BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY
Resolution number 5956 has been prepared to reflect the direction given by the City
Council on October 1, 1996 to place Mayor Pro Tem Robert Harbicht's name into
nomination to represent cities with water pumping rights on the San Gabriel Basin
Water Quality Authority Board of Directors.
Upon adoption, staff will forward said resolution to the San Gabriel Basin Water Quality
Authority prior to October 18, 1996.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 5956 nominating Arcadia
Mayor Pro Tern Robert Harbicht to represent cities with water pumping rights on the
Board of the San Gabriel Basin Water Quality Authority.

Subject: Report and recommendation for the purchase of one (1) 1997 3/4 ton
Pickup Truck with Utility Body for Maintenance Services Department -
Water Division.
It is recommended that the City Council award a contract for one (1) 1997 3/4 ton pickup
truck with utility body to Gunderson Chevrolet in the amount of $22,701.09. Funds, in
the amount of $27,900.00, have been budgeted in the Water Fund in Fiscal Year 1996 -97
for this acquisition.
DISCUSSION:
The 3/4 ton pickup truck with utility body will be used to replace a 1987 pickup truck
with approximately 96,553 miles and has serious problems due to a major collision.
The older model truck is being used as a trade -in.
Bid 9697 -18 was mailed to twenty (20) truck dealerships. The Notice of Bid was
published in the Arcadia Tribune on September 5, 1996. There were nine (9) responses
which were publicly opened.

The first apparent low bidder, Miramar, San Diego, neglected to include air conditioning
in his bid price. An additional $805.00 would need to be added, which would not make
him the actual lowest responsible bidder. Thus, the award to Gunderson Chevrolet.
FUNDING
Funds, in the amount of $27,900.00, have been budgeted in the Water Fund in Fiscal Year
1996 -97 for this acquisition. This purchase was made at a savings of $5,198.91.
RECOMMENDATION
It is recommended by staff that the City Council award a contract for the purchase of the
3/4 ton pickup truck with service body to Gunderson Chevrolet, Inc. in the amount of
$22,701.09, and authorize the City Manager to execute said contract in a form approved
by the City Attorney.

CONTRACT

THIS CONTRACT, made and executed this eighteenth day of October
1996, by and between the City of Arcadia, California, hereinafter referred to a
"City ", and Gunderson Chevrolet, hereinafter referred to a "Contractor" and
"Bidder ":
WITNESSETH: City and Contractor do mutually agree as follows:
1. The Notice Inviting Bids, Bid, Specifications and all amendments
thereof, when approved by the parties hereto, copies of which are attached
hereto, are hereby incorporated in and made a part of this Contract by
reference, as though fully set forth herein, and all of the foregoing shall
constitute the Contract documents.
2. Contractor agrees to sell and deliver to City one 3/4 ton pickup truck
with utility body within the time specified in its bid in strict conformance with the
contract documents.
3. City agrees to pay contractor the amount specified in the Contract
documents and in the manner specified therein.
4. Time is of the essence of this Contract. If Contractor should fail to
make delivery as specified in paragraph 2 above, City may give 30 days' written
notice to Contractor to make said delivery, and if Contractor fails to do so,
Contractor shall be liable to City for damages incurred by such failure, including,
but not limited, to, the price differential in purchasing and securing delivery of
the 3/4 ton pickup truck with utility body in conformance with the Contract
documents on the open market from another vendor, with or without advertised
competitive bidding.
5. Contractor agrees that City is not obligated to make payment until
documents of title, with necessary endorsements in full compliance with the
Vehicle Code are delivered to City, which delivery date shall be the same as that
set forth in paragraph 2 of this Contract.
6. In addition to other warranties and guarantees, Contractor warrants
that the 3/4 ton pickup truck with utility body as described in the Specifications,
will be of merchantable quality and will be fit for the purposes set forth in the
Specifications and other ordinary purposes for which it is used.
7. The risk of loss is on and title shall remain in the Contractor until
written acceptance of the 3/4 ton pickup truck with utility body by the Water

