Nottingham i Lopez - Report regarding southbound First at Huntington Miller - Aerosol spray paint ordinance for June 4 agenda i i i -4- AGENDA 5/21/91 ce/]/e5, /}4,//5 May 21, 1991 TO: CITY COUNCIL FROM: PLANNING DEPARTMENT William Woolard, Director of Planning SUBJECT: FENCES AND WALLS LOCATED IN FRONT YARDS OF SINGLE-FAMILY ZONED PROPERTIES The City Council requested staff to prepare a text amendment which would lower the height of fences and walls located in front yards, and to require that such fences and walls be of openwork construction. The current regulations permit fences and walls to be of solid construction and a maximum of four feet in height. The following is the current wording of the code sections relating to fences and walls: 9283.8.7. SAME. FENCES AND WALLS. Fences, walls or guard railings for safety protection around - depressed ramps, if not more than four (4) feet (1.22 meters) in height, may be located in any front, side or rear yard, except within twenty-five (25) feet (7.62 meters) of an intersection where the height shall not exceed three (3) feet (.91 meters), and provided that it does not interfere with the visibility of vehicular ingress and egress to the property and adjoining properties as per the standards on file with the Planning Department. Fences and walls located in the rear yard or interior side yard shall not exceed a height of six (6) feet (1.83 meters). 9283.8.8. SAME. SAME. A fence or wall not more than six (6) feet in height, maintained so as not to exceed six (6) feet in height, may be located along the side or rear lot lines, provided such fence, wall or hedge does not extend into the required front yard, nor into the side yard required along the side street on a corner lot, nor in the case of a corner lot into that portion of the rear yard abutting the intersecting street wherein accessory buildings are prohibited. The provisions of this section shall not prohibit the erection of a fence enclosing an elementary or high school site if such fence does not project beyond the front line of the building. If the fences or walls are to be "openwork" and not "solid", definitions of these terms will need to be added to the regulations. The following definitions are proposed: , �v /c." 1 FENCES/WALLS \-,1/1 / ir,PA 5/21/91 ` �� ' LASES 9MAnED 40 2 J ti "OPENWORK FENCE OR WALL - shall mean a fence or wall in which the sum area of the open voids through the fence or wall is 75% or more of the total area of the fence or wall. SOLID FENCE OR WALL - shall mean a fence or wall in which the sum area of the open voids through the fence or wall is less than 75% of the total area of the fence or wall." Many of the existing front yard fences or walls have been constructed at the four foot limit, and some instances higher fences and walls have been approved through the modification process, both within homeowners association areas and throughout the rest of the City. The existing four foot height limitation has been in effect for over twenty years. Staff does not believe that lowering this height to a lesser limit (i.e. three feet) will significantly alter the visual character of the property or the neighborhood. Lowering the height limit would be less effective in restraining small pets and children. Requiring the fencing and walls to be openwork will result in the greatest visual impact yet allow for fencing which can provide security comparable to the existing regulations. The following specific wording is recommended to be added to the R-M, R-O - and R-1 zones to require openwork fences and walls: OPENWORK FENCE AND WALLS. Openwork fences or walls, if not more than four (4) feet in height, may be located in any front yard, except within twenty-five (25) feet of an intersection where the height shall not exceed three (3) feet, and provided that it does not interfere with the visibility of vehicular ingress and egress to the property and adjoining properties as per the standards on file with the Planning Department. Fences and walls located in the rear yard or interior side yard shall not exceed a height of six (6) feet provided that such fence or wall does not extend into the required front yard, or into the side yard required along the side street on a corner lot, or in the case of a corner lot into that portion of the rear yard abutting the intersecting street wherein accessory buildings are prohibited. Exception: Solid columns and/or posts may be permitted at _ _ horizontal intervals of not less than 7'-6". Said columns and/or posts, including any capstones or other decorative features, shall not exceed a width or depth greater than 1'-6" by 1'-6" nor exceed a maximum height of 4'-6". Fences and walls in commercial and industrial zones are reviewed as part of the design review process for any new project or addition to an existing 2 FENCES/WALLS 5/21/91 LASER IMAGED 103 • 4 project. Therefore, existing Sections 9283.8.7. and 9283.8.8. are recommended • to be deleted, and the following section added to each of the commercial and industrial zones: FENCES AND WALLS The height, location, materials, colors and design of fences and walls shall be subject to Architectural Design Review pursuant to Division 5, Part 9 of this Chapter. If the City Council wishes to proceed with a text amendment as outlined above or as may be modified by the Council, the Council should direct staff to initiate text amendment proceedings. Such regulations must be complied with unless modified in accordance with the procedures set forth in the Arcadia Municipal Code and need not be considered by the Agency in this review. The purpose of the Agency's review is as follows: 1. To give the Agency the opportunity to determine if new private projects are in conflict with any Agency projects which are being considered or developed in the same area. 2. To provide the opportunity to incorporate the private - project with the Agency project and/or to eliminate or to mitigate any conflicts at the earliest stage of the design process. 