NOTICE OF SPECIAL MEETING
As authorized by Arcadia City Charter Section 408 and Calif.orni.a
= Government Code Section 54956 a Special Meeting of the Arcadia City
Council is hereby called for the Arcadia City Council Chamber at
240 W. Huntington Drive, Arcadia, California at the conclusion of
the regular Council Meetinq scheduled for December 21, 1993 at 7:30
p.m..
The purpose of the special meeting is to review and consider the
proposed library architecture relative to the Library Expansion
Project.
No other business shall be considered at this meeting.

SUBJECT: RECOMMENDATION TO REPLACE PROPERTY LINE FENCE AT 2248
HIGHLAND OAKS DRIVE, ADJACENT TO WILDERNESS PARK
Background
Upon .weekend closure of Wilderness Park to the general public,
unknown persons began to gain entrance to the Park via an existing
five (5) foot high chain link fence on private property by cutting
or climbing the fence (location shown on the attached sketch) .
The property owner has requested that the City repair or replace
the fence such that it prevents or discourages entry to the park.
This effectuates a public purpose for the City.
Alternatives _. .
Approximately thirty-five (35) feet of the existing fence is
currently open. Apparently, the opening is used for illegal entry
to the park after the main gate is closed to the public. The fence
requires repair or replacement (even though it may be subject to
being cut by vandals again) . The following three options are
submitted for the City Council's consideration:
1. Replace the 35' opening with a 5' high chain link fence
to match the existing fence for a cost of approximately.
$1, 000.
2. Replace the entire 5' high fence (approximately 52' long)
with an 8' high chain link fence for a cost of
approximately $1, 500. The 8' high fence should make it
more difficult to climb.
3 . Maintain the fence in a state of good repair once the
fence is repaired or replaced if illegal access to the
park through the fence continues to be a problem.
Fiscal Impact
Funds are available in the Parks and Recreation Facilities Fund
(Account #107-400-5506-8503) of the 1993-94 fiscal year budget to
cover the initial cost of either option. The annual cost to
maintain the fence in a state of good repair once the fence is
repaired or replaced is unknown at this time.

Recommendation
It is recommended that the City Council:
1. Direct staff to have the entire existing 5' high fence of
approximately 52' in length replaced with an 8' high
chain link fence for a cost of approximately $1,500.

2 . Direct staff to maintain the' 6' high keziCe'-hin a state of
good repair once the fence is installed if illegal access
to the park through the fence continues to be a problem.
3 . Direct staff to obtain a right-of-entry and hold harmless
agreement approved by the City Attorney and executed by
- the property owner -prior to any -work ,being done on
- private property. - - - -

SUBJECT: Request to Establish Long Term City/Agency Loan and
Repayment Agreement
Recently signed legislation (AB1290) will not permit the Arcadia
Redevelopment Agency to establish debt (such as a bond issue or a
City loan) after January 1, 2004. This Bill becomes effective
January 1, 1994. By approving the attached Loan Repayment
Agreement, both the City and Agency will be able after January 1,
2004 to enter into long term loans subject to City Council and
Agency needs at that time. Approval of this Agreement is merely an
enabling act which preserves the Agency's ability to cover
administrative and project costs over the life of the Redevelopment
Plan.
The Agreement was prepared by Best, Best & Krieger, the Agency's
special Redevelopment Council and approved by the City/Agency
Attorney.
FINANCIAL IMPACT .
None
RECOMMENDATION .
That the City Council and Agency approve the attached Loan and
Repayment Agreement, subject to minor modifications approved by the
City/Agency Attorney. .

LOAN REPAYMENT AGREEMENT
CENTRAL PROJECT AREA REDEVELOPMENT PROJECT
THIS AGREEMENT is entered into this 21st day of December,
1993 , by and between the City of Arcadia, a municipal corporation
("City") , and the Arcadia Redevelopment Agency, a public body
corporate and politic ("Agency") .
WHEREAS, the Agency has an ongoing need for assistance in
funding certain administrative expenses and overhead and project
costs of the Agency through 2026; and
WHEREAS, Section 33600, et seq. , of the California Community
Redevelopment Law- authorizes the Agency to borrow money or accept
financial or other assistance from any other public agency for any
redevelopment project within its area of operation.
NOW, THEREFORE, BE IT RESOLVED that the parties hereto do
mutually agree as follows:
1. Amount of Loan - City agrees during the life of the Central
Redevelopment Plan to loan to the Agency an amount to be
determined each year by the City dependent upon the
availability of City funds in each fiscal year not to exceed
Ten Million Dollars 0;10,000, 000) in any given fiscal year.
Said amount shall be in addition to any and all amounts
previously loaned to the Agency.
2 . Disbursement of Funds The City agrees to disburse loan
proceeds to the Agency upon receipt of a request in writing
from the executive director of the Agency or designee. These
disbursements may be conditioned upon receipt of funds from
the Agency in repayment of previous City loans in amounts
sufficient to cover said disbursements. The Agency agrees to
use such proceeds only for purposes provided for in the
Community Redevelopment Law. .
3 . Interest - The Agency agrees to pay the City up to twelve
percent interest. per annum on the funds borrowed at the time
or times of repayment of the loan.
4 . Repayment - The Agency agrees to repay any and all funds
borrowed as soon as tax increment revenues are available.
5. Obligation Constitutes Indebtedness - This Loan and Repayment
Agreement shall constitute an obligation and debt of the
Agency to use all available tax increment revenue to repay
City by periodic payments. Such indebtedness shall be
subordinate to any existing or future bonded indebtedness of
the Agency.

Agreement as of the date first above-written.