Manager. Contractor shall obtain adequate liability, collision and property
damage insurance to cover the 3/4 ton pickup truck with utility body and all
operators thereof at no cost to the City. Such insurance shall remain in effect
until written acceptance of the 3/4 ton pickup truck with utility body by the Water
Manager.
8. Contractor agrees that in the performance of this Contract, Contractor
is an independent Contractor, not an employee, agent or officer of the City.
9. This Contract shall be interpreted, construed and given effect in all
respects according to the laws of the State of California.
10. Contractor shall not assign this Contract, or any part thereof, or any
monies due or to become due thereunder without prior written consent of City.
11. Contractor shall indemnify and hold harmless the City, and its officers
and employees, from and against any and all claims, demands, suits, loss,
damage, injury and liability, including costs and expenses incurred in connection
therewith, however caused, resulting from, arising out of, or in any way
connected with the performance of the contract, including delivery and unloading
of the supplies and equipment.
12. Contractor shall hold the City, its officer, agents, and employees,
harmless from liability of any nature or kind, including costs and expenses, for
infringement or use of any copyrighted or uncopyrighted composition, secret
process, patented or unpatented invention, article or appliance furnished or used
in connection with the Contract.
13. Contractor warrants that no gratuities (in the form of entertainment,
gifts, or otherwise) were offered or given by the Contractor, or any agent or
representative of the Contractor, to any officer or employee of the City with a
view toward securing the Contract or securing favorable treatment with respect
to any determinations concerning the performance of the Contract. For breach
or violation of this warranty, the City shall have the right to terminate the
contract, either in whole or in part, and any loss or damage sustained by the City
in procuring on the open market any items which the vendor agreed to supply
shall be borne and paid for by the Contractor. The rights and remedies of the
City provided in this clause shall not be exclusive and are in addition to any
other rights and remedies provided by law or under the Contract.
14. Rights and remedies of City for default:
(a) In the event any item furnished by the Contractor in the
performance of the Contract should fail to conform to the specifications therefor,

the City may reject the same and it shall thereupon become the duty of the
Contractor to reclaim and remove the same forthwith, without expense to the City
and immediately to replace all such rejected items with others confirming to such
specifications; provided that should the Contractor fail, neglect or refuse so to
do, the City shall thereupon have the right to purchase in the open market, in
lieu thereof, a corresponding item and to deduct from any monies due or that
may thereafter become due to the Contractor and difference between the price
named in the Contract documents and the actual cost thereof to the City.
(b) In the event of the cancellation of the Contract, either in whole or
in part, by reason of the default or breach thereof by the Contractor, any loss or
damage sustained by the City in procuring any items which the Contractor
therein agreed to supply shall be borne and paid for by the Contractor.
(c) The rights and remedies of the City provided above shall not be
exclusive and are in addition to any other rights and remedies provided by law or
under the contract.
15. Subject to the provisions of this Contract, all terms, covenants,
conditions and provisions hereof shall inure and to and shall bind each of the
parties hereto and each of their respective heirs, executors, administrators,
successors and assigns.
16. EQUAL OPPORTUNITY: During the performance of this Contract the
Contractor /vendor will not discriminate against any employee or applicant for
employment because of race, color, religion, sex or national origin.
CIVIL RIGHTS ACT OF 1964: Under Title VI of the Civil Rights Act of 1964, no
person shall on the grounds of race, color or national origin, be executed from
participation in, be denied the benefits of, or be subjected to discrimination
under any program or activity receiving federal financial assistance.

SUBJECT: CONSIDERATION OF REQUEST TO PLACE A 'RUSSELL SIMON"
MEMORIAL PLAQUE ON CITY PROPERTY AT THE CORNER OF
HUNTINGTON DRIVE AND SANTA CLARA STREET
BACKGROUND
The City Council has been asked for permission to place a memorial plaque on the
sidewalk at the corner of Huntington Drive and Santa Clara Street. Since this is a
special request and there is no recent history of allowing such an activity, we are
asking the City Council to approve the installation of the plaque and determine whether
or not to authorize the use of City forces to complete the work.
DISCUSSION
On August 26, 1996, a tragic accident occurred in the City of Arcadia which resulted
in the death of Russell Simon. The entire community was saddened by what happened
to this young man and a group of neighbors have joined together in an effort to seek
the placement of a memorial plaque on the sidewalk at the intersection of Huntington
Drive and Santa Clara Street, close to where the accident took place. On behalf of a
neighborhood group, Paula Klein and Paul Barnes have asked for permission to place
a permanent 10" x 14" cast bronze plaque at the location noted on the attached map.
Letters to this effect are attached to this report, as is a copy of the proposed design.
The neighbors have agreed to pay for the cost of fabricating the memorial. They are
asking the City Council to permit the installation of the plaque at the referenced location
and approve and pay for City forces to handle the installation. If it is not feasible for
City employees to perform this work, the group has offered to seek a licensed
contractor for the job at their expense.

