SUBJECT: 1991 -1992 WEED ABATEMENT CHARGE LIST - PUBLIC HEARING
The Los Angeles County Agricultural Commissioner has submitted the
attached list of charges in connection with the cost of abating
weeds on each separate lot or parcel of land as listed. The
addresses have been inserted.
The list has been posted as required and is now before you to hear
any objections to the charges. If an objection is lodged, you may
want to have the matter investigated by the Fire Department, or
overrule the objection and the following minute motion would be in
order.
RECOMMENDATION:
MOVE TO CONFIRM THE LIST AS SUBMITTED AND DIRECT THAT THE COUNTY
AUDITOR BE INSTRUCTED TO ENTER THE AMOUNTS OF THE ASSESSMENTS
AGAINST THE RESPECTIVE PARCELS OF LAND AS THEY APPEAR ON THE
CURRENT ASSESSMENT ROLL.

SUBJECT: REQUEST FOR ANNEXATION
SOUTHEAST OF THE CITY BOUNDARY
The City has received a letter and petition from Annette E. Phillips who
resides at 827 East Longden Avenue requesting that the City of Arcadia
consider annexation of the area set forth in the attached map (area bordered
by Boley Street on the north, Longden Avenue on the south, the properties
along the east side of Doolittle Avenue on the east and the City boundary on
the west). There are 75 homes within this area and Ms. Phillips has secured
the signatures of owners of 37 residences.
If the City Council is interested in pursuing annexation of this area, the
Council should direct staff to prepare a report which will include the
following:
1. Changes in services which would occur with annexation.
2. Impact of annexation on the City and the owners within the area.
3. Alternative procedures by which this property can be annexed (i.e.,
initiated by property owners or City).
Attached for your information is the letter and petition from Mrs. Phillips
including a map showing the subject area.

Enclosed is an informal petition signed by a majority of homeowners
from a small portion of the unincorporated area of Arcadia
requesting Annexation to the City of Arcadia. A map is attached
indicating the borders involved.
The area is compatible with your surrounding areas and would be an
important step that has been long overdue. The homeowners
respectfully request that this be taken under consideration by the
City Council and-the Planning Commission.
If approved, we would gain police and fire protection and your
public services. The City would gain new citizens willing to
become involved in (and vote for and vote on) City issues.
Revenues allocated to the County would be a new revenue source for
the City.
I have obtained 39 signatures representing at least 50% of the
homeowners.

REQUEST FOR ANNEXATION TO THE CITY OF ARCADIA
The undersigned are requesting that the Arcadia City Council
consider the annexation of the area bounded on the north by Boley
Street on the south by Longden Avenue, on the east by Doolittle
Avenue and on the west by the Arcadia City Boundary (see attached
map) .
Annexation to the City of Arcadia would provide the following City
services: Police, Fire and Public Works. We also understand that
annexation to the City does not change School District Boundaries.
The attached information sheet explains some of the City of
Arcadia's regulations which would affect your property.
This petition represents more than 50% of the homeowners within
this area.

SUBJECT: BUILDING CODE VARIANCE - MM 92-002
25 SOUTH FIRST AVENUE
SUMMARY -
The Planning Department has received a request from Dennis Manning for a
building code variance to keep the security grates and security bars which were
unlawfully installed at 25 South First Avenue (Santa Anita Loan and Jewelry, aka
Pawn Shop).
The Planning Department is recommending denial of this request.
GENERAL INFORMATION
In early June, staff noticed that security bars had been unlawfully installed installed
on the exterior of the building at 25 South First Avenue. On June 22, the Planning
Department sent a letter to Dennis Manning, owner of Santa Anita Loan and
Jewelry and David C. Cross, owner of the property advising them that the security
bars and grates which had been installed on the exterior of the building were illegal.
The letter noted that the security grates and bars must either be removed or they
could apply to the City Council for a variance from the building code.
On July 13, 1992, Mr. Manning submitted the attached request for a building code
variance to keep the security grates and bars noting in his letter that:
"The reason for the request is that I feel the City has allowed a pawn shop and
clearly doesn't understand the need for good safe security."
BACKGROUND INFORMATION
On June 21, 1988, the City Council adopted Ordinance No. 1885 prohibiting
installation of security bars, metal grates and similar security devices on the exterior
of commercial and industrial buildings. The Council noted in the ordinance that
the City is:

