Attached for the City Council's consideration is Resolution 5976 ordering the reorganization of
territory identified as `Monrovia Reorganization No. 1-96 Parcels 1 and 2" to the City of Arcadia
and detachment from the City of Monrovia.

In October, 1995, the City Council held a public hearing to consider a request filed by Bluth
Development for a City Boundary Reorganiz-tion between the City of Monrovia and the City of
Arcadia. The boundary reorganization consists of approximately 2.56 acres of undeveloped
property located east and south of Tract 42936 (Whispering Pines Phase II in the City of Arcl dia).
The reorganization is comprised of three distinct areas:
Area 1 are "sliver" lots which were daylighted (graded) by Mr. Bluth, with approval from th City
of Monrovia, as part of Tract 42936. There are three distinct graded areas which are part of the
vacant adjacent lots 15, 16 and 17 of Tract 42936. These are not buildable areas.
Area 2 is a point lot which was graded after the Monrovia Planning Commission granted approval
in 1989. It is currently vacant and access to the Lot is through Lot 20 of Tract 42936 in . Acadia.
There is no available access in Monrovia.
Area 3 is a new lot which was graded as part of the Whispering Pines Phase II subdivision in
Arcadia. This parcel is located in Monrovia and is part of an existing lot which has two distinct
pads at different elevations. The lower building pad will remain in Monrovia and the upper pad
which contains approximately 0.92 acres is proposed to be annexed with access in Arcadia
through an easement on Lot 22 of Tract 36895 (Whispering Pines Phase I development in
Arcadia).

As noted, all properties to be annexed are vacant, however, the boundary reorganisation will
eventually result in the construction of two new dwellings in Areas 2 and 3.
In November, 1995, the City Council adopted Resolution 5883 recommending approval of a
boundary reorganization and in December, 1995 adopted Ordinance 2041 zoning the subject
property to R-M(Residential Mountainous),consistent with the adjoining property.
On September 3, 1996, the City Council adopted Resolution 5943 a joint resolution of the City
Council of the Cities of Monrovia and Arcadia, approving and accepting the negotiated exchange
of property tax revenue resulting from the reorganization.
On December 11, 1996, the Local Agency Formation Commission (LAFCO) adopted Resolution
1996-67 (attached) making determinations and approving "Monrovia Reorganization No. 1-96
Parcels 1 and 2"(Annexation to the City of Arcadia and Detachment from the City of Monrovia).
LAFCO further authorized the City of Arcadia to proceed without notice,hearing or an election to
adopt a final resolution ordering annexation of approximately 2.56 acres of undeveloped property
located east and south of the Bluth Tract 42936.
Adoption of Resolution 5976 is the final step in the annexation process which was initiated by
Charles Bluth in 1995.
ACTION
The City Council should adopt Resolution 5976 as follows:

adopted the enclosed resolution approving the boundary adjustment between the cities of Ar adia
&Monrovia. Pursuant to government code 56837 (100 percent landowner consent) the
Commission authorizes the City of Arcadia to proceed without notice, hearing, or an election.
Upon your city council's adoption of the final resolution ordering annexation, please forward one ,
original and seven certified copies of the resolution, with a check for,$250.00 made payabl= to
the State Board of Equilization.
In all further proceedings, please use the attached legal description approved by the
Commission.

COMMISSION OF LOS ANGELES COUNTY
MAKING DETERMINATIONS AND APPROVING
"MONROVIA REORGANIZATION,NO. 1-96 PARCELS 1 AND 2"
(Annexation to the City of Arcadia and Detachment from the City of Monrovia)
WHEREAS, an application for the proposed reorganization of certain territory to the City
of Arcadia was filed with the Executive Officer of this Local Agency Formation Commission, and
said Executive Officer has examined the application and executed a certificate determining d
certifying that the application is sufficient; and
WHEREAS, at the time and in the form and manner provided by law, said Executive
Officer set this matter for public hearing and gave notice thereof and
WHEREAS, the public hearing by this Commission was held upon the date and at th, time
and place specified in the notice of public hearing, and all persons present were given an
opportunity to hear and be heard with respect to any matter relating to the proposal and the
Executive Officer's report and recommendation thereon.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. Subject to the terms and conditions hereinafter specified, said proposal is
approved.
2. A description of the boundaries of the proposal, as approved by the Commis ion,
is set forth in Exhibit "A," attached hereto and made a part thereof. Said territory is found • be
uninhabited and said territory is assigned the following distinctive short form designation:

