SUBJECT: SALE OF TRAFFIC LINE /STENCIL TRUCK TO THE CITY OF NEWPORT
BEACH
The Maintenance Services Department has evaluated the effectiveness of the pavement marking and
striping programs and found it to be more cost effective to complete the functions of the operation
by contract services. Performance of this work by contract leaves the City with a traffic line /stencil
truck that is no longer needed. This truck is a 1992 Isuzu flatbed cab and chassis truck with paint
striping equipment mounted on the truck. The original purchase price of the truck was $84,584 and
was purchased in January 1993. The City of Newport Beach through negotiation with staff has
offered the City $53,000 for this truck, and was approved by their City Council earlier this month.
Independent appraisals have valued the truck between $40,000 and $57,000. In accordance with the
Municipal Code, staff recommends that the City Council waive the formal bid process, declare the
traffic line /stencil truck as surplus equipment and authorize the sale of the traffic line /stencil truck
to the City of Newport Beach for $53,000.
The Traffic Safety Section of Maintenance Services Department is responsible for the City's traffic
sign maintenance, pavement marking and striping programs. The pavement marking and striping
portion of this program includes painting and repainting of pavement markings and striping on
roadways, parking lots and routine painting of curbs. This program is also responsible for the
removal of old curb markings, street striping and pavement markings as traffic patterns and
requirements change over time. Painting services on all primary and secondary streets are completed
by a private contractor. The residential, commercial and industrial street painting services are
completed by City staff.
During this last years budget development process, staff evaluated the effectiveness of this program.
After careful review of the program, staff found that it would be more cost effective to contract for
all scheduled pavement marking and striping work rather than to continue doing a significant amount
of the work with City staff. A contractor can complete the residential, commercial and industrial
portion of the painting program for approximately the same cost ($14,000) the City expends for

Staff also evaluated the effectiveness of the traffic sign maintenance program. This operation is
responsible for the maintenance of more than 17,000 traffic signs in the City. The program consists
of new sign installation and removals (as ordered by the Traffic Engineering Section), routine
maintenance of signs and markers including straightening, replacing and/or cleaning signs, posts or
hardware and periodic sign inspection. A field review of existing sign conditions revealed the need
to enhance and standardize the functions of this operation. Many stop signs are severely faded and
are in need of maintenance or replacement. Regulatory and directional signs are not consistently
installed at standard heights as required in the uniform traffic control manual. Street name signs and
other directional signs are randomly and at times improperly located. The overall condition of the
City's sign inventory needs improvement and maintenance standards need to be developed including
an improved preventive maintenance program.
While these evaluations were being performed, the City of Newport Beach was using our traffic
line /stencil truck as a model to develop specifications for the purchase of a new unit for their street
striping program. During one of their visits, staff approached them concerning the possibility of
purchasing our striping truck. They indicated their interest in pursuing the purchase of the truck.
Independent appraisals for the traffic line /stencil truck were received from Morton Traffic Markings,
a local equipment dealer, and from an equipment auction company. The appraised value of the truck
ranges between $40,000 and $57,000, depending on how it is sold. The low end estimate represents
the low end of as sale at and equipment auction. The high end estimate represents an optimum or
high end if the perfect sale could be made. Based on these appraisals, the City of Newport Beach
and staff negotiated the $53,000 sale price for the truck.
To meet the daily maintenance needs of traffic sign maintenance and to improve the efficiency of
the traffic sign maintenance program, a pneumatic post driveribreaker and a portable generator are
needed. The cost of this equipment is estimated at approximately $7,500. These two pieces of
equipment will save staff time in the installation of sign posts and the repair and replacement of
traffic signs. This will shorten response times to requests for traffic sign maintenance service. Also,
because more attention is needed in traffic sign maintenance, the time saved from the in -house
painting program (approximately 700 man hours per year), will be devoted to traffic sign
maintenance functions.
Based on the evaluation of both programs and the City of Newport Beach's offer to purchase the
truck, staff recommends that the City Council declare the traffic line /stencil truck as surplus and
authorize the sale of the truck to the City of Newport Beach for $53,000. In accordance with Chapter
8, Purchasing System, Part 4, Procedure, Division 4, Exceptions and Exemptions, Section 2844.3,
Waiver, of the Municipal Code, staff recommends that the City Council waive the formal bid
process, declare the traffic line /stencil truck as surplus equipment and authorize the sale of this truck
to the City of Newport Beach for $53,000. The City Attorney has reviewed and approved the
agreement between the two Cities for the sale of the truck.

