SUBJECT: REQUEST FROM ARCADIA METHODIST HOSPITAL FOUNDATION TO
CONDUCT A PUBLIC FIREWORKS DISPLAY
Pursuant to Municipal Code, Section 3115.2.5, Arcadia
Methodist Hospital Foundation is requesting that the
Council approve the issuance of a permit to conduct a
public fireworks display.
The display is part of a fundraising event to be held on
September 21, 1991 at 10:00 p.m. This program will be held
at the roof top of the Arcadia Methodist Hospital's parking
structure. However, the proposed display area will be
conducted at the Santa Anita Race Track's parking lot.
Fire Department Staff has reviewed the request and
recommend that a permit may be granted subject to the
following conditions:
1. Display to be conducted by a licensed pyrotechnic
operator.
2. Site plan of firing area to be approved by the Fire
Department.
3. Insurance certificate on file.
4. Aerial shells and pyrotechnics be delivered to the site
on September 21, 1991.
5. All pyrotechnics be removed immediately following the
display.
6. A City Fire Inspector be present at the site during the
display; personnel cost be reimbursed by the pyrotechnic
operator.
It is recommended that Council approve the issuance of a
permit for a public fireworks display at Santa Anita Race
Track subject to the conditions listed in the staff report.

In consideration of the sum of $1.00 paid by you to the undersigned,
receipt of which is hereby acknowledged, and in further consideration of
the conditions hereinafter stipulated.
It is understood and agreed that the portion of the premises to be
used by you under the provisions of this agreement will be prepared and
cleaned for your use in a manner mutually agreed upon, but that you will
reimburse us for any actual cost incurred in connection with such
preparation of the premises for your use, including the providing of any
equipment which you desire to use, and the removal of such equipment, and
the clean -up of the premises and any other equipment used by you for this
event. You also agree to reimburse us for any cost of repairs of any
damage to our premises or equipment.
You agree to accept the premises in the condition in which you find
them, and to return them to the undersigned in as good condition as when
received. Any equipment and /or decorations, together with their
locations, proposed to be installed or erected, or any alterations for use
by you shall first be approved by LOS ANGELES TURF CLUB, INCORPORATED.
You agree to use only the hereinafter described areas at Santa Anita
Park, Arcadia, California, and will restrict all employees and patrons
from trespassing upon any portion other than that described as:

You agree to supply adequate policing to confine all persons to the areas
mentioned and to provide adequate protection for them and for the property
used by virtue of this lease; the personnel, including the number of
police, to be approved by the General Manager of the Los Angeles Turf
Club, Inc.
You agree to save and hold harmless SANTA ANITA REALTY ENTERPRISES,
INCORPORATED, (SAKE) and LOS ANGELES TURF CLUB, INCORPORATED, (LAIC) from
any liability for damage or injuries to any person or property arising out
of your operations covered by this agreement. You agree to carry
comprehensive liability insurance with combined single limits of
$1,000,000 with SARE and LAIC named as additional assureds, without cost
to SAKE or LATC. The policy shall contain a cross liability clause.
The insurance as provided by you shall be primary with respect to the
insurance afforded SAKE and LATC and shall not be contributing.
Your policy shall be endorsed to indicate that the insurance carrier
has waived its rights of subrogation against SANTA ANITA REALTY
ENTERPRISES, INCORPORATED AND LOS ANGELES TURF CLUB, INCORPORATED.

It is further agreed that LOS ANGELES TURF CLUB, INCORPORATED AND
SANTA ANITA REALTY ENTERPRISES, INCORPORATED have no liability,
responsibility or obligation in connection with the purpose for which you
use the property, or the promotion thereof. You agree to hold LOS ANGELES
TURF CLUB, INCORPORATED AND SANTA ANITA REALTY ENTERPRISES, INCORPORATED
harmless from all costs, attorney's fees, liabilities, judgements or
responsibilities of any kind or character which may directly or indirectly
develop, occur or accrue from the use of the property by you.
You agree to designate the chairman of your event to be in charge for
you and see that all of the terms of the agreement are carried out, and
among other things, see that the event shall close promptly on time and
that all persons promptly vacate the premises.
Should you contemplate the use of any outside services such as
contractors, vendors, entertainers, etc., for your event, you must notify
and receive clearance from the LOS ANGELES TURF CLUB, INCORPORATED. Such
notification and clearance must occur at the time arrangements are
discussed and incorporated into the Community Information Summary prepared
by the LOS ANGELES TURF CLUB, INCORPORATED.
It is understood and agreed that you will abide by all federal, state,
county and municipal laws, and that you will notify the office of the City
Manager of the City of Arcadia of your intended use of Santa Anita Park,
allowing sufficient time for the City Manager to certify to LOS ANGELES
TURF CLUB, INCORPORATED, that clearance has been granted.
LOS ANGELES TURF CLUB, INCORPORATED, expressly reserves to itself the
right to terminate this agreement at any time. This right of cancellation
will be exercised only when deemed expedient by LOS ANGELES TURF CLUB,
INCORPORATED, which shall be the sole judge of such expediency.
If this letter represents the agreement between us, please execute the
duplicate copy hereof and return to the undersigned, so that it will
constitute a binding contract.