FISCAL IMPACT
If the City Council directs staff to install the plaque, the cost to the City will be in the
form of staff time and materials. A rough estimate is that it will take one -half to one day
of work by two Maintenance Services Department employees to remove the existing
concrete, install the plaque and replace the concrete, although this estimate is
dependent upon the specific requirements of the job.
RECOMMENDATION
It is recommended that the City Council consider this request and direct staff as
appropriate.

Last week you received a letter from Mr. Paul Barnes seeking permission for the Arcadia Gardens
Neighborhood Group to place a memorial plaque on the corner where a tragic accident took the life
of Russell Simon. We are aware that the members of the City council had some concerns regarding
that proposal and, in Mr. Barnes' absence, I would like to address them at this time. -
The Simon family is now fully aware of our proposal. They are very touched by the idea and by the
heartfelt sentiment that comes along with it. The Simons drive by that comer on a daily basis, as do
all of us in the neighborhood. The fact is, that it is almost impossible to avoid. It is our hope that in
time, the memorial plaque will help to erase the tragic memories that the corner evokes and slowly
replace them with some feelings of comfort knowing that Russell will never be forgotten. Our
neighborhood has held a family picnic in early September since 1982. This year that gathering
was replaced by a funeral. If our proposal is approved, we would have our gathering at that spot
when the work is completed, and hopefully, this tribute would create a new memory for the family.
We feel it is important for the memorial to be placed at this location the reasons stated above,
and for another important reason, also. In addition to a lasting remembrance of Russell, it will
serve as safety reminder for many, many others. My own children, and several others in our
neighborhood, used that same crosswalk to cross the street on their way to school or to go to the
park. While our kids will never forget what happened to Russell, we are all aware that the passage
of time has a way relaxing ones' safety precautions. We want to do all we can to prevent another
tragedy.
We realize that by approving this proposal, the City Council may be setting a precedent for future
requests of the same nature. My neighbors join me in thinking that it would be unlikely that this
practice would offend any of our citizens. In today's world we see and hear so much that makes a
negative statement (such as litter, graffiti, and disrespect), that to come upon a message of remem-
brance that was placed by caring friends should warm the heart of anyone seeing it. When my family
visits Sierra Madre, my children are still attracted to the portions of sidewalk where others have left
their handprints or messages in the concrete - it creates such a hometown feeling. Despite growth
and change, Arcadia is still more of a "town" than a "city." We know and care for each other, and a
visual example of that could only strengthen those feelings.

The entire community of Arcadia was saddened by the tragic accident that took the young life
of Russell Simon last month. There are, however, many families in the Arcadia Gardens
neighborhood who have been touched more deeply than others might imagine. These are the
families that have been extremely close to the Simons for over ten years, who have reared their
children along side one another, and who realize that it could have been any one of our children
crossing the street that fateful day.
These are the same families who are now seeking permission and approval from the City Council
to place a memorial plaque on the corner where the accident occurred in remembrance of Russell.
As a former resident of what is affectionately called "the neighborhood ", and an engineer by
profession, I took dimensions and measurements of the area and have attached a rendering that
indicates possible placement of the plaque. The suggested location avoids any existing graded
or marked concrete, the signal control box, signal cover and the traffic signal itself.
I have spoken with monument and plaque companies who have suggested a cast bronze plaque
measuring 10" x 14 ". The wording on the plaque is indicated on a separate page, and meets with
the approval of the neighborhood families. We hope that it also meets with the Council's approval.
The neighborhood group will cover the costs of the plaque and any necessary materials. We
would appreciate the City helping out with the labor for the job if such a crew exists. If this is
not possible, we will seek a licensed contractor that would meet with the City's approval.
We hope this request can be considered as soon as possible, as the plaque takes eight weeks to be
made, and we had hoped to havethe work completed by the Thanksgiving holiday. At this point,
theSimon family is not aware of our plans, however, when approval is granted we will make sure
this is in keeping with their wishes.

