MAINTENANCE SERVICES FOR JANITORIAL AND PORTER SERVICES IN
THE AMOUNT OF $345,060
On September 16, 1996, the City Clerk advertised for bids for Janitorial and Porter Services at
Various City Facilities. Janitorial services will provide evening cleaning services of all common
areas, restrooms and offices. Porter services include setting up for meetings, light cleaning, stocking
paper goods, sanitizing public restrooms daily and helping office staff with special requests for
services. The contract will only provide porter services at City Hall, Community Center and the
Library. As advertised, sealed bids were opened on October 21, 1996. Three (3) bids were received
with D.H. Maintenance Services submitting the lowest bid for a three (3) year contract in the
amounts of $114,540, $114,540 and $115,980 for each year of the contract. Staff recommends that
the City Council award a three -year contract for this project to D.H. Maintenance Services.
The 1996/97 operating budget and proposed operating budget for 1997/98 provide for janitorial
services at City Hall, Community Center, Library, Fire Department Dispatch Center and the
Maintenance Services Center. This contract will provide evening janitorial service and porter service
five (5) days a week for the City Hall and Council Chamber facilities. Service for the City Library
will consist of night janitorial service six (6) days a week and a one -half ( %z) day porter five (5) days
per week. The Service Center includes one -half (' /z) day janitorial service five (5) days per week
with no porter service. The Community Center will consist of night janitorial services three (3) days
a week and porter service five (5) days a week.
All janitorial work will be performed after normal business hours. Night cleaning crews are
responsible for cleaning all common areas and offices. Each facility will be thoroughly cleaned
before the next business day. Included in the contract are carpets, windows and floors, which are
scheduled for special cleaning once every three months. Day porter responsibilities at City Hall
include setting up for meetings, light cleaning, stocking paper goods, sanitizing public restrooms
twice daily and assisting office staff with special requests for services.

opened and read publicly on October 21, 1996 with the following results.

Staff has reviewed the bid documents for content and D.H. Maintenance Services is currently

the terms and conditions of the new agreement.

Funds for janitorial and porter services are appropriated in the 1996/97 Operating Budget and are
recommended in the 1997/98 Operating Budget.
It is recommended that the City Council:
1. Award a three (3) year contract in the amount of $114,540, $114,540 and $115,980 for each

at Various City Facilities.
3. Waive any informalities in the bid or bidding process.

NOTICE INVITING BIDS
SEALED PROPOSALS will be received in the office of the City Clerk,
City Hall, City of Arcadia, California, up to 11:00 o'clock a.m. on
October 21, 1996 at which time they will be publicly opened and
read for the following project:
JANITORIAL AND PORTER SERVICES AT VARIOUS CITY FACILITIES
The work consists of furnishing all labor, materials and equipment
required for Janitorial and Porter services at various City
facilities as indicated by the specifications attached hereto.
Bids shall be submitted on forms furnished by the City. Each bid
must be accompanied by cashier's check payable to or bidder's bond
on the City's bond form in favor of the City of Arcadia by a surety
company authorized to do business in the State of California, and
subject to approval of the City Attorney, in an amount equal to at
least ten percent (10 %) of the amount of the bid, such guarantee to
be forfeited should the bidder to whom the contract is awarded fail
to timely execute the contract and deliver the necessary bonds and
insurance certificates as specified in the contract documents.
All bids are to be compared on the basis of the Maintenance
Services Director's estimate of the quantities of work to be done.
No contract will be awarded other then to a contractor licensed in
accordance with the provisions of Chapter 9, Division 3, of the
Business and Professions Code.
All bids shall be based on the content of the contract documents,
which consist of the Notice Inviting Bids, Information Required of
Bidder, Contract, Special Provisions, Construction Plans, Drawings
and Details, the Bid, Technical Specifications, Faithful
Performance and Labor and materials Bonds, which are by this
reference incorporated herein and may be obtained at the office of
the Maintenance Services Director, City of Arcadia Service Center,
11800 Goldring Road, Arcadia, California.
Special attention of prospective bidders is called to the bid
requirements and "Special Provisions" which contain the
instructions to bidders. Said "Special Provisions" authorize the
contractor to substitute securities in lieu of the 10% retention in
accordance with and pursuant to Government Code Section 4590.