FIREWORKS DISPLAY CONTRACT
THIS CONTRACT, entered into this day of -,19
by and between PYRO SPECTACULARS, INC. hereinafter called First Party, (Seller) and
METHODIST HOSPITAL FOUNDATION hereinafter called Second Party (Buyer).
WTTNESSETH: First Patty agrees to furnish Second Patty, in accordance with the terms and conditions hereinafter set
forth 1 Fireworks Display as per program "A" submitted and accepted and made a part hereof,
including the services of 1 licensed operator to take charge of and fire the Display with sufficient helpers.
The said display, scheduled to be given on September 21, 1991

Deposit of Sep TP=4; has been paid by Second Party herewith and acknowledged by First Parry and the same is a
credit toward the total Contract price due and payable as set forth below.
After First Parry is set up and ready to put on said Display and is prevented from doing so through no fault of First Party. Second Party agrees to pay
the full contract price as previously agreed without the right of any offset.
Should the weather prove unfavorable on the date set for said Display postponement may be arranged for display to be fired on the next following
clear night by agreement of both parties, but such postponement shall be decided on and notice given First Party not later than three o'clock P.M. on
the date on which the Display should be held, and Second Party agrees to pay First Party for any additional expenses made necessary by such
postponement, but in no instance shall such additional expenses exceed 40% of the contract price of the display. Said postponement due to
unfavorable weather must be arranged for perform== of display within sixty (60) days of the time and date set for the original display. In the event
Second Party fails to to request another date within said sixty (60) day period; Fiat Party shall have no further liability to perform and Second Party
agrees to pay the entire agreed contract price to Fiat Party per the terns of said contract.
In the event buyer cancels the contract unilaterally, buyer agrees to pay as liquidated damages to seller 25% of the total contract price forthwith upon
cancellation.
Second Party agrees to assume the risk of weather or other causes beyond the control of First Party, which may affect or damage such portion of the
exhibits as must be placed in position and exposed a necessary time before the scheduled commencement of the display.
Second Patty agrees to provide adequate police protection to protect Fiat Party from the public's getting into and about the space wherein the
mentioned fireworks may operate, rise or fall, to furnish and plum -sufficient ropes or guards to prevent unauthorized persons or the public from
gaining admission to the necessary space provided for the exhibition and hindering or delaying employees of Fiat Party or damaging display materials
and equipment. AND TO PROVIDE AND PAY FOR THE SERVICES OF A STANDBY FIREMAN[ AND/OR PER_Mrr FEES IF REQUIRED BY
LOCAL QRDINANCE OR REGULATION. Second Party agrees as requested by First Party to provide adequate access to First Party st all times to
set up said display in the event adequate accesa to display area is not provided. Fiat Parry will have no obligation to perform and Second Parry agrees
to pay the entire contract price as agreed, plus any additional expenses incurred because of non - access to said display area.
First Party agrees to famish insurance coverage, in connutxion with the display of fireworks only, for the following amounts: Bodily Injury and
Property Damage, including Products Liability: TWO MILLION DOLLARS (2,000,000)

due net ten days from date of display. Service charge on accounts over 30 days. Second Party (Buyer) agrees to pry attorney's fees and costs if First

It is further agreed that nothing in this contract shalt be construed as forming a partnership. the parties hereto being severally responsible for their own
separate debts and obligations, and neither party shall be held responsible for any agreements not stipulated in this contract.
The parties hereto do mutually and severally guarantee the terms, conditions and payments of this contract and these articles shall be binding on the
parties themselves and on their heirs, executors. administrators, successors and assigns.
All teams of this contract am in writing and may only be modified by written agreement of the parties hereto. Both parties acknowledge they have re-
ceived a copy of said written contract and agree to be bound by said tams of written agreement only.

