This is based on existing facts and circumstances, on advice of the
City Attorney, involving a significant exposure to litigation against the
City (Government Code Section 54956.9(b)(1) and is also based on
facts and circumstances that might result in litigation against the City,
which the City believes are not yet known to a potential plaintiff, which
facts and circumstances need to be disclosed to the City Council
(Government Code Section 54956.9(3)(a) (b) (1).

to confer with the City Attorney regarding the existing litigation of

SUBJECT: RECOMMENDATION TO ADOPT RESOLUTION NO. 5908
SUPPORTING THE NEW LOS ANGELES MARKETING
PARTNERSHIP
BACKGROUND
The Mayor received a letter from the New Los Angeles Marketing Partnership
( "NLAMP ") requesting the City of Arcadia's support of their efforts to promote economic
vitality in the Los Angeles region. Subsequent to receiving the letter, staff contacted
NLAMP to obtain additional information and then presented the City Council with a
report outlining the association's goals and detailing exactly what they expect from the
City in terms of support.
After reviewing the above referenced report, the City Council, at its February 20, 1996
meeting, directed staff to prepare the appropriate resolution that will demonstrate
Arcadia's official endorsement of NLAMP's efforts.
DISCUSSION
NLAMP was formed to market the Los Angeles area as an excellent location for
business. They are in the second year of a five -year promotional campaign that is
designed to promote Los Angeles' good qualities and to communicate the dynamic
economic and cultural strengths of our region. The campaign spotlights the facts that
make Los Angeles a premier place to live, work and invest. Funding for NLAMP comes
from a combination of money received from the City of LoG Angeles, the County of Los
Angeles and several corporate sponsors.
NLAMP believes that one of the crucial elements to successfully marketing our region
is through a partnership of cities, business, government and community. They feel that
it is important for all of L.A. County to pull together in this effort so that we can
successfully compete against other areas who are waging aggressive efforts to get
business to leave this area and relocate in their County /City. Accordingly, they are

seeking endorsement of their efforts from Los Angeles County cities and have also
requested that we provide them with information about Arcadia that they can use in
press releases, speeches, promotional materials, advertisements, etc.
NLAMP's marketing campaign consists of several components with advertising being
one of the more significant elements. The 1996 campaign is directed toward the
business community (as opposed to the 1995 campaign which targeted individuals first
and businesses second) and will feature ads in print media and on radio. Although the
advertisements use the name "Los Angeles," they imply the entire region, not just the
City. Virtually all of the advertising will feature a toll -free telephone number. If NLAMP
receives a general inquiry regarding suggestions for possible sites and /or cities in which
a business can locate, they will refer the person to the Economic Development
Corporation of Los Angeles which is a county -wide "broker," if you will, who will make
an attempt to put cities and businesses together. NLAMP also works cooperatively with
the San Gabriel Valley Commerce and Cities Consortium.
The benefits received by the City of Arcadia for endorsing NLAMP are the opportunity
to participate in a regionally based marketing campaign, and the ability to put Arcadia's
name and unique features in front of a wide variety of businesses. Participation also
demonstrates our support of regional cooperation and economic growth.
FISCAL IMPACT
Because NLAMP does not have a membership fee, the cost of participation is minimal.
The only expense we will incur is that of staff time and the cost of any background
materials we give to them. These are not additional costs to the City as this kind of
work is already performed by staff on a regular basis.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 5908 supporting the New
Los Angeles Marketing Partnership.

SUBJECT: Consideration of a Time Extension for Conditional Use Permit 92-003
the Rodeffer Inert Landfill
SUMMARY
On January 30, 1996 the attached letter was received from Phyllis Rodeffer, requesting a
one-year time extension for Conditional use Permit 92-003, a proposed inert landfill .t
12321 Lower Azusa Road, which was approved by the City Council on April 5, 1994.
The Development Services Department is recommending approval of a one year ti e
extension to April 5, 1997.
DISCUSSION
The City Council at its April 5, 1994 meeting adopted:
• Resolution 5779 certifying the Final EIR for the landfill operations plan . d
reclamation plan and adopting a mitigation monitoring and reporting program; and
• Resolution 5785 approving Conditional Use Permit 92-003 (including the operatio s
plan) and the Reclamation Plan for the inert landfill at 12321 Lower Azusa Road.
On May 2, 1995, the City Council granted a one year time extension for this project to
April 5, 1996.
Section 9275.2.14 of the Arcadia Municipal Code states that an extension for a
conditional use permit may be granted upon written request filed prior to the expiration of
the C.U.P. The request should set forth reasons supported by factual data why the C.0 P.
has been unused, abandoned or discontinued or compliance with the conditions has of
been achieved. No extension shall be granted unless the Council fords justifiable ca se
for such extension.

As noted in Mrs. Rodeffer's letter, the reason for requesting the extension is that th-
litigation proceedings with the City of El Monte have prevented the project fro
proceeding. However, they are currently pursuing the required permits through th-
various agencies including the California Integrated Waste Management Boar.,
California Water Quality Control Board and the South Coast Air Quality Manageme t
District.
RECOMMENDATION
The Development Services Department is recommending a one year time extension 1.
April 5, 1997, for C.U.P. 92-003
ACTION
The City Council should move to approve a one-year time extension as recommended .y
the Development Services Department.