Staff also recommends that the City contract for all traffic striping and pavement marking services
and appropriate $7,500 for the purchase of the pneumatic post driver/breaker and a portable
generator.
Funds from the sale of the traffic line /stencil truck shall be designated to purchase a pneumatic post
driver/breaker and a portable generator for approximately $7,500 and the balance of $45,500 will
be redeposited into the Equipment Replacement Fund.
It is recommended that the City Council:
1. Waive the formal bid process.
2. Declare the traffic line /stencil truck as surplus equipment.
3. Authorize the sale of the truck to the City of Newport Beach for $53,000.
4. Authorize the City Manager to execute a purchase agreement in a form approved by the City
Attorney.
5. Appropriate $7,500 from the sale of the truck for the purchase a pneumatic post driver/breaker
and a portable generator.

SUBJECT: PUBLIC HEARING REGARDING REPORT AND RECOMMENDATION TO
ADOPT RESOLUTION NO. 5954, SETTING FORTH CERTAIN
ENGINEERING PERMIT FEES, DEPOSITS, INSPECTION
CHARGES, AND RELATED LIABILITY INSURANCE AND SURETY
BONDS PURSUANT TO ORDINANCE NO. 2057 AND REPEALING IN
THEIR ENTIRETY RESOLUTION NO.'S 5677 AND 5852.
It is recommended that the City Council adopt Resolution No.
5954, setting forth certain Engineering permit fees, deposits,
inspection charges, liability insurance and surety bonds
relating to street improvements, transportation, encroachment,
and sewers. The proposed resolution combines the fees from
different but related resolutions into one resolution. It also
includes the fees authorized by Ordinance No. 2057 concerning
encroachments in the public right of way.
The current engineering fees for the issuance of permits for
street improvements, encroachment, excavation, sewers,
transportation, and related inspection charges, liability
insurance, bonds and deposits were established by resolutions of
the City Council in early 1990's.
Staff has conducted an intensive study of fees and charges to
identify the true cost of providing services to the general
public. The conclusion of the study indicates that the actual

cost of certain services being provided by the staff are
significantly higher than the current fees and charges
established by the City in 1992. By adopting Resolution No.
5954, permit fees for encroachment, excavation, and all other
public improvements will increase from $35.00 per permit to
$50.00 per permit. Attached for your reference are the current
fee schedule, and liability insurance requirements. The
transportation permit fee will remain unchanged, since it is
mandated by the state. Inspection charges, soil density fee,
surface replacement deposit fee, bonds, and liability insurance
requirements will also remain unchanged.
In fiscal year 1995 -96 the City issued 275 excavation permits
to utility companies, 136 off -site improvement permits, and 50
sewer lateral permits for a total of 461 permits at $35.00 per
permit for a total of $16,135.00. If the permit fee was
increased to $50.00 per permit, the total revenue will be
$23,050.00 which translates to an increase in revenue of $6,915
per year.
It is recommended that the City Council conduct the public
hearing and then adopt Resolution No. 5954 setting forth fees,
deposits, liability insurance and surety bonds relating to
street improvements, transportation, encroachment, and sewers
pursuant to Ordinance No. 2057 and repealing in their entirety
Resolution No.'s 5677 and 5852.

Summary
Each year, the City applies for and receives a block grant from the California Integrated Waste
Management Board for promoting used oil recycling and the proper disposal of used oil. The City
is reimbursed for expenditures made by the City for promoting the program. Staff recommends that
the City Council appropriate $17,334 from the Solid Waste Reserve Fund to the Solid Waste
Operating Budget for Used Oil Recycling.
Discussion,
For the past three years,the City has applied for and received grant funds for promoting the proper
disposal of used oil. This has involved providing free used oil collection containers to residents and
information brochures. The way the gra eiis set up, the City must first spend the money and then
request a reimbursement for the money spent.The California Integrated Waste Management Board
has granted the City its maximum possible grant of$17,334 which the City was automatically
eligible for upon submission of the application. Grant funds are determined by population.
Due to staffing and other changes, staff inadvertently did not incorporate this grant in the FY 1996-
1997 Solid Waste Operating Budget. Staff is requesting that existing reserve funds in the Solid
Waste fund be transferred into the FY 1996-1997 Solid Waste Operating Budget to cover the
projected expenditures for the grant.
This year staff intends to use all of the funds to purchase collection containers, conduct a citywide
mailing to promote the free containers and the program, and participate in the County's unified
message radio campaign to promote used oil recycling for which there will be a small cost.

meeting at the request of TCI Cablevision. In response to their review, various revisions
have been made to the ordinance to address their letter of October 23, 1996(attached).
Most of these involve clarifications that do not in any way detract from the purpose.of the
ordinance.
For example, the revised code sections still cover cable t.v. even though specific wording
referencing "cable television" has been eliminated from various sub-sections of the
ordinance. . See section 7300(a)-Defmitions.
TCI's concern regarding restoration of the right of way to "original condition" has also