SUBJECT: Reconsideration of Billiard Clubs
as a Compatible Use in the CPD-1 zone.
INTRODUCTION
The City Council, at its meeting of June 4, 1991, determined by a 3 to 2 vote that
billiard dubs could be a compatible use in the CPD-1 zone with an approved
conditional use permit. Subsequent to that determination, an application (CUP 91-
008) was filed by Pool Pockets, Inc. for a billiard club with 25 tables and a full service
bar.at 320 - 326 East Huntington Drive. The Planning Commission, on July 9, 1991,,.
denied the CUP application, and, the applicant subsequently filed an appeal to the
City Council.
At its meeting of August 20, 1991, the City Council denied the appeal. On the basis
of the testimony presented by the opponents to the appeal, the City Council directed
staff to prepare a report for the reconsideration of billiard clubs as a_compatible use
in the CPD-1 zone.
ANALYSIS -
When the CPD-1 regulations were adopted in 1981, they were designed to primarily
encourage business and professional office 'uses, financial institutions, service
oriented businesses, and very limited retail uses. Until the City Council considered.
the compatibility of billiard clubs in the CPD-1 zone, entertainment oriented uses
had not been contemplated for this area. The CPD-1 zone applies to the area
bounded by the 210 Freeway on the north, Fifth Avenue to the east, the railroad
tracks to the south, and Second Avenue to the west. A map of this area is attached.
At the Council's August 20th public hearing of the appeal, testimony was presented,
by local business office owners and employees, that a billiard dub use would be
detrimental to their office uses. Specific concerns were in regards to parking and
security issues. Additional testimony in opposition was presented by citizens who
did not believe that a billiard dub would complement the residential and
professional business characters of the City. There were some local retail and service

business owners that testified in support of the appeal. The CPD-1 zone encourages
business and professional office uses, and, based upon the testimony presented at
the hearing, the Council denied the appeal.
Attached is a packet of information from Charles and Paula Baldini. They are
prepared to apply for a conditional use permit for a billiard club at 411 E. Huntington
Drive, the Arcadia Landmark Center.
ACTION
The City Council may determine that a billiard club is not a compatible use in the
CPD-1 zone, and should direct staff to prepare the appropriate resolution, for
adoption at the next meeting, reflecting the Council's legislative determination that
pursuant to Arcadia Municipal Code Section 9260.1.12.(14), a billiard club is not a
compatible use in the CPD-1 zone.

RE: Reconsideration of Billiard Parlor Use in CPD 1 Zone
(Huntington Drive & 5th Avenue)
INTRODUCTION
We have been residents of Duarte since 1984 and are very familiar with the
goods and services provided by the communities of Duarte, Monrovia, and Arcadia.
In recent years we have witnessed the rapid growth in all forms of development
throughout these cities, especially along Huntington Dr. This growth has provided us
and other local residents of the area with unparalleled options for goods,'services,
entertainment, and dining. We believe a billiards parlor project, as we envision it, will
provide a new and welcome form of entertainment for a majority of the residents of
these communities.
Upon witnessing the strong popularity of the sport of billiards among all
demographic groups, we began researching a billiards parlor project for the area in
February of 1990. After examining many sites in the San Gabriel Valley, we ultimately
chose Arcadia as a community whose residents and many visitors might enjoy the
classic appeal of this type of entertainment. We also chose Arcadia because we truly
enjoy the City and hope to live there one day. Unfortunately a competing project
(Gateway Center Billiards Club) forced us to temporarily abandon our plans.
We are aware of the situation regarding the issue of billiards in the City of
Arcadia, as we have been following the events of the Gateway project and have
attended previous council Meetings. It is not our intention to belabor the pros and
cons of billiards or embark on an unwanted business venture; however, we would like
the council to hear our concept and determine if it is a suitable project for the image
and needs of the City of Arcadia. We certainly do not wish to further enrage the
residents of Arcadia by rehashing this issue, but we have been working on this project
for some time and felt that we must give it our best effort.

