Shahbazi, A sociate Civil Engineer Subject: REQUEST FOR INSTALLATION OF TEMPO Y STREET BANNERS ON EDISON -OWNED STREET LIGHT POLES FO CELEBRATING THE 50TH ANNIVERSARY OF THE ARCADIA CHRISTIAN SCHOOL The Arcadia Christian School is requesting permission to install approximately two (2) to four (4) temporary banners on Edison -owned street light poles right in front of the school from May 1, 1995 to December 31, 1995 (or at least to the middle of June, 1995 when school ends). Staff is recommending approval of this request and has attached the permit application package for City Council consideration. In accordance with City Ordinance No. 2004 which stipulates the City's conditions of approval for the installation of temporary special event signs /banners, the applicant is required to do the following: 1. Submit permit application. 2. Pay for all the fees and inspection charges associated with this permit. 3. Provide insurance and hold harmless protection to the City. 4. Submit an installation and removal plan subject to approval by the Development Services Director. 5. Provide any other information as deemed necessary by the Development Services Director consistent with the need to review the request of the applicant. The Ordinance also requires that staff transmit for City Council consideration the completed application with the necessary report and recommendation. Mayor and City Council March 21, 1995 Page 2 The Arcadia Christian School, in their letter of March 8, 1995, 1995 (Exhibit "A"), has requested approval to display banners (Exhibit "B") on street light poles in front of the school (Exhibit "C") to celebrate their 50th anniversary. The School would like to display the banners from May 1 to the end of year 1995, or at least to the middle of June when school ends . The Development Services Department and the City Attorney have reviewed all of the required submittal and hereby transmit the complete permit application (Exhibit "D ") for City Council consideration. Staff recommends that the City Council approve Arcadia Christian School's request to install banners from May 1, 1995 to December 31, 1995 (subject to the renewal of the current certificate of insurance that expires on September 16, 1995), and direct the Development Services Department to approve the Encroachment Permit (Exhibit "D ") subject to compliance with the provisions in Ordinance No. 2004, and subject to compliance with the Southern California Edison Company's requirements. Arcadia Christian School is celebrating its 50th anniversary this year. As a part of our celebration, we would like to place some pole banners on the street light poles located on Santa Anita Avenue right in front of the school. We would like to install a minimum of two banners and a maximum of four banners. The banners would be similar to the ones currently in place announcing the anniversary of Santa Anita racetrack I am attaching a rough layout of the banners as well as some photographs that indicate where we would like the banners placed. We are planning to have these banners made by a professional banner comp, ny and will order the appropriate mounting hardware. It will take approximately one month for the banners to be produced and installed, so we would like to get them .up May 1 and keep them up during the 1995 year. If this period of time is too long, we would at least like- to keep them up through the end of the school year, which ends the middle of June. Please let us know if there is any other information you need from us with regards to allowing the display of these anniversary celebration banners. MODIFYING WATER CONSERVATION ORDINANCE NO. 1930 BY ADDING PHASES VI, VII AND VIII AND ESTABLISHING A WATER BANKING PROGRAM SUMMARY AB 11 requires that each California urban water supplier develop a Water Shortage Contingency Plan providing for water usage curtailments of up to 50%. The City of Arcadia's Plan currently includes water curtailment phases up to 25%. The addition of Phases VI, VII and VIII - 30%, 40% and 50% water usage curtailments as set forth in Ordinance 2036 is necessary to bring our Plan into compliance with AB 11. Furthermore, on February 7, 1995 the City Council directed staff to include a section in Ordinance 2036 which would provide a way, during mandatory conservation, for water customers who conserve below their allotment to use the underused units of water ("credits") in another billing cycle when their usage goes above their allotment. It is recommended that the City Council introduce Ordinance No. 2036, adding a 30%, 40% and 50% water usage curtailment to the Mandatory Water Conservation Plan, and establishing a Water Banking Program as part of said Plan. DISCUSSION AB 11 requires that each California urban water supplier develop a Water Shortage Contingency Plan providing for water usage curtailments up to 50%. The City of Arcadia's Water Shortage Contingency Plan as approved by the City Council in June 1992 includes water curtailment phases up to 25%. Ordinance No. 2036 will add Phases VI, VII and VIII - 30%, 40% and 50% water usage curtailments to the Plan. Additionally, in an attempt to address complaints received from residents when the Mandatory Conservation Plan was implemented in 1991, the City Council directed staff, on February 7, 1995, to include a section in Ordinance No. 2036 which would provide a way, during mandatory conservation, for water customers who conserve below their allotment, to use their "credits" in another billing cycle when their usage goes above their allotment. LASER IMAGED y Recommendation to Introduce Ordinance No. 2036 March 21, 1995 Page 2 As background, when the Mandatory Water Conservation Plan was implemented in 1991, staff received. complaints from residents regarding their dissatisfaction with the fact that no provision to carry forward over-conservation amounts was included in the Plan. At the time the mandatory conservation program was in effect, the City's water billing system was not capable of handling a credit balance or over-conservtion amount in customers' accounts. In early 1993, however, the City purchased ! and installed a new