Copies of the bid forms and specification documents may be obtained
at the City of Arcadia Service Center, located at 11800 Goldring
Road, Arcadia, California for a non - refundable fee of $20.00 or
$25.00 if mailed. Said specifications, bid forms and contract
documents are hereby referred to and incorporated herein and made
a part by reference and all quotations must strictly comply
therewith.
The Contractor shall take out and maintain, during the life of the
Contract, broad form comprehensive general public liability and
property damage insurance with the carrier authorized by the
Insurance Commission to transact business of insurance in the State
of California in which the City of Arcadia, its officers and
employees, shall be named as an additional insured, and shall
protect the Contractor or any subcontractors performing work
covered by the Contract, and also the City of Arcadia, from claims
of personal injury, including accidental death, as well as from
claims for property damages which may arise from the operations
under the Contract, whether such operations shall be performed by
the contractor or any subcontractors, or by anyone directly or
indirectly employed by any of them, and the limit of liability for
such insurance shall be as follows:

Each Occurrence or Accident $2,000,000
2. Limit of Liability for Property Damage:
Each Occurrence or Accident $ 500,000
The City of Arcadia reserves the right to accept or reject bids, to
waive any irregularity and informality in the bids and bid process,
and to retain all bids and guarantees for a period of sixty (60)
days for examination and comparison, all as specified in the
contract documents.

INSTRUCTIONS TO BIDDERS Vol
Mandatory pre bid job walk of each facility will be held on October
14, 1996 at 11:00 a.m. Bidders not attending the pre -bid job walk
shall be disaualified.
Bidders shall complete the bid documents in accordance with the
provisions of Section 2 -1 of the General Provisions. SHOULD IT BE
NECESSARY TO DISASSEMBLE THE DOCUMENTS FOR THE PURPOSE OF BID
PREPARATION, THE DOCUMENTS SHALL BE REASSEMBLED IN THE ORIGINAL
FORM PRIOR TO SUBMISSION TO THE CITY. ALL DOCUMENTS ON PINK PAPER
SHALL BE RETURNED AS PART OF THIS BID PACKAGE. BID PACKAGES
SUBMITTED WITHOUT ALL OF THE PINK PAGES ARE SUBJECT TO
DISQUALIFICATION. In addition, bidders shall provide the bid
prices on the bidding schedule both in words and figures. In the
event of a difference between a price quoted in words and a price
quoted in figures for the same quotation, the words shall be the
amount bid. In the event that the product of a unit price and an
estimated quantity does not equal the extended amount quoted, the
unit price shall govern, and the correct product of the unit price
and the estimated quantity shall be deemed to be the amount bid.
If the sum of two or more items in a bidding schedule does not
equal the total amount quoted, the individual item amounts shall
govern and the correct total shall be deemed to be the amount bid.
The contract will be awarded to the lowest, responsive and
responsible bidder in accordance with Section 2 of the General
Provisions. The lowest bid will be determined on the basis of the
total bid price, calculated from the summation of all individual
bid item prices.
The City reserves the right to postpone the date and time for
receiving and /or opening of bids at any time prior to the date and
time established in the Notice Inviting Bids. Postponement notices
shall be mailed to bidders in the form of addenda.

SUBJECT: Report and recommendation to adopt Resolution 5953, setting forth Planning

The City Council at its October 1 meeting continued its consideration of revising Planning
service fees until tonight's meeting to allow staff time to review certain fees and provide
recommended alternatives.
The Development Services Department is recommending that the Conditional Use
Permit/Variance fees and General Plan, Zone Change and Text Amendment fees be
changed from deposits with maximum charges, to flat fees. In addition, per the City
Council's discussion, staff is also recommending that the Homeowner Association Appeal
fees remain the same as the current fee.
Attached for the City Council's review is a Planning Fee Schedule showing existing fees,
the October 1 recommendation and the Revised Recommendation. The Development
Services Department is requesting that the City Council adopt attached resolution 5953
adding, changing and amending certain planning fees which includes the "Alternative
Recommendations" as suggested by staff.
As noted in the October 1 report, the fee study prepared by the Administrative Services
Department identifies the true cost of providing services including both direct and indirect
costs. As an example, Conditional Use Permit fees are currently on a sliding scale based
on the size of the project. The average cost to an applicant is $706.00; the fee analysis
illustrated that the cost to process a typical application is $1,540.07. Staffs oriainal
recommendation was to charge the customer on a time and material basis with a minimum
deposit of $500.00 and a maximum fee of $2,000 to $5,000 based on the size of the
project. A summary of the Fee Study (Exhibit A) is attached for your information.