As stated in the letter last week, if it makes the road to approval easier, we will seek a licensed
contractor to perform the labor involved. While any help from the City would be appreciated,
we have a deep desire to do this for the Simon family, and are willing to do anything toward
that end.

SUBJECT: ACCEPTANCE OF A MONETARY GIFT FROM THE ARCADIA
PUBLIC LIBRARY FOUNDATION AND AUTHORIZATION TO
PURCHASE A SELF CHECK -OUT MACHINE
Summary:
The Arcadia Public Library Foundation is offering the Arcadia Public Library a donation
of $23,988.96 for the purchase of a 3M Self Check -out machine (3M being the sole
source of this equipment).
Discussion:
This money was donated to the Library Foundation by the H.N. and Frances C. Berger
Foundation for the expressed purpose of acquiring this equipment. A Self Check -out
machine will allow library patrons to check out books themselves thereby avoiding the
wait at the Circulation desk during busy periods. This should help shorten the lines
making it possible for the staff to maintain the current level of service.
I have not been able to find any source, other than 3M, for this equipment. The
specifications not only require a machine which will allow library patrons to check out
their own books but will also be compatible with our computer catalog and book security
system.
Fiscal Impact:
The Library currently has $25,000 for a self check -out machine budgeted in the 1997/98
Capital Improvements Program. With this donation these funds will no longer be needed
and will revert to the Equipment Fund.

Recommendation:
It is recommended that the City Council approve the receipt of the $23,988.96 donation
to the Arcadia Public Library from the Arcadia Public Library Foundation and authorize
the purchase of a 3M Self Check -out machine with said funds.

RE: Report and recommendation to approve design review for a certain
property at 29 E. Huntington Drive (formerly Steerburger Restaurant)
BACKGROUND INFORMATION:
Work •
Proposed: .Interior and exterior remodel of 29 E. Huntington Drive (Att. No.1).
Applicant has proposed to make substantial modifications to the existing
structure. The building will be divided into 900 square feet of. retail .
space on Huntington Drive and 3,792 square feet of medical office
space. The project includes a total of 1,632 square feet of new square
footage. Most of the new construction will be located in a second floor
addition located at the north end or rear of the building.
Additionally, all of the building facades (north, south and east) will be
rehabilitated with substantial improvements. The Lees have applied for
assistance.through:the Agency's Commercial Facade Rehabilitation
Program (CFRP). These exterior improvements are the..focus of this
design review and will be discussed in detail below. .. "

The Applicant has applied for a parking modification of 7 spaces. This Modification
will be processed through the Modification Committee.
PURPOSE OF DESIGN REVIEW:
The Agency's actions do not supersede Building or Zoning Regulations. Such
regulations must be complied with unless modified in accordance with the procedures
set forth in the Arcadia Municipal Code and need not be considered by the Agency in
this review.