water billing system that provides the capability to track the credit or over-conservation amount (called "banking"). Establishing a Water Banking Program would allow customers to be more flexible in their water usage, e.g. they could save water at opportune times and avoid penalties during peak usage times as long as they maintain a credit balance. If the City re- establishes the mandatory water usage curtailments in the future, it is anticipated that those customers who were dissatisfied with the conservation program in 1991 will be less disgruntled next time around, and, hopefully, be more receptive to mandatory conservation. FISCAL IMPACT The goal of mandatory water conservation is to save water, which, of course, results in a negative impact on water sales revenue. However, this negative_ impact should be offset by the amount of revenue generated by violation penalties from overuse of water. RECOMMENDATION It is recommended that the City Council introduce Ordinance No. 2036, adding a l30%, 40% and 50% water usage curtailment and establishing a Water Banking Program as part of the Mandatory Water Conservation Plan (Ordinance No. 1930). Kurth, Administrative Assistant SUBJECT: Recommendation to Approve Resolution No. 5841 Rescinding Phase I of the Mandatory Water Conservation Plan Pursuant to Ordinance No. 1930 and Continuing the 10% Voluntary_ Water Conservation Goal Pursuant to Resolution No. 5435 SUMMARY Recently, the State of California and the City of Arcadia have received a significant amount of rainfall which has increased the water supply and enabled the State to determine that the drought is over. Accordingly, the City of Arcadia is now in a position to be able to lift some of the restrictions placed on residents with regard to water conservation. It is therefore recommended that the City Council approve Resolution No. 5841 rescinding Phase I, Prohibited Water Uses Applicable to All Customers, of the Mandatory Water Conservation Plan (Ordinance No. 1930) and continuing the 10% voluntary water conservation goal pursuant to Resolution No. 5435. BACKGROUND On February 5, 1991, the City Council adopted Ordinance No. .1930 which established a Mandatory Water Conservation Plan. At the same time Resolution No. 5568 was passed which implemented Phases I (restricted uses of water) and II (mandatory 10% reduction in water use) of this Conservation Plan. Subsequently, on December 17, 1991, Resolution No. 5638, which rescinded Phase II and continued Phase I, was adopted. Resolution No. 5638 also restored the 10% voluntary water conservation goal which was adopted by the City Council on August 16, 1988 (Resolution No. 5435) . Phase I of the Mandatory Water Conservation Plan (Ordinance No. 1930). outlines the following restricted uses of. water: (a) There shall be no- hose washing of sidewalks, walkways, driveways or parking areas. (b) No water shall be used to clean, fill or maintain levels in decorative fountains unless such water is part of a recycling system. LASER 1 G � CQ4 y df Resolution No. 5841 Rescinding Phase I of the Mandatory Water Conservation Plan Page 2 (c) No restaurant, hotel, cafe, cafeteria or other public place where food is sold, served or offered for sale, shall serve drinking water to any customer unless expressly requested by the customer. (d) No customer of the Water Division shall permit water to leak from any facility on his premises. (e) No lawn, landscape or other turf areas shall be watered or irrigated between the hours of 10: 00 a.m. and 4 : 00 p.m. (f) No lawn, landscape or other turf areas shall be watered in a wasteful manner. In order to implement, modify or rescind a phase under Ordinance No. 1930 (Mandatory Water Conservation Plan) , a Resolution must be adopted by the City Council. DISCUSSION Due to the recent increased water supply as a result of above- average rainfall throughout the State of California, we do not anticipate any problems this year or next year in meeting our customers' water needs. In addition, there is sufficient water in storage within the San Gabriel Valley Basins and the State for the remainder of 1995 and possibly 1996. Based on the recent report by the State Department of Water Resources declaring the drought as being over, we are recommending the lifting of the Phase I restricted water uses thus allowing residents to use water at any time. Wasteful uses of water will still be considered a violation of the City's Municipal Code and the appropriate violation notices will be sent to all violators. Despite the increased water supply, a limited water supply still exists with drought conditions fluctuating from year to year depending on rainfall. Staff is therefore recommending that the 10% Voluntary Conservation Program under Resolution No. 5435 remain in place. Water bills will continue to show allocations and will indicate over/under usage and percentage. The Water Division plans to advise residents of the lifting of the Phase I restricted water uses by an article in the next quarterly City Newsletter. FISCAL IMPACT: There may be a positive fiscal impact as customers may use more water as a result of lifting restricted uses. Butler, Community Development Administrator SUBJECT: Recommendation to enter into Professional Services Agreements ith LSA Associates, Inc. for the Preparation of a General Plan Update a ,d Frelich, Kaufman, Fox and Sohagi for legal services and to Allocate Additional Funds (from the Capital Outlay Fund) for the General Plan Update SUMMARY A General Plan Update has been a long-range goal of the Development Services Department. The most recent update was in December, 1990 and the last major technical studies (noise, land use and circulation) were conducted in the late 1970's and do not adequately reflect current land uses, noise issues and circulation patterns. Also, since 1990 there have been several changes in State law relating to required information that must be incorporated in the elements of the General Plan. The Development Services Department is beginning work on this project and is requesting City Council approval to enter into Professional Services Agreements with