3. , The Commission amends the sphere of influence of the City of Arcadia to include

specified development restrictions.
5. The Board of Directors of the City of Arcadia is hereby authorized to proceed with
said reorganization, in compliance with this resolution, pursuant to the Cortese\Knox Local
Government Reorganization Act of 1985 (Division 3 of Title 5 of the Government Code,
commencing with Section 57000).
:6. The Executive Officer is hereby authorized and directed to mail certified copies of
this resolution in the manner and as provided in Section 56853 of the Government Code.
The foregoing resolution was adopted by the Local Agency Formation Commission on
this 11th day of December 1996.

SUMMARY

DISCUSSION
On December 11, 1996, the Local Agency Formation Commission (LAFCO) adopted Resolution
1996-67 making determinations and approving "Monrovia Reorganization No. 1-96 Parcels I and
2" (Annexation to the City of Arcadia and Detachment from the City of Monrovia). LAFCO
further authorized the City of Arcadia to proceed without notice, hearing or an election to adopt a
final resolution ordering annexation of approximately 2.56 acres of undeveloped property located
east and south of the Bluth Tract 42936.
Adoption of Resolution 5976 is the final step in the annexation process which was initiated by
Charles Bluth in 1995.

ORDERING THE REORGANIZATION OF TERRITORY IDENTIFIED AS
"MONROVIA REORGANIZATION,NO. 1-96 PARCELS 1 AND 2"TO THE
CITY OF ARCADIA AND DETACHMENT FROM THE CITY OF
MONROVIA.
WHEREAS, a petition of application for the proposed reorganization of certain
territory, identified as "Monrovia Reorganization,No. 1-96 Parcels 1 and 2" to the City
of Arcadia and detachment from the City of Monrovia was filed with the Local Agency
Formation Commission pursuant to the CorteseeKnox Local Government Reorganization
Act of 1985 (Division 3 of Title 5 of the Government Code, commencing with Section
57000); and
WHEREAS, on October 24, 1995, the City Council held a public hearing'to
consider a request filed by Bluth Development for a City Boundary Reorganization
between the City of Monrovia and the City of Arcadia;
WHEREAS, the City Council on November 21, 1995, adopted Resolution 5883
recommending approval of a boundary reorganization between the City of Monrovia and
the City of Arcadia; and -
WHEREAS, the Local Agency Formation Commission on December 11, 1996,
adopted Resolution 1996-67 approving"Monrovia Reorganization No. 1-96 Parcels,1 and
2", and authorized the City Council of the City of Arcadia to proceed with said
reorganization; and
WHEREAS, Pursuant to government code 56837 (100, percent landowner
consent), the Local Agency Formation Commission authorizes the City of Arcadia to
proceed without notice, hearing or an election to order said annexation,
NOW,THEREFORE, BE IT RESOLVED as follows:
Section 1, The City Council finds the proposed reorganization will be in the
interest of the City of Arcadia and the landowners and present and future inhabitants.
Section 2, The reorganization identified as "Monrovia Reorganization, No. 1-96
Parcels 1 and 2", the legal description which is set forth in Exhibit A (including attached

map) attached hereto and incorporated herein, is approved and ordered without an
election.
Section 3, In compliance with the conditions set forth by the Local Agency
Formation Commission in its Resolution 1996-67, the City Council hereby orders the
annexation subject to the agreement signed by the property owner and agreed to by the
City of Arcadia with specified development restrictions.
Section 4. The City Clerk shall certify to the adoption of this Resolution.