The purpose of the Agency's review is as follows:
1 . To give the Agency the opportunity to determine if new private projects are in
conflict with any Agency projects which are being considered or developed in
the-sam&•area.
2. To provide the opportunity to incorporate the private prpject with the Agency
project and/or to eliminate or to mitigate any conflicts at the earliest stage of
the design process.
3. To afford the Agency an opportunity to review the preliminary architectural
plans of private projects to insure that these projects are not so out of
character with the area as to be a hindrance to future development.
ANALYSIS:
A. Design Features:
A Color and Materials Board as well as colored building elevations have been
provided by the Applicant. They are available for review in the Economic
Development Offices and will be on display at the Agency meeting of October
15.
The Applicant proposes to make substantial changes to the appearance of the
structure.. The current structure features flat surfaces on all sides (brick-veneer
and stucco) and an uninteresting flat roofline. The new design provides major
building articulation through use of a variety of materials (landscaping planters,
shake roof tiles, awnings, facia board, corbels, stucco plant-ons, exterior
fixtures and new window openings).
The Huntington Drive elevation represents a major improvement over the
current architectural theme. The current storefront is a typical downtown "bar"
facade with a flat, brick veneered surface and no window openings. The
Applicant proposes to rehab this elevation with more inviting and traditional
retail design elements. The new facade will feature two entrances (one for the
retail sales area on the west and another for the dental offices on the east),
new window openings (trimmed in white) adjacent to the retail entrance, knee _
high landscaping planters and a full sloped dark gray cedar shake roof. Wall
surfaces will be blue-gray stucco with white trim accents.
The proposed changes to the rear of the building are similar to the front
(window openings, dark gray shingle roof, blue-gray stucco walls with white "
window trim and facia boards, and landscaping planters). Additionally teal
awnings and white corbels are proposed. Plans show landscaping growing up
onto a corbel arbor.:-
The eastern elevation is immediately adjacent to a newly obtained storm drain
and pedestrian access easement connecting Parking District No. 2 and
Huntington Drive. This easement was granted during the Downtown 2000
Streetscape Project by the former owner in exchange for the Agency installing
a storm drain to relieve localized seasonal flooding in the area. Because of the
easement (and the prospect of future foot traffic) care has been taken to
include architectural detail on the eastern facade. Window openings and light
fixtures (for public safety) have been provided along the narrowest portion
(southern half) of the pedestrian walkway while an awning (teal) covered rear
entry to the dental office has been included on the north end near the parking
district. Landscaping has been included in planters near the rear entry.
B. Departmental Comments:
Planning -
Currently, the only condition of approval is the above noted parking
modification. Depending on the ultimate retail user, a conditional use permit
may be necessary.
Engineering -
None of the proposed improvements appear to encroach into the public right-of-
way. Engineering has no requirements upon the Applicant.
Fire Department -
Based upon the plans submitted (4,692 Sq. Ft.), the project does not appear to
trigger the 5,000 square foot threshold beyond which fully automatic fire
sprinkling becomes a requirement.
Police Department -
The lights in the pedestrian walkway should be left on during all hours of
darkness. .
Economic Development Department -
Any Design Review approved by the Agency is valid for a period of one year
from Agency approval consistent with the provisions of Resolution No. ARA-
126.
As noted above, this project may be eligible for certain Agency reimbursements
through the CFRP. On September 26, the Applicant submitted for these funds.
Agency staff has informed the Applicant that rehab projects are eligible for
reimbursement only for work done on existing facades and wall faces, awnings,
signs and specified on-site work. Funds are not eligible for new facades
created by the addition of new square footage or for interior work such as
walls,, fixtures, or tenant improvements.

THE ACQUISITION OF PROPERTY LOCATED AT 119-121 EAST
ALTA STREET (HOME SAVINGS AND LOAN PARKING LOT)
DESCRIPTION
Home Savings and Loan has offered for sale to the Redevelopment Agency the 16,000 sq. ft.
parking lot at 119-122 E. Alta Street (see site map, Attachment A) for$200,000 ($12.50/sq. ft.)
The lot is not required to meet any City parking requirements, but is surplus to the Bank's
needs.
Staff has had the lot appraised by an independent appraiser and the price is below the
appraised value.
The Agency's environmental attorney is reviewing the Phase 1 Environmental Site Assessment
provided by Home Savings and Loan.
The lot can be used in the short term for downtown parking, and in the long term for possible
development by the Redevelopment Agency for affordable low and moderate income housing.
FISCAL IMPACT
$205,000..in Agency funds ($200,000 - purchase price, $5,000- administrative costs, eg.,
appraisal;`escrow, title, legal, misc.).
The Agency,received $386,000 in its August, 1996 to: increment payment. Therefore, funds
are available.
If this property is used for low and moderate income housing, funds will be taken from the
Agency's low and moderate income housing set aside.fund.•
RECOMMENDATION . . - . .
That the Agency appropriate $205,000-fo le purcha a of 119-121 East Alta Street from
Home Savings and Loan and authorize the Executive Director to execute all documents
relative to the acquisition thereof, subject to approval of the Agency Attorney as to form.