"concerned about the trend to use unsightly, and at times hazardous bars and
other similar security devices on commercial and industrial building
throughout the City and.... the negative aesthetic affect and the detrimental
impact of such devices on the community, and the hazard that the
unregulated use of such devices may pose."
The ordinance further noted that:
"the Downtown Revitalization Strategy of the City of Arcadia recom ends
nonexterior use of security devices in order to promote and preserve the
appearance and economic vitality of the City of Arcadia...."
REQUEST
The applicant is requesting a building code variance of Sections 8130.21.5 an.
8130.2.5 of the Arcadia Municipal Code.
Section 8130.21.5 of the Arcadia Municipal Code prohibits the installation o' security
bars, panels, sliding metal grates, or other similar security devices on the ex erior of
any commercial or industrial building.
Section 8130.2.5. notes that it shall be unlawful to install security bars, grates, etc.
without first obtaining a permit.
As noted above, the business owner Mr. Manning, unlawfully installed security
grates on the front exterior of the building and security bars on the outside q f the
windows at the back of the building at 25 South First Avenue.
Section 8130.21.5 permits the installation of security devices on the interior pf a
commercial or industrial building provided that the entire building is equipped
with an automatic sprinkler system.
ANALYSIS
The subject property is located within the Redevelopment Area. The Agency staff
reviewed the requested building code variance (see attached memo) and
commented that the "Exterior security bars are an inappropriate improvement
within the Redevelopment Project Area and contrary to the goals and objectives of
the Redevelopment Plan."
Further, "Agency staff will only support installation of such bars on the inside of the
building in a manner which is unobtrusive from the street while in use and
screened from view when stored during store business hours."

The Planning Department concurs with Redevelopment staff's findings tha;
installation of security grates and bars on the exterior of a building is an
"inappropriate improvement". In addition staff feels that exterior security evices
do have a negative aesthetic affect on the community.
It is the Planning Department's opinion that Mr. Manning has not shown cruse as
to why a Building Code variance should be granted and that the reason cited "for
good safe security" can be accomplished by other means, i.e., security bars intalled
on the inside of the building.
Wayne Crabb of the Fire Department has indicated that the Fire Departmen has no
objections to the security bars on the rear windows if the security grates in tle front
of the building are removed and as long panic hardware is installed per theik
requirements. -
Pete Kinnahan, Assistant City Manager of Economic Development, commented that
the security bars on the outside of the windows at the rear of the building is not
acceptable to Redevelopment staff. The building is highly visible from the parking
area which services the buildings between the alley and Alta Street.
ACTION
The City Council should open the public hearing and receive all testimony
regarding the requested building code variance. Based upon the testimony received
and the evidence presented at tonight's meeting, the Council may:
1. Deny the building code variance and require removal of the security grates in
the front of the building and the security bars in the back of the building
within 15 days from the date of the Council's action or whatever date the City
Council deems reasonable; or
2. Deny the building code variance for the security grates in the front of the
building and approve the security bars on the windows at the rear of the
building, subject to Fire Department requirements and securing a bui ding
permit. The security grates at the front of the building shall be removed
within 15 days from the date of the Council's action or whatever date the City
Council deems reasonable; or
3. Approve the variance as requested, subject to fire sprinklers being ins tailed in
the building. Said sprinklers shall be installed within a time frame specified
by the Fire Department. If sprinklers are not installed within said time frame
to the satisfaction of the Fire Department, the matter shall be referred to the
City Attorney for immediate legal action.

SUBJECT: 25 South First Avenue (Security Bars)
Agency staff has reviewed Mr. Dennis Manning's request for a
Building Code Variance allowing placement of security bars on the
outside of the building located at 25 So. First Avenue. Staff is
opposed to the request for the following reasons:
1. Both the City of Arcadia and the Arcadia Redevelopment
Agency have a special interest in the ongoing evolvement of
Downtown Arcadia as evidenced by the establishment of the
Downtown Central Redevelopment Project Area. Section I.424
of the Redevelopment Plan establishes the Design Review
process as an integral part of the overall redevelopmen
effort. Further, it states that:
"One of the objectives of this Plan is to
create an attractive and pleasant environment
in the Project Area. Therefore, such
[improvement] plans shall give consideration
to. . . amenities to enhance the aesthetic
quality of the Project Area. The Agency
•
shall not approve any [improvement] plans
that do not comply with this Plan. "
Exterior security bars are an inappropriate improvement
within the Redevelopment Project Area and contrary to the
goals and objectives of the Redevelopment Plan.
2 . Agency Staff has determined that exterior mounted security
bars are a violation of Section 8130.21.5 (b) of the Building
Code (as amended) .
3. Acceptable alternatives to exterior security bars are
available which fall within the requirements of the Building
Code. Agency staff will only support installation of such
bars on the inside of the building in a manner which is
unobtrusive from the street while in use and screened from
view when stored during store business hours.
