. ' Conveyance of the Encroachment as proposed here will not cause the Agency to incur any additional costs other than a minor amount of staff time. The total sales price for Parcel "D" was not adjusted downward as a result of removing the Encroachment parcel from the Emkay sale. The Developer has agreed to pay for the Agency' s estimated administrative costs ($1, 000) for processing the Encroachment conveyance. There is therefore no net cost (or gain) to the Agency. 4 . PROJECT BENEFITS The principal benefits of conveying the Encroachment are administrative in nature. the benefits include: A. Clarification of title and property lines through consolidation of parcels. B. Guaranteeing access by City personnel for the purpose of maintaining the property line wall through provision of a prescriptive easement over Parcel D.