CONCEPT
Given the recent events at previous council meetings, we understand that the
city council is now fully educated on the sport of billiards. Therefore, we think we can
agree that billiards is an extremely popular sport, and that certain types of billiards
parlors/pool halls exist. There are still those dank, dark, sleazy halls that people have
historically associated with pool; however, there also are centers that provide a clean,
comfortable, enjoyable environment for all family members. The latter of course, is our
concept for Baldini's Billiard Parlor. After visiting many such parlors we believe we
have designed a concept that is suitable for any community.
The CONCEPT for BALDINI'S BILLIARDS PARLOR will feature:
1. r 19 billiard tables, 4-5 video games, juke box, big screen TV, and a food and
beverage counter. Capacity range is expected to be 95-110.
2. Entertainment for all residents and visitors of Arcadia and the surrounding
communities; all age groups will be welcome.
3. Top quality billiard equipment at reasonable prices; $6.00-$10.00 per hour
depending on time of day and number of players. (Four players can play for
two hours at a price less than the cost of a movie)..
4. Top quality food (cold sandwiches of nonprocessed meats) and beverages
(premium beers, wines, softdrinks) at reasonable prices. (Hearty sandwiches
under $5.00.)
5. NO hard liquor sales.
6. NOT a.21 and over nightclub theme; this should eliminate potential attractive
nuisance issues with minors and other loiterers.
7. A Baldini family investment to be family owned and operated. It is anticipated
that Paula Baldini will manage the daily operations and an owner.will be present
virtually 100% of time.
8. Non-smoking playing areas.
9. Prohibitions on loitering, gambling, foul language, and boisterous behavior.

10. Open, well-lit, clean environment. Over 50% of the facility's surrounding walls
are floor to ceiling windows providing high visibility. The security service making
its rounds can easily view the entire center.
11. League nights similar to handicap bowling leagues (providing an entertainment
environment superior to most bowling alleys).
12. Teaching clinics for youths and amateurs.
13. Tournaments for all levels of play.
14. The operation will be kept spotlessly clean.
LOCATION
The facility will occupy 6,152 square feet on the west wing of the 2nd floor of the
Arcadia Landmark Development (northwest corner of Huntington Drive and 5th
Avenue). SEE ATTACHED PHOTOS AND PRELIMINARY PLAN
The LOCATION provides:
1. Adequate evenly distributed parking facilities including a multi-level parking
structure which provides 2nd floor accessibility at the rear of the center. SEE
PHOTOS
2. The arrangement of.parking and the location of Baldini's on the 2nd floor will
have the effect of minimizing traffic congestion. The different peak operating
hours will alleviate any parking issues.
3. The Isolated" 2nd floor location of Baldini's minimizes disturbances to other
tenants and neighbors.
4. The 2nd floor location should discourage loitering or "hanging-out".
5. No previous parking reductions have been granted for this center. •
We further believe that the premier location will dictate the type of clientele that
is attracted. Arcadia is an upscale community and the clientele should mirror that fact.

RESIDENT'S ISSUES AND OBJECTIONS
We have heard the objections registered by some of Arcadia's residents and feel
our concept alleviates many of those concerns. In fact, we believe that if our concept
was presented first, the objections would have been far fewer.
1. A Billiard Parlor will attract°slimed and motorcycle gangs from neighboring cities.
We believe that the majority of citizens in neighboring communities are fine
upstanding ones who would be attracted to this type of establishment. We also
believe the concept for Baldini's and its location will discourage "slime" from
attending. The slime will more than likely want to frequent the low class
establishments which they are accustomed to in other cities.
2. A Billiard Parlor will attract drug dealers. The layout for Baldini's facility is such
that every table will be in full view of employees (no hidden corners) and the
whole facility is highly visible (many windows) to security personnel. Drug
dealers will not have the proper environment for dealing drugs.
3. A Billiard Parlor will attract loitering and gangs. The off-the-street location, the
visibility, and the security should significantly detract from this situation.
4. A Billiards Parlor would be a nuisance to other tenants. Baldini's will be
somewhat isolated on the 2nd floor wing and would operate at different peak
times than other retail and office tenants.
5. A Billiards Parlor would create traffic and parking problems. The Arcadia
Landmark facility has adequate, evenly distributed parking for all tenants.
6. A Billiards "Club" will be nothing more than nightclub with pool tables. Baldini's
is not a club and all age groups can feel welcome.
7. The Billiards Parlor owners are outsiders out to detract from Arcadia's image.
Baldini's is a family business owned by local residents.

CONCLUSION
As with the previous billiard project with which you are familiar, we believe that
a billiards use of this kind provides a fun, upstanding entertainment option to the
community.
We also believe the majority of residents, business groups, and visitors of
Arcadia are in support of this form of entertainment.
We respectfully request that you hear our ideas at the September 3, 1991
Council Meeting before you make a decision to eliminate the billiard use in the CPD
1 zone. We would like the opportunity to answer your questions and respond to the
Arcadia citizenry.