INTRODUCTION
Cities are faced with increased requests for encroachment permits due to new technologies.
A significant concern for cities is to assure an adequate permit process to cover various types
of encroachments and related costs.
The proposed Ordinance and related fee resolution is a step in the direction of providing
adequate coverage for City streets. If legal developments authorize more comprehensive cost
coverage methods, the City can consider ordinance amendments. The Ordinance has been
reviewed with revisions provided by the Engineering Division of the Development.Services
Department.
SUMMARY OF ORDINANCE
The attached Ordinance is a comprehensive revision to the City's Municipal Code provisions
relating to encroachments on City property. The current Code contains-fairly broad
requirements for anyone wishing to perform any sort of encroachment on City right-of-ways.
The proposed Ordinance sets forth a very specific definition of what constitutes an
encroachment on public property and is designed to protect the City in the event someone
wishes to do any work on such property.
The Ordinance retains the current requirement for a permit for work on public property but
the application for a permit will elicit a considerable amount of information so as to assist
City staff in evaluating the applicant and the type of work to be done. The bonding
requirements are also more specific and are provided in order to ensure that the right-of-ways
are returned to their original condition.

FISCAL EFFECT
The Ordinance protects the City by making sure that the City is fully compensated for all
costs incurred due to work performed by persons other than the City itself To this end, a
companion resolution setting forth updated fees for encroachment work is presented to the
City Council.

encroachments.
On the whole, it is our opinion that this ordinance contains fair and reasonable provisions for
management of the public rights-of-way. We would, however, appreciate your consideration of the
following edits and comments (suggested deletions are shown in skikee€4,additions with double
underline,):
Section 7300 (c)(3): 'Erecting or maintaining any flag,banner, decoration, post,sign, pole, fence LA guard rail,wall, loading platform, mailbox,sable-television pedestal or.pull-box, or any other
structure on, over, under or within a right-of-way." Pedestals and pull-boxes are used not only by
the cable television industry, but by telecommunications companies and other utilities as well
Section 7300.3: The permit should be issued or denied within a reasonable time frame, such as J
30 days or less, so that construction and repair are not unnecessanly delayed.
Section 7300.4: If a permit is denied, the grounds for denial should be given to the applicantiin
writing so that any appropriate corrections or appeals can be made.

Section 7300.16:, "CATV PEDESTALS AND/OR PULL-BOXES--CAT Viers perrnitteeg shall
locate their pedestal and/or pull-boxes and other equipment within existing utility easements. If no
utility easements exist,then the CATV-provider permtee shalt negotiate with the property owner
of record, if on private property, or with the City, if in a public right-of-way,to establish one This
requirement should apply to all users of pedestals and pull-boxes, not just cable providers.
Section 7300.23(b): "Upon the refilling and temporary patching of an excavation in the manner /
and within the time specified in the permit,the surface torn up or damaged by such excavation
shall be replaced to the reasonable'satisfaction of the Development Services.Director or his/her
designee."
Section 7300.29 (c): '...The hearing shall be heard by the City Manager or his designee. At the �.
hearing,the appellant shall establish to the reasonable satisfaction of the City Manager or his
designee that he is entitled to the issuance of a permit pursuant to the provisions of this Chapter or

SUBJECT: Modification Application No. MC 96-050 and Architectural Design R view
No. ADR 96-022 for a new 3,586 square foot industrial building in the 1700
block of Goldring Road.
SUMMARY
This Modification Application was submitted by Mr. Graham Briggs, the project architect, for a
mew 3,586 square foot industrial building in the 11700 block of Goldring Road. The
Modification is necessary because the size of the subject property (12,840 sq. ft.) is less th the
15,000 square foot minimum required for development. In addition the City Counci will
consider the architectural design of the proposed building.
DISCUSSION
The subject property is 100 feet wide by 128.4 feet deep for a total lot area of 12,840 squar; feet.
Section 9266.2.3 of the Arcadia Municipal Code requires that lots in M-1 zones be a minim m of
15,000 square feet in area in order to be developed. However, if the subject property ca of be
enlarged due to surrounding developments, Section 9266.2.3 requires that only the City C i uncil
may approve a development. Section 9266.2.3 reads as follows:
9266.2.3 LOT AREA.
Every industrial site shall have a lot area of not less than fifteen thousand (15,000)
square feet except that the City Council may approve an industrial development of a
lot of less than fifteen thousand (15,000) square feet where a hardship by reason o
surrounding development, location or configuration is clearly demonstrated.
In this case, the subject property is surrounded by the following three industrial developme ts:
North: 11740 Clark St. - 9,700 sq. ft. bldg. occupied by an elec. parts mfr. (c. 1982)
East: 11746 Clark St. & 11765 Goldring Rd. - 23,700 sq. ft. multi-tenant bldg. (c. 1 76)
West: 11725 Goldring Rd. - 7,400 sq. ft. multi-tenant bldg. (c. 1983)