3 . To afford the Agency an opportunity to review the preliminary architectural plans of private projects to insure that these projects are not so out of character with the area as to be a hinderance to future development. ANALYSIS A. Design Features: The Applicant proposes to remodel the former Better Homes and Garden Center. A materials board and colored rendering are available for inspection in the Economic Development Department and will be on display in the City Council Conference Room prior to the Agency's Tuesday meeting. The lower portion of the southern facade (on Huntington Drive) will be faced with a red brick veneer and contain a street level planter while the top half will be re-stuccoed and painted "Pearl Gray. " The front will have new window casings with clear glass. The windows are shaded with predominantly blue awnings. Articulation will be added by the use of stuccoed molding on the Huntington frontage as well as on the west and north building faces. The molding will be finished Pearl LASER IMAGED 65 Arcadia Redevelopment Agency May 13, 1991 Page 3 Gray (same as the stucco) or in a complementary color as an accent and will appear as horizontal bands encircling the building. Additional similarly treated molding may be employed on the upper corners of the Huntington elevation. West and north elevations are finished in stucco with the previously mentioned detail molding. Additionally, this rear area will feature a new covered patio. The patio enclosure is a low stucco covered (pearl gray) wall with red brick cap stones topped with a wood lattice. The outside edge of the patio area contains landscaping. The lattice and patio cover will be painted to match the building walls and molding. A rear entry door is shaded by an awning which matches those on the Huntington facade. Those portions of the site which were formerly dedicated to plant nursery uses will be converted to parking. One-way ingress will be provided from Huntington along the western side of the building. Five parallel parking spaces are - provided along this access drive with the balance of the parking (5 head-in spaces) located along the rear of the building/patio. All auto exiting is onto the alley and through the Parking District. B. Departmental Comments: Planning Department - This proposal is compatible with other buildings in the area and complies with the design overlay guidelines for the downtown area in regards to color and materials. The parking lot has been improved substantially and will provide more on site parking for the new use. Conditions of Approval: 1. The Huntington Drive access point will remain one-way in and the pavement will be clearly marked as noted on the plans with arrows and signage on the pavement stating "Wrong Way" or "Do Not Exit" so that persons entering from the alley will not attempt to drive through to Huntington Drive. 2 . The driveway entrance on Huntington Drive shall be enhanced with textured paving material. LASER IMAGED 66 Arcadia Redevelopment Agency May 13, 1991 Page 4 3 . All west and north walls of the building shall be either stuccoed or painted to match the new Huntington Drive stucco subject to this Department's approval. 4. All roof mounted mechanical equipment shall be screened from public view. 5. The parking lot shall be striped per the Municipal Code parking regulations. 6. Applicant shall submit a complete landscaping and irrigation plan prior to submitting plans for plan check. 7. Applicant shall immediately secure both the building and the property from unauthorized access. Currently, substantial safety hazards (broken glass, uneven paving, carelessly pile construction materials, etc. ) exist on the property. Fire Department Conditions of Approval - 1. A Central Station Fire Alarm System is required per NFPA 71 & 72E. Plans must be approved prior to installation. 2 . If a finger nail parlor is incorporated within the building, the Applicant must meet the requirements contained the Department's "Rules and Regulations (governing) Finger Nail Parlors. " (Note: Fire Department comments (many of a routine nature) are more extensive than those itemized above. A complete copy of those comments has been forwarded to the Applicant. ) Public Works Department Conditions of Approval - 1. Applicant shall submit grading and drainage plan prepared by a Registered Civil Engineer subject to the approval of the Director of Public Works. 2. Applicant shall construct a Standard Commercial driveway apron per City standards (Standard Drawing No. S-11) . The driveway shall be located so as not to conflict with mature parkway trees. No driveway shall be constructed closer than three (3) feet from any fire hydrant, ornamental light standard, meter box, underground vault or street tree. 3 . Applicant shall remove and replace AC pavement in alley subject to approval of the Director of Public Works. A complete copy of those comments has been forwarded to the Applicant) Economic Development Department Conditions of Approval- , 1. The site plan contained in the Applicant's submittal illustrates that the parcel depth is 150 feet while it is in fact only 145 feet. The Applicant shall submit a set of properly scaled and dimensioned plans for recheck by Agency and Planning Department staff prior to submission for building permits. Reduction of the lot size will probably result in the loss of one foot in the Huntington Drive landscape planter and reduction of one parallel parking space from standard size to compact. 2 . If approved, this Design Review shall be subject to the time limitations (one year) contained in Resolution No. ARA- 126. 3 . Detail drawings shall be submitted for review and approval if Applicant chooses to included decorative molding on the upper corners of the storefront. 4 . The Huntington Drive storefront windows shall be a "paned" style consistent with the Landsperger property (129 E. Huntington Drive) to the west. The panes shall be a dark color, of wood or anodized bronze. 5. The Applicant shall notify the South Coast Air Quality Management District before starting any interior work. Agency staff is concerned that the inside of the building may contain asbestos tiles which may be removed as part of the remodel.