LSA Associates, Inc. in an amount not to exceed $150,000 for the preparation of a General Plan Update (including the environmental assessment), and with Frelich, Kaufman, Fox and Sohagi in an amount not to exceed $10,000 for legal services. In addition, we are requesting that the City Council allocate an additional $85,000 from the Capital Outlay Fund for this project. DISCUSSION The General Plan is mandated by State Law to contain seven (7) elements: Land Use, Circulation, Housing, Conservation, Open Space, Noise and Safety. In whole, these elements comprise an integrated, internally consistent and compatible statement of policies for managing the future development of a City. GP Update LASER IMAGED March 21, 1995 Page 1 C4.0 /7 7 y r J The purpose of the General Plan is to direct and define the type of community that is desired for the future; provide a means to obtain that desired future and express the organization of physical, economic and social activities sought by the community. In order to be a working document the General Plan needs to address and resolve immediate and long-term issues concerning protection of community lifestyles, quality of life, public services, economic vitality and environmental protection. The recommended General Plan Update would achieve the following City and State objectives: • Provide a solid policy framework upon which new development and redevelopment projects can be found to be consistent with the goals and aspirations of the Arcadia residents. • Identify aspects of the community which are to be preserved or protected from change as well as identify opportunities for future development and redevelopment. • Consolidate previous City and Redevelopment Agency planning efforts to establish a comprehensive development policy for the City. • Establish a clear and logical relationship between all General Plan elements. • Respond to State Department of Housing and Community Development issues regarding the provision and maintenance of affordable housing within the community. • Provide policy in a format which is easily understandable to Arcadia residents as well as the City decision makers and development community. • Establish and provide mechanisms to continually maintain the General Plan's technical and background information so as to support the Plan as a "living document". City staff is recommending the City contract with LSA Associates. They have extensive background in the preparation of General Plans and are familiar with the City, the community and its environment. They come highly recommended by other cities for their timeliness in the preparation of General Plans and their sensitivity in creating policies which truly reflect a community's concerns and needs. GP Update March 21, 1995 Page 2 FISCAL IMPACT In 1994 the Development Services Department anticipated the need for a General Plan Update and made plans to phase the project over two years. Accordingly, $75,000 was set aside in the current year's Capital Outlay Fund. Staff is requesting an additional $85,000 be allocated from the Capital Outlay Fund. The total cost of the project is expected to be $160,000; $150,000 for LSA Associates, Inc. and $10,000 for Frelich, Kaufman, Fox and Sohagi legal services. RECOMMENDATION The Development Services Department recommends that the City Council authorize the City Manager to enter into professional services agreements with LSA Associates, Inc., in an amount not to exceed $150,000 for the preparation of the City's General Plan Update; with Frelich, Kaufman, Fox and Sohagi in an amount not to exceed $10,000 for legal services; and allocate an additional $85,000 from the Capital Outlay Fund for completion of this project. Connors, Redevelop ent Project Manager RE: Recommendation to Assign Rosenow Sp vacek Group (RSG) Contract for Redevelopment Consulting Services to James D. Williams SUMMARY: Since July, , l93, the Redevelopment Agency has contracted with Rosenow Spevacek Group •(RSG) for professional redevelopment consulting services. The contract has been serviced by James D. Williams. RSG has notified the Agency (Attachment No. 1) of its desire to assign this contract to Mr. Williams. Mr. Williams has agreed to the assignment (Attachment No. 2). Staff recommends the Agency's approval of that request. DISCUSSION: RSG has provided professional redevelopment consulting services to Agency staff since July 22, 1993. Mr. James D. Williams has been the assigned staff person for the entire period of time and has provided cash flow projections, pro-forma analysis, and negotiating assistance on the former Costco Project, the joint Arcadia/Monrovia Fifth Avenue, Northwest Corner, Southwest Corner, and Foulger Ford Projects. Mr. Williams is now providing consulting services independently of RSG. He has requested (and RSG has agreed) that the Agency's account be assigned to him for all future work. Staff has developed a good working relationship with Mr. Williams and in light of the data base he has established concerning Arcadia's projects and his insight into each of the projects, staff believes that assignment of the contract to Mr. Williams is in the best interests of the Agency. Any Assignment Agreement or supplemental contract will be subject to review and approval by Agency General Counsel. LASER IMAGED A� n dog -- FISCAL IMPACT:. None. RECOMMENDATION: The Agency staff recommends that the Arcadia Redevelopment Agency Approve the Assignment of RSG Contract for Redevelopment Consulting Services to James D. Inc. Said Agreement, dated July 22, 1993, involves the provision of urban planning services for the Arcadia Redevelopment Agency. The Rosenow Spevacek Group, Inc. wishes to assign all rights and responsibilities pursuant to said Agreement to James D. Williams. The reason for said assignment request is that all activities pursuant to this Agreement were the responsibility of James D. Williams; Mr. Williams and RSG have entered into a new relationship that necessitates this assignment request. However, RSG would like to maintain a standing for future consideration for redevelopment services to the Arcadia Redevelopment Agency.