In response to the City Council's request at it's October 1 meeting, the Development
Services Department staff has reviewed all the fees which were based on a time and
material basis (conditional use permits, general plan changes, zone changes and text
amendments) and is recommending the following:
• For a conditional use permit/variance continue to charge fees based on the project size
(sliding scale) with an approximate 15% increase in the fees which was suggested by
the City Council at its last meeting. These fees would range from $700 to $1,825.
• General plan changes, text amendments and zone changes have been revised to flat
fees which correspond to the cost to process typical applications.
Staff is further recommending that in regards to the above types of applications, that if it is
determined by the Development Services Director that a project is so complex that the
S' above fees will not cover the cost to process an application, the Director may require that
the applicant enter into an agreement with the City to reimburse the City for 100% of actual
and reasonable costs. It is not anticipated that this will happen very often, however, it does
insure that the city will recover the costs for processing very complex projects.
In addition to the above changes, staff is recommending that the fees for Homeowner
Association Appeals remain the same as is currently being charged.
The Development Services Department is recommending that the City Council adopt
Resolution 5953 as follows:

SUBJECT: DISCUSSION REGARDING THE CITY'S POSITION ON THE
POTENTIAL CLOSURE OF SANTA ANITA PARK
SUMMARY
For the past several weeks, numerous articles have been published relative to the issue
of new ownership and the potential closure of Santa Anita Park. This report is
presented to the City Council so that you can formally consider whether or not to take
an official position on the matter.
DISCUSSION '
The issue of the possible closure of Santa Anita Park surfaced several years ago when
the Los Angeles Times began to publish articles about the problems the horse racing
industry was having. At that time, there was some "talk" about either Santa Anita or
Hollywood Park closing which would mean that one of them would become the premier
race track for the Southern California region.
For the last several weeks, the Los Angeles Business Journal has been publishing
articles concerning possible new ownership of the. Santa Anita Companies and the
potential closure and/or sale of Santa Anita Park that could result from such a change.
As of last week, there were several 'suggestions that one or more of the investment
groups bidding for control of the company may decide to close the facility and move.all
of Los Angeles area thoroughbred racing to Hollywood Park.
It is common knowledge that Santa Anita Park represents a significant part of Arcadia's
history. Lucky Baldwin, the founder of the City, was known for horse racing. In fact,
an actual track was constructed many years ago in the same general vicinity Santa
Anita is now. This facility and use represents our history and heritage; it is part of
Arcadia's culture. People across the United States may not know where Arcadia is, but
they immediately recognize Santa Anita Race Track. The loss of horse racing and the
facility at which it takes place wo ■ e a negative impact on our image.

We have received several requests from newspapers, citizens and business people
asking if the City has an opinion on the potential sale and/or closure of the race track.
Concerning the sale, obviously the City has no interest in the ownership as this is a
private business activity. However, with regard to the closure, this does have an impact
upon the City, financially and culturally.
In the event the City Council desires to formally state a position on this issue, staff has
prepared the attached Resolution for consideration. The Resolution espouses some
important, points about why Santa Anita Park is of significant value to the City and is
offered at this time only for consideration as you decide whether or not to take an
official position on the possible closure of Santa Anita Park.
RECOMMENDATION
•
It is recommended that the City Council either adopt Resolution No. 5961 or receive
and file this report. .

SEISMIC SAFETY RETROFIT
Summary
The County is requesting temporary jurisdiction over portions of Baldwin Avenue and Michillinda
Avenue under the Atchison, Topeka and Santa Fe Railroads for the purposes of performing a
seismic safety retrofit to the railroad bridges. Jurisdiction will revert back to the City onde the
project is completed. Adoption of the attached Resolution will grant the transfer of jurisdiction to
Los Angeles County.
Discussion
Following the Loma Prieta earthquake of October 1989, emergency State legislation was enacted
requiring that all publicly-owned bridges be inspected. Those bridges found to be strucrally
deficient were to be upgraded and retrofitted to conform to specific seismic standards.
Furthermore, Los Angeles County was designated as the lead agency within the County for all
non-State highway seismically deficient bridge retrofit projects.
The County, therefore is requesting jurisdiction in order that it may administer a seismic retrofit
project within the City. The attached Resolution No. 5960 declares the portion of Baldwin
Avenue and Michillinda Avenue under the railroad bridges and within the jurisdiction of the City
of Arcadia to be a County highway for the purposes of repair and seismic retrofitting. Baldwin
Avenue is entirely within the City but the jurisdiction of Michillinda Avenue is shared between the
County and the City. The project is tentatively scheduled to be advertised for bid in November
1996. Jurisdiction would revert to the City after the completion of the project.

Environmental Analysis
Pursuant to Section 15301, Class 1 (d) of the California Environmental Quality Act (CEQA)
Guidelines, this project is categorically exempt from the provisions of said Act.
Fiscal Impact
•
Improvements to the railroad bridges on Michillinda Avenue and on Baldwin Avenue will be
constructed at no cost to the City.
Recommendation
It is recommended that the City Council adopt Resolution No. 5960 establishing a portion of
Baldwin Avenue and Michillinda Avenue as a County highway for the purposes of administering a
project to repair and seismically retrofit the railroad bridges.