Dear Ms. Butler:
Pursuant to the provisions of Arcadia Municipal Code No. 9275.2. 14, Rodeffer
Investments hereby applies for an additional extension of the Conditiona Use
Permit No. 92-003 which was granted April 5, 1994 and extended to April
1996, pursuant to Arcadia City Council Resolution No. 5785.
The reason for requesting this additional extension is the litigation by El-
Monte which has prevented us from proceeding. Also, we have changed leg.l
counsel to represent us on all legal matters as well and have a new proj-ct
manager. We are diligently pursuing the required permits regarding this
project.
We, therefore, request to have this item on the City Council agenda in M- rch
and are enclosing our check in the amount of $57.00 made payable to the City
of Arcadia .

RE: Report and Recommendation Regarding an Appeal of Allowed Uses
inside the Project Area for a Consignment Clothing Store (35 So. First
Avenue)
SUMMARY:
On January 19, 1993 the Arcadia Redevelopment Agency adopted Resolution No. -
ARA-172 which establishes land use preferences for the Central Redevelopment
Project Area (Project Area). Part of this Resolution identifies specific uses as
"inappropriate" and therefore prohibited. Two such uses are "Second Hand and Used
Clothing Stores" and "Thrift Shops." Staff has received a request (Attachment No. 1)
from Lee Daniels, the owner of "Second Time Around" that the Agency consider
allowing her to relocate her consignment and resale shop from 54 E. Live Oak Avenue
to 35 So. First Avenue (Location Map - Attachment No. 2).
DISCUSSION:
Ms. Daniels assures Agency staff that her store is a resale/consignment shop which
carries designer and high quality clothing for women and children. Upon visiting her
current location, staff believes the store would be an appropriate addition to the
downtown.
On May 18, 1993, the Agency received a similar request from Mary Livengood. After
review and consideration, the Agency approved the request for a designer resale
shop in the Downtown retail core. However, she ultimately elected to open a store on
Baldwin Avenue.
On February 24, 1996, the Arcadia Planning Commission met, considered and
approved the creation of a "CBD" (Central Business District) Zone which includes area
within the Project Area as well as along First Avenue south to California (Map -
Attachment No. 3). If ultimately approved by the City Council in its current form,

consignment stores will be allowed in this zone. Until Resolution No. ARA-172 can be
amended, a conflict will exist between this new zone and the Resolution's prohibited
uses.
FISCAL IMPACT:
No significant impact.
RECOMMENDATION:
It is recommended that the Arcadia Redevelopment Agency approve the resale shop
proposed for 35 So. First Avenue

Dear Mr. Kinnahan:
On Wednesday February 21, 1996 I spoke to Mr. Dale Conner concerning my
desire to relocate my shop from 54 E. Live Oak to 35 S. First Ave. in Arcadia. I was told
that second hand shops would not be permitted to operate in the redevelopment
project north of Alta street on First Avenue. I am writing to appeal this decision by the .
City of Arcadia.
I have a very nice resale/consignment shop carrying designer and high quality
clothing for women and children. I have been in business for over nine years and
attract a nice clientele. In looking over the area on First Avenue, I have noticed that
there is one other consignment shop, an antique shop, and a costume shop south of
Alta. There is also a pawn shop north of Alta, a few doors from where I would like to
relocate. I feel my shop would be a nice addition to First Avenue and fit in well with the
other businesses in the area. I also feel this location would be of benefit to my
business as well as the other businesses of that type on First Avenue.
I have met with the landlord, Mr. David Cross, of the property at 35 S. First
Avenue, located on the north-west corner of Alta And First Avenue. He has agreed to
lease the property to me beginning April 1st.
I would appreciate it if the City would consider and act upon my appeal as soon
as possible. Mr. Cross is anxious to lease his property, I am anxious to move my
business as my lease on Live Oak is up March 31, and I believe Second Time Around
would be a nice addition to First Avenue.
If there is any other information you need, please do not hesitate to call me.

SUBJECT: REPORT AND RECOMMENDATION TO PERMIT OUTDOOR
DISPLAYS FOR THE DOWNTOWN 2000 REOPENING
CELEBRATION
SUMMARY
Several downtown merchants have asked whether certain outdoor advertising and
displays will be permitted in the downtown immediately before and after the March 30
Grand Reopening Celebration. Staff recommends that the City Council waive the
enforcement of City codes regulating outdoor displays for the period of March 16
through April 14, 1996, specifically Sections 9263.4 and 9262.4.3 B of the Arcadia
Municipal Code.
DESCRIPTION
Staff has received a request for an 8 ft. by 12 ft. advertising balloon on the roof of a
Huntington Drive retail store for the week before the March 30 celebration. We have
also received a request to place a flower cart offering flowers for sale on the public and
private sidewalk in front of a retail store on First Avenue. Staff anticipates other
requests from merchants displaying their products on the sidewalk or displaying
otherwise prohibited promotion devices (eg. balloons, banners, signs, etc.) in the
weeks before and after the March 30 event. Because of the unique circumstances
affecting the Downtown 2000 Streetscape project, staff recommends that the City
Council authorize suspension of regulations affecting outdoor displays during the
period of Saturday, March 16, through Sunday, April 14, 1996, subject to the following
conditions:
• all sidewalks shall have 5 feet of clear walkway
• there shall be no bright or flashing lights, loud music, or other attractions which
prejudice the safe passage of vehicles and pedestrians
• the City Manager, Police Chief, Fire Chief, Maintenance Services Director and/or
their designees shall have the right and authority to order the removal of any
promotional materials, sales merchandise, equipment, furniture, which may
jeopardize the health, safety and welfare of the public.

RECOMMENDATION
That the City Council waive the enforcement of City codes regulating outdoor displays,