SUBJECT: Consideration of a Time Extension for Conditional Use Permit 92-003 th-
Rodeffer Inert Landfill
SUMMARY
The City received the attached letter from Phyllis Rodeffer,requesting a time extension
for Conditional Use Permit 92-003,the proposed inert landfill at 12321 Lower Azusa
Road,which was approved by the City Council on April 5, 1994.
The Development Services Department is recommending approval of a one year time
extension to April 5, 1998.
DISCUSSION
Since the original approval of C.U.P. 92-003 (Resolution 5785) approving Conditional
Use Permit 92-003,the City Council has granted two time extensions; one on May 2,
1995 and the second on April 5, 1996.
Section 9275.2.14 of the Arcadia Municipal Code states that an extension for a
conditional use permit may be granted upon written request filed prior to the expiratio of
the C.U.P. The request should set forth reasons supported by factual data why the C. .P.
has been unused, abandoned or discontinued or compliance with the conditions has no
been achieved. No extension shall be granted unless the Council finds justifiable caus-
for such extension.
As set forth in Mrs. Rodeffer's letter, the reason for requesting the extension is the
litigation proceedings with the City of El Monte which have prevented them from
proceeding with the project.

Investments hereby applies for an additional extension of the Conditional se
Permit No. 92-003 which was granted April 5, 1994 and extended to April 5, 1997.
The reason for requesting this additional extension is the litigation by El Monte
which has prevented us from proceeding. Also, we are diligently pursuing he
required permits regarding this project.

SUBJECT: Public Hearing -- 1997-1998 Statement of Objectives and Project Use
of 23rd Year CDBG Funds
SUMMARY
The Community Development Commission (CDC) has advised staff that the City will
receive $409,698 in Community Development Block Grant (CDBG) Funds for fisca. year
1997-98. In addition, the City will be receiving $106,724 in unallocated prior years funds.
Cost and project summaries must be submitted to the County no later than February 21,
1997. The total available funds to the city will be $516,422.
DISCUSSION
Any one of the following criteria is required for a project to qualify for Community
Development Block Grant Funds: (1) a project must benefit low and moderate icome
families, (2) aid in the prevention or elimination of slum and blight and/or (3) lave a
particular urgency because existing conditions pose a serious threat to the health or wel are of
the community where other financial resources are not available to meet such needs.
Federal regulations require that no less than 70% of a grantee's aggregate funds ($516,422)
are to be used to support activities that benefit persons of low and moderated in ome;
resulting in a minimum of$361,495 to be spent for low/mod activities.
The following is a summary of the proposed projects for fiscal year 97-98 as well s this
year's projects (fiscal year 96-97):

RECOMMENDED PROGRAMS - 1997-98 (23RD YEAR)
Due to the success of the fiscal year 1996-97 programs, staff has selected to continue the
programs into fiscal year 1997-98. Staff is recommending the following programs in fiscal
year 1997-98:
Housing Rehabilitation Project- $441,422
This is an ongoing program and as in previous years, the City will continue to offer a
maximum grant of $10,000 to low/moderate income homeowners for necessary home
improvements. This program also meets the City's General Plan goal, as sta ed in
Section CD-23, of providing housing programs to meet the needs for new ho ising,
housing rehabilitation, and housing conservation for all economic segments of the C ty.
Eligible improvements include exterior work such as painting, roofing and siding; r airs,
restoration or replacement of important parts of structures such as heating, plu bing,
electrical, etc.; other improvements to correct code violations as authorized and i terior
work to make structures more livable, including, painting, plastering, new flooring and
tile work. In addition, home improvement funds may be utilized for exterior yard
maintenance including tree trimming or removal, if it is determined that said tree c eated
an unsafe condition. It is estimated that approximately 40 households will be as isted
(this includes the estimated cost for administering the program of$1,000 per househ Id).
Congregate Meals Programs - $15,000
This is an ongoing program. The Congregate Meals Program provides senior ci izens
with a nutrition program that features hot noonday meals, Monday through Friday at the
Arcadia Community Center. The City will continue to contract with the school district
and CDBG funding will be utilized to subsidize the cost of the meal. It is estimated that
35 to 40 senior citizens would participate daily,.resulting in 10,000 to 15,000 meals
served annually. The reduction in the number of meals served annually is due to the drop
off in attendance during fiscal year 1996-97. This program is administered by the
Recreation Department's Senior Citizen's Division.
Information and Referral Services - $35,000
This is an ongoing program. The program provides senior citizens with essential
information to maintain independent living and healthy lifestyles.
Assistance and information services provided include: government benefits assis ance
(Medicare, social security, income tax, medical, SSI), housing, transportation, egal
assistance, in-home services, health services and educational opportunities. The number
of unduplicated persons to be assisted is projected to be approximately 8,000. The
