Butler, Community Development Administr.,tor ll/ ; SUBJECT: Consideration of assessment for City abatement of property ls/ violations at 163 Alta Street (Thomas Morales, Property Owner) SUMMARY On June 2, 1995, Hartfield Construction Company demolished the existin fire damaged dwelling at 163 Alta Street pursuant to the Notice to Abate issued to the property owner, Thomas Morales, on March 10, 1995. Per Section 9406.5 of the Arcadia Municipal Code, the City Council sitting as a Board of Equalization must approve the,cost of abatement. The Development Services Department recommends that the City Council approve the assessment in the amount of $3,952.00 as set forth in this report. DISCUSSION On December 17, 1994 fire damaged the dwelling located at 163 Alta Street (the northwest corner of Second Avenue and Alta Street). On December 19, 1994 an inspection of the building was made a City Building Inspector and it was determined that the building was burned beyond reasonable repair. A letter was sent to Thomas Morales, the property owner, on December 21, 1994 notifying him that the burned structure must be demolished and all trash and debris cleaned from the site. No action was taken by the property owner and on February 21,'1995 a second letter was sent to Mr. Morales. The letter requested that Mr. Morales provide the City with a specific demolition schedule. I 163 Alta Street LASER IMAGED Page 1 July 11, 1995 • RECOMMENDATION The Development Services Department recommends that the City Council app ove the cost for abatement in the amount of $3,952.00. ACTION The City Council should direct the Administrative Services Director to send a bill to the property owner for the assessment as set forth in this report ($3,952.00) or as modified by the City Council. Any bills unpaid at the end of thirty (30) days should be referred to the Administrative Services Director for collection. Connors, Redevelo•ment Project Manager RE: Recommendation to make annual findings Confirming Existing Agency Obligations, Programs, Projects and Activities RESOLUTION NO. ARA-177 - A RESOLUTION OF THE ARCADIA REDEVELOPMENT AGENCY DECLARING THAT THE AGENCY IS UNABLE TO SET ASIDE 20% OR LESS • OF ITS 1994-95 TAX INCREMENT FOR LOW/MODERATE INCOME HOUSING DUE TO- EXISTING AGENCY OBLIGATIONS, PROGRAMS, PROJECTS AND ACTIVITIES. SUMMARY: California State Assembly Bill AB265 requires that Redevelopment Agencies set aside 20% of their annual tax increment into a Housing Fund for low and moderate income housing. Twenty percent of the Arcadia Redevelopment Agency's tax increment is estimated to be $420,000 in FY 1995-96. AB265 permits the Agency to make findings that it is not able to set aside all or part of the 20% into the Low/Moderate Income Housing Fund if existing Redevelopment Agency obligations, projects, programs or activities in any fiscal year prior to FY 1996-97 do not permit such. Redevelopment Agencies are required to make findings annually regarding the availability of funds to be set aside in that fiscal year for the Low and Moderate Income Housing.Fund. Resolution No. ARA-177 (attached) makes findings that due to the , Agency's existing obligations, projects and activities (e.g., the Fifth Avenue Project, Downtown 2000 Program, Southwest Corner Project, Northwest. Corner Project, bonded- indebtedness, Economic Development Division operations and administration), no funds can be aside into a Low and Moderate Income Housing Fund for FY 1995-96. If this, action is approved, a copy of the attached Resolution shall be mailed to the State Department of Housing and Community Development within - 10 days after adoption. LASER IMAGED • DISCUSSION: The findings contained in Resolution No. ARA-177 have been made e annually pen the he Agency since FY 86-87. Redevelopment Law requires ccounta9n 'FY 96-97 or forfeit money from their low /moderate income housing passage 96-97 of forfeit control of those funds. In light of this e requirement and approved the on December 20, 1994 legislation (AB1290), staff prepared and Agency Implementation Plan. This Implementation Plan provides at blueprint to future in the Agency activities (including housing). Housing programs Plan include: • * contributing to the L.A. County Housing Authority for Section 8 rent subsidies, * senior citizen housing, * first time home buyer's loan program, * • mortgage credit certificate program, * affordable housing rehabilitation programs, and * Inclusionary housing assistance program (participating in • private home developments in exchange for sale or rental to low/moderate income families). The Agency intends to pursue low/moderate income housing programs in FY1996-97, pursuant to the Agency's 5 Year ImplementationPlan, adopted December 20, 1994. FISCAL IMPACT: None RECOMMENDATION: It is recommended that the Agency adopt Resolution No. ARA-1 T,THE AGENCY RESOLUTION OF THE ARCADIA REDEVELOPMENT AGENCY ITS 1996 96 TAX INCREMENT FOR UNABLE TO SET 20%.
